I am preparing everything to begin the K-1 process for my fiance, but I have a couple questions about the Affidavit of Support/Co-sponsor element:

 

I am going to be heading back to the states to go back to university and while I will get some part-time work once I arrive, I don't have anything lined up that will meet the 125% poverty line requirement. I also have some savings in a bank in America, but not enough to fulfill the requirement. 

 

Thus, I am going to ask my father to co-sponsor my fiance. He is a federal employee that makes almost 4 times the 125% poverty rate in annual income and has tax forms/pay stubs that reflect as much. However, his bank account doesn't show as much because money tends to leave the account shortly after it arrives to cover bills, mortgage, etc.  Is it necessary to show liquid assets on the the co-sponsor form? He also does not have any stocks/bonds or anything.

I am just curious somebody from the Philippines who already approved with K1 visa if they were really putting the barangay address. 

because the barangay address is not included of the questions on that address section. My barangay address has only 4 letters and that's the reason why it didnt fit. My first practiced of the form I didnt write my barangay and just answering what they ask (only house#, street name, city, province & country). But I keep on thinking about if it is okay, am not sure.

My bills like electricity and phone showed my barangay address, this adds my confusion. 

My address is look like this: 

Street Number and Name: 12345 San Nicholas Ave.  "Barangay: Apas (not part of the question of the form)"  City: Cebu City Province: Cebu Country: Philippines

 

 

 

Nope you don't need the Barangay info, just the street address, city, province and country.  We never used the Barangay in any forms.

Priority Date is the RECEIVED date on the NOA1, (it is not actually used with the K-1 but you can't complete the form without it.) you could almost make up a date but what the heck the actual date is right there on your NOA1.

If affidavit of support don't need to be send with I-129f, when are we going to send it? NO. :no: The I-134 is for the visa process in Manila later, after the petition is approved.

Yes, Yes, And Yes on all three.....I believe if nothing has changed since I filled back in 2010-2011 affidavit of support, copy of birth certificate, and copy of passport needs to be sent with the packet.

 

but to make sure do advance search on this site, and also I think here you can find a checklist for I-129F it will show you everything that's needed in packet.

To the community of VisaJourney.com, Hello to all of you! :) I just wanted to ask a few questions, here goes!

 

I have some questions regarding the Two-Year Rule of the K-1 Visa.

 

1. What do they mean "meeting up with the fiancee two years prior to filing the I-129F form"? Are they saying the couple should see each other two years BEFORE they file the petition?

 

2. My soon to be wife and I have been together for almost 2 and a half years, but have met each other only a couple of months back, she has already visited me TWICE in just a span of 4 months. Do you guys think that we are eligible for the I-129F petition?

I have another question, Hope you guys can share your ideas...

I am the beneficiary, so this is my question:

What are the documents needed as "beneficiary"  when my fiance going to file his application.

Does he needs my original Birth Certificate, Cenomar (Certificate of No Marriage), Passport Copy, NBI clearance/police clearance for his application?

I have friend who just been approved & already in the US, told me to prepare those documents that I mentioned above for the petioneer's application.

I am just wondering and curious if the US citizen (Petioneer) really need these documents during the first step.

My fiance is coming next month and let me fill-out the G-325A. So I'm thinking if he really needs my other documents I better get them earlier because it will takes time to release. And also for the police clearance there is an expiration date, so if it is not yet needed I rather not to process & wait till it's needed.

so I can save money and time.

As I read here, on assembling the package for I-129F, in beneficiary side, only fill-out the form G-325A and passport size photo.

And my understanding also while I'm reading the steps here on VJ, is I'm going to use those documents during interview.

 

But since I have doubts if im right or wrong, I decided to ask some helps from here so I can hear more ideas.

The BC, CENOMAR, passport, NBI (for travel abroad) and police clearance (from foreign country if you lived in another country for 6 months or more from age 16 and older) are are required during the visa process in Manila.

The I-134 has to be an original (send this UPS/FEDEX/DHL. Do NOT send USPS as it becomes PHILPOST and they are not known for delivering).  The tax return and W-2 can be copies (he can email these to you).

I know that a K-1 is for a 90 day visa...and yes once I'm there and married we are applying for an adjustment of status...HOWEVER...when my fiance comes up to Canada to get me...can I bring my things with me and not get stopped or declined at the border. Obviously I would have the Visa with me but is that enough?

