When my fiance shows the financial support information during her interview such as tax returns and pay stubs will the consulate make or keep the copies of them or just look them over and give them back? 

 

The embassy will keep anything you give them  Only give them copies of the tax return, W-2 and pay stubs.

Annual income - $53325
Real estate valued at - $162000
        Mortgage - $ 134000

The annual income is actually above the 125% poverty line for a household of 5 but my concern is about the real estate and its mortgage which is still high... My fiance (petitioner) had already printed our I-134 out, signed, and sent it to me when we found out that it is OK not to include the real estate. Will the high mortgage matter much despite the above 125% poverty line annual income?






 

Don't worry about it, once the CO sees the income is adequate none of the other will matter.

It really doesn't matter who the letter is addressed to within the government.  What is important is the Intent to Marry within 90 days statement.

You are correct in saying the MOST RECENT is the one that is required, however sometimes it is helpful to include 3 years.  And if you get an official tax return transcript you don't need to include any W-2s.  And although pay stubs and employer letter may be optional, they will still help to prove your income if your tax returns do not show the minimum required income.

 

I don't know about all embassies but I know that Manila will not accept anything more than then the most recent tax return, you bring three years of returns to the interview you will be carrying two years back home with you.  And yes the W-2 is included within the tax transcript, but I stated tax return & W-2 as that is what is stated in the embassy instructions letter (yes I know they will accept transcripts also.)

 

The requirement for 3 years of tax returns "died" years ago.

Hey all,

 

I am getting things ready for the i-134 and I am having some problems with getting a transcript from my bank. (I live in Texas now and there is no US Bank here)

 

I have ordered the tax transcript already and have a letter from my employer stating my yearly gross salary. Will that be enough or do I need to have the transcript from my bank? Is it ok to send her copies or does she need the originals?

 

Also, once we have a definite answer to this it should be stickied! So many people are asking about it.

As stated if you income meets or exceeds the poverty guidelines of the I-864P you do not need bank statements (if you wanted to include bank statements you could use your statements that you download from your online banking wink.png )

 

Is your income enough to meet the poverty guidelines?  If so, then you don't need to include anything from the bank.  All you need are:  last 6 months paystubs, employment letter, last 3 years tax return transcripts. 

 

What is required is the MOST RECENT tax return (which currently is 2012) and W-2, NOT 3 years.  Pay stubs and employer letter are not required, they are optional.

I just got our case number. Can I (petitioner) fill out the DS160 online or does it have to come from my fiance (beneficiary)?

 

Yes you can complete it, but the beneficiary has to "sign" it.

There will be security questions to access the form later, that is all your fiance will need to review and sign the form

Prior to my fiance going to her medical/interview, we filed the DS-160 online because we were near the cusp and wanted to make sure everything was covered.  The visa went into Administrative Processing. Do we also have to complete the DS-260 and/or 261? I went to the CEAC site and clicked on the link for the DS-260, but it seems to want the Invoice Number from the NVC, and no idea where to find that as it was not on the letter I received from them telling me the case had been forwarded to the embassy.

 

So bottom line are the 260 and 261 required for a K1 or not? If so, where do I find my Invoice number?

Hi everyone,  I am new here, and I am very anxious about my upcoming interview on the 19th..

My fiance and I never recevied an NOA2, and i am worried the C.O. might ask for it..

We only received NVC letter stating that our petition has been approved, and our case number, and that we could schedule an appointment for interview and do the medical exam already.

We have been arguing about this for a long time, and he cannot get through USCIS, someone told him that it's okay as long as we have the NVC letter, and another one form USCIS did not entertain him because she said everything was transferred to NVC already.

 

Another one is his form 1040.. He said it was electronically prepared that's why there's no need for signature.

Does it need to be signed? I already have it with me, and it says SIGN HERE on the back, where he left it blank!

Please help! thank you!!

 

NOA2 is not asked for during the visa application, so don't worry about it..... now.  You will be fine at the interview regarding the NOA2.

 

As for the tax return, have him sign a copy and EMAIL it to you.   

