Hi guys! Some petty questions here:

 

1.) What date should I write on DS-230 form? Is it the date of my interview?

 

2.) I have asked this before, but maybe I will get more answer / ideas this time: On DS-157 Question #9, List all the countries you have visited for the last ten years. (Give the year of each visit). My concern is I have visited several countries multiple times in a year.

 

For example: Singapore: 5x in 2011, 3x in 2012 and 5x in 2013. Do I need to say how many times I have visited in a year? Or simply write: Singapore (2011, 2012 and 2013)?

 

It has been suggested before that I don't need to spell out how many visits I made, but still the word "EACH" on the question concerns me.

 

3.) What is the more advisable / correct pen color to bring during the interview? BLACK or BLUEinnocent.gif

1)  Date you are completing the form.

 

2)  # 9 asks for each country visited and the year you visited so list each country then list all the different years you visited, being you have many visits list them on a separate sheet of paper and write "see attachment" in # 9.   I would go with your 2nd example.

 

3)  Doesn't really matter if you use black or blue... pick the one you want.

Those are part of the legal names but not sure if USCIS will have issue... nothing you can do about it now except be patient.

 

Just be ready if USCIS decides it is an issue and requests clarification (maybe a new, accurate G-325A).

 

Until then don't stress about it.

Skype log or other evidence of an ongoing relationship are not needed for the I-129F petition.  Those will be needed at the embassy during the visa application a few months down the road.

 

For now you need to provide evidence of having met within the past two years.

And he wants to petition me as a fiancé visa and planning to marry me in U.S. Just want to know if the U.S embassy consider my divorce papers (translated in English ) from japan as proof that I'm legally free to marry? Or do I need to get a CENOMAR in NSO? My Philippine passport is still my ex-husband surname. I can't change my status in Philippines b'coz i heard I need to hire attorney and it's expensive... And besides I'm going to Marry in U.S not in the Philippines .

Please help me. I'm worried about it....

Being your passport is in your married name the marriage with your EX was reported to NSO.  Who petitioned the divorce your EX or you?  Hopefully your EX, if so you will need to record the divorce with NSO so you are shown as single once more.  If you filed for the divorce it will not be recognized in the Philippines and you will need to do the annulment process.

 

You may have a divorce decree but in the Philippines the embassy requires a CENOMAR for the K-1.  Plus to get your CFO sticker you need to present your CENOMAR  and without the CFO sticker you are not leaving the country.

My fiance' moved to a different company right after we got our NOA1. Where/ how do we update his new employment? By the way our I129F petitions approved already. We received the NOA2 hard copy 2 days ago. Our lawyer told us that we don't have to update his employment record. We just got to stick with what we mentioned on the I129F since he already has his income tax and employment record for this. Is this true? I know he's a lawyer but I trust VJ family more. Any advice, anyone!

Use the current employer information for the I-134 at the embassy.  Being it is a new employer I would suggest including an employer letter and pay stubs.

Like said not sure what your question is.  Your income (combined) need to at least meet the 125% poverty guidelines of the I-864P if it doesn't you will have to try a co-sponsor.

# 1 - USEM wants the co-sponsor to be a relative with the K-1 visa.   Still no guarantee they will be accepted but without a relative as co-sponsor it's almost certain to be denied.

 

# 2 - It has been suggested many times to include the I-864 along with the I-134 from both you and the co-sponsor.

 

I don't know that being at the interview makes any difference in regards to the embassy accepting a co-sponsor, I have seen it go both ways even when the USC is there so not sure that is vital.

I just noticed on http://travel.state....types_2994.html for instructions on Fiance visa it now only shows that two DS-156 forms and one DS-156K form is required. Did they drop the requirement for a DS-230 form?

 

Depends on which embassy, each has their own procedure.  What country are you petitioning your fiancee from?

 

As for the other linked information, that is specific to immigrant visas, not K-1.

 

Starting September 1, 2013, all immigrant visa applicants will apply online using Form DS-260 (Application for Immigrant Visa and Alien Registration). Applicants will also choose their agent online using Form DS-261 (Choice of Address and Agent). Applicants will access both forms on the web at ceac.state.gov.

