My fiance (petitioner) called their MY HR to get the employment letter to support the I 134 form.

 

He forwarded it to me via email and it has the ff:

 

  -Company logo  (Just the logo and I do not know if you can consider it as letterhead)

 

  -name, status, income, start date, position

 

The thing is, it is sent electronically and it doesn't have a signature. It just says, if you have any question, please contact MY HR.

 

Is this valid? Or should I ask him to ask their HR for a new one?

  

 

It will be just fine.  What is really important is having a copy of your fiancé's most recent tax return and a copy of the W-2.

 

The employment letter is secondary evidence and is a "may include" type evidence, not required.

Sending the bio page and the page with the Singapore stamp of your fiancée's passport should be fine.  USCIS only wants all pages of a passport when you are using the passport instead of a birth certificate to proof U.S. citizenship.

If you income meets or exceeds the poverty guidelines you don't need any other financial info.

 

If you need to use real estate as an asset, mortgage or encumbrance(s) are any liens on the property, they want to know how much your OWE.  Also if you use real estate you would need an appraisal to assess value.

My fiancee is Filipina and is going back home to the Philippines from Dubai UAE because she lost her job. We were approved for NOA 2 on July 26th. Does any paperwork get send to her from the US Consulate/ NVC or does everything get send to me ? If any papers get send to her how do they send it ? (Email or Courier ?) We are concerned about this because her address on all the papers we have send in so far is in Dubai . How do I change the address form Dubai to her new address in the Philippines ? 1)  You do not need to list ANYTHING else as long as his income meets or exceed the poverty guidelines.  And as I mentioned in your last post asking these same questions - don't bother listing furniture either.

my fiance (the petitioner) is a union boilermaker he doesnt have a permanent employer he works for multiple employers through out the year, sometimes as many as 5 or 6. we are worried about the letter of  employer.Will pay stubs. Tax returns and a letter from his union hall be sufficient?

 

Embassy is more interested in the most recent tax return and W-2 (s) , as long as his income meets or exceeds the poverty guidelines all is good.  The employer letter is a "MAY" include item, not required.  Including current pay stubs will work just fine.  And no issue including a letter from the union.

As you stated the K-1 is a non-immigrant visa.   If it were me I would answer NO.

In my answer to this question (#18 on the I-129F) I discussed how we originally met online. I continue to discuss how our relationship evolved. Then I discuss our first in person meeting that was about 4 years ago in the Philippines. Then finally, in about one paragraph, I explain how we met in person within the past two years in Singapore (June 2013). I explained all this in one (full) page.

 

Does this sound sufficient or should the entire page talk about our recent June 2013 Singapore trip only?

But to answer you question about  #18 is about having met in person within the past 2 years, USCIS wants to know the circumstances of THAT meeting. 

 

The question isn't asking about the evolution of a relationship.

"~ "  is not an English character, embassy requires ALL documents to be translated to English (I know... ), so the lack of "~" on the BC is actually following the requirement.  Like said before your visa will not have the "~" either.

 

Without special effort on my part there is no way I can put the "~" over the N when typing... won't happen. 

 

Relax.  You will be fine with the NSO BC not having the "~", I truly do not believe its a "deal killer".

Being that the embassy requires all documents to be in English (or translated to English) they may be moot on the "n".  The visa will not have the Spanish spelling of your name regardless of what your passport or other documents show.   IMHO

Only the official documents are required to be in English by USEM, and for the Philippines that is a non-issue as they are all in English anyway.  Chat logs and such do not have to be translated.

Well that isn't correct.  Depends on how much money was made, there is a threshold to meet or exceed.

 

I don't file federal tax returns as a majority of my income is exempt from federal tax.   Use the IRS  SS-5 to determine if filing is required or not.

Trying to process a K-1 visa.

My issue is with my beneficiary's physical address being used as a mailing address. From our conversation, the conclusion is drawn that the mailing system is very challenging.

 

 

What are some options for using an alternate address?

 

Is it okay for this alternate address to be used on the I-129f form or stated in an attachment paper, instructing USCIS to use this address for mailing purposes?

 

Is it possible for USCIS to mail processing documents via FedEx and have beneficiary pick up package in their area; or  is it possible for USCIS to  address package to the local consulate for my beneficiary to pick up?

 

My goal is to ensure  my beneficiary's documents arrive in a reliable and secure fashion.

Any help you provide is appreciated.

 

The I-129F asks for your fiancée mailing address specifically, it does not ask for her physical address.   BTW USCIS will not be mailing anything to your fiancée.   Later on the embassy will.

You sign with your complete name, just like they state on the form, not the way you sign your namely daily... unless of course you always sign with your middle name included.

First I would not have posted the question if I have no knowledge of the process. I am aware that it is bigamy to marry someone else while you are still married. Your answers and questions are condescending. I was told this site is a friendly site. As far as the answer to your question we already spent almost $5000 into the annulment and I dont want to get into the detail of where we are at in the annulment process. I will just have my lawyer handle my petition and answer my questions. I posted an honest questions and I don't need anyone lecturing me about the whole process like I am stupid.

