Hey everyone, i want to ask if I can change the email address I put at USCIS site? would that be ok?  I am the beneficiary and right now it is my email address that it is in there, would it be ok if i change it to my fiance's email address? Will it affect our papers? redflag or whatsoever?

Are you are referring to the account info for status checking on the USCIS website?   No it won't affect your petition or cause a red flag.

 

The email address should be that of the USC anyway (not that it really matters) at this point as he is submitting the petition.

RFE would only be from the petition process, not anything about you changing an email address on the USCIS website.

 

You can change the email to yours from Jen's without issue.  If you get an RFE email it will not have details and you will still need to wait for the actual notice from USCIS.

First things first.  For the Philippines bank statements are NOT required if you income is adequate to meet and/or exceed the I-864P Poverty guidelines.

 

The Manila embassy instructions letter states MAY, not required...  Can you include them?   Sure.  Will it make a difference?  No, not really, being your income meets the requirements on its own.  What the embassy does want is your most recent tax return, with supporting documents of your; W-2s and recent pay stubs... and you MAY include a letter from your employer... MAY.

Your profile is incomplete regarding country and your timeline is blank so not sure where your fiancée is from.

 

If the embassy in the country you are petitioning states they require bank statements then you give them what they want... always keep the embassy happy. 

 

But I am betting in the instructions letter from the embassy it states "MAY be included"

 

"Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis. "

 

But not required, whereas the tax return is required.

 

The bank statements are only a couple sheets of paper, so not a big deal to add to the "stack" for the interview.

I'm starting to collect the information needed before I receive my hard copy of the NOA2. My question is regarding the bank statements, do I need an official one from Wells Fargo or I can just print the statements online that I can access through my online banking?

 

 

If you income stated on your tax return meets or exceeds the I-864P Poverty Guidelines then you only need to provide your most recent tax return with supporting documents (W2, pay stubs, employer letter),  you do not need any to send bank statements or lists of other assets.

I know some people here are beneficiaries from the Philippines is there a way we can download a copy of the DS-160 so we can have like a rough draft so our attorney can look over so all our information is correct or is it only available to be filled out online? 

 

Second question would be regarding the forms, I read somewhere in this forums that people who went to US embassy in manila had the DS 155,156,157 forms with them and not the DS-160 BUT what my lawyer is having us do is fill out the DS160 form.

If your attorney is asking for the DS-160 with the K-1 visa - FIND ANOTHER ATTORNEY!!!!!!!!!!!   Its isn't used with the K-1!

I'm putting in the applications for my fiance's K1 visa tomorrow or the next day.  I think I've got everything in order, but I have one question - should I include a copy of my divorce decree (a/k/a decree absolute)?

In the box to the right of the Petitioner's name and address is the Notice Type... that is where it lists the validity dates.

You aren't a K-1 petition filer so I guess this question isn't directed to you.  The letter from the Embassy, specifically states to bring a copy of the I-129F, and pretty much everywhere else you read says to bring a copy ( see VJ guides, for example - and also I read a legal guide I got from the library that says the same).  They don't give guidance on how to package it though.  Also you are supposed to have a copy of the NOA2 as the other person above, stated.  Maybe they won't ask for it, but don't want to be caught unprepared if they do.

 

Regarding the binder, that's why I was thinking of putting it into folders by major section rather than a hard binder. I just wanted to be sure that punching holes in it won't somehow invalidate the copy.   I'm probably making too big a deal about it, and should just punch it and stick it in folders.

 

Could you post a copy of the instructions letter from the U.S. embassy in UAE?  This is a first where I have read the embassy is actually requiring a copy of the I-129F petition, considering they will have the original sitting in front of them ( along with a digital copy in their computer). 

 

Never read of the embassy requiring or even asking for a copy of the NOA2. 

 

Oh I have read of "others" stating to bring a copy of the I-129F and the NOA2, but have never read where the embassy ever required it or asked to see either.  Of course I give little credence to what others say without facts to back it up.  Paranoia can get out of control.

 

I would appreciate seeing a copy of the embassy instructions letter from UAE, I know each embassy is different which is why I would like to read the UAE instructions letter.

Hi Guys, 

 

Just wanted to throw this question out and see if anyone is aware of anything recently regarding this question. 

