Hi VJ members, Im filling out this DS-160 form and also I have already looked up the example form but Im a little confused about a section. When you get to the "Family" section and it ask about the Fiance info which is me the petitioner, after that the next section is "Former Spouse". Is the section "Former Spouse" still talking about me the petitioner? Also the next section is "children" is that section also is for me the petitioner?

This form is from the beneficiary prospective; there are a few questions about the petitioner/fiance (you) but the FORMER SPOUSE question is directed to the beneficiary (not you, the petitioner),  Same for the CHILDREN section - beneficiary (NOT YOU).

 

Remember the BENEFICIARY is applying for the visa (NOT YOU), all questions relate to the beneficiary... yes they have a few questions wanting to know your name and address, but not much else.

Hello everyone!

 

I just wanna ask if it is necessary that you have been in a relationship for 2 years before you can file a fiance visa? Got confused because i kept on seeing in some post that "we should meet within 2 years of our relationship. What does  it mean? Me and my fiance has been in a relationship for 10 months now and he visited me already and stayed with me for 2 months. We decided to file the K-1 Visa because we wanted to be together as soon as possible. Are we qualified to file for K-1 Visa already?

 

Nope, no such requirement.  Requirement is having MET within the past two years, you could have met last week and filed today.

No,  they are asking for last address OUTSIDE the USA (this form seems biased toward a USC answering.. weird), for your fiancee I would say N/A for that question.  I just checked my wife's G325A and that is exactly what we did N/A for that question.

Let the CO know the child will be a follow-to-join. The child will not be listed on the I-134 because you are not yet sponsoring them. I-134 clearly states = Name of spouse and children accompanying or following to join.

Ok.  So my fiancee went to St. Lukes, passed her medical exam.  Her daughter was required for a sputum test.  This has thrown a wrench into our journey.  With the delay this will cause, she has elected to continue to the interview and have her K2 to follow...with the delay her K2 will be eligible for new medical exam next year..... I have paid for the K2 visa fee and medical......my questions are

 

1.)  Do i still list the K2 on the I-134F ?

2.) With other members experiencing a similar scenario, what steps will have to be taken to get her her in the U.S.

 

 

My fiancee will have her interview on June 5 ?????  Kind of a confusing process when something like this happens.....Thanks in advance

 

 

 

Yes you still list the daughter on the I-134, that line states = "... accompanying or following to join".

 

If after completing the sputum test no treatment is required the requirements for the daughter are almost the same as for your fiancee, follow the embassy instructions letter, depending on age of the daughter certain documents may not be required; CENOMAR, NBI.   If the sputum test is positive then 6 months of treatment is required, a new medical will be required after that.

Hi All

 

Question

 

My fiancée is flying out and has her visa and the (singular) medical packet. Her daughter is flying out in 2-3 months and has her K2 visa. Her Daughter K2 has no medical packet, it's all in one bundle.

 

 

I called the so helpful UStraveldocs but I just do not trust them.

 

I'm assuming the medial packet is submitted for AOS later on. But want to make sure her daughter when coming to the US will not have any issues with her K2.

 

Did they both interview together?

Did you guys make copies of everything before you sent it to USCIS and did you send those copies to your fiancé? Does the fiancé need the whole packet copied for the interview?

It is good to make a copy of the complete petition before submitting it.

 

As for sending a copy to your fiancee before the interview, not necessary, the embassy has the original petition from USCIS.

I have question regarding passport stamp. Is it needed to photocopy the Entry and Exit stamps as a proof of meeting in person?

Yes a copy of the BIO page and entry/exit stamps are good proof of having met in person, along with boarding passes and photos together.

 

You do not need to send a copy of every page of the passport unless you are using it to prove citizenship in lieu of a birth certificate.

No the embassy instructions letter does not state that.  It states employment letters and bank statement MAY be included ... may in essence means optional... if you have them then include them, if you don't have them - don't worry about it they are NOT required.

or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form

All depends on the Embassy someone is dealing with. The Egyptian Embassy wants employer letters from my jobs, I-134 notarized, W2's and 1040's. I printed deposits from my bank for the past year as well as copies of the 2 most recent checks, just in case.

 

That is very true, but that information was to the OP who is from the Philippines... and that is all that matters.

Misinformation was posted above.

 

Passport photos do not have to be originals. You can have them emailed to you and print them in out in the correct 2x2 inch size yourself. You can even use a service such as https://www.epassportphoto.com/

 

Plain paper is absolutely fine. No need for photo paper to be used.

This firm seemed to be easy to fill out but I do have a couple questions.

1. For parent area for city and country of residence what do you put if one is deceased? They were also divorced.

2. In the employment there is not much room to add company name and address . Do you go to next line or add a sheet ?

3. In the area where it states the firm is submitted in connection with. Do both of us mark other and note I-129 ?


Sorry if these are silly questions but it seems every sample form is done differently .

2)  I didn't bother with full address, I just put city and state.  I suppose you could use a second line for address.

