I was looking at my US Passport and apparently, I didn't present my US passport at the Malaysian Immigration window.. Instead I presented my Philippine passport. When I checked my Philippine passport, the visa stamp was there.

 

Now my question is this...

 

Should I present a copy of the pages of my Philippine passport ??

 

I am including our pictures from Malaysia as well as my flight itineraries in my I-129F petition packet so I want to know if it is safe to include these pictures.

If you are using that meeting as evidence for the "having met within 2 years" requirement, yes.  You will need to include copies of the Philippine passport as well, as it is the only passport that shows you being in Malaysia..

K-1 Fiance(e) Visa Process & ProceduresQuestions for K-1 process after noa1 but before noa 2.

My fiance is from the philippines and working in Israel.  Almost 10 years she's worked in Israel.  She has two kids but they live back in the philippeans with grandma.  I've submitted the I-129F and recieved the NOA1.  However, I'm now working on the next phases of the paperwork and need input.

 

1. Can she use a copy of her birth certificate for the interview or does she need an actual brith certificate from the Philippine government?  Also, will she need the kids birth certificates even if they aren't going?  

 

2. Can she request the police reports now?  She will need 2, one from the philippines and one from Israel.  Do I have to wait until NOA2?

 

3. On the I-134 do I really need a letter from an officer at the bank.  Or can I print the certificate of deposits?  Its the same certificate of deposits I send for loans and I've had no issues, plus the bank is only an online bank so I have no idea whom I would contact.  I should qualify off salary alone but figured I should have it just incase since gathering documents while in Israel is sort of a pain.

Will she be processing the visa in Israel?  If so then you need to follow the embassy instructions letter as to what is required.  For the Philippines NSO provides the certificated copies of birth certificate and I believe the embassy will want certified copies.  As for proof of singleness again NSO provided the CENOMAR. 

 

Don't need anything for the children if they are not apply for a visa also.

 

I would not wait for the NOA2 to request the NBI.   Regarding police certificates from the Philippines those are acquired from NBI and take upward of 8 weeks to receive when requested from a foreign country.

 

No sure what the embassy in  Israel requires for the supporting documents regarding the I-134, but USEM requires the most recent tax return and W-2, bank statements and such are secondary unless needed to prove assets for meeting the poverty guidelines and are MAY be included type evidence.  Need to go by the embassy instructions letter as to their requirements.

I'm going to petition my F from the Philippines and I want to know exactly what I need to include in the I-129F packet

NOW THE PART THAT CONFUSES ME...

 

Does he have to sign and mail the following forms to me to be included in my I-129F packet before I send it off to USCIS??  or... are these documents for him to submit to the US Embassy in Manila??

- DS-156K          NOT PART OF THE I-129f PETITION PROCESS.  Those forms are for the actual K-1 visa application

- DS-157

- DS 158

 

 

I'm sorry... The reason why I'm asking is because different people are telling me different things and I want to clarify. I would hate to receive a RFE because I know that would just delay the process.

Did you send in the Decree Absolute or the conditional order?
The decree absolute is the paper that is stamped by the judge to say that you are now divorced and that you are legally able to enter into another marriage.

 

We originally mailed the conditional order. I didn't know anything about the decree absolute (until we got the RFE) so he went to the court today to request a copy of the Decree Absolute. It takes about 5 days and costs £5. Once he get's that, he'll scan me a copy, and I'll print it out (IN COLOR, with the seal ), highlight the important info and mail it back to the wonderful people at USCIS.

This forum has been such an awesome resource, I really don't panic when something comes up, because the advice on here has been great. I will have my fiance go and get the copy and have him send me a color scan of it and then I will highlight the info and mail it off. I've read that people have gotten their approvals shortly after responding to the RFE (providing they gave the info correctly and all the stars aligned!) so I'm really hopeful that this will be a minor hiccup in the process. (Fingers crossed and wishful thinking!!!!)

don't send a copy of it..they must be able to feel that raised seal...Im sooo glad this all is behind us..I still shake my head at the mistakes we made..he would be here now if we had did it right the first time...

 

Ok, I'll send the original. Thanks for the advice! I shake my head at the mistake too, we sent a letter from his divorce attorney and a copy of some sort of divorce info, but now I know we have to get the decree absolute and send it. *sigh* I know this process can be so frustrating and tiring at times. I know it'll be worth it in the end, and if this is the worse thing that happens during this whole process, then I'll consider it a minor speed bump and know it could always be worse!