 

Your fiance (petitioner) does need to get in contact with USCIS and have them mail him the NOA2 (I-797C) as you will need a copy for Adjustment of Status once in the USA.

K-1 Fiance(e) Visa Process & ProceduresConcered About Establishing a Genuine Relationship

I have been reading threads about denials from Manila for lack of genuine relationship, and I ask advice on how to avoid pitfalls.

 

I have lots of photos of us together, phone records, Skype records, Yahoo Messenger records (we chat once or twice each day as our respective employment allows), visa stamps, boarding passes, etc.

 

But the big weak point is that we only met once in person.  There is a real reason for that, and that reason is my health.  I have cancer and simply cannot go there a second time.  The first time I went took such a toll on my health that I was in pain most of the time and in agony by the time I got back to New York.  I look fine in the photos because I just sucked it in and did what I had to do.  I explained all of that in the I-129(f) submission, including records from my oncologist documenting the miserable condition I was in when he examined me shorty after my return to New York.  I will supply Candy with those records for use in Manila, of course.

 

The second weak point is that this is my third I-129(f).  I submitted the application for the waiver of course.  Neither of the first two failures resulted in any sort of visa, nor were either one my fault, as my ex fiances broke both of them off..

 

Will they worry that I will not be able to support her because of the cancer?  I have plenty of income, several times the threshold for support, and a secure job that pays a fixed salary, so I dont lose money when I go for medical treatment.  I also have good medical insurance that pays for all this stuff.  My employer is willing to state in writing that my cancer is not threatening my job security.

 

What sort of questions can Candy expect as a result of these weak points?

 

When I was in the Philippines, we stayed at her parents' house, and they threw us a huge engagment party.  I mean huge, to the tune of 300 people and at a cost of over $1000.00  I thought about affidavits from her parents about the party and about how they witnessed the genuine love we have for each other.  Is this a good idea?  I figured the strong family oriented society of the Filipino people would give her parents good creditibilty; hence the value of the good word from them.  I have pictures of the party as well.

 

Any other advice?  I thank all of you in advance.

 

 

Biggest thing, and I do mean BIG, is that your fiancee knows you, all about you, and that when she is being interview she smiles, is self-assured and looks the CO in the eyes when she answers all the questions.

 

Many who go through this process in Manila have only met once, but the CO wants to know how well your fiancee really knows you.  They really want to know the relationship is genuine.

 

They may look at a sampling of chat logs, emails and phone records, but they are not going to "read a book" so just a sampling.  They will want to see pictures of you two together, and with family would be very good.

 

They may actually ask her about the past "K-1 adventures" you had, so it would be good for her to have the answers.

 

As for income (most recent tax return & W-2), as lone as your income meets or exceeds the I-864P requirements you are good to go.

 

Your medical records are not needed or required for the visa interview.  For that I would let sleeping dog lay.

 

I wouldn't be concerned with affidavits either.   The embassy wants to know that YOU and YOUR FIANCEE know each other... as a couple would know each other.

 

You not being there is not a big issue for the interview, truly not necessary with Manila.

Anyway, I've received my K-1 visa (yay!dancin5hr.gif ) and I have a few questions:

 

 

1. My visa expires on 19/May/2014.

 

So this means I HAVE to be in the US before/at 19/May/2014?

Do I need to get married before 19th May as well? I mean when does the 90-day-window come in at this point?

 

Correct me if I'm wrong, but typically a K-1 visa valids for 6 months, so lets say if I want to go to the US on the 2nd month after visa approval, so that means the remaining 4 months will be void and now I'll have 90 days to get married (based from I-94?)

 

So the same theory applies if I reach the US on the 5th month of the visa validity, I'd still get 90 days to get married?

 

I'm planning to move there on early April because I want to attend my sister's wedding end of March if time permits! So I'm trying to plan my trip carefully!

 

 

 

2. What is the difference between Visa Expiration Date and Petition Valid Date?

 

Petition is my I-129F and since I already have my K-1 visa in hand, should I be worried about this Petition Valid date? My petition valids until Jan 6, 2014 anyway.

 

 

 

I know I'm kinda answering to my own questions (lol), but it'd be super cool if you guys can correct me and educate me!