When I filled out the biometrics form for my fiancée, I didn't list her jobs and just put she has lived at her parents house her whole life. We were just trying to keep it easy cuz she has only had 2 jobs one for 6 months and one for 3 months. She has no idea of the addresses or phone numbers. Now that we are filling out the DS160 it asks about her past employment, we don't want to lie. So if she does her research and can find out those addresses and phone numbers and we put them on the DS160 will it be a problem in her interview that there were no job listings on the Biometric page? Our package is on its way to the embassy in Manila and we are very excited and don't want any problems over something so simple. Do you think they will say anything?  Thank you very much for your help.......

 

 

Just enter the info in the DS-160, then at the interview if the CO asks (which I seriously doubt) simply state what you said here.  Your fiancee's employment is not a major deal, now the petitioner's employment is a different story ;)

First hand knowledge only?  So you only want someone who actually had torn/opened their DO NOT OPEN envelope and tried to turn it in at POE?

 

My wife was very careful with that DO NOT OPEN envelope, I was very careful with it as well because if it gets torn you must return it to the embassy to be re-sealed.

So alas, my fiancée is finally traveling to the US to be with me.  In old posts, travelers needed to have a sealed package of papers that were provided to them by the Consular interviewing officer, to be handed to the immigration official on entry to the US.  My fiancée was not given any direction to do so, but was simply handed back most of the papers she provided during the interview.  I know much of the processing is now automated, so does anyone know if the traveler is still required to hand a sealed packet of papers to the immigration officer on entry to the US?  Anyone who has traveled on a K1 visa in the last few months?

Those papers given back during the interview are not what will be turned in at POE.

 

When your fiancee receives her visa, it will be a large plastic bag, also in that plastic bag will be a large envelope marked DO NOT OPEN, that is what is turned it at POE... keep that envelope protected!  Keep it in your carry-on bag, and protect it!

That is the validity of the petition allowing for application of a visa, like mentioned already the embassy will automatically extend the validity up to a year, so don't stress about that.

Hello, my first post here.

I'm helping with a K-i/K-2 visa. It is approved and they are ready to pay the bank---PHILIPPINES..

The bank accepted the pre-print out registration form for the K-1, but said the K-2 fee is MRV$190.

When we look on the website, that amount MRV$190 is not listed for K-2.

So my question is, What form do they use  to get the correct registration receipt???

 

Fee is the same for both which is $240, you print out two deposit slips and pay two fees at BPI.   Not sure where you are getting the $190 amount but that is wrong.

My soon to be daughter in law will have her interview in Manila.
She is deaf--does not hear or speak, and has low verbal written English skills.
Does the embassy provide a FSL sign language interpreter ?
Her mother can interpret, but I was of the impression that no one is allowed with her forthe interview.
She also will have her 2 yr. old K-2 son with her.



 

I don't think there will be any issue with mom accompanying her daughter in this situation.  They have allowed others to accompany that provide assistance.

Hi Everyone,

 

Basically we're at the step where my fiance received her instructions form the Vietnam Consulate and now has to go online to fill out a DS 160.  She has a laptop and internet access, only issue is she's never owned a laptop before LOL.  She's very limited on her computer skills. she only knows how to really turn on the laptop and go to skype when we chat.

 

I've revied the online application and its way above her skills ability to complete accurately.  From just navigating the site to uploading the visa photo (required by vietnam).  Can I just fill out the application online for her? and then some the completed confirmation page to her via email to print? cause as far as I can see, the whole applciation is done online and she just has to print out the last page.  Please any help or insight would be greatly apprecaited.  We're so close but not sure what to do from this point.  Thank you.

Hello, my pay is less than the federal poverty guidelines. I live with my parents, so my parents supports me. I do have a job but its a low paying job. I or my family has never been on welfare or and public charge. How do i go about answering the federal guidelines. There are 4 people living in the household so the minimum is $23,550. I don't make that much per year. Will I be approved? How can i add my parents that they too can support my fiancee. Please help. Thanks.

 

Your dependents are only those listed on your tax return, not how many people are living under one roof.

 

For you and your fiancee it would be two and the income requirement is $19,662.  If you income does not meet the poverty guidelines you can try using a co-sponsor but the embassy does not always accept a co-sponsor with the K-1 visa, you may only have a 50/50 chance of being approved using a co-sponsor.

Your son has to be listed on the I-129F petition, once that is approved and you are ready to apply for the visa in Manila you do not have to complete the K2 application if you decide not to.  You will have one year from the issuance of your visa to complete the issuance of your son's visa if you want to use the original I-129F petition validity.  If you decide to wait 3 years then you will have to start the process with an I-130 immigration petition and visa.

One thing you should keep in mind, and something you should check into is that

it might require a letter from the father for your son to leave the country. I have a

friend here that had a son and she was getting to leave the country and found

out that they needed permission from the father in writing for the boy to leave the

country. So, they had to find the father, get his written permission and he was

allowed to leave. That was 10 years ago, I don't know if thats changed or not.

Mother has sole custody of the child unless there is a court document specifically stating otherwise.  Nothing is needed from the father.

