Hi

I m trying to figure out how the K-1 Expiration date determined. Is it from the interview date, the medical date or the issue date of the visa? it will be good for 6 months or till the person sets foot in the US correct? Once they are in the US you have 90 days to get married correct?

 

Valid for 6 months from the date of the medical, must be in the USA before expiration.  After POE the I-94 is the form authorizing your valid status in the USA, which is good for 90 days from  POE.... the time frame for getting married.

Most people don't list the value of Personal Property - especially if their income exceeds the minimum requirement. For most, their most expensive Personal Property would be their car and it's not likely they would ever sell their car in order to provide for their household since that is usually how they would get to work. At any rate, he would have to have some sort of proof of its value.

You only need to list your income on the I-134 as long as your gross income meets the I-864P poverty guidelines.  Don't need to list assets or provide bank statements if income is adequate.

Oath or Affirmation, you can sign your name in there or leave it blank (doesn't really matter), for sure sign and date below. :thumbs:

You can do the process in Dubai if you want.  Use a mailing address in Dubai on page 2 of the I-129F as that is what NVC looks at for which embassy to forward the case file to later.

Yes, mis-spelled on both NOA1 and NOA2. USCIS is redoing them now.

 

NVC still doesn't have our file, thought it has almost been two weeks... I will call again tonight..

 

Glad you were able to get a hold of USCIS to get the NOAs redone, a copy of the NOA2 will be needed at AOS time would suck to have issues because of a mis-spelled name.

 

As for NVC it has been taking longer then the "past average" as of late, I keep expecting things to catch up as the Yolanda expedites thin out.

 

Once you get your MNL # you are good to go, I suggest you email NVC requesting the MNL # as well sometimes the letter is very slow in arriving, requirements and info in my link below this posting. (flashing arrow), then forward a copy of that email to your fiancee for using at SLEC if she can't get an interview date right away.

Thank you. I will call USCIS and NVC but I don't want to add any additional delay. It seems that the embassy can correct, so we are thinking that once the embassy has the file, we will have them correct, then contact USCIS to see if they can send out a revised NOA1 and NOA2 for AOS.
 


 

Was the name mis-spelled on the NOA1 as well?

 

You will need to get USCIS to correct the typo and issue a new NOA2 (or both if they screwed up both).  It won't slow down NVC or USEM at this point.

USCIS approved the petition (NOA2) on May 22, and I received the hard copy letter a few days ago.  We just noticed that they misspelled my finacee's name.  Her name is Jesica, but they spelled it Jessica.  We verified our I-129F has the correct spelling of her name. It seems that whoever entered it into the systems at USCIS mis-spelled it. The case has been sent to NVC but not sure if they have received it yet. I just checked and it seems they mis-spelled it on the NOA1 as well but we didn't catch it then :(

What do we do? Will this cause any problems? Can this be fixed by the Embassay instead of NVC?  We are terrified of further delays in our case (already had an RFE from USCIS) but now we are worried that this will cause problems at the end....

 

It is only the NOA2 that has the mis-spelled name?  I would suggest you need to contact USCIS and get a corrected NOA2 as you will need a copy of that NOA during AOS and the name should be spelled correctly in my opinion.  

 

If the name is correct in the file just keep an eye with NVC and USEM, as it may be only USCIS that can't read or type.  ;)

we are confused about this area because it lists our child as a Principal Applicant but it should be my fiance's name. as you can see on the image, she put a 2nd purpose and chose Fiance of US Citizen AND then she specified K2 for our child. and our daughter's name came up as the Principal Applicant. 

 

The principal applicant is my fiance not our daughter. My fiance did add our daughter below in the traveling with section and she's listed on the I-129F form. Please help and let us know what we need to do. Thanks.

 

 

There is only one purpose for travel, that is the K-1 fiancee visa, don't list a 2nd purpose as there is none.  There is another section in the DS-160 where the K2 will be listed as accompanying.

