hello, everyone, im super close to my interview, and i just got my petitioner I - 34 and its not good, because well he didn't or doesn't trust banks or financial system very much, wich makes his I - 34 really bad on banl account, he has a new job since june which makes him make a good amount of money wich makes us save, but his taxes dont show that because he p´refer keeping his money with him, we find a sponsor (his step dad)  thanks to his mom , so I'm wondering when i go to my interview i present our sponsor I - 34 and then his, just his and then our sponsor. Im afraid they see his I - 34 and said no to us. Can i present my bank accounts i have a good job with a well payment and being in that job for 2 years already. How i can present this and avoid a big no. Im super nervous about this, needing you advice. And also if we have an sponsor what does he has to put in question # 3 in relationship with sponsor , fiance??? because Im not his fiance, im his son's fiance.  i would really appreciated your help, specially from those ones who had an sponsor with them.

 

 

Does your fiancé's income meet or exceed the 125% poverty guidelines of the I-864P ?  Does his tax return from 2012 show enough income for the requirement or just his new job since June?   Bank statements are not required unless a person is using assets in their bank account to meet requirements (so don't worry about that).   If you are going to use a co-sponsor both your fiancé and the co-sponsor will complete the I-134 and submit the required documents (tax return, W2, and with your fiancée his current pay stubs for sure.) .  The co-sponsor would list you as his step-son's fiancée.

 

Your job and income/savings are of no value at the interview.

Heck no!   Embassy does not expect you to receive money from your fiancé .

 

Many do not send money to their fiancée.  Now a wife is a different story ;).

NOA2 has nothing to do with the interview process (beyond being the notice that the petition was approved.)

 

You can be with your fiancée at the interview in Manila, no issue.

 

Not having a tax return for 2012 can be an issue at the embassy as the most recent tax return and W-2 are listed as required, along with the I-134.

 

If you did not have taxable income in 2012 you will have to show the embassy proof of this.

i heard of a form I 94 and want to know much abt it,

i saw a sample on the internet and came accross a quetion stating '' have u been denied a US visa before?

it continues that if u answer yes, u may be denied entry at the port of entry and that u should contact ur embassy. must that b a problem cos i was denied an F1(student) visa in 2011 but got a fiance visa this august,

 

Immigrations does the I-94 electronically now.  You will not complete the form on the aircraft anymore, you will go online to the CBP website after you clear POE to print out a copy for your records (as you should have a copy with your passport)

 

 

the 1-94 shouldn't apply to you due to your visa type and will be overwritten once you Adjust Status (someone I am sure will correct me if I am wrong on this one)

regarding your concerns on POE, yes it will be NY and no your previous F-1 denial is a non issue.. if it was an issue, it would have been addressed at your interview.

 

The I-94 is very necessary with the K-1 visa.

Hi everyone, I am new here on this Forum, I just need your help regarding the Police Clearance from Saudi Arabia,

I work there for 2 years from 2007-2009, and now I am working here in Singapore for 3 1/2 years, Is it I still need to get a police clearance from Saudi even I am no longer resided here for almost 4 years? Because what I read on the website is "The police clearance from Saudi Arabia is unavailable for the third country national who is not resided anymore in the kingdom".

I do not believe you can get a police certificate from Saudi Arabia without being there in person.  The embassy knows there are some countries that the police certificate can not be obtained.

My fiance' and I have prepared everything that we need to send our I-129f package tomorrow. I have read from 

Step-by-Step Guide on How to File for a K-1 Visa that we need to make TWO copies of the entire package before we send it in. Why is that? Is it okay if my fiance' just scan the paper works he filled in and email them to me instead of printing out the entire package?... what about our photos that he sent.. should he print 2 copies also?   

 

 

Yes its fine to have a scanned copy of the I-129F petition for your personal records.  That is what I did, I did not make a printed copy.  Two copies are not needed.

Hello Guys,

 

I really needed your help/inputs..After submitting the RFE on August 6 then RFE response review on my case status on August 7, my fiancee and I waited for the approval but up until now there was none. So tonight, while browsing visajourney site, I went on to check on the conversation about RFEs. My mind got very interested about one RFE about redoing the Form G325A instead of the Form G325 because it's exactly what my RFE was. Unfortunately, while reading the instructions back in July 31st when I got the RFE on the mail, I didnt pay much attention about G325A and G325 as I was more concerned about some of the wrong entries that we did on my beneficiaries G325..Then now, I checked my scanned copy of the Form and we used the same Form G325.. Now I know why we are not getting the approval...I am also concerned about getting denied...Anybody who had been on this situation? Now, I am planning to resubmit the correct form and go from there...I dont want to wait for another RFE since it was the first info that they needed.. Any inputs, please. Thank you so much... I am very worried..

 

I 2nd sending the correct form (G325A) along with a copy of the RFE (hopefully you kept a copy), and a letter with name(s), case number and such explaining your OOPS!

