We used the new version of I-129f  and on the USCIS site there's an instruction on how to fill out the new form. Well it says that if your answer on any of the questions' N/A or "NOne" leave the space blank. We are about to send our packet today but confuse if we  leave  a lot of blanks!!!!My fiancee wants to follow the USCIS instruction .Now I'm worried because im reading in here that the number 1 rule in filling out forms is to never leave blanks!!!!Should we leave it blanks or put N/A to all the boxes that are not applicable ?

Sorry guys...I'm sure this topic has been opened many times here, so I apologize for possibly adding a duplicate, but I just need to know what I am to do after receiving NOA2 as far as steps are concerned.

 

Here's what I'm understanding:

 

1. Receive NOA2

2. Call the NVC to get a case number after 2 weeks? IS NVC the same for all filers? What's their number?

3. NVC will then send me a new letter with my new case number

4. My fiance is then supposed to receive a letter from his embassy after it arrives with insturcitons of what to do next.

5. Fiance is supposed to complete 2 forms and at this time I am to send him affidavit of support

6. Fiance sends the forms to the embassy, and awaits interview date/medical exam.

 

Am I missing anything? Could someone let me know anything I'm missing in this process?

Checking on your embassy case number:  As of late its taking upwards of 8 weeks for NVC to receive your file from USCIS after you receive the NOA2, then for NVC to get your file in their system and get the case #.  Call after 4:45 PM eastern time for shorter wait times K1's are not tracked through the AVR, ever. They are processed like an immigrant visa, but they are NOT immigrant visas, so they fall into a completely different class of their own. Therefore you need an operator.

Need help badly my fiance just have full-time job on this year because on 2011 and 2012 she's taking care of our son and also they return to Philippines on our son Baptismal and 1st Bday I already send a copy of my fiance Job letter and a copy of her payslip on her 2 jobs, but after I update my case no. to https://ceac.state.gov/ still refuse on my status., I'm a skilled worker previously work as Desktop Support Engineer at Eastwest Bank so I'm sure I am not be a public charge on the future. We have also a co-sponsor which her sister personally insist to help us out in-case needed on my application, but still my case is on-hold =(.

Your fiancee not working because she is taking care of your son almost screams that you would be a public charge - and it does not matter if you can work or not once in the USA, that is not how the system works.  Your fiancee has to prove she can support you, your son and herself, for that proof she has to show an income that at least meets the I-864P poverty guidelines (125%) for the number of people which in your case is 3.

 

If her sister is willing to be a co-sponsor she must also show income that meets that income requirement which would include you and herself (and any dependents she has). For this your fiancee and son are already USC and they do not need to be included.  Just the same it is very likely the embassy would look long and hard at your fiancee's lack of income in this situation and may not accept a co-sponsor.

 

The only way around this situation is for you to get married and then the embassy HAS TO accept a co-sponsor.

I am a US citizen recently divorced. I want to apply for a K-1 for my fiance. She tells me she will get denied because my previous marriage was in the philippines. Can anyone tell me of a similar case where this has or has not happened? And possibly what other options may we have short of getting an annulment.

 

I have asked a lawyer and they assured me that it would not affect the K-1 but I would like to cover all bases.

 

You were married to a Filipina before and divorced her... no issue.  Doesn't matter if you were married in the Philippines or not, you were divorced in the USA and divorce is recognized here ;)  .    You will provide a copy of the divorce decree to USCIS and would be a good idea to send a copy to your fiancee as she will need it later there in the Phils.

 

No need for an annulment.

I forgot to wear a shirt with colar when I went to have my pictures taken today.It's for the medical in st. lukes one of their requirements.I have sleeves though but just no colar.Do I have to have another photo taken again?Everything's closed here today cause it's sunday.And tomorrow we will have our medical exam already.Any advice?

 

Collar or no collar is not a requirement for the passport style 2X2 photos.   You are fine.

The only issue is that I've already done my medical (I wasn't aware of the fact that visa validity is calculated based on the date of medical exam). Do you think if I do another medical later on it would resolve the issue? (I've emailed the embassy regarding my situation but I'm still waiting for an answer from them)

 

Ah, that may add a kink, hopefully the embassy will give you a positive answer about completing a second medical later, that would for sure remedy your issue.

I'm in a tricky situation right now. I am currently studying for my Master's degree and had applied for the K-1 visa 3 months ago and to my fiance's and my surprise our visa processing has been progressing at a very rapid rate. My case is now with the embassy and will have my interview soon.

 

Now I know that if granted a visa I'll have to move to the US in less than 6 months.But doing this means I won't be able to finish my studies. Do you think I'll be able to extend/re-issue the visa based on this reason? If not, if I let the visa expire and then once I finish my degree I get married and apply for a spouse visa, will this cause any troubles (in the sense that I let my K-1 visa expire and based on this will I have any problems with the spouse visa?)