Hi. I would just like to inquire coz im wondering why in the CEAC website, my case number could not be found when i search it on the non immigrant status. Since im on K1, i believe its under non-imiigrant. However, when i tried the immigrant status inquiry, i can see that my status is still Ready and my K2(my son) is on AP since june 3. We are done with our interview last june 2. We were not told that we are denied nor approved. I was not given a 221g and our all documents were not returned to me. The consul ssaid they are just waiting for the medical result of my son since we were done just 3 days (including weekend) before our scheduled interview. And she said dont worry coz it will just be a couple of days. Is it ok if our case is found under the immigrant visa? And why is my case still READY but his is under AP? Thanks for your inputs.

 

Yes all K-1 are processed as an immigrant visa.  The embassy is waiting for the medical file for your son is why his status is AP.  Your case file will go to AP at some point as well, all cases are reviewed after the interview - that is AP.  It can still be a few weeks, maybe a little longer being the embassy is waiting for a medical file.   Relax.   :)

Okey my faince sent me his Tax  and most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2) via email. My question is should I need I-134 Affidavit of Support Form with original signature? He sent me tru email on my Gmail account.. Im so confused.

 

 

My interview will be on July 20. Hopefully!

 

The I-134 has to be an original, with original signature, best have him FEDEX/UPS/DHL that to you.  The income tax return and W-2 can be copies.

i am about to start the process to bring my filipina fiancee to the states.was going to hire an attorney til i got the $5,000 quote plus filing fees.good guides here gonna read an research an do it myself now.the U.S. embassy website is very straightfoward and step by step detailed,but still a few questions maybe someone here can help with.first.the filing fee for the petition is $340 an need i29f for both me an my fiancee is that $340 for each document or just $340 for filing and both hers and mine are included in the filing fee?second is the affidavit of support the embassy in manila requires one.the problem is i recently returned to the states after living in the philippines for 2 years.i have only been back and working 7 months an only 5 of those 7 months are on my taxes my w2 form.if i had been working a whole year i would be well over the poverty guidelines as it is on my 2013 taxws i am under them.should i get my company to write a letter saying my annual salary is xxxx amount and attach the letter to the aos.and a letter explaining the situation,would that work i just dont want any later greif coz of my tax statement for 2013

 

There is only one I-129F petition and that is for your fiancee, you are a USC and are thus don't need to get a visa to enter the USA ;)

 

The fee is $340 for the I-129F.

 

I strongly suggest for the petition process to follow the GUIDE  (look above in the blue bar for the link) here for the K-1 visa.

 

You will not be completing the I-134 until you reach the actual visa application, after USCIS approves the petition, so you have time to acquire more work history (and pay stubs) and in your case a letter from your employer will come in handy once you reach the visa process in Manila.

My fiance's passport expires November 2014. We are at the K-1 Visa stage and have received packet 3. She has appt to renew passport this month on 23. What happens if she gets interview prior to receiving new passport? We know it takes about 6 to 8 weeks to receive I believe. Any assistance in this matter will be greatly appreciated

 

I would think she couldn't do her interview without her passport.  I am not sure how quick the Philippines consulate in Singapore is, it took roughly 6 weeks for my wife to get her new passport through the consulate in LA.  She will have to give the consulate her old passport.

Hi everyone,

 

I am a full time student so my father is being our co-sponsor.  He files taxes jointly with my mother.  Although my father has more than sufficient income, i thought it might have more weight if my mother who also has sufficient income to qualify also signs.  However i'm confused as to how to do this.  Does my mother just sign fill out another I-134?  Or does she fill out the I-864A http://www.uscis.gov...form/I-864A.pdf.?   or will this all just confuse the immigration officer and it would be better if my dad just signs?

My wife's K-1 was issued April 2, 2013.  Date of entry into U.S.A. was April 12, 2013.  AOS was filed in August (still in initial review).  Her son's K-2 interview is scheduled for March 11.

 

I read that a K-2 child has 1 year from the date of issuance of my wife's K-1 to follow.  What does this mean?  That the child's K-2 must be issued by April 2 and then he has 6 months to enter U.S.A. or he has to arrive in U.S.A. by April 2?

