I guess I should have been more exacting.  It isn't scars in general on the arm, it is cutting scars.  My wife has a scar on her wrist from a surgery, the doctors do recognize the differences in scars.

Do you have any experience in taking medical exams(St. Luke's in manila) with cough and colds? I am planning to have my medical exam done this week, as my interview is coming this Oct 29. I don't want to delay it since my period would be due next week. I am not sure how my dry cough and colds will impact my medical exam results.

Nope having a cough and cold won't cause any issues.   TB is the most common issue and that is first scanned for with an x-ray, if there are concerns from with the x-ray then it is the sputum test (60 day process).  A cold with a cough will have not negative affect, if that is all it is.

hello we were approved today for our k-1 visa, my fiancé is from Philippines. I received the notice via mail I-797 notice of action letter, it stats in the letter that "we have been approved and this notice will be forwarded to the listed consulate" So my question is, there is no consulate listed on the notice? Where do I find this information for the consulate? Also does anyone know what the next step is?

I don't know of the United States being an exempted country, I would suggest contacting the embassy with this question as this is not a common situation for the Philippines.  (I just zinged the embassy an email... see how many weeks it take for me to hear back ;) )
 
If you do need to get a police clearance from the United States here is the info I found:

Hello, please correct me if I'm wrong or if there are more information I should know about it. Thanks in advance.

 

If I understand correctly, after a week of receiving my approval NOA2, I should contact the National Visa Center to confirm if they recieve my packet and then ask for my MNL case number? Should I wait for the NVC to contact me of what is needed before gathering all of the future requirement documents? I know that I need to get my I-134 form, another letter of intent marry, more evidence of on going relationships ready. However, I have no idea what need to be prepare next beside those that I listed. Should I get other stuffs ready before I recieve any letter from the NVC or the embassy? Also, will the interview has to be before the validation date? Please enlighten me. Thank you :)

 

It usually takes a couple weeks just for USCIS to get your case file to NVC, then maybe another 7-10 days for NVC to get the MNL#.   No harm in giving them a call, after all once you have the MNL # it is.....ROCK n ROLL time!!

For sure get the I-134 w/tax return and W-2 plus the Letter of Intent & other evidence on its way to the Phils.   

 

As for the validity of the petition, do worry on that, the embassy will automatically extend that up to a year.

Last sep/20 my finance got rfe by email. Sep/26 he got hard copy of rfe. Then sep/30 he signed and kept in mail box. The mail man came and got it. But we did not have tracking number..Until now we did not hear any update infos from uscis...
So now do you think he should ask post office to check where was doc or we will call uscis to request other rfe.

USCIS does not send RFE by email, they may send a notice but the actual RFE letter will arrive by mail.

No you do not need a lawyer, the process is simply completing a few forms and gathering a few documents (even if you paid a lawyer you would do this)

When you use assets, you need at least 3 times the income amount. So, you would need to show at the bare minimum, around $60,000, not only $19,662. The CO will have sole discretion on whether or not to accept it.

 

Not using assets themselves, his "income" is interest received from these assets.

 

And with the Philippines they want 5 times, IF they will accept assets at all... which normally USEM does not.

Long story short...

My ex fiance and I sent out the I129F package back in early February this year. About 8-10 days later, we received the NOA1. 

In March, he told me he received a letter in the mail.. an RFE, requesting for additional evidence of ongoing relationship. This is when he said we should quit, and broke up with me. 

Although being devastated, I had no choice but to agree with his decision. And we did not submit anything in response to the RFE. I thought our petition was deemed denied (of course).

I never doubted the existence of the RFE.. until I received the NOA2 in email in early August, and then the package from the US Consulate General stating how to follow through the process... 

 

Hence, I'd like to ask for those who are more experienced than me in this regard... has anyone experienced anything like this? 

Is there any way you could just receive and ignore an RFE, but still get a K1 approval? (what are the odds? ha...)

 

I understand either way, he must not have loved me enough and I do not intend to "save" this relationship anymore. Yet, it's a terrible feeling to not know the "truth". 

 

Someone handed you a bunch of BS about an RFE for evidence of an ongoing relationship - USCIS does not ask for ongoing relationship evidence, the requirement is having met in person within 2 years.  Ongoing relationship evidence is at the embassy phase of the visa process.

 

There never was an RFE is my gut feeling.

We filed an 129-f back in July. The VJ estimate was that we should anticipate our NOA-2 in mid-November or early December. However, this week I received an RFE and responded with the correct information within 24 hours.

My questions are:

1. Can this be seen as an indication that our petition has floated to the top and is now being processed?
2. Can this be seen as an indication that our other material has been deemed acceptable?

I know we are playing both a waiting and a guessing game. I'm just trying to gather your opinions to see if this RFE indicates we might get our NOA-2 soon, even though the VJ estimate added 30 days to our schedule due to the RFE.