Good day!

Just wanna ask  you guys about the supporting documents like the photo copy of passport stamps,

boarding pass, receipts, etc...

And about the photos together in the procedure stated that put them all  in one plastic and attach to the paper.

 

My question is that, Do we need to put Title/Header  to those attachments?

Do you handwrite the Title after photocopying or type the Title or what?

or  just only sign it and put the date after photocopying?

The bond paper that we are going to use to attach the plastic, Is it labeled or no need?

I am just wanna sure if I'm doing the right thing...So I really need your help guys.

There is no issue titling the pages if you want.  I know I just included the copies of the boarding passes and passport pages without any titles.  I did label the pictures together.

Hi guys this website is great, helped me alot about filing for a  K1 visa. I need your advice though, I'm in process of doing my K1 visa and my fiancee is from the Philippines. I'm about the file income tax for 2013 but the thing is I only worked for about 6 months because I recently graduated in the Philppines and just got back here in the U.S. My income is about 21k, I worked for at this one job (W2) where I made about 3k and then I took a delivery job where I made 18K, the delivery job is a 1099 so my income doesn't get taxed. Now concerning the K1, when I file my taxes should I not claim deductions so it will show my income over the poverty limit and pay about 2 to 3k in taxes or claim my deductions that will reduce my income to 8k thus paying only 300 in taxes and be below the povety line. Now I checked the forums and most people say The Philippines consulate will go on current sustainable income (I make about 1500 per 2 weeks so 3000 a month x 12 = 36000. Does this apply to subcontractors getting 1099? Do the consolate only look at gross income? What should I do about my income tax? I don't really want to use a cosponsor, is my income good enough? My employer said they can make me an employment letter showing my income and i will have a years worth of pay check stubs. What should I do. Thanks for your help.

 

(psst!  even with a 1099 your income gets taxed, they just didn't withhold any taxes)

 

As for your questions.  Income (GROSS INCOME) needs to (at least meet) the poverty guidelines of the I-864P for the number of people you support, for two people that is $19,662 so you should be fine.  So file your income tax, send a copy to your fiancee along with a copy of your W-2 & 1099 and original I-134.   There is no problem doing an employer letter and bring pay stubs.

Yes.  She can complete a new DS-160 then print out that confirmation page (toss the old one in the trash) and bring to the interview.

Ahh, well that not only sucks but is strange. You are supposed to be able to use income and/or assets to meet the requirements for an affidavit of support, especially when using the I-864 for a spousal visa as outlined in the I-864 instructions. I guess Manila just makes up their own rules. They are also reluctant to accept co-sponsors. Perhaps a combo of $100k in assets and a co-sponsor would work for them? Two negatives in their eyes could make a positive?

 

Friends of ours were processing the IR/CR-1 and tried to use cash assets and the embassy refused to look at the assets and insisted they get or co-sponsor if they want to be approved.

 

As for co-sponsors with the K-1 that is always a mystery in Manila.

You basically have two options if the embassy will not accept the assets with your K-1.

 

1)  Wait until you have a job that produces income to at least meet the 125% requirement.  You can delay the visa application up to a year, the embassy will automatically extend the validity of the petition for a year.

 

2)  If you have someone (that is not family) that would be a co-sponsor, then get married and start over with the IR/CR-1 visa, the embassy has to accept a co-sponsor, even if it is not family, with the IR/CR-1 visa.

 

You are still at the petition application stage of this process, you have time to make some decisions.

He lives off money his father left him when he died. Is that correct? You say money is not a problem. That sounds like there is plenty to live off of. So, perhaps he can use assets only when it comes time for the affidavit of support to be submitted at the K-1 visa interview. He would need 3 to 5 times the income amount needed. So, bare minimum of $60k, but $100k even better. Does he have that much in the bank or more? If so, he should be able to meet the financial requirements for the I-134.
 

 

Using assets to qualify with the K-1 in Manila is not a guarantee, most times they do NOT accept assets with the K-1 or the IR/CR-1.  I know of others where the embassy refused to accept their assets (cash in the bank) and required a co-sponsor.

 

I had made mention that if the money he has produces adequate return (can produce income to meet the 125% without touching principal) that maybe the embassy would look at that differently.