I got the RFE letter today and it says, "The divorce decree submitted does not show evidence of being civilly filed, signed by a judge, or recorded. As such, the peripheral is requested to submit a legible copy, including all pages of the final divorce decree that shows proof of filing that terminated the prior marriage."

Has anyone else had this or knows what info to send? Help please!

Using IRS tax transcripts includes the W-2 info, so you should be good to go.

I am sorry for this stupid question.  When paying the $340 fee is it OK if I send a check not from my checking account but from my father?  The reason why I am asking this is I pay all my bills online and I have not had any checks for a number of years now.  I don't want my bank to charge me an exorbitant fee to just have one check.  I know I can pay thru money order but I want something that is traceable.  Thanks for any input on this matter.

 

Banks (at least the one I use) will issue a bank check from your account, its not certified so no nasty fee.  I do online as well so checks are difficult when needed.

Yes I am aware that those are listed on the I-864 requirements,  as is 3 times for assets which is not the case with the I-134 (it asks for 5 times).

I did not say requirements, per se - But I'm writing of the math utilized for asset computation.  It's known that assets are ok to use on the I-134, but there's no hard-core instructions on how to compute the math in the I-134 instructions.  OTOH, it IS in the I-864 instructions, and most IV Units (I'm making a gross generalization here, thinking that Manila IV uses the same process) use the I-864 'math for assets' on the I-134.

USEM tends to cherry pick what it uses with the K-1, take assets for an example I-864 states 3 times, yet USEM wants 5 times which is the requirement with the I-134, now income requirement is 125% same as with the I-864, where the I-134 states 100%.

 

I don't know for fact what USEM uses for asset rules regarding automobiles and real estate with K-1 (aside from the 5 times), I know what is listed on the USCIS website for the I-134... which is fact not assumption, until someone posts different information from actual experience ... just the facts ma'am.  And yes its better to error toward the more restricted side to remove the worry out of being close... but that is to ASSUME.

Where does USEM state for the I-134 its uses the I-864 requirements?  I would like to add the link.

Where does it say the car has to be a 2nd vehicle?  I didn't read that anywhere (FYI a car does not have to be sold to access the equity).  Also I did not read anywhere that it states the home equity has to be assessed easily within a year.  Links to government websites for this please.

Yes, assets can be used if they are readily convertable to cash and do not put an undue hardship on the sponsor if they are converted to cash.  Primary car and home tend to fall in to the second category and are not allowed.  Assets must be 3X the short fall.  So if you are short $500, you will need $1500 in the bank to make up the difference.  Just remember to provide documentary proof that the assets exist and their value.

 

Since you are dealing with the PI Embassy, you may want to check to see if they accept assets as they tend to read the rules regarding sponsorship for K-1s differently then other Embassies/Consulated.  At least that is the way it appears here on VJ with the different stories.

A car or home can be used as an asset, just need to show the actual cash value.  ...per the USCIS webpage, it states that property is acceptable, no exceptions are listed.

 

The requirement is 5 times the shortage for a K-1.  ... easily found on the USCIS website.

 

yes true.. check with the embassy specifics.. the 134 supporting document is subject to the interviewing officers mood (ok perception.. whatever).. the 864 is the real document.. the 134 is more of a intent to commit.. the 134 requirements are 100% of the poverty guideline, but there is no need to shoot for 100%, you need the 125% for AOS anyway

 

For the Philippines, the embassy requires the most recent tax return, W-2 and the petitioner may include pay stubs and employer letter, bank statements if additional assets are in savings.  The requirement is 125%, even with the I-134 for USEM, no exceptions.

In my opinion, several pictures of my fiancé should be "enough" for proof of having met my fiancé.

Boarding passes, passport stamps are primary evidence, pictures are secondary evidence - pictures do not prove you meet within the past 2 years, they just prove you were together - not when.

 

For the I-129F you only need to provide proof of having met within the past 2 years, ongoing relationship evidence is for the visa interview.

Original of the I-134, like said a signature is required.

 

NOA2... never read anywhere that the embassy asks for that, after all they have your ORIGINAL file from USCIS.

 

What does your embassy instructions letter state for required documents and forms?  That is what you follow, to the "letter".

I have a question about the fact that I have been financially supporting my fiance for a while now. We've met in person and all so it's not a question about if she is taking advantage of me. In fact she never asked for the help, I offered on my own. The question is will this bring up any red flags at the interview. I helped her get her own apartment because she was having issues with her parents. She's afraid if the embassy knows she is being supported financially by me that they will think we don't have a legitimate relationship. My attitude is we don't have to volunteer any info, but if they ask we just have to be honest and explain the situation. She's afraid they will know I help her because she has her own apartment. She wants to say that she lives with her aunt, but I told her that we cannot lie at all ever, but she's still nervous. I'm about 8 and half years older than her; she's mid twenties, I'm early 30's. Do you think we will have any problems?

