Household size is 3 for you and your co-sponsor (you don't count with the co-sponsor).   Income needs to meet and/or exceed the 125% guidelines.

Does anyone know if the letters of consent to marry within 90 days need to be notarized? Also does the letter of consent from the parents of the beneficiary need to be notarized as well? I can't remember exactly where I read it, but is it true that if the beneficiary is under 25, that a letter of consent from the parents need to be included into the I-29F packet?

 

 

The consent letter is not a requirement with the I-129F.   You won't need the consent letter until CFO time.  You don't need a consent letter for USEM either.

When I file for my k-1 Visa, my significant other and I will have to fill out and sign the g325 form. She lives overseas and I heard that the form must be in original form. Will we be able to have her print it, sign it, scan it, and send it through email? will this work? same goes to the letter of intent. How did you guys do it? If she has to send it through mail, that would take a long time. And would I be able to sign it for her?

When my fiance who lives overseas fills out the G325-A form, can she send me a copy of the form?

Because it says on the guide that "All Forms that you submit must be originals with original signatures". So i was wondering, what would happen if she prints it, signs it, copies it and then sends it? would it be ok? how would i obtain the original if not?

 

Also I have many people telling me to do the K-1 Visa because it is faster and I have the choice of doing either K-1 or Cr-1 because of my circumstance. Under Islamic law I am technically married amongst my family members because it is required for me to have a nikah in order to be able to talk with my fiance or now considered in my eyes, wife.  How would the government know I am married or not? It is in Saudi Arabia and it is not documented meaning I don't have an official marriage certificate under the state of Saudi Arabia or the consulate or embassy of Saudi Arabia. So I dont know what route to take on this? any advice is appreciated.

If your income meets or exceeds the income requirements of the Poverty Guidelines you do not need to list additional assets, just include copies of your tax return, W-2, pay stubs and if possible an employers letter.

 

If you are short you need assets that are equal to 5 times the shortage.

And what am I supposed to do on the very bottom on the "Oath or Affirmation of Sponsor" part... there's a line that says, "I acknowledge that I have read "Sponsor and Alien Liability"..." then a blank.  Just my initials?  Bec it dont say to sign like it does on the very bottom "Sig of Sponsor"... what do i put in the 1st blank?

So you screwed up on the I-129F by not listing the legal name of the child correctly?  Now you are ready for the visa process and go    oops8rh.gif !!

Best that I can think to do is complete all the forms with the correct legal name of all children, then at interview time go "oops!  ... I made a mistake. "  Hopefully the CO will look at it that way and all will go smoothly.   I think you will be OK but that is just my personal opinion...  only the CO knows for sure.

If the form specifically asks for your prior wife's maiden name - that is her name when she was single (birth name)

Your timeline is blank so not sure where you re in this process.  Still waiting for the -129f approval?

 

The I-129F only looks for proof of having met within the past two years; photo together is something they look for.  They also want the Letter of Intent stating you plan to marry within 90 days fore each of you.  Don't worry about an engagement ring or receipts of same.

I suggest you call DHS for clarification.

She needs to go to the medical first before going to the interview. At least a week before the interview the medical should be done. Your MNL will come from NVC. It should be like MNL1234567890 and this is your case number

my Fiance and I have gotten our I-129F approved on June 11th and i now have gotten a letter from the Dept of homeland security. in the letter they said they will be sending the information to the Consulate in Manila. i thought it had to go to the Visa service center first. Also what is a MNL # and on the USCIS site the instructions said when i got this letter it would have instructions on what i needed to do and what she needed to do.  there is no information on anyof this. also does she need to go to embessy for interview and they send her for the medical or can she just go in for the medical then set up her interview at the embessy.

 

As stated by others (some) - all petitions are forwarded to NVC from there they are assigned the embassy case number after which the packet is sent to the respective embassy.

That doesn't sound right for your daughter getting her citizenship recognized.. after all you ARE a U.S. citizen and she is your daughter ... I don't know for fact... just my opinion.

 

You should really post a separate topic concerning your daughter's citizen, you may find other's who have dealt with this.

 

As for the K-1/K-2 (daughter) on the petition you list your daughter on the I-129F in section 13, that's it for now.

 

I don't see issue with using your military address on base, but you could use your mother's address easily enough also.

i need some info on this. i asked about the I-134 and what i needed to send to my fiance in the Philippines. as iread through the instructions about this form it says noing about sending tax transcripts. however it does say you need to send in bank statements and proof of deposits and or proof of employment abong with pay stubs. why is it that some people say i need to send in tax transcripts. would bank statements and w-2's be enough???

 

The Manila embassy requires your most recent tax return, states so in their instructions letter.

 

 

n. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form with original signature will be useful to the consular officer to evaluate your petitioner?s ability to be financially responsible for you. You should also submit your petitioner?s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). If your income along meets or exceeds the I-864P 125% guidelines then you don't need to bother with bank statements and such.  Only need to sent the documents relating to your employment; tax return, W-2, pay stubs, employment letter.

1)  Beyond the  documents and evidence required the embassy only provide answers to questions asked at the embassy. 

2)  What happened with your EX has little if anything to do with what you are doing now.  Your EX would be the one under the microscope if EVER that were to happen.  So leave that stuff at the curb... unless asked specifically about it.

3) As for the pregnancy, if your fiancée has not delivered the baby by interview time... let sleeping dog lie... say nothing regarding an old boyfriend stopping by for a "visit" one day and that you are fine with it.  Now if the baby is born before the interview you have a new issue, she is not listed on the K-1 so there will be NO visa for her and she will have to stay behind and you will have to apply to bring her later... or you stop the process until after the birth and start all anew later. 

