My finance and I were officially engaged our last trip together.

 

We are anxious to start the process for K1 application.

 

However we would like to confirms what forms and documents necessary at this point to commence.

 

Through browsingThe USCIS Page on Fiance(e) Visa it follows:

 

1.  Form 1-129F Petition for Alien Finance(e) 

2.  Filing fee USD 340.00

3. G1145 - Notification of Acceptane  of Application/ Petition

 

Are we required to submit our evidence to support ongoing relationship, letter of intent, documents etc at this stage?

When do we fill out the G-325A( Biological Information)?

When do we submit the 1- 134- Affidavit of Support?

 

Please provide some clarity guys. We really want to submit everything as needed to avoid any delays in the process.

You only need to submit the Letter of Intent (both of you) at this time.  Support and evidence of an ongoing relationship are for the embassy stage.

Hi, this is my first post and I know this has probably been covered over and over again, but I have yet to find the answer.   In the K1 packet we need to both put and sign a "Intent to Marry" what is the address used at the beginning of the intent page.  Is it the same for both of us.  She is in Malaysia and I am in the US. 

 

For the K-1, I-129F you use the Texas address (USCIS) for both letters, doesn't matter where you live.  Once at the visa process stage you use the embassy address.

It really doesn't matter what you "use to " make, it only matter what you do make as income.  The embassy will want your most recent tax return, W-2s, the employer letter (which will explain your current income to the embassy very nicely) and don't forget current pay stubs.

Hello! I am just confused because my fiance's annual income that is reflected on his ITR is $61, 467. In his form I 134 affidavit of support he put in there that he derives an annual income of $61, 000 because he just round it off. And on his employment letter, his HR officer put that the rough estimate of his annual income is $60, 000. 

 

Would this be okay? Or does these three (ITR, I 134 Affidavit of support and Employment letter) annual income need to be exactly the same? 

 

I really need your help guys as I am so bothered about this. Thanks a lot! 

 

As long as his income tax return and supporting documents show his income meets or exceed the poverty guidelines stated on the I-864P there is not a problem.

Good day, VJ friends! smile.png Is it okay to have 4 working days gap from medical exam to interview? My interview will be on July 10 as appointed and I plan to fly to Manila (since I'm from province) on July 1, and have my medical exam on July 2 and 3. Do you think it's possible to only have 4 working days gap.

Embassy recommends 7 - 10 days before the interview for the medical, but there should be no issue with 4 days for SLEC to get the medical report over to USEM. 

 

If the medical isn't there for the interview the embassy will simply delay the approval until they have reviewed the medical report.  NO problem.

Hello. I am looking for some answers in regards to my submission of the I-134, affidavit of support. Any help would be greatly appreciated.

I've seen both that a K-1 visa sponsor needs to meet 100% of the poverty guidelines and 125% of the poverty guidelines. Which is it?

If it is the 125%, I fall 300 dollars short of the required amount for 2013. I was only working half of 2012 and my situation has greatly improved with a sizable hourly pay rate increase and 3 promotions in the NYARNG. That leads me to another question. I realize the National Guard is not considered active duty time, but we are in a drilling status that of which I am curious to know if on the I-134F I would be considered "active duty military." That would put me back in the parameters of acceptance to sponsor my K-1 fiancé.

With all of that said, if I am not able to sponsor my fiancé on my own, how do I go about getting a co-sponsor? I have one lined up. My 2 questions with that are, #1 do we have to live in the same house and #2 do we both fill out the I-134?

And finally, what do I need to send in with my I-134? I've seen so far that I need a copy of my tax return, letter from my employer, and copy of bank account withdraws and deposits along with date of bank account opened.

Any help is appreciated. Thank you!

 

125% is the requirement.   If you current income has increased since 2012 (tax return) provide evidence of this and there should be no issues.  Not sure about the active duty, are you full time "active" with the National Guard?  Is all your income from the NYARNG?

 

If you use a co-sponsor they complete the I-134 as well along with all the required supporting documents.  No you all do not have to live in the same house.

 

If your income alone meets or exceed the 125% requirement you do not need to submit bank statements or list other assets.

 

This is what I have heard. You need your bank account statements from six months ago, your pay stubs (W2), letter from your employer, and if you are falling behind you have have your parents as your co-sponsor if they are willing to help you. I am NOT an attorney, this is something info I have gotten from a paralegal. Make sure you print out COLORED copies of your bank statements and perhaps checks that have been deposited. Your bank statement will state the "Average" amount of money coming into your account. IF you have any sort of savings account, you may also get that balance and have it notarized or a bank statement will be better.

 

Thats what I am going to do when I get approved. If you are going to add your parents, you can have (2) I134 Affidavit of support listed. They also need to provide the documents, etc. 


Once again, I am NOT an attorney , and this is something my friends have used for their petitions.

