hello. need some piece of advice from you guys. i was admitted in the US as k-1 and right now, done the marriage and AOS as well. a sudden change of plan. i will go back to Philippines to get my son. i did  not bring my  son here anyway because our plan before is me and my husband should wait that my son is  a bit matured that he can take care of himself like eating, changing clothes and taking a bath by himself because my son is still 5 years old and i will go to school,so, i can't eye on him always and i don't want to bother my husband too because he have a lot of things to take care of. But as time flies so fast, i can't stop   missing my son everyday, that's why, i wil  lgo back and get him and i will just be  having home school so that i can do both, eye on him and studies too.

HERE'S MY QUESTION:

1.) does my son still need passport also even if he is still 5 years old?

2.) does my son have visa interview and i will set an  appointment on that too?

3.) does my son need cfo seminar?

4.) do i still need to pay visa fee for my son or he was already part of my visa fee before?

5.) what are the process to follow for my son's visa processing? where should i start first,second, third and so for...?

Question:  Was your son listed on the I-129F petition with you?  If yes, has it been less than a year since the issuance (issuance date is listed on your visa) of your visa (months less)?  

 

As for your questions.

 

1)  Yes your son needs a passport to travel international, all people need a passport regardless of age.

 

2)  Answer to this one depends on your answer to my above questions.

 

3)  Your son needs a CFO sticker, just no the seminar.

 

4)  Yes a visa fee has to be paid for your son's visa. 

 

5)  Answer to this question depends on your answer to my questions above.

Hello, im just a newbie here and me and my fiance were looking for some advices about k1 visa and someone on facebook told about this site. Me and my fiance from Georgia are planning to hire lawyer and she said it will cost 5k dollars, what she said that she can assure that she can really help us in k1 visa, is that the real cost of hiring lawyer or it will cost more? i know its kinda same topic from everyone and maybe repeatedly discussed but we really need some of your advices. My hubby said it will cost overall 10k dollars just to fix the visa including hiring lawyers and some papers needed. And we are 5months in relationship and met once for only two weeks ,coz he can only have a vacation for 2 weeks acc. to his job. Is it ok the length of time of relationships in visa? The process can easily be don't without an attorney, total waste of money.  Follow the GUIDE here for the process at USCIS for the K-1.   Save your money for other things.

 

There is no requirement for length of time being together, only requirement is having met in person within the past two years.

So I was checking the USCIS website and it changed from "Initial Review" to "Post Decision Activity" and it says:

 

On October 16, 2014, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

Is this my NOA-2?

FORM G-325A: submit a properly completed and signed form G-325A for  the petitioner,  _my name _____ and for the beneficiary _____my fiance__name______.

Note: you had submitted form G-325'S, instead of the required G-325A'S.

i recently  went to visit her last week, my 2nd visit.  we missed each other so much that i went to visit her from  Oct 2, 2014 to Oct 12, 2014. i documented my visit with airline tickets itinerary, hotel receipts and pictures together on my visit. Should i also send it with  the RFE for extra evidence even if they are not asking for it . IT WOULDN'T  HURT TO SEND IT RIGHT ????

 

NO.  Only send what USCIS requested.     Send copies of all that to your fiancee for the interview, evidence of ongoing relationship.

Thank you for replying! My fiancee should be here aug 16, Wedding will be on sept. Follow up question: for us to not have problems with aos later, does my fiancee need a repeat medical exam upon entry before aug 30? If so, would a general practicioner suffice for this exam?

 

Medical is good for one year so as long as you file AOS within the year a new medical is not required.  If you did need to do another medical it would have to be with a civil surgeon.

My fiancee got his passport delivered aug 8, 2014. Looking at the visa, issue date says aug 6 and expiration date says aug 30,2014. my question is, what does this date mean? Does he need to have the medical again before this date expires? I booked him a flight for aug 16. Do we have to get married before aug 30? Any help would be greatly appreciated!

Also, he was Required to undergo the TB test so could that have affected this short expiration date?

It means your fiance needs to in the USA before the visa expired.  Yes the short visa validity is because of the TB issues.  Just be in the USA before 30 Aug.  