These forms replace the paper DS-230 and DS-3032. The National Visa Center (NVC) may instruct some applicants who previously submitted Form DS-230 to submit Form DS-260. Only Diversity Visa and Cuban Family Reunification Parole applicants will continue to use the paper forms. If you have questions or feedback about Forms DS-260 and DS-261, contact the NVC at

Need help. I am an expat in a foreign country on a work assignment when I met my fiancee. When we did our K-1 interview together, the officer told us very clearly, multiple times that we have to marry within 90 days from the visa acceptance. We said OK because we don't want to argue, and the officer approved the K-1 request. But my work assignment in this foreign country isn't scheduled to finish in another two months, so our original plan actually was to go back to US together almost exactly 3 months after the interview and marry officially within 20 days at City Hall. Following this plan, the total days from visa interview is 110 days from interview, which meets the 6 month to enter the US and 90-days to marry rule which is documented on the official website http://travel.state.gov/. However, when we stated this plan to the officer, he told us that it is not possible, since we have to marry within 90 days from visa acceptance.

Also, when we received the envelope with the sealed package and her visa a few days after the approved interview, the front page attached also says to enter US within 6 month and marry within 90 days after enter US. I am confused whether to go with what the interview officer clearly stated (marry within 90 days from interview) or with what all the documentation and websites say (90 days from entry into the US)?

 

 Can the individual officer make special rule for some cases, such as in mine since I am an expat? For example, could he have written a note inside the sealed, do-not-open envelope saying we have to marry 90 days within interview date?

 

The validity date is printed right on the visa, enter the USA before that date.  Then you have 90 days from POE to marry.

Priority Date isn't used with the K-1 visa.  It may be asked for on a form or website but it doesn't affect anything.

 

As for what is your Priority Date?  Is the RECEIVED DATE on your NOA1.

I have a family's friend would like to know if he can file for I-129F even if he's 63 years old and his girlfriend 59 years old. Is there age's limitation on that? I have tried to research online but no luck on that.

Only age restriction I know from USCIS is the person filing must be 18 years or age or older.   I think your friend is safe wink.png

 

I know a fair number over the age of 63 who filed the I-129F petition (me included)

If a k1 is a nonimmigrant visa and you don't pay the immigrant fee at poe, why does ceac on their website consider my k1 case an immigrant visa?

For example i search on ceac with my case # DOS told me to put "immigrant visa"

Ours is not to question "why" .... ours is to get everything done as quickly as possible.  :lol:  OK that isn't how the quote goes, but seriously do we actually care?   

 

Personal opinion is that once there is a marriage in the USA the process quickly turns into a immigrant process.  Before that moment in time.. the visa holder is a non-immigrant, with the perk of being processed like an immigrant visa.

Hello folks,

 

I am a newbie and want to thank everyone for all the help I have received thru other couples journeys.  I have filed my K-1 visa for my Fiance in the Philippines and listed her 3 year old son on the K-1, we have received our hard copy of our first NOA.  What else will I need or should have done prior?  I have checked prior postings and I am being told that her 3 year son will be allowed if she gets her Visa and has completed all the necessary paperwork, forms, medical evals ect.

  • Should I have sent in his NOS Birth certificate with the K-1 application?
  • What forms will I need to submit only the k-2?
  • What fee's will need to be paid?
  • Should my Fiance bring her son to the interview once it is granted?
  • Will her son need the same medical examination as my Fiance prior to the interview?

 

Sorry for all the questions but i have not been able to find documentation on the step by steps procedures for bringing her son with us so we can keep the family together.

Fees are $240 for each.

 

Your fiancee will schedule the interview for her son at the same time as she does her scheduling online.  Yes, her son has to be at the interview.

 

Yes to the medical as well.

Nope can't file a K-1 through the embassy, have to go the long way around for the K-1 and file with USCIS in the States.

 

How long have you been in the Phils?  Maybe look into getting married there then do a DCF for the CR-1 spousal visa, you can do everything through the embassy and the USCIS office there.  Much faster.

At the embassy phase of the process - If his income at his new job meets or exceeds the poverty guidelines of the I-864P you should not have any issues.  The embassy asks for the most recent years tax return (not 3 years worth), W-2 and in this case (because it will be a partial year of income) I would suggest for sure including a letter from the employer along with copies of his pay stubs.  