 

 

1)  Arrive before 19 May 2014.   Then you have 90 days to get married AFTER you arrive.

I won't be able to provide a letter from my employer. I will send a letter from my union hall showing my good standing for our work list and my position ( journeyman). I meet all the requirements. I have 4 yrs of tax transcripts. plus pay stubs from current year. Will this cause any problems?? Also. I just received my nvc case number over the phone and my packet is in route to embassy. Letter from employer is NOT required, it's optional, so don't bother with a letter from the union hall either. ;)

 

What is required is your most RECENT tax return & W-2 (tax transcripts are fine also), embassy does not want 4 years of returns, they will not look at the additional returns nor will they even take them.   Copies of pay stubs are fine (and optional)

 

You should be fine to schedule the interview now as long as you allow about 4 weeks between when the file shipped from NVC and the interview date.

Makes little difference who you use, but whichever way you send in the petition make sure signature required so you have evidence it was received, and of course tracking helps as well.

I've been reading the materials in the K-1 application guide carefully and found one more question that I can't quite resolve. When do we need to submit the 134 (i-134f) form, indicating that we either make enough money or (in our case) have a co-sponsor? Should this be sent in the first step, with the I-129f, or is it later, during my fiance's interview? 

 

Thanks in advance for your help! If there's a page already written about this process, I'd be happy to know, but i wasn't able to find it stated in the K-1 flowchart or the step-by-step guide.

Hi all

 

I tried posting this in the Asia: East and Pacific regional forum but didn't get any bites so, I'm trying here instead. I'm looking through the financial documents my fiance sent me for the I-134 and I'm not sure if we have enough. We've got:

 

For 2010-2012

 

 

1. W2s for 2010 and 2011, well above poverty guidelines

 

2. 3 different W2s for 2012 which add up to above poverty guidelines   - :thumbs:

 

We don't have his ITRs and it's too late to request them now. sad.png

 

For 2013

 

For income this year, it's a little trickier cos we don't even have any w2 forms yet and he's had three employers, one of which is fairly recent. We have:

 

3. copy of last paystub from job A showing gross earnings from january to end june 2013

 

4. copies of electronic bank statements showing some of the direct deposits (net income) from job B over july to september 2013

 

5. copy of the offer letter from his current job (job C) on business stationery stating the start date (21 oct 2013) and gross pay on a bi-weekly basis (does not say whether it's a temp/permanent position though)

 

6. copy of earnings statement for the first week of job C stating hourly rate and number of hours worked (40 hours that week)

 

no. 3-6 add up to *barely* above the poverty guidelines mostly because our proof for earnings in job B are lacking. any ideas if this is sufficient or if i should be worrying? he has a great job now and current income is just fine, but i'm also aware it's a new job and will carry less weight than a long-held position.

Most recent tax return and W-2(s) are required, that would be 2012 currently.   I am not sure about the Singapore embassy if they want to look at other years of tax returns (Manila only wants the one year.... 2012).  Follow the embassy instructions letter for Singapore.

 

Current pay stubs are fine as is a letter from his employer(s)

 

If his tax return shows he meets the poverty guidelines all is fine.

Hello everyone. I need your advice regarding this matter that made me confused. I don`t know what`s the best thing to do with it. My fiance (petitioner) was born in US with his blood father`s surname written in the birth certificate. His mom and blood father got divorced and she remarried again. My fiance is using his stepdad`s surname in all his school documents, drivers license and other legal papers. He was not legally adopted yet. He is waiting for his stepdad to adopt him but it didn`t happen. My fiance got married and divorced with his stepdad`s surname. He only have a certification that says he was named with his blood father`s surname and it changed to his stepdad`s surname when he grow up and go to school. This certification serves as a certified birth record to his new name but it was lost. We are going to send the forms for the petition but we are doubtful because we might have problems with  his names. He put his stepdad`s name in the FATHER at the G 325a. But he put his name with blood father`s surname at the OTHER NAMES USED. Are they gonna question the information? Do we need to send his birth certificate with his blood father`s surname? Do we need to write a supplement that explains why he got other names?  I hope someone could answer my case. Im really bothered with it. If only its easy to get a certified copy of his new name, but he said it will take long time. We are still in the petition process but we can`t move forward because the basic documents are very confusing. We dont know what to do. All answers and ideas are appreciated. Thank you so much!