 

 You have 90 days after arriving to get married.

My question is in regards to part 1 question 14 have you ever filed for this or any other husband/wife before.

I'm not sure of the answer because my second wife was in the U.S and a green card holder when we met and got married. Because of our marriage she was able to get her citizenship a little earlier.

My fiance already received a mail from the USCIS last May and our petition is approved. My problem is the validity of the petition is only until September 8, 2014 but have not yet paid for the Visa fee because we are still saving for the it.  We are planning to pay for the Visa fee this month. Is it possible that they will extend the validity of our approved petition? I need your help guys!  :(

 

 

USEM will automatically extend the petition validity up to a year (if you are activity pursuing the visa) so you have no worries.

You don't need to contact the embassy, they will AUTOMATICALLY extend the visa validity... no phone call needed ;)

Hello, I need some advice. I made a digital copy of my entire package that I sent to USCIS, I know probably a dumb idea, and then my hard drive crashed.  Now most, I had other copies other places or was able to save them before it died of some of the data,  of what I sent I cannot get back is there something else I can do to help prepare her for her interview?  Thank you for the help.

 

Don't need it.   Everything that is required for the interview is listed in the embassy instructions letter, and a copy of the petition package isn't on that list ;)  :)       Just so you have your NOA2, you will need that once your fiancee is in the USA.

What happens when K1 approval notice has been expired for more than 4 months and both petitioner and beneficiary have not taken an action to call the embassy for extension?  Their personal meeting will also be over 2 years by now.  I believe one of the requirement is that you should have met "within 2 years", does it matter?  Thanks in advance for advice.

 

Don't need to call the embassy to get the extension, they will do it automatically, but you need to be active in pursuing the visa.  So if you have not created your online account  do that.

 

2 year requirement is only for USCIS, at USEM you need to show evidence of an ongoing relationship

Screwed the pooch on that one, you are married, K-1 is a fiancee visa. Can't change visa types in mid-stream.   Just stop everything with the K-1 and start over with the IR/CR-1 spousal visa.

What about custody under PI law when the father is listed? Wouldn't they have to get his permission for the child to immigrate or a court order since the father is listed on the BC?

 

The mother has sole custody 99.7% of the time.   Doesn't matter that the father is listed on the BC, NOTHING is required from him giving permission for the child to immigrate

You have certification that she was never married (had to have it to get K-1), with that a relative should be able to get the birth certificate corrected.

 

If not it just means you will have to keep producing the documentation at every step showing the birth certificate is wrong.

 

I would NOT delay the K-2 visa for this, I just mean you want to get it fixed sooner or later.

 

No need to correct the birth certificate, it saying married means little.  Some people were married and aren't now, the CENOMAR is the controlling document for that and she presented it at her interview... so no issue with the BC

I haven't posted in awhile. I made a new account.

 

My wife came here via k-1 visa on October 10, 2013. She already has her green card. As for her 2 children, we left them with her family in Philippines. Now we're planning on bringing them over here. I think I remember somewhere seeing that they would be able to come using their mom's K1 visa. If so how would we go about that?

 

Also a slight problem, The son is 5 years old with the real dad's last name, and the daughter is 4 years old with the mom's last name. I want to be sure that the son's last name isn't a problem. Upon filing my wife's K-1 visa we did include proper names of children.

Did you list both children on the original I-129F petition?  If yes then no issue as long as their visas are ISSUED within a year of when your wife's visa was issued.  That means they need to complete their interview about a few weeks before that date so their visas are issued according to requirements.

 

No problem with the names on the birth certificates as long as they were listed on the I-129F the same way.

My fiance earned income annually $ 35,000 and I think enough for the two (2) persons as I read the income guidelines  to petition without having co-sponsor.

He was born in the states, so on

item# 1. Do we leave all blank from a.~e. ?  or do we need to write NONE on each item?

 

item#3.  We put my information (beneficiary), I am single and no children, so we leave blank again for the name of spouse and children below.  Is it correct?

