K-1 Fiance(e) Visa Process & ProceduresK1 process and the implications for family members
I want to share this story as I believe it might be important to some of you and it really bumped me as I did not know about this.

Our wedding is supposed to take place in 2 weeks. I was approved at the Frankfurt embassy this last thursday and I know my passport with the visa is on its way to my mailbox. smile.gif

Just a small story which is almost unbelievable to me from this morning.

My parents were about to board the plane this morning which would connect them with their flight to Miami where they wanted to go on vacation before they come to our wedding.
The system said they are denied and not approved for entering the US!
My dad already called me to say they are coming back home when my mom just yelled "It is ok. We can fly!" Apparently they were not allowed to enter the US for as long as my visa was not issued yet. The airline called USCIS to make sure their status hasn't changed yet after my parents told them all about our visa process and that I was approved at the embassy just this past week. After the airline's call the system changed my parents' status to approved.

I am just imagining what would have happened if my visa interview would have been today. They would have been sent back for sure and wouldn't even be able to go on vacation….Unbelievable! I really didn't know that our K1 process could possibly impact my parents' travel plans.

K-1 Fiance(e) Visa Process & ProceduresDrug testing
Don't worry. In Germany they did a blood test and urine. I don't really know if they even tested me for drugs (don't know if they would tell us all the tests they perform anyways). All I know they tested is HIV and Lues (Syphillis). However, I heard in certain countries drug tests are standard procedure (like Jamaica, for example).

However, if we were all saying the thruth I doubt that many of us would get our visa ;-)
Believe me, it won't show up in their tests if you haven't been doing drugs for weeks. They would need to get hair and analyze that to verify that you did drugs.

K-1 Fiance(e) Visa Process & Proceduresdrug test
Ok, just as a side note. They only test your blood and urine at the medical. If you read up on this you will notice that drugs are not verifiable in your urine for this long period of time. Whether you tell them the truth about your past is up to you. However, you will be denied most probably.

If you are unsure about how quickly you can find another job, can you try and find a co-sponsor?
Also you will need to show again that you are able to support your fiancée during AOS. You will need new proof again.

K-1 Fiance(e) Visa Process & ProceduresUSCIS, you win...sort of...and a question about canceling the K-1
I can at least to some degree understand the OP. I mean, what if you are really indifferent about where to live? If you can have a happy life together, both get a good employment and the language and other cultural barriers that might exist are not that strong for you...then we would probably have gone to Germany too.

For us it was more important what country provides the best opportunity for the two of us together. We decided for the US because he would have had a harder time finding a job in Germany than me in the US (mainly due to the German language which he is not fluent in yet) and because he has another year to finish school there anyways. So we figured we might as well wait out the K1 process, get married over there with our families being there, start up something and then after 4-5 years (by that time I'll hopefully have citizenship so we can freely move between the two worlds) when we feel ready to have kids we can think again which country is best for raising them. My fiancé so far would like to live in Germany and Europe so we will reevaluate the situation in a few years to see what is best.

I have to agree that the K1 process is hard on us. It is hard leaving each other over and over again when you don't know at what point in time you will see each other again. But it is also a fortifying experience as it draws us closer together. We talk about our feelings more than we usually would probably and we see what we are doing for each other (waiting, paying all those long distance flight, spending evenings at home talking on skype while you could go out with friends, filing all those documents, giving up your life in one country, preparing everything (from wedding to new apartment and our financial situation) until the other one is finally able to come. We are fighting to be together and I think that is one of the best and most rewarding experiences a couple can have together.

I think you'll be fine doing it alone if you have an easy case. It will need some time to figure out what forms are needed and what to state on them. But thanks to VJ, its members, and a lot of great guides online it is possible to manage that yourself. We did it, and didn't have much trouble so far.

K-1 Fiance(e) Visa Process & ProceduresSolid Evidence You met in Person

What I did in addition to having the boarding passes and country entry exit stamps, photos and hotel recipt. I went to a notary with my fiancee and 2 witnesses and had the notary examine our Identification as we are using it it apply for the K-1 and state that we were present together on this day [while I was ther of course] in her office and applied her notary seal. Then I took it to an official translator to be translated into english... I read someone mention here somewhere that it was a solid way of proving you met in person.. Has anyone else here done this type of evidence document ?

I've never heard of anybody going to such lengths. The boarding passes and passport stamps evidence you were in the same country. That's good enough for USCIS every time.