 

We just received our NOA 2 and wanted to know if it would be okay to travel for my fiancee before she has her green card. Our plan is that she will visit me in US once she gets the visa, we will get married and then apply for AOS as soon as possible. However, knowing that it can take up to 4-5 months or may be more for her to receive anything official, we wanted to find out if it would be okay for her to travel. We have planned our marriage towards the end of this year and we will be going to India since that is where her family lives. 

 

any suggestions/recommendations on what needs to be done for her travel would be greatly appreciated.

Once she gets her visa it isn't a visit, its a move!  ;)

 

When you apply for AOS also apply for the EAD and AP (they are free if done at the same time).  The EAD (work) and AP (this allows travel while waiting for the green card) will arrive between 2 and 4 months after filing.  My wife got hers in 2 months.

 

The green card will arrive between 4 and 8 months (depending if there are issues)

 

Until she has her AP or green card can't leave the USA without issues returning.

Hello everyone. I have a quick question about filing. My ex-wife moved out last year, we weren't in a hurry to file for divorce at the time. After she moved out I met Marife and we got along very well. So I went to the Philippines to stay with her and her family on my birthday. Before I went there I tried filing the divorce papers, but incomplete info kept getting it kicked back. Anyway, we wanted to get all of our papers ready to go so we could send them out after the divorce decree was issued. The decree should have been issued around the 22nd of June. We thought we'd be safe and put June 30th on Marife's and my papers. So she could mail them to me ahead of time and I can get everything ready. But due to whatever reason the court didn't get to finalizing things until today, July 1st. I am wondering, should I have my fiance fill out new papers with a date later than the the 30th or if that one day is going to make a big difference.

Where do I even start. All of this makes my head spin.

 

Here are the basics:

 

I'm American. My boyfriend is British. For almost 2 years we lived in Grand Cayman together. I have recently returned to "set up shop" here in NY. I am hoping that once I begin working and settle in, and we save at least $5,000 dollars that we will apply for the fiancee visa. K-1? 

 

Lee is from the UK, and has been in Cayman for 15 years. He was previously married but his divorce went through over a year ago and we have the documentation. 

 

How many of you went through a lawyer? I feel like it may be our best bet because I just don't want to get denied. I couldn't handle it. Being apart is hard enough!

This is what is have in income and assets. Can anyone tell me if they think it is enough for a household of 3?

 

Annual Income: $36000 (that is the annual income of my new job that started last week, and for which I will have one pay stub and an employment letter as my only proof. I have also three years of tax returns 2010 - $16000, 2011 - $24000, 2012 - $27000. I have been employed continuously for the last 5 years.)

 

Assets: Cash $5000 in US bank account for which I can give a bank statement as support. The bank does not provide an official letter but only a copy of the bank statement they email to me every month. I also have cash in a foreign bank account (I have been living abroad for the last five years) of $8000. Can I show a statement from my foreign bank account as proof of funds as well?

 

Home: Purchased in the last 6 months, debt free valued at $135000. 

 

My main concern is that they won't consider my annual income as sustainable since its a new job at the family business and if that is the case are my assets enough? Co-sponsorship is not a great option for me.

 

 

The I-864P lists income requirements, look at the 125% column.

For 3 people even your 2012 income is adequate.  Don't worry about a new job, you have the employer letter and pay stubs you are good.  You will still need your tax return for 2012 and W-2.

 

If your income meets or exceeds the poverty guidelines you do not need bank statements - no harm to bring them but not necessary UNLESS the embassy specifies they are required (as opposed to MAY include)

I know it's not revoked, but after all it does say cancelled even if its "without prejudice", so I am afraid if I say No then they'll be like...well this visa was cancelled so why did you say No? and that if I say Yes, they'll tell me it was wrong and I should have said No and then have to do another interview or something...

 

Answer honestly!  You can add an addendum for that question explaining just as you did here, as your visa really wasn't cancelled, just the one in your old passport, they put a new visa (new number) in your new passport (correct?), their rules required the old visa number be cancelled.  Just be honest.

i had my medical exam this week but unfortunately i was told to undergo a sputum exam. on my DS-156 form i already put Aug. 16 as my intended arrival date (US) but my sputum exam results will be on the 3rd week of Sept. so hopefully if it turns out negative, my interview date will likely be around early Oct. if i got an earlier available slot and that means i won't be able to go on the intended date of arrival i put on my form. my question is should i change my DS-156 form or just present the original one even if it states there that Aug. 6 is my intended date of arrival? if i should change it, are we allowed to generate or fill-up more than once for the DS-156? i hope somebody can give me an idea. TIA

 

Do a new form.   And you can put "unknown" for arrival date, after all the embassy stressed to not book any flights until you have your visa in hand, so they do not expect a date in that box.   

