Well that's what I'm trying to figure out, if she needs to go back to the Philipines or not.  I'm still confused on the answers people are giving. 

 

OK.  Can she keeping working where she is working right up through the visa process or will they want to terminate her employment and have her return to the Philippines once they learn she starting the visa process?

 

If she can stay working where she is until it's time to fly to the USA then do the visa application there (not to be confused with the petition process you are about to start ;) ) in HK.

 

That is pretty much the key to where, along with what your fiancee may want.  She may want time to go back home to visit family, so processing there in Manila may be better....  you two have to figure that one out.  

 

But I would suggest you do so before filing the I-129F, that way you don't have to try and do a change of embassy in mid-stream.

When I start to file for the K-1 Visa, what does my Fiance have to do?  I don't quite understand what she needs to do.  She's from the Philippines, but she works at as a domestic helper in Hong Kong.  Does she need to go back to the Philippines once I start the Visa?  Or is all the work done on my end?

When filing the I-129F petition, you do MOST of the paperwork, you fiancee will need to complete the G-325A, a letter of intent to marry, and provide a 2X2 passport photo (white background)   See the GUIDES for the K-1 process.

 

Now for a question.  Does your fiancee plan to complete the actual visa application in Hong Kong or will she be flying back to the Philippines once the petition is approved?  I ask because if she is planning to stay in Hong Kong, list that address, if she plans to fly back to the Philippines list her address in the Philippines -   NVC will send the file to the embassy in whichever country you list for her address.

Hello everyone,

 

I have just a few questions relating to the financial aspect of the K-1 Visa.

 

* First off, in terms of the qualifying income, right now I am a single man working two jobs, but when my fiance and I apply for the Visa together I am not sure how they will count the size of family unit, either 1 or 2? Will they count it as just my single income which will need to be $11,490 or will they count is as a married couple which will then need to be $14,363?

 

** Secondly, when they count the qualifying income is it my yearly income after taxes or yearly income non taxed?

 

*** Thirdly, last year I only had income from a full calendar year at one of my jobs and had only started my other job for about three months so my income was a bit thrown off. This year I will have income for a full calendar year at both my jobs, how would i present this to whoever I need to turn my paperwork into? Do I show it throw a tax return form next time I pay taxes?

 

**** Fourthly, If I do not meet the income requirements could my parents "co-sign" or help me out if it comes to that situation?

 

***** Lastly, if I happen to change jobs, like quit one job and get a higher paying job, how will that effect the situation?

 

Your income must meet the I-864P poverty guidelines for two if there are no children, based on gross income.  

 

If you new job is not in your 2012 tax return the bring copies of the pay stub from the 2nd job and a letter from your employer.

 

Whether you can use a co-sponsor is embassy specific, some embassy are more willing than others to accept co-sponsors.

 

Switching jobs to get more pay, for sure you want an employer letter and copies of pay stubs from the new job.

Did you get an email or the actual letter?  If the letter it lists what is requested, provide that information and send it back to USCIS with the RFE letter (make a copy before sending it to USCIS). 

 

Once USCIS has the requested information it won't be too long before you get the final decision.

I have issue opening the I-129F with Chrome or Firefox but it opens fine with IE (10), if the page is blank it may just be slow loading up, even with my blazing speed (65 MB) here at home it was slightly slow opening.

Once your fiancee arrives here in the USA and you two are married (within 90 days) she will file for Adjustment of Status - this will get her a green card.  So, nope, no reason at all for her to leave, in fact it would be very bad if she did leave before getting her status adjusted.  ;)

hi guys, My fiance is just working for 2 years and 7 months as Registered Nurse , and we can only provide W2 and ITR for 2 years,though his salary is not below poverty line,   do you think it would be a problem?do the embassy really require 3 year W2, 3 year ITR? The embassy only requires the most recent tax return and W-2, which currently would be 2012.  USEM does not want 3 years of tax returns.

So my F is back in Manila now (he just came from Malay) and we are gathering all he necessary documents to include in the I-129F packet.

 

I asked him to get his birthcert and cenomar. He picked them up just this afternoon and he noticed on his bc, there is no first name!!

 

what is he going to do?! 

 

how could nso be so stupid?! his previous bc copies were fine and complete, but this new one... omg

 

his passport, cenomar, nbi clearance, etc are all fine with full first middle and last names except the most important of all.

 

any advice?

 

i told him to go to the main nso and get it fixed.

 

i really hope they don't charge him extra for their stupid careless mistake and i hope he doesn't need to have an attorney involved.

You don't need the beneficiaries birth certificate for filing the I-129F  (see the GUIDE at the top of this page), so you could start the petition process without issue.

 

But it is good to have caught the mistake on the NSO birth certificate, as you have time to get it corrected.  Going back to NSO is a good first step in correcting the issue, they may send your fiance back to the local registry but starting with NSO is best.    Good luck. :)

My fiance and I are about to schedule her interview.  The problem is that I just separated from the military and now I am in between jobs.  I am going to be starting school in January majoring in Engineering.  The reason why I got out is because I will make about the same as I did in the military by going to school and working part time because of the GI Bill.  I've been out of the military for only 2 weeks now and my fiance wants to put on the DS-160 that my occupation is military even though I am out.  I told her that's a bad idea because obviously that's lying and if we got caught then she would definitely get denied.  I told her to put my occupation as student and I will get my dad to be a co-sponsor for the I-134.  Anybody else think that's my best option or do I have a better one?  Any advice would be greatly appreciated.