 

You don't need any of that right now to start the process and file the I-129F, and this can take a few months (sometimes up to 6 months) before the petition is approved.  

 

If you meet the requirement of having met in person within the past 2 years, have your supporting evidence of same, you should be good to go for starting the petition process.

Hello there! I have a problem... I entered united states last September 27,2013. In my passport the immigration officer stamped Sept. 27, 2013 as my date of entry but when i printed out my I-94 online the date was put into Sept. 28,2013! I have tried alot of times typing the "correct" date on the information thinking that i just made a mistake on encoding but still Sept. 28 comes up!

Am i heading in a big headache?

 

Don't worry about it.  Just get married before your 90 days are up.

NOTE: For K visa cases in process at a U.S. embassy or consulate, the DS-160 is not required when, prior to October 7th, 2013, one of the following situations exist:

  • The K visa applicant has already been interviewed and has been requested to submit additional documentation or is pending administrative processing.
  • The K visa applicant has already submitted a valid, signed, unexpired DS-156, DS-156K and/or DS-230 or received instructions to do so.

K-1 is a non-immigrant visa processed in many ways like an immigrant visa.

 

Being you have not scheduled your interview yet:   As for the DS forms, all the rules have changed, Manila updated their instructions letter and (part) of their website 9 Oct 2013, the form now used is the DS-160, the old DS forms are no longer used.

 

Follow the flashing arrow for more info and links to assist you in the process for Manila.   The new embassy instructions letter lists everything that is required.

Would there be any way for me to get approved on my visa interview if my fiance's W2 shows he doesn't meet the income for household of 5? He earns  about $25,784 annually and it requires that he has $27,570 for household of 5. Is there any way his mom be a co sponsor since they live in the SAME household. I've read that the US Consulate in Manila does not allow co sponsors for K1. What do we need to prepare?

 

I want to cry now..i called the Immigration Visa Unit and they said it will just be denied bec of insufficient income and that i'll be public charge..I don't know what to do anymore..We even have an immigration attorney, if we get denied we just wasted money for nothing... sad.png Help please...

 

USEM does, on occasion, accept co-sponsors with the K-1 visa, the co-sponsors has to be a relative... so mom is good.  She will need to have income to meet or exceed the 125% requirement of the I-864P poverty guidelines for herself, you and your children if there are any.  Both your fiance and his mom should complete the I-134 (and I suggest to also complete the I-864 for both as it has helped many times) plus supporting evidence = most recent tax return and W2.   With all of that it may not be a slam dunk, but at least there is a good chance of having the co-sponsor accepted.  

 

If you were going to try using assets to make up the shortage in income you would need 5 times the amount of the shortage.  Now with that said I know of a few that tried to use assets and USEM did not accept the assets...  so I would not count on that route.

 

 

K1 visa has only the 100% headbonk.gif  poverty guideline requirement...double check...  no0pb.gif

 

The USEM requires 125% for the K-1 visa for the I-134.   They come in with only 100% they will be denied.

This website and forum is a wonderful resource!  This is my first post!  Thanks to everyone for all the information I have gleaned over the months.  Today I have joined...so I can post!

 

Here is my question:

 

My fiancee has her embassy interview in Manila for her K-1 Visa Wednesday, October 23rd, 2013.  I have sent her a scanned copy of my divorce decree by email attachment.  She has printed it to take.  Is it worth it for me to Fed-Ex a certified copy to her?  I really am not rich, but I also don't want things to be delayed because of a $50 Fed-Ex cost either.  But like I said, I don't have lots of money, so I want to be wise about this.

 

Has anyone taken a photocopy (or scanned copy) to Manila and been required to provide a certified copy (you know, with the embossed seal, etc.) before a Visa would be issued?

 

Or, has anyone been asked to see their petitioners' divorce decree, and when you presented a scanned copy (or phtoocopy), they accepted it?

You sent a copy of your divorce decree to USCIS when you did the I-129F petition, correct?  The embassy will not ask about your divorce decree for the interview, most everything is about your fiancee and the relationship you two have, except for the support, I-134 and most recent tax return/W-2, which the embassy wants an original of the I-134 but copies of your tax return & W2.

 

Follow the Embassy Instruction Letter for what is required for the interview.