 

You would think the language would be less vague so we don't have to guess what it actually means.  Thanks!

 

The K-2's visa has to be ISSUED within one year of the K-1 being issued.  Which means her son's visa has to be issued before April 2, 2014, issued happens after the interview.  The language on the embassy website is rather clear on this:

I am just starting to get everything together to apply for my fiances visa. I have read over a lot of guides and even paid $79.00 for another guide from some web site. (facepalm) Here are my questions!

 

1) The proof of relationship information... How should I put this information together to present it with the application? Should I organize it in a binder? Stick the papers in folders? Staple everything together? I have a few dozen pages of recipts from flights and hotels, about 50 pages printed of my inbox on yahoo mail showing over 1000 emails between my fiance and my self over the last 3 years. I also have lots pictures from March - May when I was in the Philippines last year.

 

2) I-134 and proof of my income... I made $26,000 in 2013 (Took 4 months off of work when I visted Philippines), I made $43,000 in 2012 and I made only $17,000 in 2011 because I was laid off of my job for half the year. If I send them 3 years of tax returns will the year I was laid off hurt me? Everyone says you should send in 3 years worth of tax returns so I thought i would ask. I changed jobs in January because I moved to a new city but I will probably make around $40,000 this year also.. 

 

3) It says I should send a copy of all pages of my passport... It seems the only important page is my ID page and my page that is stamped. What about all of the blank pages and the instruction pages. Sorry if the question seems dumb... I just want to be clear on this one.,

Are you talking of the I-129F petition process with USCIS (1st paperwork you file) or are you talking of the actual visa application in Manila?  I am not sure as part of your question is for the I-129F and part is for the embassy.

 

1)  Proof of (ongoing) relationship is for the visa application in Manila, proof of having met in person within the past two years is USCIS.. the GUIDE here on VJ is good for the I-129F process, for Manila click the link below this post.

 

2)  I-134 and supporting documents; USEM only requires the most recent tax return and W-2, NOT 3 years. 

 

3)  Copies of all pages of the passport is part of the I-129F process and is used to prove citizenship if you DO NOT have a copy of your birth certificate, and yes if you are sending a copy of your passport you must send all pages, even the blank ones (as instructed with the I-129F).  If you are using passport stamps to prove you were in the Philippines within the 2 year requirement you can send the BIO page and the stamped pages... along with your other evidence.

 

 

It would truly help if you updated your timeline.

I am beginning to assemble our i-129f package.  She is emailing her forms to me.  But the "Letter of intent to Marry" requires her signature.  What is a good, fast way to get it here?  Is there an acceptable way for her to send it to me electronically?  Snail mail from Kazakhstan can take weeks!  

 

The Letter of Intent and the G-325A both require original signatures.

I have couple questions. Please help me out.

 

1.Does NVC send all the documents to the embassy,which we sent to USCIS? We sent more than 10 affidavits from family and friends to USCIS with other papers. My fiance came to Japan for the interview, but he forgot to bring all the original affidavits with him and he did not make digital copies. Do you think NVC has sent all the documents to the embassy including the affidavits? Do you think affidavits will be a big part of our relationship poof?

 

2. We already sent a lot of photos to USCIS. Is it necessary to bring more photos to the interview? Should I put dates the back of the photos?  WHY?  You only need 2-6 at most.

Yes the complete petition is forwarded to the embassy.  But you still have to bring everything listed in the embassy instructions letter to the interview, even if you included it in the petition - two different events.  

 

USCIS wants evidence of meeting within the past two years.  Embassy wants evidence of ongoing relationship.   

 

Never DO-DO when do will DO.

Okay, let's say a a male sponsor, before ever meeting his fiancee, may have been sleeping with a married woman.  Let's also say that, even though it was over a year ago, as a response to a jealous husband strangely now sending threats of physical harm, the ordeal is made a little more visible via a court-ordered restraining order (protecting the sponsor from the angry husband--just in case).

 

Would this have any bearing in relation to Moral Turpitude?  Is this something both the beneficiary and the sponsor must meet?  

