hi everyone! Can someone help me here....
My boyfriend only have his 2012 w2 and tax return but its only 6 thousand so we cant use it because its below poverty level.... But last 2013 he made almost 20+++ but we don't have his 2013 tax return yet.... We only have his Pay Lists that states how much did he earn on his regular job for 2013 and firecheck list since its his 2nd job.....

2nd, his dad is our co sponsor but he provide us us his affidavit of support, how much he had at the bank and 2012 tax return..... no employment letter or w2 or paystubs......

What should I do? Is this okay now or not really? please help!

Im thinking of canceling our petition coz the petitioner dont even give effort with our papers.... im so sad right now but i think thats the best I can do. im so stress out for months asking him for the papers but he dont listen to me..... i had enough with him....

he dont have tax return but he have a proof that he is making more than enough.....
Its a check history report. It shows that he made 20000+ $ on his regular job and 9000+ on his second job..... its shows his gross wages, federal tax, med tax, deductions, benefits and net wages.....

 

If you are not ready to cancel everything and give up, I would suggest you reschedule your interview for something in February (if you can), then your fiance will have his W-2 from his current employers (by the end of January at the latest) and he can file his tax return for 2013, then he can send you a copy of it along with his W-2.  Then you will be good to go and will not need a co-sponsor.

 

This can be an extremely stressful time...

I do not know if unemployment is considered means tested benefits.   Means tested benefits can not be used as income for sponsoring.

 

Doing a quick search I could not find a clear answer.   You may want to email/call the embassy on this one.

 

  Means-tested public benefit means either a Federal means-tested public benefit, which is any public benefit funded in whole or in part by funds provided by the Federal Government that the Federal agency administering the Federal funds has determined to be a Federal means-tested public benefit under the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, Public Law 104-193, or a State means-tested public benefit, which is any public benefit for which no Federal funds are provided that a State, State agency, or pol itical subdivision of a State has determined to be a means-tested public benefit. No benefit shall be considered to be a means-tested public benefit if it is a benefit described in sections 401(b), 411(b), 422(b) or 423(d) of Public Law 104-193.

Me and my boyfriend met online last March 2013 and meet 4 times in person. We went home twice and introduced him to my family and will be finally engage next month when he arrive. We applied for a K-1 visa and was already link to the check. Now we are waiting for the documents from USCIS and hopefully will start getting the  requirements needed and submit them. How long will the K-1 visa be approve? We are hoping that I can come with him back to States next month. Or maybe not?

 

Would you think the the sort of time we've known each other will affect the approval?

Were you displaced/affected by typhoon Yolanda?  If so you could request an expedite, otherwise you will have to be patient as the petition process can take months before approval of that so that things can progress to Manila and the actual visa applications.

for filling-out the DS-160 form, there's a question that says " TRAVELLING WITH"

 

and there's the portion that says K2...

 

my questions are:  1) i'll be travelling with my 4yr old baby girl ( me and my fiance's daughter/US citizen born abroad w/US passport) do i have to indicate her name since she'll           

                                   be travelling with me? Do I have to take her with me on my interview?

                          

                               2.) what about my 2 kids from my previous marriage, they will just follow within a year do I have to indicate them as travelling with me and explain to the interviewer

1) There is no issue with listing your USC daughter as traveling with you, after all she is traveling with you.  No you do NOT need to taker her to the interview.

 

2)  The K2, children from previous marriage, are not traveling with you you so NO you do not list them as traveling with you.

 

3)  YES you should list your children from your previous marriage where the info is asked for (Family Information: Children), but check NO for traveling with you as they will being following later.

The above website says that I must make $19,387 annually in order to file for my fiancee to come over here under my support. I do make this before taxes annually, but I make a bit less than this after taxes.

My question is: do they count your total annual earnings (gross salary) or do they look at how much you make after you pay your taxes?

My fiance received the NOA2 Approved Petition in the mail yesterday, it was quicker than expected so I am kinda overwhelmed right now.  He will start preparing the I-134 and I just have some concerns. He asked HR from his work regarding the statement and they said that they don't provide instead they gave him a website where he can print a sort of record of his employment and pay (I'm gonna have him tell me the details again). He works in a retail store like Home Depot. So what are we going to do? Just prepare a copy of his last income tax return? Do I need to ask him to prepare the previous years as well? (Because I've read somewhere that they ask that during the interview) Do I also need to bring copies of his pay stubs in the future for the interview? Thank you in advance for your replies.

