K-1 Fiance(e) Visa Process & Proceduressupporting documents for k1 visa
Hi everyone! I'm a newbie here from the Philippines. My US citizen(naturalized) Boyfriend is planning to petition me on a K1 visa, I've read some other websites and I'd like to know if being a part time worker of my boyfriend will affect his petition w/ me. His working almost 2 years in the company but as a part time only... and I know he needs to write it in a I-134 form & affidavit of support if I'm not mistaken. Please help me so that we can do something about it before he pass the I-129 form. Thank you very much.

My advice.... try not to expect any touches and you won't be disappointed. Our petition hasn't been "touched" in 140 days.

K-1 Fiance(e) Visa Case Filing and Progress Reportswhere are the bloody noa2's?!?!?!?!?!?

Jim&Gemz,
I hope if anyone gets an approval, its you and jlcross ! I would gladly give up my place in line if it meant you getting your NOA-2. Trust me, I know what your wait time has been like. It happened to me last year. It isn't very pretty.(F)

Thanks, I appreciate the sentiment. I've quit waiting for the NOA2, now's I'm just waiting for the 6-month mark so I can call and, hopefully, get more than a canned answer.

K-1 Fiance(e) Visa Case Filing and Progress ReportsWhy aren't things moving at CSC?

wasn't offended...didn't realize there was still a November filer hanging around. I hope they get to you soon.

yeah, unfortunately there are a couple of us still stranded between NOA-1 and NOA-2. :(
It's a lesson in futility and patience, and I truly hope none of the people on who who have filed more recently have to learn that lesson.

no offense, but I'm hoping the finish November before they start cranking on January

It may be about time to contact your congressman.

Been there, done that. Both senators and my congressman. All three have contacted USCIS but they can't really do much more before the "normal processing time" of 6 months goes by. There is a glaringly apparent lack of accountability with USCIS.

K-1 Fiance(e) Visa Case Filing and Progress ReportsCSC\NSC\TSC Case update

Site is updated as or 05.06.07

BIG WEEK!!!! A total of 39 reported NOA2's!!!!!

Our oldest November filer received an RFE. Not what Jim was hoping for but at least it is something

One straggling December filer reported approval

Case Status

PS.
I will update next week, then I will be gone for two weeks as I will be traveling to assist my SO and her son in there journey to the USA!!!!

great - thank you ! Here is my commentary :)

Munching over my favorite 'Movement' chart , the biggest ever movement reported last week with % approval gain close to 70% from previous high-week. This tells me that USCIS is definitely in the 'catch up' mode. Also, about 20% of the Feb filers have been approved. Overall I see this as a positive indication and chances of delaying subsequent filers look low if USCIS continues in this 'catch up' mode.

I hope "catch up" mode translates to "let's finish November ASAP" mode.

K-1 Fiance(e) Visa Case Filing and Progress ReportsFebruary Filers - a question
"And, bottom line, we DON'T want them to enforce a strict FIFO system because it would likely cause EVERYONE to go more slowly."

I'd settle for a "loose" FIFO system.

It is six months ago today that they received our package. Hasn't even been touched since November 18, 2006. Now, as per their M-620 publications (http://www.uscis.gov...e/f_english.pdf), they do state that ..."we process cases that are the same type based on the order of when they were filed." um.... bullhonkey. The woman at the USCIS phone center tried to explain that to me. When I pointed out the fact that I know of people after me that have gotten their NOA2's she decided to read it to me off her computer screen again. When i asked her again she told me that she "doesn't have access to that information".

Let's see, what else was there? Oh yeah... the defined "service level goal" for an I-129f petition is six months. One might think at this point they could give at least a few answers to a few simple questions like, say, "Do you still even have my petition"? One might think they could do this, but one would be wrong. In fact not only will they not tell you anything after six months, they still won't tell you anything if you reach that lovely little date they post on their "currently processing" webpage. You must wait 30 days after that lovely little date. So as of now, that will take me to 8 months before anybody becomes even slightly accountable for answers.

It is also interesting to note that in that same M-620 publication they state that "The extra 30 days is to allow time for any notice from us to reach you as we process your case". Now I'm sorry if I got this wrong, I did go to public school after all. But wouldn't that technically mean that a decision or notice would be sent out prior to this 30 day period. Those extra 30 days are not defined as "extra processing days if we don't make the cut in the first seven months". And one might again think that when speaking to a USCIS rep on the phone during these 30 days they might be able to say something like "Hey, somethings coming". I'm sure one would be wrong there too.