Many people will disagree with me; however, I think visa journey should also be a place for advice that goes beyond the logistics of obtaining the visa and its procedures. The #1 cause of divorce is money. The situation with which you are presenting is a very difficult one. Borrowing a loan, of $75,000, is an enormous sum that should not be taken lightly, especially at your age. You are underestimating the financial burden it would cause on you, your family, and your spouse in the future. In a sense, maybe the marriage visa is your best option. For starters, the fees are cheaper than a fiance visa. From my estimation, the total cost not including transportation to and from the embassy on interview and lodging expenses, easily exceed $2,000 once the AOS status is complete -- meaning the receipt of the first green card. You need to take this into account as well. You could also use time. By going the marriage route, I believe you have about a year to find a job considering the length of the process, meaning earning income for yourself and your spouse. It doesn't have to be a lot, just something to help with the added costs. How far away are you from graduating? If you haven't lived with your spouse before, those will be added challenges as well. I suggest think things through and don't rush. If you are a couple years away from graduating maybe your parents money could be used to visit your fiance during the summer off periods and or Christamss. Once you graduate you can get a decent paying job and support a family without assistance.

 

If you possibly could not live without her, well go ahead and get her to the US as fast as you can and figure everything out later. Just be open about the challenges and don't put yourself in debt. Embrace that things will be difficult, and you will probably win half the battle. Let her know that it won't be easy so she is ready for the challenge as well.

for fiance visa, 1 year of tax return, could i use a previous tax return in which i was a waiter but no longer work there for several months? if i have get a job now and have income do i need to wait for tax return of next year or could i still just use previous job?

 

the money is from my parents so maybe i could just keep the amount and if they need anything i would help pay? im not intentionally trying to commit fraud thank you for bringing that up though.

Most RECENT tax return is required, which doesn't mean pick a year, currently 2013 is the most recent tax return, in a few months 2014 will be the most recent tax return.  

 

If you have a new job with adequate income and no tax return you will need a letter from your employer for sure, along with copies of pay stubs.  I would suggest a letter from you as well explaining your situation.

 

The money as an asset, even if it were your's would not be accepted by USEM, the interest on the money would be accepted as income.

 

I am not a pro on the spousal visa, but once married and in possession of the marriage certificate the CR-1 process is not much longer than the K-1 process (6 - 9 months most times).   For use NOT 7 years.... :lol:

Hello all. My question is about visas. I'm not sure whether to go along a with fiance visa or get married first ( last resort ) and then continue with marriage visa in order to bring my fiance from Philippines to US. I've gone to visit her this summer already and proposed to her so I know I'm eligible for fiance visa, but I'm not sure about the success rate if I continue with it. I'm currently unemployed but I plan on finding a part-time job while I'm taking courses at a community college. 
 
If I continue with fiance visa, I don't wish to go the tax return route to prove my financial abilities because I would need to work a year or so and receive [ multiple? ] tax returns as proof and that would take too long. I wish to ask for a joint-sponsorship from my older sister who is financially stable with a good job as a loan officer or ask parents for a loan to my account in order to meet what I believe is [ 75,000? ( I currently have 1/3 of this amount ) ] to be in my account currently in order to be considered financially stable if I don't have proof of an on going stable job? 
 
So my question is, is what I'm planning correct? Would I be allowed and be successful in applying and having financial proof by joint-sponsorship from older sis or have a current bank balance of 75,000 by asking a loan from parents? I'm ready to process fiance visa but i just need these answers first. Thank you for your time. 
 
Extra info, I am currently receiving medical health insurance and financial aid. How does that affect me if I am able to get enough assets? Do I need to stop receiving them by the time I need to proof my financial stability ( I probably will )?

 

 

#1 - USEM in Manila is difficult (as in next to impossible) regarding co-sponsors with the K-1 fiancee visa, whereas with the CR-1 spousal visa they have to accept a qualified co-sponsor.   Smartest way to proceed if using a co-sponsor is getting married and pursuing the CR-1 spousal visa.

 

USEM requires the most recent tax return and W-2 (NOT multiple years, just one year).

 

USEM does not readily accept assets, in fact I know of a number of situations where they refused to accept assets.   But if they were to accept assets they would want to see 5 times the shortage.  So DON'T count on using assets.

 

Borrowed money is NOT assets and to try to "pretend" a loan is assets is fraud.

 

You receiving financial aid and medical is not an issue...  You not having income is.

Yes it will be necessary to file for an IR/CR-1 spousal visa.   

 

Couple things you NEED to do before leaving the USA is do the Report Of Marriage with the consulate that represents the state you are living in.  Second thing that you need to do is Report of Birth for you son at the consulate (you will be glad you did this LATER)

I been in the states for 10months now waiting for my 2 years green card.We married here in California and our 5 month old son is born here. We plan to go back to Philippines within 3 weeks. If we decide to stay in the Philippines for couple years, would there be any problem with my coming back to the states since I don't have my green card.

 

10 Months in the States and you don't have your green card???   Have you started AOS?  On average it takes 4-6 months after filing AOS to receive the green card, if you filed you after getting married should have it by now.

 

If you do not have an AP or green card and EXIT the USA, you are not coming back without completing the visa process once more. 

 

If you have an AP card or green card and gone a year or more USCIS will consider them abandoned... and you will not come back in to the USA without completing the visa process.