 

Never lie!   Period.  It will come back to bite you in the butt.

 

Listing your occupation as student is better, waiting until you are actually a student then listing the GI Bill income and part time job income would be even better... along with your dad being a co-sponsor.

Not for me, this is for the guy I know Please suggest what to do!

 

His k1 just got approved last month. The girl has 2 kids but planning them FOLLOW-TO-JOIN later since his earning is not qualified for 4 household. His plan to bring his fiancee only. But here's the real problem that he is depressed about.

 

He is on SSDI and his earning last year 2012 doest not look promising. (TAX 2012 only $15K).

Although, his 2013 he said he is speculating to be making $20k.

He plans to delay the interview next year until he files the tax 2013 that way he can be qualified for poverty guidelines.

 

He is worried that he might not get approved because his last 2 years earnings were only around $15k.

 

Will this cause problem even tho his recent income 2013 is at least just above poverty guidelines for just his fiancee $20K.

 

What do you think guys?

Shall we go ahead and have interview now with 2012 income only $15k

or wait file 2013 tax (speculation earnings is at least $20k in 2013) first then continue the interview next year?

Personally if his income is at $20K now I would drag feet a few months before doing interview so he has his 2013 tax return showing the "acceptable" income.  The petition validity can be extended up to a year, simple call to the embassy.

 

As for a co-sponsor in Manila, if he goes that route it needs to be a relative for him to even stand a chance at it being accepted with the K-1, but still no guarantees.

 

The is no issue with his fiancee's children to follow later, it will not have an adverse affect on things.

No.  What you will do is process your visa application now and do nothing with your son until later when he is ready.  Only thing you need to watch is the timeline as he has to be issued his visa within a year of when your visa was issued, so his application has to be started with adequate time to complete everything within that year.

I'm just getting started and already can't get the most basic thing to work.  Hope it isn't a sign of things to come!  But I can't get the link to work from the page:

It just gives me a bunch of crazy symbols.  Can anyone help me find the right form?  I have one that is a pdf that appears to be the right one, but I want to make sure it's correct, as it isn't exactly the same as the example forms that I find here.  This one says it expires 6/30/2016 and is OMB no. 1615-0001.  If that helps.

I live in northern California if that makes a difference.

 

I'm assuming that address will be also used for the cover letter.

 

Looking and googling isn't coming up with the addresses for the service centers.

 

 

Use the dropbox address in Texas if you want to put an address on the LOI.  Don't worry too much about an address to USCIS, just so there is an original letter of intent from you and your fiancee.

So im just finalizing my I-129F papers and ive come to a halt regarding the dreaded None or N/A questions, after reading many posts about which is better and how they both have slightly different meanings, some say you shouldnt leave boxes blank at all. I then found some information on the instructions for the I-129F that i overlooked previously where it states;

 

''Answer all questions fully and accurately. if an item is not applicable or the answer is none, leave the space blank''

 

Straight from the USCIS form that expires in 2016, should i go with leaving the boxes blank as i am told to or do i fill the boxes to the best of my ability as a lot of VJ posters have stated to do so?

Follow the instructions for the I-129F, leave them BLANK.   This is a new I-129F form some may be answering from when they complete the old I-129F.

Yes I've actually miscalculated my gross income for this year, I would be over 125% so hopefully that is not an issue. My biggest concern is now when is the best time to reschedule my fiancee interview for? I don't want to schedule too early before I have a chance to file my taxes but also I want to avoid unnecessary delays. 

 

Also, I've been reading FAM and it sounds like COs are asked to be more suspicious of petitioner interest to marry the beneficiary if the interview date is far from the petition expiration. My petition already expired Oct 31 because we had to transfer it from Amman to Ankara which took long time to finish and I don't want to raise red flags by scheduling too late.

 

I am not sure how things for for your embassy.  Every embassy is different, I was posting to kryzkyle as he stated that the embassy in Manila uses 100%, which it actually doesn't, they want 125%.

you are evaluated for that income at the poverty level, not at 125 percent of the poverty level.

So, take your final LES statement, look at the biggest number there, and tell us if it's OVER the poverty level or no.


 

Being he is not in the military at the time of the interview do you think that is true?

My fiance's interview is scheduled for November 21.  I just recently separated from the military less than a month ago and right now I am in between jobs.  I am planning to go to school starting in January and during that time I will be working a part time job.  While I'm going to school I will also be collecting BAH (housing allowance) from the Post 9/11 G.I. Bill.  I'm really worried because our interview couldn't be at a worse time.  We can't wait any longer for the interview because the petition expires November 23.  My dad said he will be a joint sponsor but I heard that the Philippines does not accept joint sponsors for I-134.  What will happen if they deny her at the interview?  Will they give us another chance?  It really sucks because we have already been apart for more than 2 years.  If I fill out the I-134 I don't even know what to put for my employer because I don't have an employer right now.  But if I show them my last 12 bank statements it shows steady income from the military.  Has anyone ever heard of the consular in the Philippines accepting a joint sponsor for K-1 applicants?    

