Correct. If you can meet the guidelines on your own you do not need a co-sponsor. That goes for assets too. If your salary meets the guidelines without any doubts then you do not need to worry about this either.

The 2006 Poverty Guidelines have already been published by HHS, as cited by pax.

However, the new guidelines have not become effective for immigration purposes. Not for USCIS, anyway, not sure when DoS implements them.

Poverty guidelines 2005

If you have dependants on your tax form then these are counted as part of your household size. You must also count your fiancee. So if its just you and your fiancee then there are 2 of you and you must meet the criteria in that row.

This will increase (100% certainty) when the 2006 guidelines come out in a couple of months time.

Remember the K-1 is valid for 6 months and then you have 90 days to marry. So if you need to seriously plan you have plenty of time. However that means you will be apart for longer of course. We will not be doing any serious panning until the K-1 is in my sticky little mits!

What sorts of questions did they ask ya? Did you tell them you were on the K1? and just visiting while it was being approved?

I went to USA december 2005 and I got stopped and questioned - this is even before we started our k1 infact the last time i visited my boygfriend was 3 years prior, I got asked all sorts like how long you known him, are you here to get married, have you proof of going back to uk and ties to UK - I really didnt think I needed any proof as I had no problems before I just told the truth that we were thinking about marriage if we did we would go via the k1 route but this visit was just to see if we can still get along together. I am now worried that that short interview would be on record and if it would interfere with my next visit if I go before my k1 is approved. I got surprised by a proposal by my boyfriend on christmas eve and we did fill in our K1 paperwork while I was there but he has to wait for his paycheck to mail it out hopefully around 20 Feb it will go in the mail to nebraska.

I only gave them the information they asked for and I answered honestly and truthfully.

They asked 'What is the purpose' and I responded ' to visit my fiancee for Valentines, just for a week'
They then asked 'What do you do in the UK?' and I responded ' I work in IT'
That was it.
I said 'thankyou'

The guy at the POE scanned my passport, I have no idea what came up on the screen in front of him.
If he wanted to know about K-1 I would have answered honestly.

I have been asked all sorts of questions before...it depends on the mood of the officer! and that was also before the K-1 process.
If you got in after those questions there is nothing to worry about...

I had in my pocket: LEtter from Employer stating my job and need to be back in the UK, evidence of ties. I take these on each trip, but they have never had to come out of my pocket!

Again, no problems, I did get asked two questions this time, but the second question was after the left finger, right finger bit. Time at POE..hmmm about 90 secs.

I have visited three times throughout the process without any problems. But as a backup I have had letters from my employer in my pocket on each visit as well as copies of bills etc. I always keep the little US-VISIT receipts on exit from the USA as well. Those I can tie up with each entry stamped in my passport to show that I have never outstayed.
I also never give them more info than they ask for. When they ask purpose of visit? I reply to visit my fiancee for a week or so. No more than that, no life story. Just answer the questions honestly and I am sure there will be no problems.

No, maybe waiver was nt the right word. It was a form that you signed to say you understood the consequences of having an HIV test.

Well I just thought I'd share details of the new Kensington Medical (not sure if this has been done before)
The place is easy to find and is only about 50 yards from Harrods. The receptionist was friendly and asked for my passport, form, photograph and vacination card (not supplied) and then she asked me to go and sit down in the waiting room. It's a strange thing about waiting rooms they always seem to contain a variety of unmatched furniture, and unmatching lamps. The room was welcoming, comfortable and did not set one on edge. Within 15 minutes the secretary arrived with a clipboard with a form to fill in. This seemed extremely similar to the questionaire I brought to the Interview. It also included a waiver for the HIV test.

Almost as soon as I finished this I was ushered into a room to see the vacination specialist, she was very friendly and I decided to have the Tetinus injection for a fee of £25.00. This was recorded on a US form.

I then went to wait in a different waiting room which was not as pleasant as the first, with harder chairs, but the newspapers and magazines were current. It gave me the opportunity to catch up on the weekends soccer results.

The doctor came and collected me after about 15 minutes and showed me into his office. he was very pleasant, wanting to make me at ease and kept asking me if I had any questions. He took my weight and height before giving me a fairly simple examination, not the slightest bit invasive.
I was surprised that he took my blood pressure before taking the blood sample and told him so. I figured I was sure to be more relaxed after my arm had been drained of a percentage of its blood!
After taking the blood he made sure I wasn't going to faint. And then gave me a quick eye test.
We exchanged some brief banter which was very pleasant. I asked him if all seemed ok, to which he answered 'yes' before he showed me back to the second waiting room again.

After about 10 minutes the radiologist came and collected me and took my chest X-Ray. She basically just wanted to get the job done and was n't that talkative, but by this time I knew the medical was almost over.

Back to the small waiting room once more. This time just to wait to 'Pay'!
Well it was n't long before the receptionist arrived and took my credit card payment for £185.
That was it, out into the cold again after about 90 minutes.
One stage nearer!

You do not need evidence of the vacinations until AOS once you are in the USA. But, as you were born after 1956 you will need evidence of the MMR vacination at that time. If you have not got a doctors record, I think you will have to have the shot again, but make sure it is properly recorded!

In the medical they do ask a question about that. You will need to talk to the doctor at the medical about the exact situation. He then records it on the appropriate US form. Ask him...I asked him about the medical, you are paying for it!

Also remember that the 90 day clock does not start ticking until you are in the USA. The K-1 visa is valid for entry for 6 months from the time of issue. So, if you get the visa quickly and you need time to sort things out BEFORE going to the USA then you have that opportunity.

So in effect, you have 9 months max. to get everything done and dusted. And thats yer lot!

i have read over and over most of the information regarding the 125% poverty level issue. However im still left with some questions.....

1. I understand that when counting assets they have to be 5 times the difference of income to the poverty level. Just say for instance that the beneficiary has a lot more money than the sponsor. is there anything to stop them buying the sponsor, for example a house which could be counted as as asset?

2. The official wording on the government site says things which can be counted are, savings, stocks, bonds and property. or anything that can be sold quickly....would this include a car??

3. This one ive read, but i find it hard to beleive so im checking, when they give the household numbers, am i correct in thinking that its the total in the household once the beneficiary has been counted?

Also interested to see anyone elses experiences with this if they were cutting it fine or not meeting the requirements. Its very frustrating since my sponsor easily meets the requirements now, however by the time that this stage of our journey comes around its more than likely that she will not


1. No, just as long as a quitclaim deed (or other) registers the property in the sponsor's name and that it is registered. You will need a notorised copy of this deed also you then need a valuation signed and dated by a Realator (Estate Agent).

2. A car is unlikely, the value can drop dramatically in a collision! Also it is an asset that sufferes major depreciation.

3. You and the sponsor count as two. Anyone else adds to this number and anyone else that is declared as a dependant on the tax return.

We've got the DS-156/f and DS-230 example forms from the guide (to use as practice/draft forms) -- but what else will Packet 3 ask for? Do they want copies of the birth certificate and police report then, or just bring them to the interview?

The DS forms must be returned along with a completed checklist.
The checklist itemises those things you need for the interview: birth certificate, former marriage and divorce certificates, police record, medical. photos (x3 ) 1 for medical 2 for interview etc