What was trying to be said is that until the annulment is finalized you can't even file the petition (I-129F), both people must be free to marry at the time of filing the petition.  So until the annulment is completed and you get the finalized documents... you can't start the petition process.

 

And as you read on the USCIS website there isn't much cause for an expedite from your "list".

Actually this is the 2nd petition for my fiance. She has been petitioned before but it got denied in USCIS because of her Ex bf background. the denial was about 2 year and 5 months ago. She is confused if we need to cancel the denied petition before here interview schedule. 

 

According to the Denial Letter:

The decision will become final unless you appeal it by filing EOT-29. The decision is final if your appeal is not received within the time allowed which is 30 days.

 

I hope someone also can answer me with the same situation.

 

Correct me if I am wrong.  Your fiancée was petitioned 2 yeas and 5 months ago by another USC and USCIS denied the petition?  Now you filed a new petition that was approved and are now heading towards the embassy and the visa application... (congrats BTW) ?

 

No you do not need to cancel the old petition - if it was DENIED.  It's dead... finished.

 

Like said by others your fiancée needs to be very honest about the old petition when at the interview IF asked questions about it.

I work abroad, and me & my fiance (USC) decided to see each other in Philippines. I arrived in PI on April 19 but it was stamped April 10. Should I still include the copy of passport stamps with a notation about the error, or just put a copy of my boarding pass?

Yes include a copy of the arrival stamp, and your return stamp, along with your bio page, adding a notation is fine but your return date is more important.  And yes for sure include a copy of your boarding pass (this is always good to include).  And of course a few pictures of the two of you together.

 

Based on my experience, you should include the copy of all you passport pages...not just the page stamped with your entry...

 

A copy of all pages of the passport are only requested if you are using the passport instead of sending a copy of the birth certificate for the USC.  She is a Filipina.

Hello people just wanted to say that I am a newcomer and am wanting advice with the procedures with the K-1. So my fiancee and I have been together for quite some time and is wanting to come over to the US to see me first before I will go see her and also wants to stay with me till I go to the Philippines. I know that when applying for the K-1 the requirements are for me to go over and see her first . I already have everything planned for me to head that way at the end of November. If everything goes well we both want to start on the paper work ASAP. Again we don't plan on starting the K-1 till after November. Will her visiting me cause us any problems in the future when applying for the K-1.

 

 

Its very difficult to get a tourist visa in the Philippines, many try, most get denied.

 

But if you fiancée is one of the lucky few then have her come visit and return to the Philippines on or before the date stamp on her passport at POE.   Visiting on a tourist visa and leaving the USA on time then later filing for a K-1 visa is not an issue.

 

Just remember don't LIE!!!  Don't lie at USEM or POE.  That is where you can create problems down the road.

Hank, you are very knowledgable in these matters. But a K-2 is possible, its a child of the alien fiance. Thats what a K-2 (fiance) and K-4 (spouse) are for. Its the timing of the birth that raises questions.

 

I know a K2 can be filed for a child of a K1 but I don't know how to add a K2 in mid-stream, I am sure it's possible, I just don't know the details...

I need to add a K2 from a pregnancy while the I129F was filed . Right now with our case we have an RFE on July 16th . The baby was born on July 23rd . Since we have an RFE will this be a chance to add the baby ? If so how would I do this ? At this point I did not receive the letter . However I believe it is for outdated G325A forms I used . It was the only thing I could find fault while looking at my I129F copy . Born in the Philippines baby girl smile.png

when you are done filling up the form, and ready to be print  then you can click the print, it will show you an option on how you would like it to be print (select destination), click the save as PDF. it will direct you on where you want your document to be filed. you can save your file (the filled-up form) on your USB and print it later when you want it. pls note that when you do a print out at the cafe, make sure that in the preview, it should be "document and markups" so your input data will be printed also. or just ask help from the attending person in the cafe. smile.png

You have to have PDF software on your computer to use that idea.  Better to use PRINT and choose Microsoft XPS Document Writer as that comes with all Microsoft computers and allows the file to be saved to the computer for actual printing later.

I don't have a printer; so, I want to fill out the forms and save them to be printed later, but I can NOT save them.

 

Example DS 156k:  I have downloaded and when I open it, I get a message at the top "Click sign to fill out and sign this form.  When you are done, you can save a copy by clicking "Done Signing".

 

I have click Sign, but can't find where the "Done Signing" is to click.  I have also tried many other ways to save the form after filling it in, but wasn't able to.

 

I have seen where it says to Save a copy, but when I click it, I get a message that Adobe Reader can only save a blank copy.

 

Any suggestions?

As mentioned the DS-156K has to be completed online as it generates a bar code from your answers.  Once you have completed the form and the website has generated the bar code click PRINT then choose MICROSOFT XPS DOCUMENT PRINTER, this will allow you to save the file to your computer so you can save it to a memory stick then later have it printed.     You can then take the XPS file to have it printed easily.