 

The embassy does not care if you are assisting your fiancée, doubt they will even ask.  Trust me the list is long and varied of those on here assisting there fiancée.  Its not an issue.   You will find many topics on here about XOOM and Western Union as sending money is a common occurrence.

 

For sure DO NOT LIE during the interview, there is no quicker way to get denied a visa then to be caught in a lie.  Your fiancée just needs to relax and understand what you are doing to help her is very common.

 

I would not call 8.5 years age difference an issue at all, there are many on here with much larger age gap.  Heck if you search you will find topics on just that.  The embassy will not care about that either.   For a fair number you could put a 2 in front of that for age gap.  ;)

I started filling another affidavit of support since there is this new version since 12/17/2012. And in the for example Middle name i should put N/A and it is not allowed, for State also, for annual income only numbers (example 55700). Should i put only numbers like that 55700 or what, and leave middle name and state blank? 

 

For middle name, characters are not accepted, just the alphabet... maybe type none (that makes me nervous, some idiot could give you a middle name - "none") or try leaving it blank.

I see. Do you think it's better not to present the 2012 ITR anymore since our I-134 is substantial? If the CO asks for the ITR and I showed him the current ITR (which was from 2012; below 125%) that old ITR should not affect their decision for visa approval, right?

 

The instructions letter from the embassy states the want the most recent tax return, doesn't matter if it shows you are below the 125% requirement or not.   Always give the embassy what they ask for.

 

For the new job (with its adequate pay :)  )  provide the employer letter and pay stubs. 

 

Being you just filed your I-129F your petition approval will be border line with the coming tax year, so you may very likely have the coming year's W-2s, and a lot of pay stubs if you want to show them.  May not have the next tax return, but I doubt you will have any issued with the I-134.

I know I will be reading some replies about the Manila Embassy is not accepting co-sponsorship.. but I've read so much and I have verified that they do not disallow it. 

 

Well, we really haven't gotten our NOA2 yet, but I am curious to know if my stepfather could be a co-sponsor, because I need one. Last year, I only made $9,500. My mom makes just the right amount for the 125% Poverty Guideline, how ever she is a couple of hundred dollars under, but my stepfather makes more than. So would it mother if it's my mom or stepdad that co-sponsor's us?

As stated USEM is not known for accepting co-sponsors with the K-1, and when they do accept a co-sponsor they want it to be a family member not a friend.  If you can document you step-fathers relationship (copy of your mom and step-father's marriage license may do the trick) then USEM may be more likely to accept as a co-sponsor.  Even then there are no guarantees.

 

I also suggest you complete the I-864 along with the I-134 for both you and the co-sponsor.

does the sponser have to fill one of these out when the case is at the pre interview stage( at fiance/fiancee foriegn country) what about a co-sponser? or is this just used when doing your AOS ? 

 

Being you are Philippines.... sometimes it is suggested you use the I-864 when attempting a co-sponsor with the K-1 visa, as USEM can be very difficult with accepting a co-sponsor.

 

For the normal K-1 application the I-134 is just fine.  Then at AOS you will use the I-864

So I jumped the gun when filling out the DS-156 form (I was way too excited) and filled it out, totally forgetting to look at the example forms on VJ.

I messed up on question 37 and did not list my fiancé is a US citizen, I didn't thoroughly read the question.

Hi everyone. Me and my fiancee are filling I-129 F part B and here is what we wrote for question #18 :

     We met online. I saved up thousands of dollars to be with her in person since she can't visit the U.S. I have been to Morocco in November 2012 and have tickets to go August 2013. I would visit more often if I had the money. We communicate daily via email, phone, skype, and instant messaging. Have tried visitor visa,DV lottery-none worked. Sufficient evidence will accompany. 

 

 

 

 

Is this enough?      Do you think we should add more informations?        Do we need to add a separate letter where we give more details about the circumstances where we met?       Do you have any  samples to share with us?

2)  For #18 Did you describe how you MET IN PERSON for the first time (not how you met online or whatever)?

 

3)  Did you initially include copies of your passport stamps from visiting your fiancée?  Copies of airline tickets?  Just what did you include as primary evidence of meeting in person?  Pictures are secondary evidence?

 

If you didn't do those things... that is why they are asking now.

 

No matter, give USCIS everything that they have listed and returned all per the instructions with the RFE.