 

I-129F petition can be extended up to 1 year, so if you want to delay the interview you can.  Simple contact the embassy and ask for them to extend the petition validity... no issue.  They will extend it 4 months at a time up to the 1 years.

 

USEM can be difficult accepting a co-sponsor with the K-1, but when they want the co-sponsor to be a relative.  I know of a fair number of co-sponsors for the K-1 that have been accepted.  Your not having a job yet may be the biggest issue, even if you have a lower paying job would be a big plus.

 

- get the extension.  Take the extra time to get a job.

We do not have our interview date yet, but should know any day now. I am thinking it will either be in December or January. My question is, if it is in january or later, do I need to redo my I-134 and have to wait to file my 2013 Tax returns? That would cause quite a delay since employers do not even have to send out W-2s until January 31st. 

 

Nope you do not need to wait for the 2013 tax return.  You need the most recent tax return, even in January that is 2012 tax return.

shes currently working and we have a letter from her employer stating that shes a full time worker and earns 30k per year plus. commissions, I do not know how to compute if we are above the poverty guideline. ..

How much chat history do people seem to be sending with the I-129F packet? ive seen people post about printing off 800 pages of chat, i don't own any kind of industrial sized printer to handle that many printouts let alone USCIS bothering to read through all of that! ive also heard that it depends where the foreign fiance is from, ive currently filled up 5 pages of facebook chat messages, nothing important as such just general small talk that we started with in the beginning. im now moving onto skype history and as a mac user there is no easy way to copy and paste the entire history into a word file, im going to have to screen grab the majority of it so i could be spending the next couple of weeks just doing that! 

 

can anyone shed some light on this? how much did you send and what do you think the bare minimum would be to send in?

NONE.  The I-129F requires proof of having met in person within the past 2 years.... chat logs provide zero proof of this.

 

For the actual visa application at the embassy... later, you can do a small sampling of chat logs, a couple pages from each month.

Hi everyone!

 

So, our interview is next Tuesday and I am busy organising the relevant documents to bring with me. I just noticed that my fiancee didn't send me any of his tax information whatsoever, and the original I-129F contains no tax information either. He's sent me his pay stubs, letters from his bank regarding his accounts and deposits, letters relating to stocks he owns and a letter from his employer, but no tax transcripts. I am freaking out since he's applied for them online today and was informed that it takes 10-30 days to acquire. Are these required? Is there a chance of us being denied because I don't have them? 

 

Have him email you copies of his tax return.  Do NOT go by the instructions with the I-134, go by the embassy instructions letter - and I am betting that letter asks for the most recent tax return and W-2.   Copies are all that are needed so he can email them.

 

The tax transcript is only required If your fiancé self employed as far as I understand. It just helps to establish proof of his ability to support you. I think you are ok

 

For sure don't follow that when you do your interview at USEM as the most recent tax return and W-2 are REQUIRED.  Follow the embassy instructions letter.   And for you .... follow the flashing arrow below my post.

I am going to vist my fiancée in thailand and am bring my I-134 and supporting evidence, should I bring the original Noa2 or just a copy and leave original home?

 

 

NO!!!    You don't need a copy either.

 

But you will need the NOA2 after you are married to do Adjustment of Status.

 

Leave the NOA2 at home.

I realize I mixed up what co and joint sponsors are up there...I just wanted to know (if even possible for k-1) that one somehow looks better than the other if allowed. The other sponsor already makes about 10-11,000USD above the 125% limit as is so we are not short in that sense.

 

Using a co-sponsor with the K-1 depends a lot with what country as each embassy has different rules.  What country is your fiancée in that you are petitioning?    And also I don't see the value of waiting either.

 

As far as I know, for K1 Visas, they don't accept co-sponsors.  At least that's what happened to fiancé, and now husband.  The CO, refused to take any other persons income other than mine.  They said, it is the fiancé's responsibility to support their future spouse and not anybody else.  Therefore, providing a co-sponsor is useless because they will not even look at it.  Hope this helps. There is nothing disallowing a co-sponsor with the K-1 visa.  Whether a co-sponsor is allowed is more so tied to which embassy in what country.

Yes only the petition approved,never been on interview yet...I called the embassy already to let them know that I want to revoke it,but they told me,I can't do the revocation,just only the petitioner!!

 

 

Being you have not started the visa application.... do nothing.   You can email the embassy stating you will not pursue the K-1 visa then save that email for "evidence" one day down the road should you need to.

 

Easy way to save the email is to choose PRINT then CHOOSE  Microsoft XPS Document Writer, then save it as a file.

When my fiance shows the financial support information during her interview such as tax returns and pay stubs will the consulate make or keep the copies of them or just look them over and give them back? 

 

The embassy will keep anything you give them  Only give them copies of the tax return, W-2 and pay stubs.
