Hello guys...

 

I am feeling desperate and upset since my dad has just refused to be our co-sponsor. He doesn't feel comfortable about being a co-sponsor for my fiance and be liable when it comes to money eventhough I assure him that we will never ask him for money. I never ask anyone for money. 

 

My situation is that I don't make 21K in income due to having minimum wage jobs trying to obtain healthcare experience for a graduate school. I recently found out that I have been accepted to a graduate program, which won't start until September of 2014.

 

I am wondering...Hypothetically, how long AFTER the visa as been approved...from the first day after my fiance enters the United States to marry me that I need to keep a steady and sufficient income? For instance, it is about 11 months from now until I starts school...and once in school I won't even be able to have a job due to the rigorous nature of the program. 

 

 

I feel so hopeless right now that we will most likely have to wait 4 more years from now before I could file for him independently sad.png

Did you complete an I-94 on the airplane and turn it in at POE where the Immigration's officer stamped it and affixed it in your passport?

 

How long ago did you pass through POE?  For some time now the I-94 has not been given at POE and is available online.

Hi,

We have sent our I-129F package via priority/certified mail with USPS on 12/12 with return receipt. The expected delivery date was set to 12/14. On 12/19, I called USPS and received case number for lost mail. Today I got a call from our local post office that they don't know where our package is and they only know that it has left their post office on 12/12. When I try to track it online, all I get is that it was accepted to our local sorting facility on 12/12.

There is no return receipt in our mailbox, there is no indication online of the fact that the package has been ever delivered either. The check has not been cashed. I'm assuming my mail has been lost.

What should we do now? Re-send the package (we have 2 exact copies, but I'll make one more if I need to)? Wait?

What if we decide to re-send it and the first package gets found and forwarded? Will both of our checks be cashed?

What a terrible way to start our K-1 journey :(

If the post office is saying its lost, then cancel the check that is with that package and send a new package FedUp!!

With the first check cancelled if USCIS should receive it late they will not process it if the check doesn't clear and it will be returned to you.

Scheduling the interview appointment tonight YAY!!!

 

I have a question regarding the process at the time of interview for my fiance who has a child living back home in the Philippines.  We planned on him coming at a later date so we listed him on the application as we should.  My question is this:  Do we need his passport now if he is not going to be coming to the US within the next year or so?  We have his birth certificate.  I am just concerned because his name is listed on the bottom of packet 4 and I am afraid of delays if they want his passport.  He is 6 years old and does have a passport, however it is with his grandmother who is taking care of him at the moment.  Is it ok to tell the interviewer that we didn't intend on bringing him to the US yet?  

 

 

sorry, one more question...Do I need to pay for his visa to schedule the interview appointment as well?

You do not need the child's passport for your fiancee's interview.  

 

Yes you will have to pay the visa fee before scheduling the interview for the child.

 

Process for the K-2 child is the same as the K-1  ... for the Philippines follow the flashing arrow below.

can someone hep me how many percentage is the income requirement for fiancee visa? ive read its only 100 percent which is around 15k. but some would say 120%. according to one of my sources, the 120% applies only to i-864 form and during the sdjustment of status. can someone help me on this pretty please

 

For the embassy in Manila the number is 125% with the K-1 visa.  (don't listen to some that say 120%... that is a oops8rh.gif  :lol:)

     i am the beneficiary and we got our noa2 already so we started collectign all needed docs as per visajourney's post. our problem is this: . my fiance's ITR for 2012 was only around 15grand. and according to income requirements, she did not meet the requirement. my question is. what other documents or anything that will supplement her to meet the requirement given the fact that her ITR for 2012 is only 15k. please help us. we are totally wreck right now with this.  my fiancee has no other relatives in the US, so co-sponsoring is out of the question although i do have a second degree  cousin who lives in the US and a USC whom i asked and is willing to be a co-sponsor. my consulate is manila, philippines. please please help me on this... 

 

For the K-1 visa Manila can be very difficult with allowing co-sponsors.  If they accept a co-sponsor they want it to be a relative, now being the beneficiary's cousin is a new one so not sure how USEM will react with this.  All I can say is try...

 

I suggest along with the I-134 both the petitioner and co-sponsor do the I-864 as well.  All of this is still no guarantee as USEM is totally unpredictable with the K-1 in this situation.  I would suggest you make a point of telling the CO that the co-sponsor is your cousin so he knows it is family.