Embassy Instructions Letter is what to follow:

 

 

h. OTHER COUNTRY POLICE CERTIFICATES. Applicants aged 16 years and older must also present police certificates from other countries where they have lived for six (6) months or more after reaching the age of 16. As with NBI clearances, foreign police certificates should be obtained in any maiden names, aliases or nicknames used while in the country in question, including different spellings you have used of those names. You can't print out the I-94 until AFTER you are in the USA and have cleared POE.  About 10 days after clearing through POE you should be able to get your I-94 online and print it out.

My fiancee's K-1 visa should be issued in the next couple of days which means she will be travelling to the US soon. What documents besides her passport and visa will she need on arrival? What documents besides the I-94 will she collect at immigration when she arrives? Are there any documents besides her birth certificate that she should bring with her from Russia? POE Update

 

There has been a change regarding the I-94, you are no longer given this form during the flight to complete and turn in at Immigrations (POE).  Immigrations now stamps your passport and the I-94 is done electronically.

i know somehow i am flooding the forum with different questions. i do hope u understand that i have little knowledge on this matter and now is the only time i have to ask before my week starts to gets so busy.
heres the scenario
my fiancee and i filed i-129f last aug 6,2013. i am the benefiaciary.
we made a copy of everything we sent. and glad that we made a copy because i just foind out couple of minutes ago that we would need that copy once i have my interview at the embassy. :no:   my questions are ff:
1. our petition is i guess still in uscis , does my fiancee needs to send those copy of the docs we sent for filing to me now? or its too ealy ?
2. i know we sent proof of ongoing relationship and all that stuff, my question is, when she got back from the states,
our mode of communication everyday is tru facetime. its an app from
iphone. we find it cheaper because we dont need pay for it so long as we both have internet connection. now, how will i be able to show it during my interview that we are communicating via facetime? altough we have some imessage but its just brief, most of our imessages are like '" babe, u awake? facetime?" lol. can someone tell me how shud we show to the embassy that we are contactinh thru facetime? or will that even be ask during my interview?
3. i read somewhere that theres another notice that uscis will send us and thats called NOA2. should we make a copy of that too?
4. regarding affidavit of support: what exactly does my fiancee needs to get from her side( shes the petitioner) regarding affidavit of support? i kind of think that it would be her itR and w2- is that correct? if so, how many years of her itr that he should mail to me? shes been in the statesfor roughly 10years now. i dont think the govt would ask for 10years itr. lol. and just in case, whats w2? my fiancee is asleep as i write this down so which ever comes first to answer my question.smile.png

5. regading medical: i am a smoker. will that be a
problem? just asking.
6. how will i know which service center is our petition beinh process?

1 -  You do not need a copy of the I-129F petition package for the interview (and yes I know they list it here on VJ, all I can say is Forest Gump must of posted that information), it is not listed in the embassy instructions letter, it is not asked for during the interview either - the CO has the original I-129F petition sitting there in front of him.   If you want to have a digital copy on file, have him email it to you, but its not required at ANY point for the interview.

 

2-  Even if you don't chat much keep a chat log of those "short" conversations, do a few emails.  The embassy will only look at a sampling of emails and/or chat logs (if they bother to look at them at all), they like pictures of the two of you for sure. 

 

Excerpt from embassy instructions letter:

 

k. EVIDENCE OF A GENUINE ENGAGEMENT. You must be prepared to prove to the consular officer that you have a genuine relationship with your petitioner and a clear intention to marry within 90 days of admission into the U.S. In the past, successful applicants have submitted photographs, letters, e-mails, phone records, bank records, and remittance records as evidence supporting their relationships and intent to marry.

 

3-  You do not need a copy of the NOA2 for the visa application process/ interview.  You will need that once you are in the USA for adjustment of status.

 

4-  You only need the most recent tax return and W-2.  One year only, there is no value in bringing multiple years of ITR the embassy will not ask for them and they will not take them even if you try to hand them to the CO.

 

Excerpt from embassy instructions letter:

 

n. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form with original signature will be useful to the consular officer to evaluate your petitioner?s ability to be financially responsible for you. You should also submit your petitioner?s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

 

5- No smoking is not an issue with the medical.

 

6- Your NOA1 will have the service center listed on it.

My I-129F is approved last week. When I take a look on all list of documents that I need to send to my fiancee, I see below as one of the required documents. 

 

 Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.

 

 What are these original documents?

 

You do not need to send originals, copies are just fine.  If you send originals and the embassy takes they... kiss them goodbye

There is not a "1" bracket, its starts at 2... you and who you are sponsoring.

On the DS-156 form when it askes for additional visa issuance, Question 30, what is it asking for? US type only or any I might have had issued or applied for in my past. My fiancee' had a working visa in Hong Kong before in her past...does she need to list it. Thank you for your help.

You fiancée will need to get a police certificate from Hong Kong being she lived there (if she was there for 6 months or more)

I received noa2 in the mail today     it says the petition is approved and will be sent to the listed consulate     i have read it will go to nvc      it that the listed consulate    it sorta sounds like the petition is being sent to manila   not nvc    just wishful thinking   ?  ?   do all noa2 say that      hope someone will tell  something    

 

The letter always states that yet the petition is always sent to NVC before forwarding to the embassy.

