i am confused with what i need.

 

in the picture i have posted,  do i just submit the letterings all in bold with the asterisk (About foreign documents) ?

 

or do i need to submit the items below the black line ??

Intent to Marry, etc..

 

 

 

1) Did you initially send in Letters of Intent signed by each of you (original signatures)?

 

2)  For #18 Did you describe how you MET IN PERSON for the first time (not how you met online or whatever)?

 

3)  Did you initially include copies of your passport stamps from visiting your fiancée?  Copies of airline tickets?  Just what did you include as primary evidence of meeting in person?  Pictures are secondary evidence?

 

If you didn't do those things... that is why they are asking now.

 

No matter, give USCIS everything that they have listed and returned all per the instructions with the RFE.

On DS156 my lawyer made 3 small errors ( wrong work number , wrong items marked no instead of yes)
I called to ask her to redo it but she said once the barcode is produced you cannot change form. She advised to use black ink pen to correct.
Do you think that it is acceptable to correct with black ink after form is printed

You lawyer is full of sheeeeeeeee.....it.  laughing.gif   The barcode is all the information entered onto the form coded.

 

You can redo the form, WITHOUT you lawyer to screw it up.

I don't know.  I only share what has been passed on by others before you regarding the I-134 and/or I-864 when using a co-sponsor.  Could USEM accept a co-sponsor with only the I-134?  Sure, its happened . USEM not accepting co-sponsors with the K-1 visa is well known.

petitioner and co-sponsor should complete both.  The I-134 as its listed as required by USEM, the I-864 as it has been found to improve the chances of the co-sponsor (family member) being accepted.

 

Getting USEM to accept a co-sponsor is always a gamble, but those that have gotten approved have found the I-864 to help.

USEM knows you can't get a police certificate from Dubai without being there in person, so they waive that requirement.  There are a few countries that will not issue a police certificate unless applied for in person.

I don't agree with you question being moved out of the Philippines forum..   but that is my opinion.

 

Being that at this stage of the process requirements are embassy specific... and they are dealing with USEM... this is not generic a K-1 question.

 

Some countries police clearances can not be obtained (except in person), which USEM is aware of, thus does not require them for those countries.

Just for an update, I got a call from the Embassy saying that the envelope of my visa packet was changed and ready for delivery. Yay! How i wish it were October now lol. 

 

Yikes, i know temperature there can go as low as -24 C or maybe lower than that!  wacko.png

 

Very good!  The way that stamp was I figured they would change the envelope.   Now you are good to go!!  Time to relax, visit with family and friends.  We stayed in the Phils a month after the visa arrived, just to have time for visiting.

 

Coldest weather I was every in while living in Minnesota was -51c (actual temp, not wind chill, the wind chill was -87c).  Luckily for you it doesn't get that cold in Iowa.  ;)

 

Now in Arizona its temps that go extreme the other way.   Couple weeks ago it was 47c.

I hope so. I received an automated response from the Embassy and said they cannot address the concern the quicker the possible due to the high volume of emails they receive everyday. They acknowledged they were unable to receive attachments too. (bad).

 

Anyway i am giving them 7 working days as what they promised.

 

We wanted to fly the soonest the possible and only October is the month when my fiance permitted to file his leave of absence, for he already used his paid vacations when he visited me last year.

 

Yup, I am already geared up when i get there and January is the peak month of winter when our wedding will take place wink.png

 

 

Very understandable they do not accept attachments, as long as you explained what the DO NOT OPEN envelope looks like with the stamp they will figure it out as to whether you need to send it back or not.

 

You will be fine for flying in October.

 

Owwwwwwww!  January for sure is cold.  I am originally from Minnesota, if you think Iowa is cold ... remember Minnesota is COLDER !!  :lol:

That is good to hear smile.png  .  The reason why I want to submit as much proof as possible early on is because I don't want my fiancee to face a CO who will be interviewing her be biased against divorce as well as age difference between the couple without reviewing evidence or proof in hand. 

 

Two things that has worried me from day 1  that might appear as a red flag to a CO eventhough I meet USCIS criteria are:

 

1. I am almost 21 years older than my fiancee. She is turning 24 years this year and me 45.  Although I look young for my age, it might play a role of the CO thinking that my fiancee goal is only to migrate in the US! 