Coincidentally the USCIS people must be bad with simple math. The woman at the call center tried to tell me they update the "currently processing" website bi-weekly. (hmmm, let me think.... 5/9/07 minus 4/18/07...hmm....carry the 2.....oh, yeah 3 weeks) Gifted they are.

And one might think that when you ask to speak with a supervisor that you might actually get to speak with a supervisor. One would be wrong again.

Don't trust a thing you read with regards to timelines, especially if it comes from the USCIS.

Moral of this story.... Don't look a gift horse in the mouth. MM_MS, I appreciate the sentiment of your post, but if you get your NOA2 soon.... take it and run. I'm certain many other that have waited as long and longer than I have can agree with that. I wouldn't wish the pain and frustration of this experience on anyone, except people that work at the CSC. Karma can be a beotch.

This rant is now concluded

K-1 Fiance(e) Visa Case Filing and Progress ReportsThe "No, Nothing Yet" Thread

What about you, jlcross...did you have anything like divorces or something out of the usual that might slow your packet down? I have a very straight forward, easy divorce as well but back in 2000.

I wonder if they just started the Security/BAckground Check with my touch and now we wait til the all-clear. Not sure why someone in the UK would have to wait a long time for a background check though.

I'm just rambling...trying to make sense of all of this. This is really putting a strain on everything in my life right now...I just flip out on my guy sometimes which doesn't help things... :(

Nope... no previous marriages, no former applications, no law enforcement record, nothing. We are both clean as can be.

My advice, don't try to make sense of any of this. There is no rhyme or reason when you're dealing with the US government. Trust me, I know. I've worked for the US government before.

No doubt! What is UP with getting 2 touches last week and then nothing...I don't remember ever seeing that before!!!

NOA1: 1/3/07
Touched: 4/24/07
Touched: 4/25/07

...(raises hand) Don't want to worry you but I had two touches back in January and nothing since. :crying:

Touches?? what are those??

(yes, I know what they are but since mine hasn't been "touched" since 11/18/06 (NOA of 11/16/06) I have classified them in the same group as santa claus and the easter bunny)

First I would like to sincerely thank everyone that in one way or another helped me threw this nerve wrecking experience. At times I felt hopeless and very negative due to the relationship between the two countries and this website really helped me through some tough times.

It took a 3 month wait for the interview and a 4 hour wait in line, but finally. They interviewed her for about 40 minutes (pretty long compared to some of the other postings), Questions asked included!
How and were we met
What were here wedding plans when she arrived in the U.S.
They asked her my parents names
Places we visited in Cuba during my trip, ect.
Went over pictures, emails, letters, phone bills, basically through the whole package!
Only set back was the visa was not going to be ready for a couple of days, so she had to go back to Pinar mad.gif than back to Habana. Know I just have to wait for the carta blanca and the plane ticket!

There's plenty of French Canadians that have blond hair. Do I need to go get mine dyed? I didn't know the English term, that happens.

So now you're claiming you should be blond for being ignorant to a very important term? Wow.

Didn't they change the rules so your guarantor only needs to be a Canadian citizen that has ever held a passport? Surely there is someone back in Canada that knows you at least a little that holds a passport, no?I would call up some friends and family members and ask if they have one, then mail the form to them for signing. It would take a while but it would be done. And I agree, that is pretty stupid...

I have an aunt that use to have one, but it's expired. But now, I am so fed up with this passport business that if she accepts, I am going to pay for her renewal and have her act as my guarantor.

I know that there is a form that I can file out, if I can't find a guarantor, but I don't wanna go that route. Reason being that, my health card (the only picture ID I have) is expired, so someone over at Passport Canada said that I can use my Social Security Card (as long as it's signed, it is) instead. So, if I use the SSC AND file out that form, I'm afraid they'll deny it simply because my paperwork has too many "exceptions".

I do have people in Canada that can help. My point is that the guarantor thing is stupid.