 

item#7. He is a delivery driver, we'd practiced to fill-up the form, we put "Transportation" as the type of business,

             but we read the sample form here, on the sample it showed "Supervisor", so now we're thinking maybe that question is asking the position,

             We got confused here.

             And for the following question about income, assets, etc. We only wrote the annual income and leave blank the rest...Is it correct?

 

item#8. My fiance (USC) still giving alimony to his ex-wife every week,

Do we need put  his ex-wife name here?

#7 )   Put transportation, or whatever. The embassy only cares about the tax return and W-2 info.   You don't need to have bank account info, assets info.  As for alimony it has nothing with anything... unless there are children from the previous married as they need to be listed.

#11  Really doesn't matter.  In the space below simple write: K-1 visa.  

 

Thing to realize is the I-134 is not designed for the K-1 visa, so some questions really don't fit/work/or make sense.

There are two people,  sponsor and beneficary (fiance and fiancee...unless there are children)

I couldn't find any info on this subject so I decided to ask it here.  If it has been addressed before, please guide me to the appropriate section.  Ok, so here is my situation.  I receive taxable income from my federal govt retirement.  I also receive social security which only a portion is taxable and I also receive Disability Compensation from the Veterans Administration based on service connected disability.

 

My problem is that on my tax returns, the only income is retirement and about $4,000 of the social security which equals about $17,000 per year according to tax returns, but in actuality I make about $70,000 per year when you factor in my disability from the VA and the non taxable portion of my Social Security.

 

If I send only my tax returns, they will not accurately reflect my current income.  I have 1099's for each year from SS, and Letters for each year of income from VA.

 

I want to include these with my tax returns but don't know how to go about putting it together so that the CO can ascertain that this is additional income although not reflected on taxes because it is non-taxable.  Please any suggestions on how to do this will be greatly appreciated.

Not a real issue, include copies of your benefits letter from VA and Social Security showing your actual benefits received monthly.   This is what I did being my VA and SS is not taxable

Did the UK citizen petition the divorce or your fiancee?

 

Did your fiancee ever do Report of Marriage to the Philippines while married in the UK?   If yes, she will need to get the divorce recognized in the Philippines.   If NO then forget about it.

This may be a silly newbie question but it seems that most of the K-1 visa people had their first meeting in a foreign country. Can your first meeting take place here in the US? Originally we were going to just meet in the Philippines in January but I came into some extra money from the sale of a car and am paying for her to come here for two months. Can we file with this meeting or should we wait to file when I go this January?

 

If she already possesses a tourist visa no issue.   But do not plan on your fiancee coming to the USA on a tourist visa, it is extremely difficult to get a tourist visa in the Philippines.  

 

If she does not already have a tourist visa - you best plan on a "road trip" (ok it's over water but YOU will need to do the traveling)

Tourist visa for your fiancee to come visit you - from the Philippines HIGHLY unlikely.  

 

I am planning on marrying my girlfriend from the philippines, however i am unable to go meet her in person due to being in college and working two jobs, as well as having some mental health issues that make traveling to her very difficult. Does anyone know how to waive the part about meeting in person on the k1 visa?

 

Waiver - not happening.

 

Do you get days off?  Take 3 days, fly there, meet, take pictures together, get a receipt or two, fly back.  Now file your K-1 visa.

 

 

Marriage by proxy - erase that from the list, not happening.  This is right up there will catching a unicorn.

No you can not combine the income of the beneficiary with yours.  Not how it works, your income must meet the requirements.  Besides USEM doesn't give much consideration to assets, they want to see income that meets the 125% guidelines.  

 

You could try using a co-sponsor, but that is even "iffy" with USEM.

Not trying to bounce off another thread, but the info seemed across the board. My question relates to the I129F and the k-1 k-2 visa process. As I understand it, the child of a k-1 visa holder can delay entry up to 6 months. Are there any extensions applicable after the 6 months? Does another entirely different process need to be imitated in order for the child to follow later than the initial 6 month time allotment?