 

 

How much does he need to meet that 125% income? I have no idea..


Oh.. So he needs $100k to to acquire the 125% income? I think he could reach that..

Then a co-sponsor will be needed.  Obviously his father would be a great choice.

 

If you want to take the gamble out of the co-sponsor acceptance, get married in the Philippines and go the IR/CR-1 spousal visa route as the embassy HAS to accept a co-sponsor with that visa.

Hi! My lovely wife is here now, we are married and will be celebrating our 30 of being married two days from now....

 

i just sent her AOS out on 12/31 (Sheesh it's pricey isn't it?)

 

Next we want to start focusing on the K2 that needs done.  My wife has a daughter (I will be adopting her, she's not even 5 until Sept) still in the philippines that we still need to bring over, and she was declared on the K1, we were told we have 1 year to do so from my wife's via approval...

 

So far we our daughter *might get interviewed, will need medical tests...and that's it...that's all we know...

 

Is there a step by step K2 guide (when bringing the child later to the US) available somewhere?

 

My wife read somewhere that some organization (UCSIS?) needs to get the child's birth certificate at some point...and what papers must she have if they DO ask her for an interview...she will be going with her grandmother (again, she's not even 5 yet)

The process for the K2 is the same as what your wife did - with small variations; pay the visa fee at BPI, complete the medical, attend the interview - even thought it will be more like a "visual inspection" then an interview being she is only 5.  ;)

 

She will need the NSO BC, but won't need the NBI or NSO CENOMAR obviously .    She will need to be registered at CFO and get the sticker but does not have to attend the seminar.

 

Follow the embassy instructions letter as that covers the K1 and K2.

Hello, I sent in the application I-129F for my fiancé and her daughter. The amount I wrote the check out for was $340. My fiancé now says I should have wrote the amount out for $680 to pay for her daughter to.

 

How much should I have sent?

 

Our paperwork is in the process of being reviewed. If the amount is wrong should I call them or?

Fee is only $340 for the I-129F, as long as you listed her daughter on the form all is fine.

Mine is more complicated. I am exploiting the K1 so to speak. We stated in the i129F packet that we will marry in the USA, but we do not intend to file a change of status. We will be leaving the USA after the honeymoon. We have no plans to ever live in the USA. I am definitely an EX patriot.

The i129F is approved.

I have a job in Singapore. I make well over five times the poverty level. I have four credit cards (all zero balance), and more than enough in bank accounts in the USA to keep us fed and lodged during the visit.

What will they say?





 

Just curious, why are you even bothering to do the K-1 process?  You can get married right where you are, seems like a complete waste of time and money to do a K-1 just to get married inside the USA.

I would give it a week and then pay for the visa interview and then go online and schedule

an appointment. The reason I would wait is to make sure the embassy gets the paper work

before scheduling the appointment. After you schedule your appointment. you can then

get the medical exam and CFO done in the same week.

 

I would not wait at all to pay the visa fee and get things started, NVC does not mail out the notice letter until after the petition package has shipped to the embassy.  They only need to schedule the interview for some time in February and all should be good.

 

 

i just called uscis and they dont have any clue.  they said that in their computer that it is still at change alien registration number and they have no record of an approval so someone must have made a mistake and not entered it in their computer.  they said that its prob been approved and that i need to call the embassy in manila to verify if they recieved it since its already been sent out by the nvc.  I really dont understand how they could not even know if its been approved.  does anyone know how to contact the embassy in manila and when i should call them.  Im really nervous that they screwed it up and will be hard to get that i797 for her aos change. i really hope they can get this taken care of.  i know it wont hurt us now for the visa approval but worried it could really mess us up in aos if they dont get this right.  i have my fiance paying the visa fee today so we can schedule the interview and get that set up.

We got noa1 on oct 22 2013  and we waited and waited for noa2 and started to get really worried cause everyone else was being approved and not us.

I just got back from visiting my fiance in the phillipines and opened the mail and got a letter from nvc stating that they recieved my approved petition and forwarded it to the manila embassy and it has our mnl #   

can i ask are we good to go can we schedule our interview now and  what do i do about not recieving anything from the uscis.  on their website it states that the last thing they did was change alien registration number on oct 25th and shows no approval and we never recieved noa2 but i assume that i am approved and that they just never updated it and never sent me the noa2.  what should i do any advice would be greatly appreciated. 