Here's the question. I know that for instance in 2007, that they looked at a 1099 misc income..as income that would be applied toward meeting the minimum income statutes. In other words..it came right off the top..BEFORE any deductions, expenses were considered...and not considering the net "taxable income" which would of course knock the dollar amount down considerably. I again, know for an absolute fact that this was true back then. My question is..has anything changed? Do they look at misc 1099 income the same way they did in 2007 and before? Thanks

 

Income is income, taxable or not, as long as you have documentation (1099, W-2, etc), taxable has nothing to do with it..  If you have income to meet or exceed the requirements as listed on the I-864P there should not be an issue.  

 

Some people have zero taxable income and do not file tax returns even, yet they meet the requirements of the I-864P to satisfy USCIS.... so no issue.

I received my Packet 3 and am a little concerned about the fact that it says the interview must be completed and the visa issued within 4 months because I'm in the US for the next month and a half. Can anyone tell me where I find the date that this 4 months begins from? Is it on the NOA2 or elsewhere?

FYI - you can contact the embassy to get that extended if needed, they will extend it 4 months at a time, up to a year.

As people say, we need to call NVC to get case number, right?
Why do we need case number? Where to use it?

The embassy case number is what is required for you to complete the process at the embassy.  Once the case number is issued and your packet forwarded to the embassy things can move much faster!  I would suggest going to the sub-forum for your country to get details on the embassy process.

It will take 7 - 10 days business for NVC to receive your file from USCIS after you receive the NOA2, then another 2 - 5 business days for NVC to get your file in there system and get the MNL # from USEM.  Call after 4:45 PM eastern time for shorter wait times K1's are not tracked through the AVR, ever. They are processed like an immigrant visa, but they are NOT immigrant visas, so they fall into a completely different class of their own. Therefore you need an operator. To get there:

Hi, I'm a newbie here.
Here is my story...
My Fiance(EJ) & I had been dating since 2009. But we broke up early of 2011 & I met a guy(LEE)& we've been dating for a few months until he got me pregnant. & when I told him about my pregnancy he told me straight to my face that he wasn't ready to settle down. He will just support our child. Then we parted ways.
...It was my 3rd month of pregnancy when EJ called me up asking me how I was & I told him everything (that I had a boyfriend after him, I got pregnant but Lee wasn't ready thats why we broke up)... EJ was said he was sad... But still wish me goodluck about my pregnancy after almost an hour of talking he said goodbye...
1 month had passed... Its was my fourth month of pregnancy... When EJ called me again he told me that he was deeply hurt after he learned that I was pregnant, he said he can't sleep at night because he's thinking of me sad.png after a month of sleepless night he realized that he still love me & told me he want me back he even wanna marry me. Even though I got pregnant with somebody else. He is willing to take the responsibility of being a father to my child... But I turned down his offer because I felt that time It wasn't right... It's so not fair to him... It's like I'm being dishonest to him even though we're not together anymore when I got pregnant... But he said will do whatever it takes to win me back. (believed me I still love him too)... But it's just sooo not fair to him... After a months of pursuing me I finally gave in. We got back together on my 7th months of pregnancy.
He' calls me often especially on his Day Off. Calling is our number 1 means of communication. After a month when i gave birth he ask me the most important question in my life smile.png he said if "I can be His Wife?" he said he is willing to be a father to my child"... & i said YES! With a tears of happiness... But we decided that he will file the Fiance(e) Petition after a few months because ge wanted me to take care of my child first...

He filled the Petition March 2013...
My question is how long will I wait to have my Interview?

Problem(s):
I only have 2 snail mails that he send me because we talked a lot on the phone. But we dont have a call history of telephone bills to show because he use call cards. & we a few email to each other because I don't have internet at home & he is not into "using computers" until now told me that he ask his kids to teach him the basic wink.png (BTW he is already divorce with his former wife)
Will I have a problem with the CO about the proofs? What should I do? Please help...

Only potential issues I see are -

 

1)  Was it before or after March in 2011 that you two met in person?  USCIS requirement is within the past 2 years from filing the petition.

 

2)  Did he include the child on the I-129-F petition?

 

You can short up the ongoing relationship evidence with a few emails, and also copies of ticket stubs, passport stamp and more pictures from his second visit... you should be fine then.

Not sure what embassy you are dealing with as your profile and timeline are BLANK for that info, every embassy has different ways of handling things.

My friend's fiance (petitioner) didn't put on the I 129F form and G325A that he is annulled but they got approved by the USCIS. How is that possible? Will they be having problems on the interview because of that? 

 

Omitting data pertinent to the process is not good. 

 

What did you fiancé answer for Part A question 9 of the I-129F?  If he completed the form correctly and USCIS just didn't catch the absence of the annulment documents, then its just an oops...  and who knows what the embassy will do with that, just make sure to include it at USEM.