 

In short, could this affect the Interview for AOS for the fiancee obtaining a Green Card?

No, the only thing u need is the G-235A for both of you and both of you need a 2x2 inch passport style photo with a white background

My fiancee is a Philipino citizen and airline attendant who lives in Qatar. She has a tourist b1/b2 visa for the united states and a crew visa. When completing the G-325 A for the k-1 visa and completing the A number should i leave it blank for my fiancee? 

 

The A# is the Alien number, if your fiancee has one issued to her on her other visas then enter it (which I doubt).   But there is no issue leaving it blank at this time.

I used my nicknames on my emails like Jheng and Jing (on different email addresses) and that's how my fiance calls me.

 

I just wanna ask about the form G-325A "All Other Names Used question".

 

Do I need to write my nicknames on that question?

 

I am confused if I will write or not because it shows on my emails, 

but I didn't use those names on legal papers just my letters and my emails.

No names used doesn't refer to email names or even little nicknames between two people... if that were the case everyone would have to do an AKA for "honey, sweetie.. etc." ;)

K-1 Fiance(e) Visa Process & ProceduresVisa REFUSED... Again. Didn't even go thru AP/AR.

So, I got an email from my fiance's mother this morning saying that I need to call her husband ASAP.

 

I called and I couldn't understand why he was proposing to me that we (my son and I) need to go back home to the Philippines. So I called my fiance's mother and ask. Apparently, they got an email two days ago saying that the visa is refused again, and on the document, the one that is checked is, "You have not established an adequate financial blah blah blah", when I have sent a letter, and pay stubs from my second employer this time around. Included my mother and stepfather's I-864 and I-134, tax papers and pay stubs.

 

My question is, is it even possible for them to refuse the Visa without putting it on AP/AR? Because ever since we submitted more docs, I have been checking the status to see if it has been updated, and on the 15th, it was updated again to Refused, but I thought someone just touched it, not reviewed it.

 

What would be the possible reason why we keep getting refused, when there are others who are getting approved under SS, or no annual income and stuff like that?

Yes. We checked it. My uncle and cousin was listed on the I-134. She was just a joint sponsor (not even the primary), they live in LA and we're in ATL.

 

My mother makes, $45000+/year and my stepfather makes $41000+. On the I-864, she put herself, my stepdad, and my two siblings and of course, my boyfriend, 'cause that's pretty much all there is to it. My other brother lives with us, but is independent in terms of financially. Well, he barely lives with us.
 

 

It's not a "known fact" that USEM does not accept co-sponsors with the K-1 visa, it is known that USEM is very difficult with accepting co-sponsors with the K-1.   You have a variety of variables affecting things; your mom is already co-sponsoring two others (doesn't matter if it's co-sponsoring or sponsoring the liability is there), I don't remember if you are working or not, there are your kids.

 

How many are dependent on your mom (and yes being a co-sponsor is counted for the full meal deal)?  Step-dad doesn't count as he has his own income, then there are siblings (??) (mom is still supporting  two children? Or are you referring to you children - those are not siblings except to each other)

 

mom = 1, you = 1, two children = 2, cousin & uncle = 2, your fiance = 1  Total = 7     Income required $44,512   (mom is on the edge)

 

If you step-dad is the co-sponsor;  step-dad = 1, you = 1, your two children = 2, fiance = 1   Total = 5    Income required = $34,462   (step-dad is better)

 

Now with all that said, if you are not working that can be a big red flag to the CO ( I am only going off memory here), and may be part of the reasoning for not accepting your co-sponsor(s).  There is little you can do at this point regarding the K-1, the CO is sort of the all knowing and powerful OZ.... the CO rules.

 

You can go the CR-1 route and the embassy has to accept co-sponsors, but like has been mentioned already you need to verify the numbers for meeting the 125% guidelines also.

You may have to start over and go the CR-1 route, I know that sucks, but the options are slim to none to revive the K-1, and with the CR-1 they can't refuse a co-sponsor and at the moment your step-dad seems like the better choice.