 

Yes you are good to go to do the complete visa application process in Manila now that you have your MNL #.  (follow the flashing arrow below)

 

BUT.... you need to contact USCIS and ask them to send you a copy of the NOA2 as you are going to need that later when you go to file Adjustment of Status once you are married.

I know that for I-864 Affidavits of Support, the usual and required guidelines are for 125% of the Federal Poverty Guidelines. What I'm not yet clear on, however, is if that requirement and that information being asked is for *before-tax* earnings, or for *after-tax* earnings? 

 

 

You are only approaching the visa application phase at USEM, the I-134 is the form used at the embassy with the K-1.

 

As for income, it is GROSS income before taxes.

Hey I don't know if anyone has experienced this but unfortunately my Mom took a fall and I had to move back to Tampa from Miami and take care of her and during the process had to give up my job. Due to this fact I would like to have the interview in mid to late February but our expiration date for the interview is February 8th. I'm sure by mid February I'll have a new job but how do I request an extension on the February 8th date from the Consulate? If anyone could give me advice I would appreciate it.

You are correct she is already a USC, as long as she has her U.S. passport she is good to go. 

 

Don't forget BI for the exit clearance (tax) or waiver for your daughter.

 meaning, they will still have an interview like the K1 visa application procedure?  Is this some kind of a formality and that they have to be seen by the consul physically? but that this  mean chances are they will still be disapproved for a K2 Visa? :-(

please correct me if i'm wrong, this is what i understand: 

 

1.) i'll include my K2 on my DS-160 and indicate "to follow"  

 

That would be fine.

 

2.) before 1 year ends or the date of my K1 visa approved will expire they have to follow me to the state Per embassy instructions letter:

 

"Minor children who are identified and listed in the approved I-129F petition may follow-to-join their petitioned 
parent. However, such follow-to-join K2 visas can only be issued within one year from the time the parent 
was issued the K1 visa. After one (1) year, they will no longer be able to derive immigration benefits from the 
I-129F petition and you or your spouse will have to file an immediate relative or second preference petition for 
them to qualify again for immigration benefits. "
 

3.) example if they will follow me after 8mos. that's the time I will start the procedure as follows:      

 

After 8 months would be very good.    Read on page 4 of the embassy instructions letter.  The K2 must be ISSUED within one year, so you have to start the process early enough to complete the interview and get approved within that time frame.

4.) payment for K2 visa and get a schedule for them for interview

 

This must be done early enough so that an interview date can be schedule before the 1 year deadline needed for issuance

                                     

5.) schedule a medical for them a week before the interview and the rest will follow like the CFO...

 

Yes for the medical and interview.  CFO is dependent upon the age of the children, below a certain age they only need to be registered.

Embassy suggests to do the medical about 5-7 days before the interview, but for sure don't do it too far in advance as the visa validity is tied to date of the medical.

 

Interview again?  They won't have gone to their interview until the fee is paid and the appointment is scheduled.

 

Process for the K2 is the same as the K1.

Happy new year everyone.

 

Me and my fiance' are on the process of K1/K2 fiancee visa. I have 2 (two) kids (18yrs/14yrs) from my annulled marriage and won the custody.

 

My kids will just follow me to the states wihtin a year from the date of my visa (hopefully) approval...i  am about to pay for my k1 fiancee visa and schedule for an interview..

 

MY QUESTION  are: 1.)DO I NEED TO PAY FOR K2 visa also??????

                                   2.) DO I HAVE TO SEPARATE THE PAYMENT UPON PAYING TO THE AFFILIATED BANK OF US EMBASSY?

You only need to pay your visa fee at this time, you can pay for the kids later.  Each visa application has to have a separate fee, DO NOT make payment for multiple visa fees with one payment.

Please help, it is confusing... do i need to fill up DS260&DS261 or DS160 only for k1 visa?........ I've been reading a lot that i hav to do the DS160 since k1 is non-immigrant visa but my fiance(petitioner) keep telling me that it is Ds260&261 we need......... since we havent receive our package from embassy, we dont hav instruction letter... we alrdy got the mnl case number tho

Whatever you are talking about regarding children has nothing to do with the visa process.