 

Do your fiance only have an income of $15K even now?  That could be an issue, even if they look at your co-sponsor, if they see the possibility of you becoming a public charge they will deny the visa.

hi, please help ame shed light on this matter. i am the beneficiary, and my fiancee (petitioner) has just landed a new job. she did not make that much last year. i was reading the income requirement for k1 visa petition and we both agreed to have a co-sponsor. here are the questions that bothers me right now. please take time to answer them smile.png) i would appreciate it higly. 1. does the sponsor needs to be a relative of my fiancee (petitioner) 2. what form does my co-sponsor needs to fill up im confused whether its i-134 or i-864. 3. given the fact that we are getting a co-sponsor, does my fiancee still needs to fill up i-134? 4. up to how many sponsor are allowed for k1 visa petition? two of our friends wants to help. 5. how much does our sponsor should be earning so we odnt have any problem. il give you a little background. 1. sponsor owns a construction company in the US. he lives with his wife. so im guessing that his wife is his dependent? his wife is also working. given that, how much should atleast he makes to qualify?. my second sponsor is single, and living alone, how much does he has to make in order to qualify? 6. does my sponsor needs to have the form (i134 or i864) notarized? 7. does my fiancee's i-134 needs to be notarized? 8. what are the accompanying documents that my sponsor needs to send to us along with the form? thank you in advance

 

Is your Fiancee's income from her new job adequate to meet the guidelines of the I-864P for the two of you?  Then focus on providing evidence for this income; employment letters, as many pay stubs as you have.  You will still need to bring the most recent tax return, but if the new job has adequate income that is where you want to shine.

 

As for you questions:

 

1)  USEM can be difficult about accepting co-sponsors with the K-1 visa, but when the do consider a co-sponsor they want that person(s) to be a relative, so trying to uses friends decreases the odds of USEM accepting a co-sponsor, and the embassy doesn't always accept relatives as co-sponsors.

 

2 & 3)  USEM requires the I-134 but it has been suggested many times to include the I-864 from the sponsor and co-sponsor.  (6 & 7)The forms do not have to be notarized.   

 

4) I don't know that there is a limit on co-sponsors, most only have one (or a married couple)

3. Do we really need to fill up all items or has the option what are the things just enough to prove capacity to support the beneficiary?

hi guys,

my fiancee ( petitioner) had her changed couple of months ago. her new name was the one we use for all our process except for her passport which is still on her former name. we have the proof of legal name changed documents. do you think its going to be an issue on the embassy? our interview will be next month.


another issue i found out just today is, while i was re reading for 100th time our noa2 i found out that they mispelled my petitioners name. they lack one letter. her name is ysabelle. but they spelled it as ysablle, minus the E. do you think its going to be an issuea as well? im starting to get paranoid here lol.




 

Did your fiancee provide evidence of the name change to USCIS during the petition process?  If YES then don't worry about it, otherwise have her send copies of those legal documents.  The CO may ask you questions about the name change just to see how well you know your fiancee. ;)

 

Don't worry about a misspelling of the petitioner's name on the NOA2, the embassy does not care about the NOA2 and does not ask for it, plus they have the original I-129F petition in front of them with the correct spelling.  Relax.

hi guys

i just found out for those who are new here that if your case is already with nvc and they have generated an nvc case number. do also ask for another number which is called the invoice identification number which is an 8 digit number. you will need it come the time you need ti fill up the online IV forms ds261 and ds260.

just a thought you might wanna know to save your time. i had to call nvc twice. first to ask for nvc case number and then after couple of weeks, the Invoice identification number. had i known i would need thosetwo. i could have just asked both numbers in one call...



 

 

FYI - In Manila the DS-260 and DS-261 are NOT used with the K-1 !    Plus the K-1 visa does not have a invoice number as it is NOT an immigrant visa.

You do NOT complete the DS-260 .... the K-1 is a non-immigrant visa.

 

Follow the embassy instructions letter, you complete ONLY the DS-160.

Her fiance is in Dallas, but she asked the permission of her fiance to stop over first in Seattle (to where I live now) to stay for two weeks with us here before she will fly to Dallas and they will get married there in Dallas. Her port of Entry in San Francisco from Manila. Upon arrival in San Francisco she will then will fly to Seattle and stay here for two weeks before going to Dallas. Now my question is, is this okay for a K-1 visa entering San Franciso and will fly to Seattle before going to the place of her fiance in Dallas? Please we need your help. Thank you and God bless!