What if i do not have the boarding passes from my first trip???? I do have the Visa stamps in my passport and LOT of pictures of US together at obvious HCMC landmarks. Will that be suffient as proof of arrival in Vietnam??? unsure.gif

Chris and I meet online over 12 months before we meet in person. Though we started really talking November 06, and by Feb 07 we knew we wanted to meet. It took 9 more months from that point till we meet, and till I flew to to the USA on my own. I'll admit after 32 hours in transit (brisbane to LA, 8 a half hours in LA, and then onto DC) I was so tired, and lost as all hell. Washington Dulles is a horrible airport to go to, and they couldnt even get us to an airbridge so we disembarked in the cold at midnight and had to be bussed to the terminal. When I got in the actually terminal I missed seeing Chris waiting at the gate as I was shunted down with everyone else to baggage claim.

Chris called, fearing i had gotten lost as he hadn't seen me come through with everyone else and then managed to walk the longest way around the baggage claim without seeing me, it took me calling out "Not even going to say hello then?" for him to notice me and for our first hug, twas amazing really how a simple hug can be so special, especially after what was 15 months of knowing each other as characters in a game. It took an hour to drive back to DC after I got off the plane, and Ill admit the first thing i did there was shower, but after that we spent 4 hours just sitting together on the couch talking and hugging, and stupidly working up the nerve of that first kiss (isn't odd you can be shy about that when you had already admitted that you loved the person lol), even though I had been awake for almost 40 hours at this point it was still amazing.

I guess we were lucky though, I had just finished Uni the week before (in October) and wasn't starting my new job till January the following year in England, so we spent 2 and half months together and lived a lot of life (weddings, travel and sadly a funeral) truly like we had been together from the day we meet. It was amazing, I have been there so many times now that with him, in DC feels like home, and oddly enough I get more home sick in Australia then I do in DC. Perhaps "home is where the heart is" really is a very true statement.

Our first meeting in person was a good four years after having met on WoW. Our intentions during that time were obviously not the same throughout those fours years, but it was one of those lingering friendships that eventually hit the perfect time where both of us were unattached and willing to admit that we were interested in one another.

And it was so very odd indeed to work up the nerve to kiss one another! Haha. It was actually I who kissed him first... and I even did it in a sort of huff, as I recall. He was paying attention to the movie we were watching at the time, and I simply tapped him on the shoulder, surprised him, placed a good ol' kiss on his lips and then asked if he had intended on going through the entire visit without even trying to make a move! Needless to say, that got the ball rolling, hehe.

Hello fellow VJer's, (I had posted this before but realized I posted in wrong place)

I just wanted to join the April 2009 K-1 Filers. I submitted the paperwork for my fiance on April 1, it was received on April 14, and I received NOA on April 16. I keep feeling as though I'm missing an important piece of information regarding this entire process because everytime I log on to the U.S. Immigration website to check our online status there has been no change just the same old message "received and pending". This is normal right? I mean it can be months before our package even gets touched right? If anyone has any additional advice for me I'd surely appreciate it. Thank you.

At the moment I am working abroad in Iraq supporting our U.S. Military troops and my contract ends in November 2009, so I'm praying that we will have SOME word of even something before then. The only joy I have about this entire thing is that my job affords me a vacation every 4 months (since I work 7 days a week/12 hours a day) allowing me the opportunity to see my love. I touched him for the first time in person March 2009, and will be going back August 2009. Now if only there was word of some kind of action being taken concerning the status of his Visa it would be wonderful.

Good luck to everyone who's holding on.

Hi, welcome to the April filers! kicking.gif

Far as touches go online... outside of our initial NOA1, perhaps maybe a few days following, I don't believe any of us here have seen anything else on our status online. A lot of folks don't even see word of their NOA2 until it's sitting in their mailbox at home. It doesn't seem as if all case workers are as diligent in filing the status online these days, so it's really not a concern.

Were you eligible for military expedite?

Thanks for the mention of the "military expedite" i just went to the USCIS website and did some reading about this matter. I plan to give them a call later today to see if we qualify. Hopefully, I'll get a positive answer.