 

Evidence of Income & Resources

A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details  regarding the account
1. Date account opened;
2. Total amount deposited for the past year; and
3. Present balance
B. Statement(s) from your employer on business stationery showing:
1. Date and nature of employment;
2. Salary paid; and
3. Whether the position is temporary or permanent.
C. If self-employed:
1. Copy of last income tax return filed; or
2. Report of commercial rating concern
D. List containing serial numbers and denominations of bonds and name of record owner(s)
 

 

 

Follow the embassy instructions letter for what is required, you only need to provide your most recent tax return and W-2, employer letter is optional an not required.  As long as the petitioner's income meets the I-864P 125% guidelines all is good.

Hello...I'm preparing to send the I-129F to bring my fiance here from Malaysia on a K1 visa.  I have quite a few photos and receipts proving our most recent meeting in September 2013.  I read here at this website that you print the photos on photo paper, label them and put them in a bag.  Is it acceptable to print several color photos on white printer paper and place a caption beneath each photo describing what it with the date?  Or, should I really print each photo at Walgreens and label on the back as described?  I could certainly organize them nicely using Microsoft Publisher if it is allowable to do as I described.

 

Also, do I staple documents together or paperclip them?

I printed pictures on bond paper, no issues.  I used a large black paper clip to hold everything together.

     OK , in 2010 i was living with my XGf and had one child,  We filed married joint on a tax return,  I live in Texas its a common law state.  I found out that the xgf was married still from previous marriage and had a previous drug problem and failed to tell me. We basically filed joint married to get more money back on the refund....Well 2013 is here , I have full custody of the child and filing a K1 for my fiancee in the Phils,  I am not legally married to the x and never had a civil wedding with her.  Well I am about to file my K-1 visa papers any day now,  but I'm worried that I will be flagged as married by the USA. They could ask me for divorce papers but , guess what , There are none , since we were never married just on that one tax return it says married. And you can have a legal marriage if your spouse is married to another guy at the same time. ALL of my w-2 say single, my last 2 tax returns (2011 - 2012) were all single head of household. 

 

I think I can fix this with a amendment maybe or maybe I have to hire a CPA to correct this mess but I am afraid this could stop or process dead in its tracks Im not sure ...Any one have any Ideas what to do ?

 

USEM is NOT going to care about your 2010 tax return... stop worrying.   USEM in their instructions letter for the K-1 state they want the most recent tax return and W-2, currently that would be 2012, very soon it will be 2013.   They do NOT want three years of tax returns, they will not accept three years of tax returns even if you tried to hand them to the CO.   You are fine.    Every heard the saying - let sleeping down lay?

 

Now filing as married in 2010 and not actually being married could be an IRS issue.  ;)

I (a US citizen by birth) am applying for a K1 visa for my fiance from Malaysia.  I plan on sending the application at the beginning of February 2014.  My fiance's daughter is getting married in Bali, Indonesia November 2014 and her son is graduating from college in Australia December 2014.  I have read that my fiance cannot leave the USA and return during the time she will be awaiting her green card unless she is granted "advance parole" by submitting the I-131 form  at the same time we apply for her green card.  If I understand the process and timing of the entire processes correctly, it looks like it takes about 5 months after you file the I-131 for advance parole before you are told yes or no.  Is this correct?

 

Here is what the timeline seems to me.  Please correct me if I am wrong:

  1. Feb 2014 send in I-129F
  2. Sept 2014 if we are lucky, she gets her interview at the embassy in Malaysia
  3. If granted the K1,(and I see no reason why she would be denied), she would probably come to the USA within one month, thus making her arrival be sometime in October.
  4. We marry within about 10 days of her arrival.
  5. We apply for green card and I-131 advanced parole immediately and we start the waiting for advance parole permission or denial.  Which I think takes 5 months or so?
  6. Daughter marries in Bali in November and son graduates in Australia in December..mother misses both wonderful events

Maybe I am misunderstanding the timeline on the I-131 application for advance parole.  Can anyone tell me?

 

I suppose the obvious answer would be to say delay sending your I-129F until September since it won't be processed for 8 months anyway -- then the daughter's wedding and son's graduation happen while we are awaiting I-129F processing.  I'm sure you all understand how much we want to be together and are not willing to postpone things any longer as we have been in love for 7 years and waiting for her youngest child to go off to college so we can be together without disruption to the youngest son's life and schooling.   He is now away at college and we don't want to wait any longer.  We are both getting too old.  ClockWatch2.gif

They say 3-4 months for AP, but my wife got hers within 2 months of filing.

 

Of course all of that is moot as you have yet to even file the petition.