Hello everyone!

 

I am preparing all my documents to file for the petition for fiance. 

 

Questions

 

1. Should we put the same date on the letter? or hers would be date earlier than mine? I am currently in Manila with her and be flying to California to file for the petition. Should it be close to the date that I will mail the forms?  Dates do not need to be the same

 

2. Is there an I-129F form that I can edit or does it have to be handwritten?  The form and instructions are online, simply need Adobe reader to complete on your computer.   http://www.uscis.gov/i-129f

 

3. I know I am supposed to use blank ink for handwritten documents, what about for signatures? I read somewhere to use blue pen.  Some say it matters, I used black ink for everything.

 

4. For photos, is it ok to copy like 5 photos in a word document and print it in color or do I have to print all the photos and glue it to a bond paper? We printed pictures on bond paper, no issue.  Don't need tons of photos 4-6 is more than enough.

My visa has my middle name in it. I am already in the US and went to file for my SSN but the guy there told me things were wrong because under given name in the visa it had both my first and middle names. It didn't even occur to me that it shouldn't have my first and middle name there.

I am scared I did something horribly wrong. Does anyone have any advice or any idea what I should do next.

 

Under GIVEN NAME it is supposed to have both your first and middle name, guy at SSA is an idiot.... nothing new there, they hire from the Forrest Gump school of "stupid is as stupid does"

For the Philippines the embassy looks for 125%.  

 

If your income meets or exceeds the 125% requirement of the I-864P you do not need to list other assets (i.e. personal property, other assets or bank statements).   You only need to provide your most recent tax return and W-2.  If your income does not meet the requirements look at getting a co-sponsor (which is still iffy with Manila)

 

 

you have to be at 100% of the proverty level to file k1 and 125% to adjust status

I was wondering what photo evidence needs to be included in the initial k1 visa application.

Do we only need to include photos from the past 2 years or from our whole relationship? I did not want to include too many photos, how many did you all send?

I dont want to make a mistake and make the application take longer than it needs to.

When going for the interview do i need to take more photos or only if they ask for them?

 

 

 

USCIS wants proof of you both meeting within the past two years... that's it.   So a few photos of you two taken within the past two years.

My fiance and I have planned to file a Fiance Visa (K1) this June 2014. So now we are reviewing the forms and starting to 

gather proofs of our relationship and our communicatons.

We started chatting September 2012 onwards...(we are over a year of chatting)

 

So my question is, What dates do I start to print-out for our proof of communications and how many pages needed?

Do I have to print-out 2 to 5 dates each month of conversation or more?

 

We are communicating at least 4 times a week (16 times a month).

For the I-129F all that is needed is proof of having met in person within the past two years.  Proof of an ongoing relationship is for later during the embassy interview.

Why were you denied?  You said your interview didn't go good and you were sent to FPU--what is FPU?

 

I will try to answer your questions from what I know and understand:

  • There would be no difference, and unless you correct why you were denied the first time it would probably happen again.
  • The average processing time according to USCIS is about 5 months.  I have heard many success stories here of it taking much shorter time, like 3 months or less.
  • Filing fiancé visa or spousal visa may not make a difference depending on the reason for your denial.  You need to fix that part first.

 

 

FPU = Fraud Prevention Unit.    Not a good place to go!

I last saw my fiance April 2012 and filed I-129F petition August 2013, Got approved Nov. 2013 and had my interview Feb. 20,2014. After my interview I was told that I need to submit additional documents. I sent it and received by the embassy March 7, 2014 so then my case status change into READY (case open) but since that day, It didn't update anymore.

 

My worry is that, the time that me and my fiance did not see each other for almost 2 years might cause my visa to be refused! I would really appreciate some opinions here and insight about my case. Thank you 

 

 

 

It is going to take a few weeks for the embassy to match up your documents with your file and review the application one more time... be patient.   There is no issue with it being almost 2 years since you have seen each other, the two year requirement is for the petition process (I-129F) - required to have met within the past two years, so there are no worries now.