I try not to think much about this whole thing as it only makes me sad. I decided today to logon here and see how things were coming along for other fellow VJer's and that's when I saw that an acquaintance of mine who had travelled to Africa in November '08, filed in December '08 (at the VSC) and now her honey's Visa was approved in June. Seems like it didn't take long for them at all. I feel like we've been waiting forever. I had talked to a USCIS Rep. back in April and they had told us that we could still file for a Tourist Visa while waiting but when my fiance' got his interview he was advised he could not get a Tourist Visa while waiting for a K-1 Visa and was told to just keep waiting. I had hoped that he would get the Tourist Visa so that we could vacation together in the States in August. So since his request for the Tourist visa was declined, I'm going home to Africa for vacation in August to be with him instead.

I had noticed that when I was completing the packet they had asked if I was serving in the military but I'm not military so I didn't check this box. However, I work as a contractor serving the U.S. military here in Iraq. I didn't list my overseas address because I didn't want any paperwork to get lost should something be mailed to me, and I'm glad I didn't list my APO address now because I just got transferred from Southern Iraq to Baghdad on June 20. Things change so much around here, that's why I keep all my mail coming to my address in the States and just keep in touch with my kids as to whether I've received any important mail.

Although I'm not an actual military service member, I still plan to ask the question because I support every branch of our U.S. troops and am in harms way just as they are (i.e., motar attacks). It's worth asking

Thanks again for replying and for your feedback.

I didn't even know a such thing as military expedite existed. I hate being away from home too cause I have to always call back home and ask my family if any important mail has come for me. Am I allowed to call the Service Center and ask any questions since I'm currently overseas in Iraq?

Middle East and North AfricaConfused About Visa Types...Help Please
Hello fellow VJ's.

I am new to this site and I am so glad I found it. It appears to contain a wealth of information. I have a question that may have already been asked before but I was unable to find such a question during my search on this site. Here goes....

My current fiance and I have met via the internet in October 2006 but have never met in person physcially. We do however, maintain daily contact via webcam, Yahoo IM'ing, emails, telephone and text messaging. He proposed via webcam, I accepted, and he Fed-x my engagement ring...*lol* We would like to be married in Nigeria in December 2007, and then file for a K-3 Visa for him to join me here in the U.S. in 2008.

Since this will be our first time ever meeting face-to-face, and I have to have a Visa to travel to Nigeria to marry abroad, what is the best Visa for me to apply for? If I understand it correctly, in order to apply for a Fiance Visa you have to show proof of having met at least once in the past two years? Should I apply for Tourist Visa in order to see him for the first time, although we plan to marry during our first face-to-face visit? We both realize that I will come back home after we marry in December, but I plan to apply for his Spoual Visa upon my return.

Any information you can provide would be greatly appreciated.

Thank you.

K-1 Fiance(e) Visa Process & ProceduresDidn't Know Where To Ask This Question
All,

First, please forgive me if I have posted this topic in the wrong place but I didn't know where to post it at specifically. Here's my issue....I am a U.S. citizen currently working abroad in Iraq as a contractor supporting the U.S. military. During my time here, I have met a wonderful gentleman who also works here on base with me but he is part of the Coalition Forces (Uganda military) who also support our U.S. military. I would like for him to accompany me on my vacation home to the U.S. in July, 2009. How would we go about obtaining a Tourist visa for him since we are both here in Iraq and it is impossible for him to return to Uganda and apply for the Visa in person, as he is only allowed vacation once a year, and his year will be in July. We wanted to get a headstart on the Visa issue in hopes that we might vacation in Tulsa, Oklahoma together for two weeks in July.

Any advice would be greatly appreciated. Thank you.

P.S.--We wondered if perhaps he should talk to his contractor who is currently sponsoring his work Visa here in Iraq?

Its been awhile but thought I'd give an update and some info. Mark and I moved our wedding to August 21st (instead of June 12th). His packet #3 has been received as of May 20th...it will be 6-8 weeks until the interview..ugh. We had heard through a previous filer that he was not allowed to travel outside the UK until this process was finished, just want to pass along that that is not the case. You can travel to the U.S. during this process, you just need to carry proof that you are returning to the U.K. (ie not trying to pull a fast one on them). It has been since January since we have seen each other, but luckily he will spend 3 weeks here in the U.S. before having to go back to the UK for his interview. He has already passed his medical (YAAA!) and we are getting so much closer. Good luck to all...I love seeing emails of new posts and hearing good news from others. Thanks to everyone in this forum who have stayed positive and kept our shipmates spirits up! Good luck, may we all be with our loved ones soon!