 

Now what you could do is delay doing the visa application for a couple months so mom can attend both events. (you have up to a year to complete the visa application after the petition is approved)

No.  The petitioner's birth certificate is not part of the required documents for the K-1, his nationality was handled during the petition process at USCIS.

Hi all,

 

Since I have a very small family and my fiance has a large family, our plan is after she has her visa in hand we will get married in her native country the Philippines. Our plan is to have a ceremonial/religious wedding but not sign any documentation. This way her family can attend and 1 or 2 people from my family may attend. We will then fly home together and go to the court house for the legal marriage.

 

I've never been married before so are we allowed to do this in a church wedding? ie: exchange vows and so forth without signing documentation? I did mention this as part of the 34.a' of the I-129F question about our wedding plans, and I am sure she will be asked what our wedding plans are during the interview.

Should be no issue to do a "practice run" for the wedding there in the Phils, as long as there is no documentation.  If you fiancee is asked about wedding plans she can tell the truth - that you two are getting married at the court house.

 

The Catholic church is known for not doing this so keep that in mind.

We just received an RFE yesterday (checking on the USCIS website) and obviously we are very nervous. We really struggle to see what is missing and we even prepared our petition with a lawyer (but this is not a guarantee anyway).

Do you know if the USCIS can give us the content of the RFE over the phone before we receive the hard copy by mail? 

It is nerve-wracking to wait (I didn't sleep really well last night!). I hope it is not going to delay the process too much (pretty swift so far). We plan to get married in October.

Hi! i really need some advice for those who are in uae. I am a filipina working in dubai and I will be finishing my work contract this coming feb 17, 2014. I am for k1 visa interview in abu dhabi on feb 26, 2014. and planning to go home to philippines when i got my k1 visa. I was informed by my company that they will be cancelling my visa asap i finished my work. i am worried that they might not approve my fiance visa because I dont have a valid uae visa that time that i will be on interview. I also heard that there's a 1 month grace period that anyone can stay in a certatin country when visa is cancelled but im not sure if they will consider it..Does anybody here encountered the same issue as mine. help! thank you!

 

Your K-1 visa approval has nothing to do with your visa in dubai, like said though do over stay and have issues you don't need.

    this is my first time to post a query regarding a fiance visa sponsorship, my BF for 3 years is going to be an  American Citizen next week and we will be sending our pocket of 1-129F soon.

We follow the step by step for K-1 visa in this forum and it is very helpful for us, my question is,  do i need to include my previous marriage certificate and death certificate of my strange husband or can i just bring it on my interview?

 

Also do we need to wait for specific time after he is granted an American Citizenship? or we can file right away after his oath?

Don't need  the previous marriage certificate and death certificate from the beneficiary for the I-129F petition process, follow the GUIDE here for the I-129F process and you will be fine.  

 

Actually what will be required at the embassy for the interview is the NSO CENOMAR (CEMAR), did you file the death certificate with NSO so that your status is updated?  If not get that handled.

 

No limitation for filing, once your fiance is a citizen have fun!!

My fiancée (Filipina) and I (American) are in the midst of filling out the D-160 (an online form that a part of the k1-visa process). She has her passport which will expire in 3 months. According the one of the criteria, in order to complete the D-160 there are points in the form that ask for her passport information. The passport information must not be less than 6 months in terms of the expiration date. We are taking the necessary steps to renew her passport however; this process will cause a minimum of a 2 week delay in our objective to complete the D-160. Patience is definite a virtue during this journey and we really don?t mind waiting the two weeks. However, since my fiancée is from the Philippines and their government business process is not always a science what would be the ripple effect if we did not provide that information and proceeded process the DS-160 without acknowledging that she has a passport?

 

Wait until you have the new passport, don't be impatient.   It only take a hour or two to do the DS-160 .. no don't rush.

Hello fellow VJ's. My fiancé is worried about when we applied for our K-1 V, her youngest son is under 21 years old. But by the time of their interview he will have turned 21. I think we will be OK because he was under the age limit when we started the process. So he should be able to accompany her when she comes.  She thinks not, & he wont be able to get a green card when he comes to the US. Any one else have any issues with this? Any help would be great thanks. Also is the new interview fee now is $350.00 at Manila embay?

It means that you must provide a completed I-134 along with a copy of your most recent tax return and W-2 showing that you income meets the poverty guidelines of the I-864P for you, your fiancee and any others (if any).

My fiance's sealed k-1 envelope arrived damaged, its got small knick on the front of the envelope which is fine. However, on the side of the envelope it looks ripped half way open (see picture), will we need to send for a new one even though we weren't the ones that damaged it?