I am the partitioner (us citizen) who was divorced 3 years ago who is applying for a k1 visa to bring my fiancee from thailand. Do I need to send the entire divorce decree copy to the i-29 office? To the consulate? Will a copy of the front page do for either purpose?  The point is just to show I am divorced, right?  Do they even care why?  My decree has Social Security numbers, kids names, address, etc. that I don't really want floating around.  Any advise out there on what might be appropriate?

 

USCIS will want your complete divorce decree.  I am pretty sure the U.S. government already knows your SSN and your kids names as you do file tax returns, so not sure what your concern is. ;)

Well the Philippines is a picky place regarding accepting a co-sponsor with the K-1 visa.  One thing for sure, USEM wants the co-sponsor to be a relative.  Then you both have to complete the I-134 (original signatures) copies of the most recent tax return and W-2.  Some complete the I-864 (both co-sponsor and sponsor) along with the I-134 because of USEM being difficult with co-sponsors.

 

Income must meet and/or exceed the poverty guidelines of the I-864P for the number of people.

Just got my Visa yesterday September 10, 2013 and I noticed the misspelled firstname of my fiance under the annotation part. It was supposed to be FRANCOIS, but was typed as FRANCIS. WHAT WILL I DO?

I agree with Jay-Kay, if the misspelled name is for the USC (petitioner) then don't be too concerned.  If the misspelling is with the visa applicant (beneficiary) then for sure contact the embassy and have it corrected.

 

If you want it corrected no matter then follow the embassy instructions.  Don't do anything other then what the embassy instructs you to do.

T_T My problem is that on my last year's ITR it shows I've earned 10,000 from August 2012 because I started working August, I've heard from a friend that there are a lot of cases where they deny it because it is below the poverty guideline. So I would like an opinion from past experiences whether to go with it or not? Or if there are ways to go through and still pass. My fiance is really down because he has to wait another 6 months until we can be together again and I would rather not wait for 6 months for this years ITR showing my complete earnings.

 

If you do not have an employer letter, if not get that, your employer can show that you were hired last August and what you sustained income is now.  Along with including current pay stubs.  Really no need to wait 6 more months.

 

You need to meet and/or exceed the 125% poverty guidelines of the I-864P

What if you cant provide Police Certificate because you cant go back to that Country like Saudi Arabia, because your contract has ended , and the only way you could go back there is if you have a job offer, and they need a personal appearance for the Police Certificate, so you cant really ask somebody else to get it for you...... anyone had similar issue like this? 

 

Saudi Arabia is one of the exception countries, USEM knows you can not get a police certificate from there.

  ok so i got my noa2 and im geting everything redy. i was downloading the ds forms and came accross this. https://evisaforms.state.gov/ds156.asp it says dont print this page, but i read that i need 2 copys...what do i do?? fill it out then print??

  also how long did the medical - visa approval take? my boss gave me a month and i plan to go to phillpines and fly back with my fiancee. is this enough time?? medical, do i need to set an appointment or can i just walk in?? can i accompany my fiancee?

  how do i print uid number??

You need to read the page again, there is a continue button you need to push after filing out the form, after pushing the continue button a bar code will be generated... after that you can print the copies you require.

 

Medical is a two day process normally, visa approval happens at the interview, delivery of the visa is sort of an unknown as each case is different, norm is a couple weeks.

Yes, while it shouldn't, this is really a country-specific question.

 

Each embassy has their own rules and processes to follow, so much is country specific at the visa application stage of the process.

So I have worked for myself and file returns every year but the last 5 years have shown barely more than the poverty level. So this year things change and I have partnered with someone on a "real" business and have a "real" income (minimum 60K closer to 100 with year end profit but I have no assets).  But...... all our K1 papers are going to be filed in the next couple weeks and needless to say the 3 years of tax returns show I don't make enough to support my fiancé and her daughter but my bank statements show my current salary (5K a month) so will they look at this as my future income or do they actually only use the past years as the multiplier ?

 

I cant really go back and change last years return but I have been collecting this salary since Oct of last year so there is a 12 month pattern of income that is verifiable.

 

Thoughts ?

Good day, me and my fiance' got confused about the poverty level. I hope you can help me understand as i am so worried after I just got his ITR and when i checked it didn't reached the 125% for 4 household..
 We applied for k1/k2 visa and our interview schedule is for next month at Manila US Embassy. He is living alone in his apartment but i have two k2 and that would make it four including me? 
My question is do we need to reach the 125% poverty level good for 4 households or is 100% be okay? On his itr he reached the 100% but need just a lil bit more to reach the 125%.
 I am so confused if we need a joint sponsor or will it be okay? Thank you very much.

 

 

For Manila you need 125% of the poverty guideline of the I-864P.  For the petitioner, yourself and two children that would be a household of 4.

 

If you fiancé is slightly short of the 125% he can include assets (5X the shortage), such as cash in a savings account, to make up that difference.  Or maybe get a relative to co-sponsor.

What embassy will you be applying at?    Have your fiancé called NVC or emailed them?   (no matter what country you are dealing the info in my link for NVC is good)

 

The DS forms you complete will be the name used for the visa.