This is jumping ahead but what happens after we get approved at the interview (thinking positively here). I know we have six months for my fiancee to come into the country, then 90 days to get married, but... how long does he need to be here before we are married? How long once we are married will it be before he can work? What papers do we need to file for this all to happen. I have been looking and looking for this info and just haven't hit the right area I guess. I'm definitely gonna need more rum!

Thanks,

K-1 Fiance(e) Visa Process & ProceduresAffidavit for Support
Hope you don't mind if I add a question, we seem in a similar situation.
I am a mom of 3 as well with an English fiance. I also am about to graduate medical school (in May). I will be matched to a residency program in February (start date of July 1), and this is a binding contract, but will not receive pay until my residency begins. Does anyone know if I can use this future income for my Affidavit for Support. Being in medical school for the past 4 years, I have not had income but obviously will have substantial future income, just wondering if this will count or if I need a cosponsor. Thanks and good luck to us all. :)

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA2 and Christmas
Mark,
I am now 9 months into this process and at this minute setting in Warsaw with an Interview scheduled after two days of problems and now an even bigger one I have no control over so I will add some points to make you aware of that you are so close to this point. First as you or maybe your Fiance will have to travel here to personally to pay the Interview fee there is only one location in all of Watrsaw you can make this payment though they make it sound as though it can be done at any Bank Placowka Banku Pocztowego Branches, the one Branch is listed below and I will post a picture and try to post a map in my profile pictures.
Bank Pocztowy Branches (Placowka Banku Pocztowego)
Polna 11, Swietokrzyska 31/33, 00-950 Warszawa
It is right on the corner of Swietokrzyska and Jasna Street (Lat, Long 52.23587,21.010714) and directly catacorner from the bank is a Kantor or Money Exchange so you can turn your $ into Zloty if you have not done so yet. Now understand this whole section of Swietokryska St is tore up at the moment and you have to walk your way around to get here and this Branch is not like a Bank in our way of thought it is more of a Payment center/Post office type facility. As you walk into the big glass corner door you will see a desk with a guard or two you go past them to the right through the door and immediately enter through the next door to the right with a counter and behind them the windows that face the street, here you will give them the Receipt you printed off with a current date, make sure you have a copy of her picture passport page as you will need info from it for him to fill out the form as well you will need it when you pick up her VIsa. He will then send you directly through the door and Catacorner across the area outside his door to a Counter marked as A (really the furthest one to the left front corner as you walk out. (the only person in this office that speaks english is a guy named Sezam, but as long as you go to the right counter and hand them the paperwork and 768 Zloty they know what to do. You will then take your paperwork back to the gentleman in the first office and he will write your receipt number on the your receipt form, should be 12 numbers in all and read it back to him to verify and make sure you have the correct number. This is the number you will need when you call and schedule your Interview. (Wrote mine down with one extra digit and made it a big problem getting the interview scheduled along with the first embassy staff I spoke to insisting I needed the DS-160 filled out so you can get your application number, but is not needed for the K1 VISA and all 0's are entered but I am sure it would not hurt to fill the DS-160 out if she wants, just make sure she has her profile and UID # from here. https://cgifederal.s...m/ApplicantHome
When the interview has been scheduled ask the embassy staff to please copy you in on the Interview Appointment email also and make sure you or her have printed out the page including the Bar Code's to take to the interview.
Well a lot of information, just trying to look at it from the perspective of information that would have made my process easier and more streamlined. (wish I would have known)

Hang in there and keep up the good faith, I also have had very high clearances from my Military, but don't think they help as much as just a good clean record here. If in your heart you know she is the one then it will all be worth it, if anything my life has taught me the hardest things to acquire are always of the most value, worth and respect.

God Bless,
Carl

Hi All,

I filled for K-1 on June 18th, and was last touched on July 10th...

USCIS website shows received and pending...I even tried calling them but no help...

But I did call NVC and gave them my Receipt Number and they told me that they received my case last week and i was approved. They also gave me my NVC case#

So, all the people that haven't received NOA2, i would suggest you call NVC and ask them they received anything...all you need is your receipt #

Hope this helps!!!!

and by the way, NVC people are really nice and ready to help....

What do you mean USCIS people couldn't help you? DId they also tell you your petition was still pending and yet it was actually approved and received and already sent to NVC?? Who did you talk to? Level 1 or level 2 support staff?? This would be really strange! But yet another way to maybe find out more...

Pen,

I talked to both levels at USCIS and both of them said case is received & pending, I would suggest you call NVC and give them your receipt # and they can tell you if they received your case...