 

2.  I got divorce from my ex wife of 12 years recently... back in January of this year. Our relationship had been going downhill for a few years ... and without any kids to have a real bond holding the marriage, we had a mutual agreement that we should separate ways when we meet the right person.  Unfortunately she lost her job and I did not want to just abandon her.  I hang around her until last year when she finally went back to the workforce.  After I met my fiancee back in May of last year (we were introduced to each other by a relative of mine), we started contacting each other online when I came back  home to the states. Eventually we fell in love with each other , spending at least a total of 6 hours a day chatting either thru facebook or skype. These two events made it easier for me to go ahead and file for the divorce.  My fiancee knew of my marriage and I explained to her my relationship with my ex.  I did not get engage to my fiancee until my second trip to the Philippines last April 2013. We had an engagement party with both our families and her friends present. 

 

Other than those two red flags me and my fiancee are pretty compatible since we came from the same province, I can speak her own native dialect and we do have a strong feeling towards each other.  Oh by the way, I came to the US when I was 19 years old .  I have dealt a lot with the INS in the past since I came here in the United States with a student visa then working visa, green card ( thru labor certification) and finally US citizenship so I have my own experiences with  the INS  smile.png.  But the US embassy I only dealt only once years ago when I left my country to study in the US. 

 

There are many here on VJ that have more that 21 years of age gap, my wife and I being of that group.  So 21 years difference is not an issue to be too concerned about.

 

Your recent divorce will not be an issue that I can see, USCIS and USEM only requires that you be free to marry, not that you were free to marry for "so many years".

 

If it makes you feel better to front load your petition, then add a sampling of chat logs or such, but hundreds of page of chat log or tons of photos are really not necessary.... USEM is not the embassy from hell.   :lol:

 

Are you planning to be at the interview with your fiancée?   Rather than killing a bunch of trees wink.png, I would suggest doing that "to take the worry out of being close".    I was at the interview with my wife and it was a wonderful experience!

 

All the embassy is really looking for is a real relationship, no fraud ... after that they are happy.  USEM has no desire to prevent two people in love from being with each other.

I am about to submit the I 129F packet and have some questions/concerns regarding front loading the application since my fiancee is from the Philippines.  So far I will include:

  1. Facebook chats ( sampling of at least 2 to 3 per month) during the last 14 months of our relationship.

  2. Facebook postings of 2 to 3 postings per month spanning 14 months.

  3. Skype chat logs for the last 14 months.

  4.Skype or Facetime pictures of us taken while we were  Skyping (spanning different months in our relationship)            and posted by my fiancee in facebook with the posting date showing.

  5.A few emails, a few google voice calls showing a log of calls 

  6. Flowers and bear I sent my fiancee for Valentines day which she took a picture of her holding them. I am                 including receipt of it. 

  7. Two receipts from shipping company when I sent her some chocolates

  8. About 40 pictures of us together. Most pictures were taken from our engagement party. While the rest were taken       from the various places we visited together.  I will also include pictures of us with her family and friends.

 

Is this enough or do I need to submit more evidence of our relationship?  Can I include passport stamps , plane  boarding passes , travel itinerary and hotel receipts and will they qualify as proof of on going relationship? 

  

  

 

USEM is not THAT difficult of a embassy that you need to be concerned with front loading your petition.  Save all your ongoing evidence proof for the embassy where it actually matters.  

 

Right now you need to show proof of having met within the past 2 years.  That is passport stamps, airline tickets, receipts while together and 4-6 pictures together, (you for sure don't need to send 40 pictures.)...  (never DO DO when DO will DO)

 

 

What you need to do is make sure you have everything that is required with the I-129F, follow the GUIDE for the K-1 visa here on VJ and all will be fine.

My fiance is going to have to change jobs and her residence address for family reasons.  We are 3 months into the waiting after receiving our NOA1.  Is this going to cause any problems or delays?  How do I go about notifying the Vermont Service Center or do I need to do this after we get the NOA2?

Don't worry about your fiancée (beneficiary) changing jobs and residence address in regards to the I-129F petition.    And don't worry about later at the K-1 visa application either, the embassy only mails out a letter and some pamphlets (which some do not ever get) all the important stuff is done online.