 

CFO will want to see a copy of your divorce decree but the copy you emailed is more than adequate.

Yup!  USEM wanted the original I-134, not USCIS (it may be in the file but its not where USEM wants it... silly them I know).  Most recent tax return and W-2 can be copies.

Called nvc to check on k1 status...I've already check it on ceac website with a case # but nvc said that they can't give me a status update because I'm giving them the wrong birthdate of my fiance(benificiary) which I double check it with the I29f I sent and it's the right birthdate so nvc was saying that they prolly input the wrong birthdate on they're system...now they want me to send my fiancé passport to correct her birtdate....my question is why can't they correct it themselves coZ they're the one who input the wrong date and shouldn't they check my i29f form from uscis which I check it a million times and I am giving them the right birthdate same as the one on i29f.

 

 

Don't fight city hall.  Have your fiancee scan the bio page of her passport and email it to you, then you can forward it to NVC.

My filipino citizen fiance is staying in london via student visa. His visa will end february 2014. We dont mind if the interview will be in Manila, Philippines. But is it okay to start applying for k1 visa now and use his london address in the meantime?

 

It's fine to start the I-129F petition, but if you use the London address NVC will send the petition approval to the embassy in London.  If you want to do the interview in Manila use the address in the Phils... keep it simple from the get go.

hi!  we apply k1 visa last July 2012 it was granted and expires sept 15, 2012 it's just due to my fiance's work contract in afghanistan which ends Dec.11,2012 sad.png the day in my interview my fiance made a letter to the consulate to ask for extention til my fiances end of contract but since there is no extention unfortunately we weren't able to use the visa so We reapply k1 and next week is my interview but my concern is i still have the old packet in hand my question is should i just bring the old packet on the day of my interview? i don't know.. sad.png

Nope, you will get a new DO NOT OPEN packet with your new petition and application documents (you may want to bring the packet just to see to see what the embassy will do with it, but it yesterday's new) .

 

There is a new form used by the embassy now, DS-160, there is a link to it in the embassy instructions letter.

 

You will need a new I-134 with a copy of your fiance's most recent tax return & W-2.

I just want to ask about the question 7 and 11 on the affidavit of support I-134. 

 

Concerning the question 7 , I am going to use my social security income , and also rental property , it is a house that i own and i rent it for people . How am i going to put this there ?

Does your social security income meet or exceed the 125% requirement of the I-864P  for the number of people that you are sponsoring or dependent?   If so you don't need to list additional assets.

 

If you need to use your rental property as an asset, you will need to get a certified appraisal and a mortgage statement showing your current mortgage balance to establish equity.  

 

You can go to http://www.ssa.gov/myaccount/ to get a benefits verification letter showing your income from Social Security.

My fiance approval of i129 with USCIS will expire November 5, 2013, and we still didnt recieve packet 4 from the Embassy. What happens now??? So frustrated..........

 

The approved petition can be extended for up to a year by the embassy, they do extension 4 months at a time.  Contact the embassy

K-1 Fiance(e) Visa Process & ProceduresDocumentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

I applied for a K1 Visa I129F followed the instructions here (thank you!) Sent it on 9/11/2013 with Checked cashed on the 12th and an SRC number assigned 09/13 from the Texas.

 

Today i received my (5) 4x6 color photos returned stating that they cannot support my application/petition with photo pictures.  They are standard pictures in the format stated in the guide here.

 

Anyone else had this issue?

Did you include the airfare receipts, copy of passport with the stamps in the petition you sent in.  May be a silly question, but...

 

Just curious why they would return the photos.... seems strange.

Hello I have filed for and have been, approved for K1 visa for my finance, she is currently in Qatar, but will be going home in the next few weeks.
 
Will she need police clearance from Qatar as required the US Embassy in Manila?

IF she can get the police clearance before leaving Qatar then for sure she should do that, but if it is not possible in that short of time I believe Qatar is on the waiver list of countries that will not provide a police clearance unless done so in-country - thus not needed for the interview.

 

I am not certain Qatar is on the waiver list, you should verify that info.

NOW THAT MY " WIFE" have been approved I think the lecon you should learn is that cases ares differents, and do not came on this site trying to play theCO cause you are not.give your opinion, but do not do like you work at the US Embassy.You did not even have all informations on my Case.