 

Wording on the form is " (Provide specific date if known) " , its not an issue to put unknown in that box.

Since my fiance has been busy, he has not sent the packet yet though he is trying his best to complete all the needed requirements for it. My question now : Are my papers like g-325 a, I - 129 F, letter of intent to marry etc, which are dated april 02, 2013, still be acceptable? or do i already need to provide new ones? You shouldn't have any issues with USCIS.  A few months is nothing to worry about.

For the record, NVC doesn't seem to have any knowledge of DCF cases and is unable to access them at least from a basic standpoint.  We had an issue in which we already had an approved visa and a STK number and another STK number was generated by the NVC when they received the first approved I-130.  When I contacted them about the issue they could not see anything relating to the first case at all.

 

 

Exactly.  That was what I was saying... DCF is controlled at the embassy level.  At some later time NVC may become involved but from the ones I read about on here the folks doing DCF process everything at the embassy and most times are done with visa in hand in a couple months.

 

(USCIS does have a section there for DCF)

Fine for you.... NVC controls ALL the embassy case numbers for every embassy in the world, even for those individuals that are doing Direct Consult Filing, the embassy has no clue what case numbers they are going to assign for those UNTIL they contact NVC..... "duh"

 

Now for reality; NVC electronically transfers ALL files to the respective embassy where the case number is assigned, when NVC is notified of this number (by the embassy) they physically attach this number to the proper file, then the file is physically sent to the embassy.

 

And yes an embassy code is needed, and it does have a function, but NVC doesn't assign it.

 

BTW - this information came from NVC, not an opinion.

NVC DOES issue the Embassy case number because I for one received my case number on the letter NVC sent to me to tell me they were forwarding the petition on to my embassy in Dublin. So without a doubt they are the ones who issue the case number. no0pb.gif

 

No NVC does not issue the case number.  You got the letter from NVC with the case number (true, as does everyone else) AFTER the embassy issued the number, notified NVC of the case #.... then you were notified.

    My finance was wondering, if she needs her parents marriage certificate, or fathers death certificate, to get married in the U.S.

My thinking was she doesn't, but didn't know for sure. Apparently there might be a problem with them, as well and she's concerned about that.

She's from the Philippines, & we're marrying on a k1 in the state of Michigan.

Did you check the State of Michigan website for what they require?   Most likely HER birth certificate, passport with visa ( and I-94) and she should be good to go.  But for the facts you should check the Michigan website.

Hey Everyone,

 

I'm having a few problems with the vaccinations portion of the process. I don't have my records and spoke to my personal doctor today. He seemed unsure with what would be required, so I decided to look it up online. This is the link I found listing the vaccinations: http://www.panelphys.../Pages/Age6.htm

 

It says Heb B is required for 18 and under. Does that mean that, since I am 25, I don't need to worry about it? I haven't had any vaccines since I was 10, so I need a lot already. He was hoping that it wouldn't be needed in addition.

 

Also, does anyone have any ideas how to handle an allergy? I never got my full tetanus/Diphtheria shot as a baby (nor any boosters since) because of an allergic reaction, but have no medical proof of that. My doctor is reluctant to sign a note of exemption because he was not my doctor when I had the reaction, and only has my word to go on. I am worried that I will still have to take it and risk a bad reaction again. 

 

Just to clarify, the list of vaccines that I will need is:

 

- Tetanus/Diphtheria

- MMR (Measles, Mumps)

- Chickenpox

- Influenza

Im extremely thankful that I was referred to this site by a friend of mine. I recently got engaged to my girlfriend from Germany. She was previously here on a J-1 last year and was issued a SSN during her time here. I have noticed on some of the forms it will ask for HER SSN #? We were under the impression that hers had expired. Do we still enter the number? or leave it blank?

 

if anyone has any insight into this I would greatly appreciate it! I have been on this site for about 10 min and it has already helped tremendously.
