K-1 Fiance(e) Visa Process & ProceduresPolice clearance certificate

Hi everyone..i'm just a new member here and i dont know how where i start
Anyway im so stress about my problem to police clearance certificate.
I'm working here in kuwait 4 years now and i plan to go in philippines end of july
But im worry about the police certificate, my fiance and i we tried to email the us embassy kuwait how i get the
Police certificate form?or is it okay i don't get the police clearnce certificate in us embassy kuwait?
Just only in us embassy manila? I heard that a police certificate is one of the major requirements because
I stay here in kuwait.
Please help me or give me advice how i get the letter request to us embassy kuwait
For police clearance certificate..
Thank you

You are in a Catch-22.   (may have to look that up if you don't know what it is)

Kuwait won't give the police clearance for the US embassy without a letter from the embassy requesting it.  The embassy won't give you a letter there in Kuwait as you are not doing your visa there (I am gathering you are going back to the Phils for this) so no police clearance.  Is that about it?

The US embassy in Manila knows that Kuwait will not issue a police clearance through its consulate there in Manila, they only issue the police clearance in person.  BUT you can't get the letter from the US embassy in Kuwait...  yikes!

That is a catch-22.  laughing.gif

Now IF you are doing your visa process in Manila, relax, the US embassy knows you can't get a police clearance from Kuwait so they don't expect you to have it, all will be fine.

Gotta love the ways of government!

K-1 Fiance(e) Visa Process & ProceduresI134F question HELP!

The co sponsor is just a back up plan incase. But my fiance meets the required guidelines. I will use the I864 form, thanks. Do you think providing my diplomas and certification that I graduated with honors to support the educational background letter we will both sign would be helpful?

In your case I would provide as much information as possible from the petitioner because of being in college as previous years of ITR don't show adequate income.

Does anybody know how many paystubs are needed?

I suggest 4-6 (more the merrier) if that is possible as you are trying to establish income that can't be proved with a tax return yet.

If you are going to try getting a co-sponsor accepted at USEM with the K-1, use the I-864  (can't use the I-864ez, note the instructions for that form:

And everything Tahoma listed...

I didn't mean I don't want a helpful link, I meant I wanted some advice from someone who already knows before I got another link.

My fiancé said that the noa2 form was vague and she was confused on what the next step is. On the USCIS website it says "post decision activity" when we enter our case number. Is the next step to contact the NVC? Fais chier

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support question

Hi everyone,

I had a quick question about one of the lines of questions in the I-134

Question #11 has me choose.... I intend OR do not intend to make specific contributions to the support of the person(s) named in item 3.  If you intend, indicate exact nature and duration of the contributions

What does that mean in that how do i answer?

Background info... it will only be me and my fiance that will be living together

I didn't check either box, then in the space below I typed K-1 fiancee visa.

The I-134 isn't designed with the K-1 visa in mind.

K-1 Fiance(e) Visa Process & Procedures2013 Income Tax $2,450 (k1 & k1) Will it get approve?

She is worried cuz the ITR prior to that for 2012 was only $17k, and 2011 was only $15k.

Are they gonna look at the previous 2 years of his ITR?

Thanks Hank.

Being he has his 2013 ITR the embassy does not care about 2012 or 2011, the embassy ONLY wants to see the most recent tax return which you stated is for 2013 at $24,500 gross income.  DO NOT bring other years of tax returns to the interview, they are not asked for, nor wanted, per the embassy instructions letter.

K-1 Fiance(e) Visa Process & Procedures2013 Income Tax $2,450 (k1 & k1) Will it get approve?

I have a question. My friend is going to have an interview by March 2014.

Her petitioner earning for  2013 ITR showing $24,500. She has k2 to bring along with her.

The question: Do you think she will have a shot to get approve at the US Manila Embassy?

Thank you.

I-864P states $24,412 for three people, meet or exceed that and all is good.

K-1 Fiance(e) Visa Process & Procedureshow many paystubs?

How many paystubs are needed to be presented on the interview? Us manila embassy

None.  Pay stubs are not even asked for in the embassy instructions letter, that is not to say you can't bring a few if you want.  The embassy wants to see the most recent tax return (tax transcript) and W-2, if the income shown at least meets the poverty guidelines then all is good.

Most embassies look for 125%.   You will need be at 125% when it comes time for AOS anyway, which is shortly after marrying... don't meet the 125% requirement... NO green card.

K-1 Fiance(e) Visa Process & ProceduresI-134 affidavit of support question

Due to the fact that I put money (pre-tax through my main work) into my retirement account, the amount for line 22 is less than my gross income for my main job.  i also think my other job had already been factored into that.  So, the (combined) amount on line 22 is still less than my gross income from my main job.