Contact the embassy they will instruct you how to handle this issue as it will need a new envelope.   Immigration at POE would not accept that.

Hi,

I have a fiancé living in Cebu Philippines. Iam waiting to send in the I-129 application. My problem is she lives way out in the country and actually has no real address or postal service. 10 years ago I went through this process and filed a K3 visa and at that time I knew it was very important to have an address so that once all the approved paperwork reached the Embassy they would be able to send her the paperwork telling her when her visa interview appt. was. Is this still how it works? or is it just all done on line now and she just checks to see when her appt. is. Also I keep hearing about this 2go service, is that a delivery service the Embassy now uses? and will they just try and deliver it to my fiancé or they will receive it at one of their offices and she will go get her interview paperwork. Im just afraid to send in the I-129 without a proper numerical address and they deny it. Any help would be greatly appreciated......Thanks

 

Address is not all that important now, everything is done online, you/your fiancee schedules the interview online so no issue there knowing when it is.  The embassy does not mail anything of importance to your fiancee.  The passport w/visa is delivered by 2GO but you can arrange for that to be picked up at a 2GO location when you are scheduling your interview online.

 

For the I-129F wanting an address I would do like was suggested use an address from another family member or very close friend.

K-1 Fiance(e) Visa Process & ProceduresHow long can my fiance postpone her interview before all our paperwork expires

We were notified by mail, from the embassy in Manila on the 27th of January (date I actually received it, but was sent on the 28th of Dec.) that my fiance could now book her interview. In the Philippines the recipient petitioner can select there interview date from whatever dates are avail. But, we have 2 problems preventing us from doing so at the present time.

 

My fiance got her annulment finalized (she thought she did, anyway) back in 2009, before we ever met.  We discovered that her annulment papers were actually not fully finalized, they still needed to be sent to NSO (National Statistics Office) to be signed and make completely legal and finalized, which her lawyer should have done back in 2009, but didn't for whatever reason. Back in March of 2013, she contacted her lawyer, and had her send in the papers to NSO. My fiance had a copy of the annulment papers, that would let us proceed to start the visa process, and the NSO signed papers wouldn't actually be needed til her interview. We were told it would take 5-6 months to get them back from NSO, so in Sept. of 2013, we submitted all the paperwork for her K-1 visa, figuring we would have the NSO papers long before we would actually need them, well almost a year later and we are still waiting for the NSO papers to be returned to her, and no way of getting any info from NSO as to how much longer its going to take them to process the papers.  About 6 weeks ago, her lawyer did receive something from NSO, stating that they wanted to verify that the Judge, and Clerical officer, were who they actually say the are, because they did sign the annulment papers. Seems as though there have been many counterfeit annulments coming from this area in recent months, and they currently want extra proof at NSO as to who signed the documents are actually a real judge and clerical officer. So I figured, no big deal, NSO could pick-up a phone and call the judge in his office and confirm it that way, but no,,, that would be far to easy, instead the want the Judge and the clerical secretary to go to another Judge and sign an affidavit stating they are who they say they are. I couldn't believe it when I heard it, but that's what they want for proof. My fiance's lawyer knows the Judge well, so he complied with NSO demands, although he that it was absurd also, but thats the Philippines. 

 

The other problem, which because of NSO being so slow, seems as though it will work itself out, just not the way we had hoped. My fiance needed to  have a major surgery, but we wanted to try and wait til she got to the US, but because of the NSO delay, her local Dr. said she should have the surgery ASAP, so we opted to have it done on the 27th. of January, in the Philippines. The surgery went fine, (thank God) and she is healing well, but wont be fully recovered for apx. 2 months or so, so seems as though this part will hopefully no longer be a part of the problem. 

 

So now, to my question. Does anyone know how long we can wait to do the interview before all our current paperwork will expire, and we would have to start the K-1 all over again.

 

One year from the date stated on the NOA2.  Embassy will automatically extend the petition validity, so you don't have to do anything.  But you do need to get the visa application done within that year.

K-1 Fiance(e) Visa Process & ProceduresK2 visa expired for my stepson due to a medical issue - What are my options

I petitioned my fiance under a K1 visa and her son as a K2.  It was approved and she came to America under her K1 visa, we got married, changed her status, and she received her green card.  Meanwhile, her son remained behind to finish college and we did his paperwork and everything was fine until it was time for his medical exam.  He failed his exam because he had a respiratory infection so he had to return once he was healthy.  Upon returning for his second medical exam, he passed just before his K2 visa expired (one year after his mother received her K1).  The problem is that the medical clinic in Manila required him to take third medical exam which he passed BUT it was beyond his one year limit.  We were told to email the embassy to ask for an interview date and give the reason for the delay.  I did so and now it is two months later and NOTHING.  We called the embassy but they do not take calls, just emails.  My stepson is now 19 so we are afraid that we will never hear from the embassy before he turns 21.  We would like to know what our options are.