 

Reschedule your visa interview to as late a date as possible (you can reschedule twice without penalty), the petition validity will be extended up to a year by the embassy.   Don't take your medical until closer to the interview date also, as the visa validity will be tied to the medical date.

We are getting close to the time where I need to fill out and send my fiance my  I-134 paper along with everything else for her interview. 

 

We are an older couple, and I have had my own business for over 25 years. I pay myself well over the minimum amount needed for the poverty level part of the I-134, and well send my most recent years tax statement to show that. My company is set up as a corporation C , and I am the only owner of it. I have a fair amount of assets and money in various types of bank accounts. I own my home and have no mortgage, or owe any loans.

 

1. Is it necessary to send my tax records for my company, wont my personal  tax returns be enough evidence.

 

2. Must I disclose all my assets on the I-134.

 

3. Once we are married, I will add my wife"s name to a joint checking account for the 2 of us. 

 

Since I am nearing early retirement age, and plan to retire at 62, I am just trying to make sure that if our marriage didnt work out, I wont loose everything I have, as is many times the case here is US. We have known each other for close to 3 years, and have spent much time together, but even so, a long distance relationship is not the same as being able to spend time together on a daily or weekly basis like we would if my fiance was close by. I know that by asking this, I probably will sound like a very cold person, but sadly, over 50% of marriages here do not work out for various reasons, but I do pray ours will work out. Since everything I have, was earned before us getting married, I am trying to lookout for myself, cause once I retire, I will not be able to get my business back ever again, if our marriage was to not work out. As time goes by, I will most definitely put things in both our names, but am trying to not put my future wifes name on everything right from the start. 

 

I dont know how to ask this type of question without sounding like such a jerk, cause when I read it, thats how I sound to myself. 

 

Hope I will get some answers, and not all insults, but I do understand how this sounds.

 

 

 

Your tax return with supporting documents should be more then fine as long it shows you meet or exceed the poverty guidelines.  You do not need to list all your assets.

I just received the hard copy of my RFE. It says I need to provide the "complete and final divorce decree" for my fiancee. My question is what does a complete and final divorce decree from Japan look like? My fiancee sent me the document and translation that is shown in the attached pictures. Is this a divorce decree? Or, do we need a better translation than the one from the Japanese language school in Davao City, Philippines? Also since my fiancee is in the Philippines, can she get a copy of the divorce decree from the Japanese Consulate? Sorry to read this,  your gals divorce is going to have to be on record with the NBI, the catholic church, and reflected on her CENMAR.  This is going to take a lot of time and $money$.  Hopefully, others in this forum can add more info. and help.  Best of luck!

Not necessarily true.  If the marriage was never reported to the Philippines then for all intents and purposes in the Philippines she is still single.  USCIS and USEM are the only ones that will need a copy of her divorce decree to process things.  Now if they did do a report of marriage then ... yes its a long costly process.

Okay, so I looked around and couldn't find this information so I thought I would ask.

DO I need to provide proof of my insurance policy? Its value and current cash surrender value? Or can I just state what my policy amount is at and its current surrender value?

If your income is adequate on it's own you do not need to list additional assets.

Hi VJer's! I'm just new in this site... My fiancee and I got our NOA2 hardcopy August 29th and we're just waiting for our Manila Case Number from NVC. I'm kinda worried about my fiancee income if it fits the poverty level requirement for K1. My fiancee retired 1 1/2 years ago and he got savings, insurances, owned 3 cars and a house... he got no dependents. 

 

Will this be an issue for denial of visa? Any thoughts...

Being retired is not an issue, its all about income.

 

Petitioner's income must meet or exceed the 125% poverty guidelines of the I-864P, if the income is low assets can be used to make up the difference at 5 X the shortage.

USEM can be very picky about accepting a co-sponsor with the K-1 visa, when they do consider a co-sponsor they want it to be relative so your sister is a good co-sponsor.  And yes I suggest that both the sponsor (your fiancee) and her sister complete the I-134 & I-864, the addition of the I-864 does improve the odds of having the co-sponsor accepted (still no guarantees).

My fiance is a cab driver who is self employed, what should he be submitting for affidavit of sponsor? W2? Employment letter or what not?

 

He has been making stable income of about $17k annually for about 4 years. 

 

Do we need a co sponsor for that? If we do, does it need to be family/relatives?

 

 

Income needs to meet or exceed the poverty guidelines of the I-864P  http://www.uscis.gov...form/i-864p.pdf.  If it doesn't you will need a co-sponsor.   Other question is does your embassy accept co-sponsors with the K-1 visa?  Some embassies can be difficult about this.

It was because my fiance just started his new job this June 2013 so we just presented a coply of his paystubs for his new job and also his latest income tax return for his self employed but a little low, so we didnt meet an income requirement. Anyone there that can give us input. Is there anybody there that can relate with my case? Thank you.