4) Employment; hard to sponsor your fiancée without a job, so hope all goes well there.  Manila is not known for accepting co-sponsors with the K-1 (even though there are a few approved with co-sponsors that I know of)

5) Petitioner being present at the interview, in your case - yup it may be a good thing.  Just don't DO DO.... what may be lingering in your mind may not be an issue in the CO minds... unless you speak.

May I know if there are cousin couples here who's already done with the K1 visa interview? What happened during the interview and what did they say about your case? 

 

I know that the state where my fiance resides allows first cousin marriage but I am just so anxious right now as I am thinking that they'd still deny us for some reason. Me and my fiance have been with each other for quit a long time now but I don't think that it's a plus because they'd still focus on the fact that we are cousins and they might think that the application is just for immigration purposes only.

Being your are 2nd cousins, not 1st cousins, it may not be an issue at all with the embassy. 

 

BUT if there is any change it may be an issue within the Philippines it could cause problems at CFO and you need the CFO sticker to leave the country.   As long as you are certain its not an issue in the Phils then you should be fine.

The K-1 is treated as an immigrant visa.  So choose immigrant then K-1

I need help with the I864. So, we found a joint sponsor who has an income of around 16,000. She also receives pension and has a house with no mortgage(paid off)...worth at least 175,000.  The required income is 19,387 for 2. She is 3,242 short. So, in order for the assets to count they would have to be worth 5x the difference, which is 16,250. Could we use the house as an asset and make up for the difference? It's more than enough. Please help. I hope someone responds as soon as possible. Thanks (: (oh and I almost forgot she has an IRA of 10,000..not sure if we can use that too) Help? We are just waiting to fill this out and then my fiance can go to his interview. 

 

You need to find out if the embassy accepts co-sponsors or not, some do, some don't... some are "maybe"

 

You said the potential co-sponsor has income of $16,000 plus has a pension, what is the total of the two incomes?

 

Yes you could use the assets of the house; an actual paid appraisal would have to be done to show value & a copy of document showing the mortgage is paid off .

Embassy does not ask for either of the 797 notices, thus they are not needed, but if you want to send copies just for grins that is fine..  Everything  can be copies UNLESS the embassy specifically states they want originals.

Hello guys! I've been searching and searching this K1 forum about my problem to get answers but couldn't seem find a topic with the same exact concern I have. Anyway, my petition for my fiance has been approved last June 13 and today I received my NOA 2, we are very excited but I'm very concerned about the fact that I still live with my parents, though I meet the annual income requirements(last year I made a little over 22k), worked at the same place for 5 years now and just graduated an Associated Degree(if it matters). My dad was also telling me that I barely pass the poverty guideline which adds up to my worries. My dad is willing to co-sponsor for us, but do I really need one? Plus, it was stated that the Manila Embassy doesn't allow co-sponsors. Please help? Thanks so much in advance! 

 

As long as you meet or exceed the requirements stated on the I-864P you will be fine.

You don't need the NOA2 for the interview at all, the embassy does not ask for it.  If you want to send her a copy just for grins do that but keep your original.

I was wondering if anyone knew if me and my soon to be wife would be allowed to marry on a cruise ship ? We both understand that a K-1 Fiance Visa is a single entry visa but we would love to marry on a cruise ship that does a cruise to "nowhere". In other words there are NO ports of call. The ship would leave Tampa, Florida on a Friday night and return back to Tampa, Florida on Sunday morning. Again there are NO ports of call. I have called and asked many people abd even a travel agent but no one knows if this allowed. Any help or advice would be greatly appreciated. ( we would marry BEFORE the ship left Tampa, Florida )

 

Basic requirement  for K-1 is = you must marry IN the United States within 90 days of entry.  If the ship just putts about and does not leave U.S. waters it may not be an issue, if a passport is not required to do the cruise would be the key.

 

Even if you get married before the ship left Tampa, the key question still is whether a passport is required for the cruise, if so YOU can't go as you have no legal way to re-enter the USA until after you start the AOS process and receive your AP card at a minimum.

K-1 Fiance(e) Visa Process & ProceduresVisa Issuance - NOA2 expiration approaching

 

Thank you for your reply. I did just contact DOS to ask what and if any implications if the NOA2 expires. It was explained that the consulate officer needs to make a decision before the expiration. The CO can extend the validity of the NOA2. I then asked if the CO can see when the petition expires. He said they should. I then asked if the NOA2 expires, who is at fault; the CO or petitioner? DOS stated both. The DOS representative pretty much stated I can only email the CO (i.e. embassy) and make a note that the NOA is expiring. THe DOS rep also stated I could get a congressman involved if I have not heard anything after submitting an inquiry.

 

So since I emailed them yesteday i will wait the full 5 business days have passed before referring to my congressman.

 

Sounds like a bunch of "DO DO" when DO will DO.  

 

Simply call the embassy and ask that your K-1 petition be extended for an additional four (4) months, the embassy will extend the petition validity up to a year, four months at a time.  No issue, very simple to do.

My finance and I were officially engaged our last trip together.

 

We are anxious to start the process for K1 application.

 

However we would like to confirms what forms and documents necessary at this point to commence.

 

Through browsingThe USCIS Page on Fiance(e) Visa it follows:

 

1.  Form 1-129F Petition for Alien Finance(e) 

2.  Filing fee USD 340.00

3. G1145 - Notification of Acceptane  of Application/ Petition

 

Are we required to submit our evidence to support ongoing relationship, letter of intent, documents etc at this stage?

When do we fill out the G-325A( Biological Information)?

When do we submit the 1- 134- Affidavit of Support?

 

Please provide some clarity guys. We really want to submit everything as needed to avoid any delays in the process.

You only need to submit the Letter of Intent (both of you) at this time.  Support and evidence of an ongoing relationship are for the embassy stage.