 

All names used must be listed, that is a given.

 

What name is shown on his NSO birth certificate?  That is his legal name.

Do we need a total of two affidavit? If so, the name of my son should be written in question number 3 and the other will be my name? Thank you so much! Im really confused. sad.png

 

 

 

If your son is has his interview at a different embassy than you, he should have his own I-134.  I would say his name should be listed in # 3, and your name listed below (have to fix it to read fiancee ;) ) .  I would include a copy of your I-134 just to clarify things, but that is me.

We are wondering how long can we delay the process.  We received our NVC number Dec. 2 and letter.   About how long can from then could we expect to be able to delay?

 

I know the medical is good for a period of 6 months.

Up to a year.  Embassy will automatically extend the petition validity 4 months at a time up to a year.

 

Don't do the medical until you are close to ready to complete the visa application as the visa validity will be tied to the date of the medical.

Very nice...thought so but guess I'm just paranoid, thanks as always.

 

Her 4 yr old daughter doesn't have her passport yet and we want to schedule their interviews same day so they can go together for that and medical so we plan to fly her daughter to Manila this week (from CDO) to get her passport in 7 days for extra fee so they can pay visa fees at same time and we can schedule online their Embassy interview same date. Originally I hoped we could schedule fiancees interview now with MNL # and then daughters after she gets passport in about 1 1/2 week but don't think that would work. Getting excited, thanks so much Hank!!!

 

I agree, it's a good idea to be patient a little longer and both do the interviews together.   Very soon....

We have received our MNL # and I opened a PO Box here to ensure delivery of NOA2. I called USCIS and NVC and updated my address to the PO Box (only using PO box for K-1 paperwork).

 

1. On I-134 should I use the PO Box address or my house address (the one that caused NOA2 returned)?

 

2. When I called NVC to update address they did and said our petition left the NVC for Manila two days previous...Will this cause any issues?

You're fine to use your home address, the embassy isn't going to mail you anything.

I've searched the forum and believe I understand all of the steps I need to do to correct this but I just wanted to make sure I'm not missing anything. Today I received an email from USCIS stating the hard copy NOA2 was undeliverable and returned to post office:

 

On September 20, 2013, the post office returned the notice we last sent you on this case I129F PETITION FOR FIANCE(E) as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.

 

My fiancee in the Philippines has had issues received mail in the past and obviously it happened again here.  

 

I was thinking of updating her address to her Grandmother/Aunt's house since that's where I mail most of my fiancee's things due to problems with her address.

 

1. Will that cause any issues with K-1 process using that address?

2. When I call USCIS to update address should I tell them it's a relatives address or just tell them I need to update?

 

From my research I think what I need to do now is:

- Call USCIS to update address

- To be safe also update address online

- Call NVC to inform them of new address as well (I called them this week to see if they had received our petition yet and they had not)

 

3. Am I missing anything that needs to be done to correct this?

4. If I understand right this should not delay the process much since NOA2 hard copy is really only needed for AOS?

You really don't need to update the address for your fiancee in the Phils, the only mail the embassy sends never arrives for most... and you can do everything without it anyway.  Nothing else is mailed to the beneficiary.

 

After the interview 2GO will deliver the passport with visa to your fiancee but that is about it, and her home address should be just fine for that, as 2G0 will text and/or call when they delivery the package.

 

Only important address is yours in the States.   And you are correct the NOA2 isn't needed until AOS.

 

Everything for the visa application is done online for USEM.   Now to wait for your MNL #

Embassy will automatically extend the petition for up to a year, 4 months at a time.  Relax all will be fine. ;)

 

Things have really gotten backed up at the embassy because of the typhoon, those affected have been given priority for interview dates.