Oh and to all my admirers that follow me from thread to thread, saying nice little things. HI! How's that glass castle holding up? smile.gif

I don't think so. I mean, as an example, there are people out there who don't have any recent ID like yourself... why wouldn't they want to add another layer of protection so that they can guarantee that you are who you say you are. Passport fraud is no joke. They need to have a process in place to ensure that people are who they say they are.

Like Udella said, in the US, you have to IN PERSON to get your first passport. That is their verification, which always outweighs photo ID of any kind.

I personally find it a little scary that you live in a foreign country with no valid photo ID and no passport.

Good luck with the passport!

No I agree with that. The discrepancy between forms is what bothered me. A Canadian in.. let say... France, can use the mayor, but not in the US. I miss the logic behind that, and when I asked an operator at Passport Canada, she couldn't tell me.

HI! How's that glass castle holding up? smile.gif

ranting33va.gif I'm trying to get my passport (first ever, not a renewal) and passport Canada is being a b****. I've looked up how Americans get a passport and their form is simple! Freaking Canada requires that I find a guarantor! The US doesn't even require that!

Oh, but just to make even MORE sense... If you're a Canadian abroad, you can use the mayor of any city as a guarantor (as long as he's known you for two years)... "Oh great, I'll ask our mayor, he's the one who married us!"... That'll work, right?... NOPE! That's for abroad! Canadians in the US get a special form THAT IS EXACTLY like the one for Canadians abroad, accept for the fact that MAYORS can't act as guarantor...

And that's when I had a psychotic episode, your honor.

/rant off

Thank you for listening... rose.gif

Visajourney is an amazing resource and wonderful site full of helpful people.

But we can't give advice in this situation. Contact a lawyer, or your local police for advice.

Actually the advice we've given (Carla, Flames, you and me) is the best way to proceed. If the finace feels that she is in imminent danger then she should call the police ASAP. In most places this kind of sitution warrants a 911 call regardless of anything else. There are social services and other agencies that can help out but SHE has to make the effort and step one is to contact the police. good.gif

Ditto.

After hearing stories of people calling 911 because McDonald didn't have any nuggets left, or because someone's neighbor has their music too loud, I am not afraid to call 911. And I certainly would call them for death threats. good.gif

Honestly, if I was receiving these kind of threats from my family, a lawyer isn't who I'd called. I would call the freaking cops. And yes, they can help her get her belonging out of the house. If anything, they will be witness to whatever is going on with her family.

KF, the time for recrimination is long past. Pardon my French but you, my dear, have been jerking off long enough. It is time to formulate a battle plan and follow-through. 1.) get your passport, USCIS DOES NOT record the entries for Canadians 99% of the time, even if you have a visa. I got this info from Washington, D.C. You must get a valid passport. 2.) Be prepared for all the potential repercussions. I would try a legal clinic that caters to illegals or refugees as Len suggested. Check in the phone book or library or contact the closest law school or bar association in your area. Tell them everything, I mean everything. If you volunteer to go back to Canada, you might not get banned but how long after you entered the US did you get married? If it was over ~90 days then you'll be OK as far as the presumption of entering the US to get married just so you can stay. (knock on wood) If >180 days, you overstayed and presumably you got married to avoid returning home (that's what the USCIS folks will think) and this might be a problem but it is best to discuss all possible permutations with your legal counsel. 3.) Don't lose hope. Hope is a good thing, maybe the best of thing and no good thing ever dies. (Sorry, Mumsie really likes The Shawshank Redemption)

Thank you, we are not losing hope. We ARE going to file for a passport and take it from there. HOPEfully, our situation will be common to them and we will not run into any trouble. It might cost more to get legal advice, but at this point, it is worth it. I have been overstaying for a long time, but we didn't get married right away after I came here, so I'm hoping that will work in our favor.

Thank you everyone for your kind words, I really appreciate it, specially from people who are not always on my side. It's good to see we can all play nice when someone has a genuine problem. Now, we are ordering the passport soon. For now, I'm going to take a small break from this forum because if not, I'm just going to be running circles for no reasons. I will not even be checking this for replies. BUT I will be back once I have the passport... or the denial.

Take care guys rose.gif and thank you. heart.gif

Where are you living that your mortgage payment is far less than $1000/month + taxes, living expensive, etc.? If you have to borrow the money, that 's probably what you should do. In fact, you should be able to borrow against your house.

We live in a very small town, mortgage is pretty low for everyone here.