You do the I-129F petition for both, but then don't do the K2 when the K1 does her visa application. You can do the K2 to follow, this allows you a year to file for visa for the K2, the K2 must be issued their visa within a year of the K1 visa being issued.   Then once the visa is issued there is the potential 6 months to enter.

Hi everyone, i am filing K1 fince visa form for my fiance. I filled it up and even gathered all the requirements. I noticed it has to be sent to Dallas Lockbox? Can anyone help me about where to send it to? I live in Hawaii. Every single requirement is done.

 

Addresses are the same for all 50 states, only difference is if you send the package UPS/FEDEX, SIGNATURE REQUIRED or just mail it.   If just mailing it use the PO BOX address.

If anyone  help me regarding about filling K-1Visa. I've gathered just about every requirement that is needed for filling K-1 visa except the Fiance Letter of Intent. I am doing/filling it on my own. Is it ok to send the K-1 form now even without the "Fiance Letter of Inetent?" I still need to make one for my fiance, have it sent to her so she could signed it and doing this will take about at least a month. Is it ok to send the K-1 form now so that it can be processed and will I send the "Fiance Letter of Intent" when it's completed? 

 

You need a original G-325A and the Letter Of Intent from your fiancee for the I-129F petition.  No sense sending anything in without all the requirements.  You can not send in the missing documents later, you would have for wait for the RFE from USCIS to send those missing documents in... not the best idea.

 

You can email the letter to your Fiancee, she then needs to print it out, sign it and mail it back to you, along with a complete G-325A signed and dated.

I am scheduled for the K-1 interview this coming October. Although we have completed our documents and ready for the interview, I can't help but get nervous. I have read some sites about the reasons of being denied of the visa. One of which was:

7. Couple hasn?t spent enough time together in person 

 

Though me and my fiance are engaged for 6 months and only met once, I am not sure if we will fall under this item. We had been talking everyday, and even if I am at work, I still spend time talking to him. Would that be sufficient? We have only spent a week together here in the Philippines. Are there any people out there who has the same experience? :) or maybe I am just too pessimistic and too nervous. Thanks and hoping for your replies.

 

 

 

No that is not a reason for denial.  Insufficient evidence of an genuine and ongoing relationship is a reason.  Have a sampling of chat logs, emails and such over the time you have been separated, know your fiance well and all should be fine.

 

MOST couples that do the K-1 visa in Manila only met once and did not see each other again before the interview.... none had issues.

hello everyone this is my first time posting on here but i had a few questions about my citizenship.

i acquired a dual citizenship because i went to school for 4 years in the Philippines .

i have my birth certificate as well as my passports(both US which expired 06/14 and Filipino exp 02/14).  

 

1. should i send copies of all of them and send it with the I-129F packet?

2. do i need to place US/Filipino under citizenship?

3 do i need to explain or prove that i am a dual citizenship anywhere on the packet?

4. will it be a problem that the passports are expired? (i am only using them for the stamps proving that i arrived and left the Philippines.)

 

any feedback will help greatly..i have everything already setup to send i am just a bit worried about that and if i need to make any changes.

This is a USC process only (for now forget about being a dual citizen).  

 

1)  Send copies of all pages of ONLY your U.S. passport for proving citizenship (oops yours is expired).  Or if you were born in the USA a copy of the birth certificate.  Or if naturalized a copy of that document.

 

2)  You MUST be a U.S. citizen to do the I-129F petition (once again forget about the dual citizenship, concentrate on USC)

 

3)  NO~!   This is a U.S. process (forget about the dual citizenship, it has nothing to do with this process)

 

4)  Both passports being expired is not an issue when using them to should evidence (exit/entry stamps) of having met within the past two years for the I-129F.

 

Erase dual citizenship from your thoughts.   :thumbs:

i still can't find it. all i can see is the icon for Facebook, twitter, etc. and on the bottom right corner is the link for domain for developing the website. or may be because I'm using mac computer. I'm not sure but ill try opening the page again at work tonight. computers at work are windows based. thanks.

 

I don't have a MAC to check it, wait I will "borrow" my asawa's iPad, I just checked the site using her Safari browser and it was all there.