Now, which amount should I put?  Still the amount on line 22?

Yup... so put both in huh

Take the gross income (box # 1 I believe) from both W-2, total them... use that number.

Hank_MalePhilippines2014-02-20 09:04:00
K-1 Fiance(e) Visa Process & ProceduresI-134 affidavit of support question

Hank,

I have two jobs.  My main job alone is more than enough to meet the poverty guideline.  The second job I have will def not meet the guideline.

Do I list both incomes combined or just the gross income of my main job?

Thanks for your awesome help!

Do you get a W-2 for both and list both incomes on your tax return?   ;)

K-1 Fiance(e) Visa Process & ProceduresI-134 affidavit of support question

Quick question... For the I-134 affidavit of support, where it asks, "I derive an annual income of $...." What should I put down?

Is it the total income I have thru wages

OR

Total income thru wages, minus money that goes into my retirement fund (403b)

Not exactly sure

Gross income as stated on your W-2.   Then the embassy wants a copy of your most recent tax return and W-2, if you income at least meets the poverty guidelines that is all that is required.

K-1 Fiance(e) Visa Process & ProceduresK1 Interview April 10 2014 I-134 Affidavit of Support form

Hello, I was wondering how recent the supporting documents  for the Affidavit of support have to be for this interview date? Within 90 days, 60 days, 30 days prior to the interview date? I will be going back to the Philippines so i can be there during the interview with my fiancee.

Information is based on your most recent tax return and W-2, that data doesn't really change no matter what day you enter it on the form. so 30-60-90 days... doesn't really matter too much.

(OK the 15th of April it could change ... ;) )

K-1 Fiance(e) Visa Process & ProceduresStarting K-1. Have a question

Hello

I have been reading up and everything makes sense. My future fiancé and I have been talking since we met 2 years ago. Now that my divorce is finally through the court hurdles it is time to bring her here. She is from Philippines but is working in Bahrain where we met. Question is once the application is accepted should she return to Philippines for the interviews or remain in Bahrain. Does it affect anything. There is a U.S embassy in Bahrain. Can't she do everything from there?

Yes you can use the embassy in Bahrain.  The only issue you may have is her employer, once they learn of her visa process might cancel her work contract and work visa forcing her to go back to the Philippines.  If the employer is cooperative then things should go smoothly.

Hank_MalePhilippines2014-02-20 09:16:00
K-1 Fiance(e) Visa Process & ProceduresHello, New to this K-1 visa need help. Thanks

Hello.

I'm Joseph and i was lucky to met a wonderful girl from Philippines, we are talking about marrying already so i decided to start looking on the process, we have not seen each other yet but I already bought my ticket for this April to go and see her. I'm a US Citizen since May 2012 never been arrested other than driving while driver license suspended back in 2006, no other records or crimes on file.

so my question is that when filling the F-129 i found this parts a little bit tricky.

1st :  Part 2, point 2a,b,c Her name is Mxxxxxxx Mxxxxxxxx P Rxxxxxxxx, she told me P is the initial for her middle name which is Pxxxxx even though Pxxxxx is her mother last name so i have it like this on the form

2a Family name   : Rxxxxxx

2b Given name    : Mxxxxxxx Mxxxxxxx

2c Middle name   : Pxxxxx

is it good like this or should i put both last names together then (the second) Mxxxxxx as middle name?

2nd : Part 4 City/Town/Vilage of Birth. she was born on  Xxxxx, San Andres, Catanduanes, Philippines. I believe Xxxxxx is like the town and San Andres is like the county and Catanduanes like the province, so how should i fill this part?

3rd : Part 34a Describe how you met.  So im guessing here ill put online first then i visit her and we met in person. am i right?

so far those are all my questions, Im sorry if someone has already ask something like this before and thank you for your help.

Ps as you may have notice my grammar is bad, sorry as english is not my first language.

(Personally sensitive information that can be used to identify the individual discussed has been either removed or hidden.  Please remember than anyone can read Visa Journey, not just members, so it is never a good idea to post information that can be used by abused or misused  by someone else. - VJ Moderation)

In the Philippines the mother's maiden name is always the middle name of the child (yes all the kids have the same middle name), if there is not a space for middle name then that name would be included with her GIVEN name, not family/surname.   Ask your fiancee how her name is listed on her BC

City/town of birth; what city/town does your fiancee tell you?   Have her look on her BC.

How did you meet, they want to know about your meeting in person.  Meeting in person within (before filing) the past two years is a requirement for filing.

K-1 Fiance(e) Visa Process & ProceduresPoint of Entry - What to expect?