I was reviewing the G325a of my fiancee ( which I typed for her ) and I noticed that I type in the wrong date of her father's date of birth by one day and I forgot to add on her employment that she worked for six months at a local boutique.  She is scheduled to be interviewed on Feb. 2014.  My question is can we submit an updated G325a to reflect the DS 160 or wait during the interview and give the CO an amended G325a.  Thank you for any help or advice.

 

I would bring the updated G-325A to the interview, if the CO wants it they will add it to your file then.  The CO may just update the information in the computer.

My husband entered the US in September with his K1 Visa and he just had his EAD appointment today for his bio-metrics. We noticed his K1 expires in a month, does anyone know what we do if he doesn't receive his EAD before the K1 expires? 

 

As noted by others the K-1 visa expired the second POE was cleared, the I-94 is now the controlling document for status.  You have filed for AOS so relax all is fine.  :)

It seems this is a debatable question among many.

 

So I present, this.

 

Question : I-134, Question #11

 

1) Do you check one of the boxes? Intend / Do not intend

 

2) Do you leave both boxes unchecked?

 

3) What to do you write below the boxes? I have found the following:

 

N/A (K1 VISA PROCESS FOR PERMANENT RESIDENCE)

 

 

4) On the bottom of the form where it reads ".......adn the Food Stamp Act, as amended. ____________________

 

On that line, are you supposed to a) leave it blank, b) initial it, or c) sign your name there

 

Looking forward to your replies.

 

  This form was not designed with the K-1 visa in mind, more of a "make due" form.  Check either one (or none) that makes your day... really doesn't matter that much.   I put the - N/A K-1 visa in the space below.

 

As for the space I left that blank when I did mine, just make sure to sign and date it ;)  :lol:

we got our case number from nvc and now waiting for eligibility letter from USEM. trying to be ahead and complying with all requirements. i just want to knoe if i need the petitioners original copy of ITR, w2, and paystub? or a photocopy will suffice? please help

 

Do NOT wait for the eligibility letter from USEM... most NEVER get it.

As for most recent tax return, W-2, pay stub - copies for all, only the I-134 needed to be original.

It's been 4 months since NoA2 and it has expired. I have not scheduled my interview with consulate yet. What can i do? I know i can request an extension but how do i go about it? will my consulate care that its been 4 months since it was issued? have i lost all hope?

 

As far as I know, you have up to a year after NoA2 to gather your documents and complete the interview, but i don't know if it really has any meaning that it expired.

Contact the embassy to make sure they have extended your petition, if they haven't ask them to.  The embassy can extend a petition up to a year, four months at a time.

My fi is born in italy but his dad is a US citizen. His parents filed for a CRBA and since he is one year old, he lived in the US. Technically he is a US citizen by birth acquired through his dad. He is a holder of an American passport and is considered a US citizen since birth. So my question is, should he check no on the question no 13 on the I 129f asking if a certificate of citizenship is issued to him? Or should he put yes and put his CRBA details there?

 

Answer:  NO.  Your fiance is a born USC (not naturalized), he does not have a certificate of citizenship.

Hello all,

 

Is an employers letter required for supporting the I-134 when presenting during the interview. My gross is $ 100,000.00 so I am not worried about the amounts being close to the guidelines.

 

Here is what I sent:

1) I-134
2) 2 check stubs
3) efile documents with copy of 1040
4) IRS ACCOUNT transcript
5) IRS RETURN transcript
6) 3 years of Wester Union Transfers totalling over 45K




 

Should I send an Employers Letter as well?

 

If your income alone meets or exceeds the poverty guidelines then you don't need any other evidence.  In the embassy instructions letter it states MAY include regarding the employer letter and pay stubs - neither are required.

We used the new version of I-129f  and on the USCIS site there's an instruction on how to fill out the new form. Well it says that if your answer on any of the questions' N/A or "NOne" leave the space blank. We are about to send our packet today but confuse if we  leave  a lot of blanks!!!!My fiancee wants to follow the USCIS instruction .Now I'm worried because im reading in here that the number 1 rule in filling out forms is to never leave blanks!!!!Should we leave it blanks or put N/A to all the boxes that are not applicable ?

The instructions for the NEW I-129F form state to leave any question that does not apply BLANK.