I'm getting ready to send off the initial K-1 visa application (I-129f and such).  Should I sign and date everything?  Sign and date all copies of everything, including the copy of my birth certificatate, the passport photos (I wrote the full names on the back but didn't sign/date the back), phone call logs, screenshots of our email communications, printouts of my hotel reservations, the copies of my boarding passes... you know, everything?

You only need to sign and date the documents that require your signature and a date.  Of course names on the back of the passport photos and on the photos of you two together.

Hi everyone,
 
I'm sort of panicking a bit... I've just looked up some information that I need for drivers license and for AOS etc... and the I-94 is something that appears everywhere, but it doesn't look like I have one? When I came through POE, I handed over my sealed envelope, gave my fingerprints, handed in my customs form, have the photo taken with the webcam-looking thing, and then the officer stamped my passport and wrote in it. The whole process took around 5 minutes...
 
Should I have received an I-94? Does my stamped passport with the VISA inside count as the same thing? As far as I can tell, the I-94 is to state admittance with an expiry date, and that is evident on the stamp in my passport.
 
Any help would be appreciated!

  POE Update
There has been a change regarding the I-94, you are no longer given this form during the flight to complete and turn in at Immigrations (POE).  Immigrations now stamps your passport and the I-94 is done electronically.

I have my I-94 in my front right now, it is the small paper from the plane that u need to fill up before you go through the immigration.. they attached that to your passport nxt to your visa..   NOT any more... that is the old way.

Just want to make sure I cover my basis for proof of relationship and having met in person also.

 

I spent 2 months in the Philippines. So I'm attaching bank statements from savings account for atm withdrawals and CC statement for purchases, plane tickets we both used to fly from Davao to Cebu, 2 hotel receipts 1 in her name and the other in my name. Then also the lease agreement we had on the town home we rented. With this 7 pictures at varying dates during the trip of us and also some with me and other family members.

 

This going to be good enough or anything else I should include? Should I also include a few statements from my vonage phone # for communications outside my trip dates? I don't want to miss anything and make sure everything goes smoothly and as quickly as possible.

 

You have no timeline information and you don't state exactly where you at in the process.  Are you just starting and getting ready to file the I-129F or are you getting ready to file for the visa itself?

 

If you are just getting ready to file the petition, I-129F, then you only need to provide evidence of having met in person within the past 2 years, for that your plane tickets, condo lease receipts, pictures together, passport stamps will do just fine.  Phone statement will come in handy during the embassy state to show an ongoing relationship.

Hello everyone,

 

I would like to ask some advice.

 

Here it is. We just discovered that the court had made a typing error for information of my fiancee in his divorce paper.

 

1.) They put New york for his birth place when he was born in Florida and;

2.) Court Assumed that he got 4 years in college and put it in the paper.

 

Are those will affect or may cause of us getting and RFE later in our filing or those were not really matter since they're just going to see a proof of finalized divorced?

 

Any advice will be highly aprreciated.

I would not worry about the typos on the divorce decree.  Highly unlikely the typos will cause an RFE.

USCIS only cares about the names and addresses of the places you have worked, just be honest.  

 

USCIS and USEM don't even care if you are employed.

On the DS-160 it says I need to show an "evidence of approved I-129F".  I figured this is the NOA2.

But on my case, we have not received our NOA2 hard copy yet.

Is there anything that I can give them for now since I can't provide that yet to them.

Can I show them the letter from NVC stating that our approved case wil soon be transferred to USEM Montreal? will they accept that? or the Printed copy of the status update on the USCIS stating that our approved case was forwarded to DOS for visa processing?

If the DS-160 is required for Canada and the form requires you attach a copy of the NOA2 then you will need to wait.  Is the form asking for a copy of your approval notice?

So I got the papers from my fiancé. He sent me the original tax returns since he already had them on hand. Now my question is.. I only need the W2 and 1040? I see there are other forms as the form 8879 or IT-201??? I'm so not familiar with these documents.

And people that sent the originals did you get them back?? Or just send copies? I don't wanna chance getting an RFE for that tho.

You only need copies, do not bring the originals to the interview as the embassy will keep them if you do.

 

I don't know what an 8879 or IT-201 is... doubt its something the embassy wants.

 

Follow the embassy instructions letter ... exactly.  Bring what is stated there.