Your filing date is similar to mine and you were touched on the same day as mine (July 10th), i think..... you of all people should have better chance with NVC..

and by the way, I got the NOA2 letter in the mail yesterday, and USCIS website still says received & pending...

Please call NVC, if you really want to find out...

double d's

Thank you so much!!! We will for sure try tonight!

Sh***. After hours we finally were able to talk to the 2nd level. Petition is still pending sad.gif :-( :-(

I'm so sorry panterchen! I was so sure that you were also approved since you and I have the same filing date and last "touched" date sad.gif sad.gif sad.gif
I hope it comes soon! I want to much to share my excitement with all of the June Filers!!!
This stuff just doesn't make sense....it makes it worse to have everything so disorganized like this, and then on top of that, to have to deal with robotic CIS workers with 'tude headbonk.gif

Thanks for the congrats everyone! I am sending good karma your way!!!!! goofy.gif goofy.gif goofy.gif goofy.gif

Thanks!! I know, I hoped too that somehow our files were close to each other. Apparently they are not. I know that NOA 2 could come any day now but I am just stressing out about falling into a black whole in which so many people on VJ are. That would be our nightmare.

We already contacted our congressman and they inquired about our case at USCIS saying they would get back to us when they hear something. I know we contacted him pretty early but by the time they hear something we might already have hit the 6 months mark and; sure who knows if they can do anything at all even.

Also Daniel is thinking about going to an infopass appointment. Does anybody know anything about that? Could that be good? Maybe after we hit the 6 months mark (if we do)?
I know we are still within the timeline but we start not wanting to leave it to chance whether we get approved or not. We are horrified to have to wait for years.

What really pisses me off though is that the USCIS staff tells everybody the same bullsh*** on the phone: "working on March" tsetsetse...And that now we have to call them anytime we want to know the status of our petition. Oh yeah, plus the first lady yesterday said something like "What does it help you to know the status of your petition? If you are approved they will send you a letter" Yeah, sure. Weeks later, if ever at all!!! I hate this system.

Jeez it just does not seem fare.................we were all happy when we first filed with Vemont as it was so much quicker that California then Vermont slowed up dramatically.................at least with California they seem to process in date order

My heart goes out to all of you guys who are still waiting

I am hopeing for some good news from you soon

Thank you guys!! We are sitting here crying. I know we cannot expect to be approved at any specific date but we are just hoping it soo much every single day. I am blessed that he can be with me right now but this waiting is sucking out our joy.
Thank you guys for being here, I don't know what we would do without you!

I don't know...The first level lady said they have had problems with their computer system and that sometimes it works and sometimes it doesn't. Right now it does and it shows our application is still pending...Hmm...Maybe that's true. But could it be that she doesn't have the same info like the 2nd level even if the system is running??? And of course, she told us they are working on March filers. Yeah right.

Hey,

we keep trying to call USCIS but they don't want to transfer us to a 2nd level supervisor. How can we get there? They say they won't transfer us as long as we are not outside of the normal processing time...How can we get through??

Hey everyone. I decided to try and sleep in late this morning and no luck. I tried not to think about this waiting game. I decided to call my significant other. He is way more patient than I am and always says don't worry we will get the approval soon. I decided to take a quick road trip after checking USCIS website this morning and found nothing has changed. I didn't even wait for the mail to come.

But then.........................................I just got home @ 11:00 pm and checked my mail. Whooooooooooooooohooooooooooo!

WE GOT OUR APPROVAL! NO touches online. Website still reflects a last touch of 07/10/08. I keep trying to call that lazy boy but he won't wake up. I kept him on the phone so late whoops.

I'm off to update my timeline! Thank VJ for this wonderful site. I was beginning to think I screwed up the paperwork!

Congrats, I am so happy for you!!!

@MikelovesGracey: Thank you for your message. We read it both this morning and it made us feel like we are not left alone. My fiancé is here right now, which is a tremendous blessing but of course we worry and want this NOA 2 so we can move on with our plans.

Good luck to all of us who are still waiting. Our time will come (and I hope soon)!!

Just read in some other post on VJ that apparently the VSC computer system is down or at least has some problems (that's what the operators tell people on the phone) so that the online case status is not working...

I guess we have to rely on the post man from now on... Maybe that will relief me of franatically checking their homepage 10 times a day. tongue.gif
