K-1 Fiance(e) Visa Process & Procedureswhat to write - US citizen thru naturalization or thru parents

If it comes up in interview, you're probably need to explain those things.  Sometimes people made an error when filled out the forms. I hope everything is okay. I'll pray for both of you.

Thanks :) hope it won't become a big issue :)

K-1 Fiance(e) Visa Process & Procedureswhat to write - US citizen thru naturalization or thru parents

So its really thru naturalization but with our I-129F we tick thru parents. Do you think it would be a big issue/problem since we will declare thru naturalization this time with I-134? Hope an explanation during the interview will be just fine since I will still be presenting a copy of his Cert of citizenship...

K-1 Fiance(e) Visa Process & Procedureswhat to write - US citizen thru naturalization or thru parents

now Im confused! what is the difference between US citizenship thru naturalization vs.  thru parents? when you are petitioned by one of your parents (US citizen) and got approved and have obtained a certificate of citizenship - that is thru naturalization or thru parents?

we already got our NOA2 but it is just now that we thought of this... what we have placed in our I-129F was US citizen thru parents but now we are confused as we are filling up the I-134 (affidavit of support) as preparation for the interview.

if ever we are wrong with what we have placed in our I-129F, can we just declare US citizenship thru naturalization on the I-134? Would we have a problem since its different from what was written on our I-129F previously? Can we just explain the mistake made on our I-129F during the interview?

comments & suggestions are much appreciated TIA

K-1 Fiance(e) Visa Process & Procedureswedding after filing I-129

i agree with them... you already waited for so long... what is 30days compared to more than a year of waiting as you will start all over filing for spousal visa.... more patience... after 30days follow up your application. K1 approvals nowadays are faster...

K-1 Fiance(e) Visa Process & ProceduresI-134 HELP
questions regarding I-134:

1. What should we put on the annual income? Annual income from the previous year as stated in the W2? Or Annual income (estimated) this present year?

2. If the petitioner own a real estate, is it OK if he chooses not to declare it because the annual income anyway already met the poverty line?

3. Do we really need to fill up all items or has the option what are the things just enough to prove capacity to support the beneficiary?

TIA

I think your proofs are enough already.. But you may have problem with the scanned passport photo of your fiance.. I think it would be better to ask from him clear passport photos.. try to avoid having RFEs

Don't worry about it, once the CO sees the income is adequate none of the other will matter.

Thanks Hank! Such a relief ;)

They only look at how much you bring in, not how much goes out. wink.png

Oh okay :) Thanks! Was bothered by the high mortgage :) I feel relieved now... Thanks!

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support question

No. It is already on there and makes no difference. The house value doesn't matter, and debts are not used for determining the affidavit of support.

If he already signed it, then you could fill it out and leave the assets section blank. They are not needed.

Thanks! So I guess I will be using the I-134 that he already prepared even with the mortgage on it since it will not matter.. :) Thanks again! I feel relieved.. :)

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support question

And he sent me a signed 'blank/empty' I-134 just in case there will be any changes. Do you think its better if I fill it up handwritten and just declare the annual income?

Babe18Not TellingPhilippines2013-11-16 20:47:00
K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support question

you don't need to show 125% for I-134. No don't use your mortgage because it will make things complicated you just need 100% of the poverty guidelines. You will need 125% poverty guidelines when you adjust your status with the I-864.

But my fiance (petitioner) had already sent me the I-134 wherein the mortgage was declared.. Do you think I have to ask him again to send me a new one? It will cost us a lot though.... i think he paid almost $40 whent he sent me docs the last time :(

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support question

Will not matter. The income more than meets the requirement, so no assets are even needed. They do not care about your debts.

So even with the mortgage declared, I will not have any problem?

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support question

Hi! Opinions please....

For a household of 5 (petitioner&beneficiary already included) is this OK?
Annual income - $53325
Real estate valued at - $162000
        Mortgage - $ 134000

The annual income is actually above the 125% poverty line for a household of 5 but my concern is about the real estate and its mortgage which is still high... My fiance (petitioner) had already printed our I-134 out, signed, and sent it to me when we found out that it is OK not to include the real estate. Will the high mortgage matter much despite the above 125% poverty line annual income?

K-1 Fiance(e) Visa Process & ProceduresCan a cardiac/heart problem affect visa approval?

Nope, that won't cause a visa denial.

Really....? thanks! i am so worried right now..

K-1 Fiance(e) Visa Process & ProceduresCan a cardiac/heart problem affect visa approval?

I had my medical in SLMEC as required before interview. Unfortunately, during physical exam the doctor detected heart mumurs. I was asked to consult a personal cardiologist since they are not allowed to make referrals. She requested for a detailed medical certificate particularly stating the diagnosis of my condition. I thought if there are problems detected, consultation to a specialist is already included with the medical fee ($223).

I already consulted a cardiologist and I was asked to undergo ECG and 2D echo which will cost almost 7,000pesos or about $170 (consultations excluded!) :( And in the Rx it is stated "T/C Vascular Heart Disease" . Aside from it being pricey, my concern is WILL IT NEGATIVELY AFFECT VISA APPROVAL??? :'( I was told though by SLMEC staff that after I present the medical certificate to the doctor who examined me and requested for it, I can already have my vaccines at the same day.

Anyone who had experience this? Your insights would be greatly appreciated.. TIA

K-1 Fiance(e) Visa Process & Proceduressame aftername

i don't think it would be an issue... there are lots of other couples who have the same family names and i think USCIS is not that stupid to think you are related just because of that... iammrsregi is right... the adjudicator would probably check your parents names and learn that you are not actually related..

K-1 Fiance(e) Visa Process & ProceduresChange of phone number on I-129F

i don't think it would be an issue.... during her interview, she will also be asked to confirm if she still has the same address, email, and phone number... so she can simply notify the change in her phone number during her interview because it would only be needed during visa packet delivery notification

K-1 Fiance(e) Visa Process & Procedures2 Old k1 petitions returned. What now?

i know someone who had the same problem as yours... she had 3 previous uncancelled petitions and got no contact with her ex-fiances.. she was approved and went to interview with her present fiance.. the presence of her fiance helped a lot according to her... so they got approved and now waiting for her visa to be issued

as long as you will not have any record that you are married i think you won't have any problems.. but it would be better to be careful not to mislead the CO that you already got married by showing them your pics of the ceremony (if any)..

K-1 Fiance(e) Visa Process & ProceduresTraditional marriage as ongoing relationship (evidence)

wait and see if they will deny or ask for more evidence that you qualify for K1 visa.. then try to obtain a document stating that you don't have any record of marriage... im not sure though if Uganda has that kind of document. because im from the Philippines and here we have CENOMAR (certificate of no marriage)