 

Relax its not going to be a problem and will not cause delays.

If you are asking regarding evidence for the I-134, your income exceeds the requirement for a family of 4 which is $29,437 so there shouldn't be an issue there.

I am a Filipina currently working in Indonesia, on my G325A for my present address is Indonesia but it has overlapping dates with my philippine address since my permanent address is still Philippines. so it's like this on the form:

 

Indonesia 2010- present

Philippines 1998- 2013

 

Someone told me that the overlapping dates are ok since I mentioned that I am just working here. JUst confused about my letter of intent address?The lawyer told us to write my Philippine address there and have it notarized. Is this okay cause I am presently in Indonesia and my letter of intent address is Phil?Help again please!!!!

 

Letter of Intent does NOT need to be notarized, you do not even have to have an address on it, just your signature.   Lawyers!  ranting33va.gif :lol:

Nope.  Won't be an issue for denial, as long as you have evidence of an ongoing relationship then all is good.

Your fiance will be sent a packet from the Manila embassy which will tel her everything she needs to provide. 

 

There is not an I-130 in the K-1 process for Manila, and there is absolutely ZERO reason to bring the original NOA2 to the Philippines, no one ever asks for it.  A copy of the NOA2 will be asked for at AOS time.

 

Everything for the K-1 process in Manila is done online.

Nope USEM does not send a packet to your fiancée, everything is done online.  Your fiancée "may" get a letter and a couple pamphlets from USEM... most don't.

  

Yes you can fly to the Phils if you so choose once YOU get the NOA2; you are the petitioner so you will receive the NOA2.

 

There is a link to the complete process for the K-1 in Manila in my signature below this post.  There are links to the Embassy Instructions Letter and everything else needed.   Read this letter, print a copy and use it as a check list.

Well, I'm not about to lie or have Juliet lie on a Federal document and so my suggestion to Juliet will be to check the (sister) box and simply put: "working."

 

Will this response in fact delay things?

 

At first I wondered if the sister did not have a proper visa.  However a few months ago she left America, visited RP (Republic of Philippines) and returned to America.  If her Visa was not in order she would never have been allowed to return.  So I'm mystified as why she would suggest that we not answer this.

 

Any thoughts from you VJ'ers who are wise in these matters?

As for honestly answering the question; you answer YES, then you be honest and state her status is a B1 visa.   Can you honestly say what she is doing while in the States?  Do you know for fact?   If you don't know what she is actually doing while in the USA, they put UNKNOWN

The form appears to be only printable directly from a computer to a printer.  If it could be saved as a .PDF file then Juliet could simply take the prepared form on a pen drive to an internet cafe and get it printed.  But this does not seem to be possible.

 

Therefore there seems to be only two options: 1) Buy a printer, and print it.  Or 2) Have Steve fill out the form, print the unsigned form and mail it to Juliet along with the other documents necessary for the beneficiary. 

 

If I go with option 2 then I have "prepared" the form and must fill line 40 out.

 

Will this in any way delay or create some red flag?

The DS-156K creates a barcode after you answer the questions which is why it can't be saved.

 

Your fiancée could complete the form at an internet café and then print it, just another option.   One more thought is you completing the form then scanning and saving it as a .PDF file, then email that file to your fiancée to print.

 

Lastly, don't worry about line 40 - not intended for you.   Leave it blank

Hi VJ buddies!

 

We're almost ready to file our I-129 packet. My fiance' hired a lawyer to help us. He provided the Letter of Intent format and asked that it should  be notarized. So okay, we followed him. On the letter of intent, it's stated that I am a Filipino citizen and a resident of...(mentioned my Phil address). However, on my G-325A it's stated that I am presently residing in Indonesia but I also mentioned that I am working here. I've been working here for almost 4 years and I just go back to the Philippines once a year. My letter of intent was notarized when me and my fiance' were in the Philippines last month. That's couple days after he proposed to me. I told my fiance to get rid of the lawyer and follow the VJ letter of intent format because there's no need to mention the address there right?He told me to just follow the lawyer. Ugh, I don't know if I'm just worrying too much over nothing. Part of me also says that whoever is going to review our file knows better since it shows on the document that I am working in Indonesia.

 

Can somebody please give me some peace of mind:))

How nice, K-1 approved.  So on to readying new documents.