I am a Filipina currently working in Cayman Islands. I already have an approved I29f. My fiancé would like to apply k2 visa for my 8 year old daughter, but she is currently in the Philippines. Our plan is to apply her k2 visa at the same time with my k1 visa. If the visa will be approved, I want to go home first in Philippines to pick her up and enter in the states at the same time. What will be the process if we want to apply for k2 visa considering my daughter live in Philippines? Is she going to have a separate interview in the Philippines? Is she going to have a medical in St. Lukes? If yes, which consulate, they will forward the medical result considering I will be interviewed in Jamaica, which is the nearest US Embassy in Cayman Islands.

If you process your visa application in the Cayman Islands you will have to follow that procedure (in Jamaica ).  You daughter will have to follow the procedure for the U.S. embassy in Manila.   If you travel back to the Philippines after receiving your visa (hopefully before entering the USA so there are no issues at POE later), you will have to complete CFO also, as will your daughter (she only needs to be registered and get the sticker), before exiting the Philippines.

 

One thing I am not sure of is how that will work for your daughter, being the petition file will be in Jamaica... that could cause lots of issues.

The more I think on it the more I see problems.  Would it be possible for you to do your visa application in Manila?  Getting the file transferred may take some time, but I think it will have to be transferred to complete your daughters application anyway.  Just thinking out loud.

Hello everyone. First, I want to say thank to my fellow VJs here who replied my last post about the best visa option for me and my fiancee's situation. We chose K1 and we sent our I-129f packet today through FedEx. We'll just wait the USCIS approval. If we get denied, we just get married then. 

 

I have another question though. Is it okay to send a 'crossed out' personal check? My fiancee has old bank checks. He got his name, the ex-wife and old address on it. Ex-wife is not an account holder since 2008. He didnt get new one because its expensive plus he's far away from home. He's here with me in the Philippines. So what he did, he just crossed them out using a black pen. Do you think USCIS will accept it?

If you are talking in the upper left of the check, I don't see that as an issue.

 

Just curious.  Why did you choose K-1 over CR-1 being your fiance is there living in the Phils already, you could have gotten married and done a DCF (Direct Consulate Filing) which is a ton faster than the K-1 process?

You put in your current (estimated) annual income, if working two jobs then the combined income.

Option 1:

 

Since they want you to attach the tax returns (2012 in this case), whatever you have on the 2012 tax return as your income (from 2 jobs from last year) should be on your I-864 (AOS) Part 6 Line 13 (a) and also on Line 10. The fact that you have a different job combination in 2013 does not have to be on the form as you do not have a tax return for 2013 yet, anyway.

Note only 2012 tax return is required. Returns for 2011 and 2010 (second and third most recent years) are optional. I had included all three of them myself.

 

Option 2:

 

Use letters from your two current employers to substantiate your estimated income in 2013. That estimated 2013 income  should be in Line 10 and also Line 13 (a). In that case you still need 2012 tax return amount to match with what you put in Part 6 #13 b (in this case).

 

My recommendation would be Option 1. You do not need to mention 2013 jobs and income because it is not over yet.

 

 

 

K-1 doesn't use the I-864 form.

Am about to fill out my I-134 form..  my 2012 total annual income was $95k.. and that's because I had 2 jobs last year (a full-time and a part-time job).. this year 2013, I still have 2 jobs but i changed my part-time job to per diem and with a different hospital now.. And I kept my full-time job with the same hospital as of last year.. here's my question.. number 7...

 

-- i am employed as or engaged in the business of ________ with __________ at _______ (address) ----> how can i put the names of my 2 jobs? or do i need a separate form for each? do i put my 2 jobs i have this year 2013 or the 2 jobs i have last year 2012? (coz my previous job is what's written in my W2, which of course am gonna submit to USEM)

 

 

-- i derive an annual income of:  $_________ ----> do i write the total annual income which was the $95k added from both jobs?? Or do i need to fill out another I-134 form for my 2nd job so it'll show the annual income in each job/hospital?? You only complete one I-134.  You write your gross income for the year in the " $____________"

 

If there is not room on the form to list both places you work, added the info on a sheet of paper for listing the company names and addresses.

USEM will want a copy of your most recent tax return and W-2 (or in your case two W-2s)

 

If you income meets or exceeds the 125% poverty guidelines of the I-864P you do not need to list any other assets, nor include bank statements and such.

 

A copy letter and pay stubs are good to include.

I'm a bit confused as to who I make my check payable to.

 

The website says to make it payable to Department of Homeland Security unless I live on Guam or the Virgin Islands.

 

Can anyone inform me as to who I would make my check out to?

 

And for Guam residents, after we send our application packet to the Texas lockbox, where does it go from there?