 

Did you initially have an interview date scheduled with the embassy before the medical?

Proof of ongoing relationship ( emails, chat log, skype, photos etc.)

 

Here's our questions:

Do i need to enclose my fiancee's, Birth certificate and Cenomar in this pocket or she just have to bring them during the interview? she is single , never been married but have 1 daughter, she decided not to bring her daughter right away if she is able to come to USA, but we are going to declare her and we can file a petition later when she adjust her status in USA once we are married.

Its a very good thing to list the daughter on the I-129F for K2.  

 

Proof of ongoing relationship is not required for the I-129F petition process, what is required is proof of having met in person within the past 2 years.

 

No you do not need to include a BC or CENOMAR, those will be needed later.

Anyb?ody help please... My fiance and I appliead for K1 visa August 5, 2013. We got approved november and the approval will expire this month when we set for an interview date the available date that time was March. So my interview date is this March. Is this okay? Are we not gonna face any problem since my interview date exceeds to my approval date?

Oh sorry...our date of approval was August 5, 2013 so it will expire this month...sorry for the confusion...

 

Relax.  The embassy will automatically extend the petition validity up to a year, in 4 month increments.

K-1 Fiance(e) Visa Process & ProceduresPlanning to have a wedding party outside the US and interview questions?

I must say that this forum has helped ALOT in our visa journey. So here's our brief story and a few of our initial questions

 

I am a naturalized US citizen (born in Indonesia) and she is an Indonesian citizen who live and holds a permanent residency in Singapore. I am in the process of filing the I129F form. The plan is that after she's got her K1 visa, she'll come to the US, and we'll get our marriage certificate at the civil court, apply for green card and after she gets the greencard, we'll have our wedding party in Indonesia. The main reason is that we (both her & I) have a lot of family members in Indonesia. 

 

We've got a lot of our questions answered already. However, we still have a few remaining questions:

  1. After the I129 is approved, and she goes to an interview, if she is asked regarding wedding plan. Will it be harmful to say that we'll sign our marriage certificate in the US but have the wedding in Indonesia?
  2. Does she need to bring proofs that we have looked at wedding venues and ideas to the interview?
  3. Do I need to go to the interview with her (in Singapore)?

1) You will be married in the USA, can't get a marriage certificate without that ;)    The fancy "wedding" after you get your green card will actually be a renewing of vows, just a ceremony for family and friends.

 

2) Nope, if they ask just tell them your plan.

K-1 Fiance(e) Visa Process & ProceduresDenied entry on B1/B2 visa, will it affect K1 visa application?

I was denied entry into the US on my B1/B2 visa, the immigration officer said I didn't have enough documents to support my claim to stay for 1 month. My boyfriend (now fiance) wants to petition for a fiance visa. Will it affect my K1 visa application? Thanks guys!

K-1 Fiance(e) Visa Process & ProceduresNeed advice, still have USPHS Envelope

Fellow VJers, I need some advice. My Fiancee arrived in Florida this week (FINALLY!!!). When she gave me her paperwork I noticed that there was still a sealed brown envelope labled USPHS. She underwent the TB treatments in Manilla, so I figure its her records for the treatment.

 

My question is what to do with the envelope now? Do I send it in with her AOS paperwork or do I need to send it to USCIS now? I thought the POE in GUAM would have taken it from her.

Think about that for a second.  She is now illegally in the USA... and you want to know if she can apply for a visa while staying illegally in the USA.

Please do not reply with answers to hypothetical situations. I am providing all the information.
My woman came the the USA from the Philippines on a k1 visa. She did not marry the sponsor. Her k1 expired yesterday.
Now we have met, we want to get married. She is living with me in the USA. She will stay less than 6 months so she does not incur a 3 or 10 year ban. We want to apply for a new K1 visa. Can we do that while she is still in the USA? We know that she will have to return to the Philippines for the consular interview.

 

Her K-1 expired the second she cleared immigration at POE.  After that she was here on a I-94

 

The K-1 visa she entered with was to marry the person listed on that visa... no one else.  She needs to leave as she did not marry that person within the 90 day requirement.   She can not stay legally at this point.