 

Oops... question arises:  Do you have any relatives in America?

 

Gee...gosh, we do a sister (half-sister) who travels back and forth from RP (Philippines) to America.  But when queried as to what visa she has we get a blank stare. So something stinks here. 

 

Now I find that having a sister here in America is grounds for denial of the K-1?

 

Gosh...when someone gets a speeding ticket do we haul brothers, sisters, mothers, fathers into Court as being guilty by association?

 

We do everything by the book--honest in all things, at all times and now, what I am hearing is--we're screwed and will be denied.

 

How many millions of illegals do we have in America and we welcome them regardless of their felony record and here, simply because a relative is here legally or illegally--our K1 will be denied?

 

I suppose it makes sense, Obama gives amnesty to a few million and guess what--he's got a few million votes.

 

Any suggestions for plan B?

I see by your timeline your petition was recently approved.    So when did you get denied?

 

If you have a sister (or half-sister) traveling back and forth between the Philippines and the USA, but you don't know what type of visa she has that doesn't mean anything.   If you don't know what type of visa she is using for entry into the USA simple put UNKNOWN in the form.

 

My wife has a cousin who travels to the USA often as he works on a cruise ship, but I doubt my wife has a clue as to what visa he uses.  Heck now that I think about it, she did not mention him on the forms....  oops!  Or not....

 

What your sister is doing has little, if anything, to do with what you are doing.

 

Follow the instructions letter from the embassy and you should be just fine.

 

Why not pop down to the Philippine forum and say "Hi"  ... lots of good folks to help you with questions at this stage of the process.

Hello everyone! According to my case situation, I found out some unkown steps and quistions about Criminal Records and K-1 visa petition. Maybe somebody had already experienced such things and can give suggestions on it.
Situation is that I have criminal record for marijuana posetion in 2008. At that time I still had Green Card. April 2013 I got my citizenship and couple weeks later I got into a trouble in different state. I was arrested and my case is still not done. In the worst scene I am looking for a misdemeanor for the Theft from a motovehicle and get on probation in PA or in good scene I will dismiss it. Depends on how good lawer be on the last court day. I filed my petition for Fiancee and on a form I-129F they are asking if I was convicted of one of those convictions which they listed on the form. And none of them looks like it is my case. BUT my courts still pending and I am still not convicted in anything. The only thing is that that arrest might be shown somewhere in the national criminal backgroud check. I am not sure How it works. If somebody have an idea about it, post replies on this topics. Thank you everyone.

 

Rule # 1.... DON'T LIE during any part of this process.  If you need to attach a letter explaining your situation do so.

The foreign fiance(e)'s passport is not required for the I-129F petition. If there were stamps/visa in it that could help prove face-to-face meetings, then they could include copies of those, but no reason to copy the entire passport. Only the USC needs to prove citizenship for the petition and that is what the entire copy of their US passport would be for.

 

 

You don't. It is not a requirement for the I-129F petition. She will provide her passport and birth certificate later for the K-1 visa interview.

Employment letter and bank statements are not required, they are of the "may include" type evidence.   Tax return and W-2 are required.  Copies of current pay stubs are good.

Hi everyone! I'm new here and I need your help. Our I-129F was approved last June 26, 2013, my fiance received a letter that our papers are received by NVC by July 8, 2013, BUT UNTIL NOW I HAVEN'T received anything yet from the US embassy or NVC regarding the "packet/package or letter of appointment. I was thinking if I have to wait for anything or If I can have an appointment and call the US embassy here in the Philippines for my interview?

Odds of getting a letter from the embassy are between slim and none.   Embassy does everything online

My fiance (petitioner) called their MY HR to get the employment letter to support the I 134 form.

 

He forwarded it to me via email and it has the ff:

 

  -Company logo  (Just the logo and I do not know if you can consider it as letterhead)

 

  -name, status, income, start date, position

 

The thing is, it is sent electronically and it doesn't have a signature. It just says, if you have any question, please contact MY HR.

 

Is this valid? Or should I ask him to ask their HR for a new one?

  

 

It will be just fine.  What is really important is having a copy of your fiancé's most recent tax return and a copy of the W-2.

 

The employment letter is secondary evidence and is a "may include" type evidence, not required.