 

 

I don't find where you are reading about Guam and Virgin Islands.

 

USCIS I-129F    This website makes no comments regarding Guam or Virgin Islands.  Didn't see anything on the form or instructions either.

I have contact NVC yesterday. Took a lot of tries before I got put on hold for an hour. The lady said it has not arrived yet. It has only been a week since NOA2. She told me to wait a week and call every 2 days. She told me they don't hold onto the packet for long. She says it can take up to 8 weeks to get the pack from USCIS. So she is telling me that they give you a NOA2 and it takes 2 months to package and send onto them?

 

Oh when I try to call USCIS they asked for my receipt number and I put it in and get a response it is not a valid number and it hangs up. Does anyone know how to get through besides choosing the spanish choice?

 

In regards to USCIS, it sounds like the package has left there and is headed to NVC.  Forget about USCIS at this point.

Something has happened not good for my fiance. Her boss is closing business and won't let her stay with another company. So she has to go home this weekend or Monday next week to Philippines. We just got NOA2 on 9/20/13 and we put it in for Doha Qatar. Since it is not at NVC yet and sent to the embassy in Doha can we change it by some form or phone call? If it's a call when do I start calling the NVC? I have not got my NOA2 hard copy yet. Also how do I change her info, address, phone number to contact her in Philippines.

 

I would contact NVC for sure, you need to catch the file before it leaves NVC.   You might try calling USCIS also

Contact the embassy about this "typo", there is contact information in the link below.  Email and call them.

 

When you registered online did you type all names correctly?

 

Make sure when you do the DS-forms for the K2 to not have any "typos" ;)

 

Don't stress too much on this, as long as all the documents and forms are correct at interview time, you should be OK.  It's a hiccup... they happen.

K-1 Fiance(e) Visa Process & ProceduresI had an autoimmune disorder, will that affect my medical exam?

I had an autoimmune disorder, called GBS (Guillain Barre Syndrome) and i got a tracheostomy (i was on a respirator for quite some time) because of it. It happened 3 years ago but im all good now. Also, this disorder is not contagious at all. I was just wondering if it would affect my chances of passing the medical exam? I have no health problems right now and the GBS is a once in a life time thing only but it still worries me. Thank you everyone!

 

I don't see that as being an issue.  They are serious about screening for TB and do watch for scaring from self-inflicted wounds... so not a worry in your situation.

 

Do they ask about scars in your body? i have a scar on my neck because of the surgery

 

They do look at scars, I would do as suggested and maybe have a copy of your medical record from the surgery.  Even though you just explaining the surgery to them may be adequate.

I was hoping someone would have an answer to my question. It is really important for me for my fiance to meet my family before we get married. We would like to get married here and then live in Rio. Does us getting married here tie him down to this country? Do we HAVE TO fill out the paper work for the green card soon after or can we worry about that when we decide to come back and live here? Can I process that paper work from abroad? Due to other personal reasons my fiance can not leave Rio for too long and I really want to go back and live out there as well.

Can't he get a tourist visa?  Doing the K-1 process just to get married then return to Rio ...hmm.   Of course nothing to stop anyone from leaving the next day after getting married.

hi i just need help... im just worried because my interview here in the USEM phils is near. i just want to ask question on what i need to do... before i applied for a business visa and unfortunately the one who did our online application for interview keyed in incorrect college course of mine, since she is the one who is doing the application for all of us who will attend the conference in US. i just found out the night before my interview during that time, so ofcourse when they asked about my course i told whats on the documents. 

 

Now im applying for a K1 visa and on the DS forms course in needed, what will i put there?  the course that was on their system before or my real course. coz im quite worried that if i put my real college course they might question why on my previous intervw for B visa is different.. please i need advice.. i dont want to ruin this long process just because of my college course. thanks

Hi guys! Some petty questions here:

 

1.) What date should I write on DS-230 form? Is it the date of my interview?

 

2.) I have asked this before, but maybe I will get more answer / ideas this time: On DS-157 Question #9, List all the countries you have visited for the last ten years. (Give the year of each visit). My concern is I have visited several countries multiple times in a year.

 

For example: Singapore: 5x in 2011, 3x in 2012 and 5x in 2013. Do I need to say how many times I have visited in a year? Or simply write: Singapore (2011, 2012 and 2013)?

 

It has been suggested before that I don't need to spell out how many visits I made, but still the word "EACH" on the question concerns me.

 

3.) What is the more advisable / correct pen color to bring during the interview? BLACK or BLUEinnocent.gif

1)  Date you are completing the form.

 

2)  # 9 asks for each country visited and the year you visited so list each country then list all the different years you visited, being you have many visits list them on a separate sheet of paper and write "see attachment" in # 9.   I would go with your 2nd example.

 

3)  Doesn't really matter if you use black or blue... pick the one you want.