One of the main requirements for the K-1 process is that each party much be free to marry.  The instructions for the I-129F are very clean about providing documents showing your are free to marry (divorce decrees or annulments) - 5 (d) of the instructions.

No, I am saying a 1040 and a 1040A are the same thing... federal income tax returns.   The embassy very likely sees a large number of 1040A, and is just fine with them.

 

I am saying... you have nothing to worry about.  As long as the income meets or exceeds the 125% requirement of the I-864P - all is good.

If your fiancé income is taxable he needs to file a tax return.  USEM states in their instructions letter that they require the most recent tax return.  A W2 is only part of the evidence in support of the tax return.

Have your fiancé read the embassy instructions letter, plus the I-134 and its instructions.  If he wants the visa approved he has to follows the rules set down by USEM.

Hi everyone!

 

We just got our K-1 approved (Yeah!) and are waiting for the visa to be mailed?

 

I tried to figure out if / when I'll be able to start working in the US, but there seems to be some confusion about this. Here's what I understand now:

 

Once I've entered the US on a K-1 visa?

  1. It's not legal for me to work unless I have an SSN and either an EAD or a green card.
  2. I can apply for an SSN immediately.
  3. The best way to apply for an EAD is together with the AOS application after we got married. That way it's free of charge (included in the AOS filing fee) and valid for up to 2 years.

Please confirm / correct / comment! Thank you!

 

 

1)  Correct, can't work until...

 

2)  Correct.  Wait at least 10 BUSINESS days after entry before applying so there is adequate time for your information to get in the system.  If you wait until after you are married you can get the SS card in your married name, this is what my wife did.

 

3)  Almost correct, EAD one year, GC two years.   I would suggest applying for EAD and AP as both are free if filed with your AOS.  Many have received there EAD in about 4-8 weeks, my wife had her EAD/AP combo card in about 4 weeks and had her GC in about 4 months.

No that is not correct.  The EAD is valid for a year from date of issue.  When you apply for AOS you can apply for the EAD and AP free of charge... so there is no waste of money.

 

Once married and have certified copies of your marriage certificate you can file AOS.

Do you get pay statement from the military or is it all direct deposit (been too long since I was in)?  Include those.  Along with your W-2 (it shows your actual income, taxable or not),  bank statements showing deposits.   And yes an explanation letter is good.

When it comes to the last section of the I-134.   What do you do in the top right high lighted area?  Sign or initial?

I am going to need a co sponsor for my I134  . My brother is considering helping , but wants to know if he is responsible if I can not support my fiancee . Once we reach the stage where the I864 is submitted at which point I will be in a better position and not need a co sponsor . At that time would my brother's obligation be fulfilled once the I864 is submitted with no co sponsor ?

 

 

The I-134 is not a binding document, but the I-864 is.

 

With that said, the embassy in Manila can be very difficult about approving the K-1 visa with a co-sponsor.  Not many get approved.  But I have found that using the I-864 for both you and the co-sponsor greatly improve the odds of USEM accepting a co-sponsor.... still no guarantees.

 

I would suggest your and the co-sponsor complete both the I-134 and I-864, odds are the embassy will take the I-864 and not be interested in the I-134 even though it is the form they request in their instructions letter. 

 

If you want to improve your odds of getting the K-1 approved with a co-sponsor for sure include the I-864.

Oh as for your other question, if you are able to file AOS without a co-sponsor you could then be listed as the sole responsible person.

Can I leave this blank and write see attach paper  marked as I-129F Supplement: Part B, Question 18: Has your fiance(e) met and seen you in within the two-year period immediately preceding the filing of this petition  OR  write something on it and if there is not enough space  I just write see attach paper for additional information marked as I-129F Supplement: Part B, Question 18: Has your fiance(e) met and seen you in within the two-year period immediately preceding the filing of this petition?  TIA.

hi can someone tell me how can we prove that were getting married,,and how can you to tell whats the date of the wedding when u do not know when will they approve the visa,,how can you plan the wedding then?

 

You can't "prove" you are getting married, at this point you each complete a Letter of Intent and sign them.

 

The GUIDE has details and examples for the I-129F, K-1 process.

If it's okay that the email address is under my fiancee's email address then I'll leave it that way. But if it really matters that it should be under my email address (petitioner) I hope I can still change it and hope it won't affect my case.

 

It really doesn't matter, all that REALLY matters is that USCIS has your current mailing address.  :thumbs:

 

I am very sure any emails received from USCIS your fiancée will share very quickly!  :lol:

Hey everyone, i want to ask if I can change the email address I put at USCIS site? would that be ok?  I am the beneficiary and right now it is my email address that it is in there, would it be ok if i change it to my fiance's email address? Will it affect our papers? redflag or whatsoever?

Are you are referring to the account info for status checking on the USCIS website?   No it won't affect your petition or cause a red flag.

 

The email address should be that of the USC anyway (not that it really matters) at this point as he is submitting the petition.