If you already clicked submit (electronic signed)  and have the confirmation page, no you can not change that DS-160, but you can mention the oops to the CO during the interview and they can update it there, OR you can do a new DS-160 and bring the new confirmation page to the interview.

For some countries (Mostly UAE) you can only get a police clearance in person so the embassy waives that requirement.

NVC determines where your case file will be sent by the address that is listed on page two of the I-129F, NVC tends to not look at page five item 36a & 36b at all.   So what address is listed for you?  That will determine which embassy the case file will be forwarded to.

Yes we also submitted photos together, quite a lot of it. We added details at the back of the photos.

 

We have a sort of "love story" about how we met but it does not include a detailed story or timeline on our times together. So, we decided to create at least some sort of timeline for the details.

 

About the pastor, it is just an additional proof of the intention to marry, like part of the "wedding plans."

 

Ah... pastor letter is of no value then.   Doesn't have any value at the embassy either as it doesn't SHOW ongoing relationship let alone evidence of meeting in person... sort like including a checklist for planned oil changes on your car.

Has anybody gone through this?

We got an RFE by mail without any online case status update nor text an email notification. They are even asking for documents that we have already submitted like the ff:
1. Beneficiary's letter of intent to marry.
2. Evidence of meeting in person.

We submitted number 1 and submitted flight scheule, ticket receipt, boarding pass and passport stamped copy. We even submitted a letter signed buly the Pastor who would officiate our wedding.

Would anybody know what the problem is? Could this just be a mistake? We already called and talked to tier 2 rep and he was even surprised. Tild us to just write a letter and say that we have submitted everything and there is nothing to add to it. But, is this the right response as per experience? Anybody?

I would submit whatever was asked for, even if it is a repeat.

 

Did you submit pictures of the two of you together?  The pictures can be printed on regular bond paper, and yes it is secondary evidence but they do look for pictures.   Did you write a detailed letter of how you met in person?  If not do it now.

 

Not sure how a letter from your pastor is proof of having met in person, was he there in the Philippines when you two met?

Good day to all!

I just like to ask about I-129F, this form has 6 pages...Do I need to staple together the 6 pages or not?

and about the mobile phone...My fiance is from USA, he is asking if he is going to put the country code and area code...

No staples, just paper clips (big ones :)

 

Just need to put area code and phone number.

 

When you finally send the petition to USCIS use a delivery with signature required so you can track it easier.

Is it really possible that the petitioner received the NOA's? He got all my papers I thought they going to send me that here. All I have to do now is to wait my NVC letter. I am so surprised!!! I cannot wait to go to BPI to pay my Visa. Here is my Notice of Action 2. :joy:

Valid from 04/22/2014 to 08/21/2014

 

If you have your MNL # you are good to go!!

K-1 Fiance(e) Visa Process & ProceduresFiance Mailing Address

Hello Again,

 

I'm filling out the i-129f and it asks for my fiance's  mailing address.  She's in the Philippines (fyi) and she's not sure if she will actually get mail at her residence.  I'm planning on sending her a package to her work, can I use that address?  She lives and works in Quezon City, not too far from the US embassy in Manila.  She thinks I should use her mom's address in Cebu, but then its not where she lives and its serviced by the US Consulate in Cebu.  So do they want her physical address, an address for mail, or what address should I use?

The embassy does not mail anything of importance to the beneficiary, so if you wanted to use her mom's address in Cebu that is fine, the U.S. embassy is in Manila only with a small office in Cebu for assisting with a few things, but all interviews are done in Manila.

 

When it comes time for setting up delivery of the visa you will enter the address you want to use then, you can even arrange to pick it up at MOA which would be very easy for your fiancee to do.

K-1 Fiance(e) Visa Process & ProceduresStarting K-1 and have concerns

Hello Everyone,  I'm a new here and so I'm trying to read the guides and everything but right away I see a few things that worry me.

 

I have a Filipina fiance, she worked as a caregiver in Saudi Arabia for 7 years, basically as a slave, and had to run to the Philippines embassy to escape.  She needs police clearance from Saudi Arabia?  How if she's not there anymore?  When she ran away the family accused here of stealing but the Philippines embassy turned them away because she had nothing but the clothes on her back!

 

My next concern is the i-134 form.  I'm severely physically disabled (basically a quadriplegic) and I only work part-time as a community college professor making about $30k annually with no assets, is that enough?

Saudi Arabia is one of the countries the embassy waives that requirement. So relax, no worries.

 

Your gross income needs to meed the requirements of the I-864P poverty guidelines for the number of people you are supporting, for two people that is currently $19,662.   You should be fine there as well.

Hi

I m trying to figure out how the K-1 Expiration date determined. Is it from the interview date, the medical date or the issue date of the visa? it will be good for 6 months or till the person sets foot in the US correct? Once they are in the US you have 90 days to get married correct?

 

Valid for 6 months from the date of the medical, must be in the USA before expiration.  After POE the I-94 is the form authorizing your valid status in the USA, which is good for 90 days from  POE.... the time frame for getting married.