Ongoing relationship evidence is NOT requested with the I-129F, what USCIS wants is evidence of having met in person within the past two years.   Passport stamps showing entering the Philippines, airfare ticket stubs, photos together, receipts from purchases while in the Phils.... those are needed.

 

Ongoing relationship evidence is later at the visa application in Manila.

I'm hoping that someone can give me some advice.  Yesterday my fiance had his interview at the U.S. interest section in Cuba.  Today, he received a voicemail message that he needs to go back to the Embassy on a specific date and time to make again the oath in front of the officer.  Any ideas as to why this maybe?  Will he have to undergo another interview?

No he won't do another interview.  The CO forgot to take his oath during the interview.  CO did that with my wife but caught his oops and called her back up to his window before we had left the embassy.

Hi guys, I've read lots of threads here and seen couple of timelines as well I noticed that noa1 is usually sent a week after sending the packet, ours was sent oct 7th and we still haven't received any notif if the packet was received but according to my fiancées tracking number it was delivered to Dallas lockbox 1 day after sending it. Is this normal? I'm already freaking out

Hi everyone! Im new here. :)  Hope you guys can help me with my concern. Just filed our papers today and keeping my fingerscrossed to hear good news soon. Anyways, Me and my fiance lived in Philippines and we filed k-1 visa to get married in the US, after we get married can we comeback to the Philippines or we need to stay in US until I'll be approved for permanent residency? Thank you . 

 

Once in the USA and married, you file AOS to get the conditional green card (good for 2 years), can travel outside the U.S. but can't be gone forever or USCIS will consider it to be abandoned and you will have to start over with the IR/CRI-1 visa.  There are limitations on how long you can be outside the U.S. for ROC which will get you the 10 year green card.  With the 10 year green card can still travel outside the U.S., (of course) and there are still restrictions on how long you can be gone before USCIS considers the green card abandoned ... again.  But there is a rainbow after 3 years of being an LPR, you can apply for citizenship, once that is completed you can stay outside the U.S. as long as you like and still be able to enter the U.S. at your whim.

One caveat to Hank's instructions some have been asked from the bank for their passport when making the payment. I suggest you bring it along in case it is needed. Otherwise, follow Hank's handy dandy guide and you will sail through the process with little or no problems. 

 

No caveat... no fish eggs either!   ;)

Manila Embassy:


NOW THAT YOU HAVE YOUR MNL #    (don't need to wait for the letter from the embassy )

(NOTE:  When getting NSO certified copies of your Birth Certificate get a few extra copies to bring with you to the United States (no less than two).  (You will need a birth certificate from time to time)

Once you have your MNL # :

You can pay your K visa application fee with cash or debit card at any Bank of Philippine Islands. Before going to the bank, you must print the applicable U.S. visa application deposit slip available below on this page. 

For K-1 the visa fee is $265

Take the printed deposit slip with you to pay your fee and PASSPORT to BPI.      (wording sucked, so I just "adjusted" it, but it has always said to bring the passport.)

The embassy will send out a letter? to the beneficial?

 

The embassy will not send anything out that is needed.  Most never receive the letter

 

There is a link to the embassy instructions letter in the guide I link to below.  Follow the flashing arrow, everything is there.

I have read many posts and it seems that the fiance in the Philippines are less likely to receive packet 3/4....I have also read Hank's guideline, but I just wanna make sure I understand correctly...Please correct me if I understand it wrong..

 

After I get my case number...

1. fill out form DS-160 - need a passport photo to upload....and print out receipt...this is the only form tat we have to fill

2. Pay visa fee of $265 at the Bank, but print a deposit slip before going there....i should save the bank receipt..need it for the interview.. - deposit slip can be obtained at http://ustraveldocs....paymentinfo.asp

3. after paying the fee...i can schedule an interview online at this website... https://cgifederal.secure.force.com/ - i should choose Immigrat visa instead of nonimmigrat visa - save 3 copies of confirmation

4. then on interview date...i just need to bring all of these?

 

  a. (DS-160) confirmation page

  b. passport

  c. birth certificate  NSO birth certificate

  d. NBI clearance

  e. evidence of engagement

  f.  certificate of no marriage record NSO CENOMAR

  g. evidence of support

  h. 3 visa photographs

  i.  medical examination SLEC delivers this

  f.  RECEIPT FROM PAYING THE VISA FEE AT BPI; ORIGINAL AND COPY. 

 

Am I on the right track? Please correct me or guide me if Im wrong. Thank you.

 

 

1) Yes the DS-160 is the only form needed for the interview.

 

2) Yes pay the visa fee at BPI, and yes you need a deposit slip, and yes keep the receipt safe, I suggest scanning and making copies also.

 

3)  Yes choose immigrant when scheduling.  Print 4 copies of the interview confirmation, SLEC increased their requirement (I just updated the guide to reflect same... sorry)

 

For the interview follow the EMBASSY INSTRUCTIONS LETTER, use it for your checklist.

yes, my son was listed on i-29f. can i call the USEM and set an appoint for my son? what  number to call if i base in US?