We'll we finally have the tickets purchased.  I have two questions. Do the K-1 have to pay the immigration fee of $165 (ELIS)?  What instructions do she and I need to do at immigration once she arrives at the Point of Entry with her packet?

There is no ELIS fee for the K-1, that is an immigrant visa fee, K-1 is non-immigrant visa.

At POE she hand over her DO NOT OPEN envelope (she keeps the CD and DS-3025 she was given at St. Luke's), many times the have a special counter for doing this and most times there is a CBP agent at the front of the room that can guide her to the right place.   It depends on the airport whether you can both process through the USC counter, when my wife processed through POE they had a special counter, I went with her as well.

For the most part POE is very quick (once you get to the counter ;) )

K-1 Fiance(e) Visa Process & ProceduresQuestion #10 on form I-134

I am the petitioner, and this I-129F for my fiance is the very first and the only petition I have ever submitted to the USCIS. I have just sent Form I-134 to my fiance in the Philippines. When I was answering the form, I thought question #10 meant any previous visa petitions which I have submitted for someone else (other than my fiance), so I have put "None". Did I do the wrong thing?

His interview is already next week, so I am hoping this is okay...  =(

10. I have submitted a visa petition(s) to U.S. Citizenship and Immigration Services on behalf of the following person(s). If none, state "None".

Your replies are greatly appreciated. I am hoping someone who's already passed the interview in Manila and whose question #10 answer ("none") is the same as mine can assure me that this okay..? Thanks!

You are OK, don't worry about it.  USEM is more interested in seeing your tax return and W-2 as evidence of your income... relax you will be fine.

K-1 Fiance(e) Visa Process & ProceduresFiance's passport copy for the interview

Hi guys,

I have a question regarding documents to bring for the interview. Do I need to take a copy of my fiancee's passport to the interview? And what other document copies of hers do i need to take to the interview? The reason I ask is because I have a checklist of documents to bring to the interview but it doesn't mention whose documents these are supposed to be (I know they are mine but do I also need to include my fiance's too?)

Depends on what embassy you are processing the visa application through.  What country?

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding setting appointment for K-1 Visa petitioner

Hi, I hope anyone can help me with my problem / question. I received a letter on Jan. 27, 2014, stating the NVC will be forwarding my approved petition to the US Embassy of Manila, Philippines. Until now, my fiancé hasn't received any notice/letter from the consulate, so he went ahead and applied for the DS-160 and paid for the $240 visa fee. He tried calling for an appointment but there aren't any available slots for interview until april 2014. I don't know why they don't have available slots for K-1 petitioners, they told us to check online everyday, but it's no guarantee that we will find any available slots. We have only until May 8, 2014 to get married otherwise my approved petition will expire. I don't know what to do now...

First relax, the approved petition will be extended by the embassy for up to a year.  Second the approved petition has nothing to do with when you need to get married, that date will be determined by the date you clear immigration at POE... you will have 90 days from THAT date to be married.

As for available interview slots, April is where things are at unless someone cancels an earlier appointment and you are able to grab it.

Pop over to the Philippines forum to get assistance processing through Manila.

K-1 Fiance(e) Visa Process & ProceduresDeclaration of how you met

Hello

Newbie here.  The guideline mentioned that it should be a single typed page attachment regarding question '34.a' of the I-129F. Some people say to keep it simple but I have seen some have written ""lots and lots of details" (as quoted).  With that statement, I already imagined a couple of pages. So, what was your actual number of pages? Will the beneficiary write this one too? Thank you

You only need to write a brief description of how you two met IN PERSON, some fit that in the space provided, some write "see attachment" in that space and attach another piece of paper with a lengthy description.

Would you like to "enlighten" the group as to what "Consulates" that you know of and/or have had experience with that do not "accept [a] co-sponsor?"  I really have a problem with your post!

The Philippines is one of those embassies that do not readily accept co-sponsors with the K-1 visa. USEM is very unpredictable and difficult about accepting co-sponsoring with the K-1.

K-1 Fiance(e) Visa Process & ProceduresDoes The Intent To Marry Affidavit Have To Be Original Copy?

Hi Everyone!

My fiance and I just received and RFE because our lawyer did not include or inform us that we needed a statement of intent to marry  within 90 days of his entrance into the US. cray5ol.gif Needless to say, I do not trust a word that my lawyer tells me anymore.

So we both have to write and sign these affidavits of intent.  Does anyone know if this document has to be the original copy?  Or can my fiance just fax or scan/email me his signed letter?  I ask because I want to submit this as soon as possible and not wait for 3 weeks while his letter arrives, from the Ukraine, in the mail.

Any thoughts will be greatly appreciated and more trusted than my lawyer's opinions.

Thanks All!
