Being your timeline is blank I have to ask - where are you in this process, just starting the I-129F petition?

 

It is fine if you complete the forms and forward them to your fiance.  But if you are just starting the I-129F petition process the evidence you need is of having met in person within the past 2 years - passport stamps, boarding passes from the airlines, pictures of the two of you together.  (not chat logs or screenshots... that is for later at the embassy)

I am a newcomer to this website. Am glad that my cousin's hubby had recommended this to me because l find it very helpful and interesting to read all those posts especially the K-1 Fiancee Visa. My boyfriend and l first met in person last January. He visited me for 3 weeks. And he plan to come again in August for our second meeting. Just a month ago, he told me about his plan in August to submit his petition by September when he get back to the States, God willing. We already started preparing our paperwork by downloading the forms and etc. And we will just have to finalized everything once he's here in August. Regarding the DS-160 sample form that l saw here l got worried when l read, "Has anyone filed an immigrant petition on behalf of you"? Because my mother filed an immigrant petition way back in 2007 and still pending. I wasn't able to go with her because l was already overage then, that's why when she got to the States she petitioned us thru the F2B family based immigrant. I'm feeling anxious if it would affect in getting my K-1 fiancee visa. What do you think guys? Please help!!! :-(

I'm trying to figure out the length of time before the medical examination/ K1 Visa expires. I have found seemingly contradictory statements on the DOS website, I can not find any information regarding a 'length of time' for the medical exam and there is nothing to indicate expiration on the medical exam paperwork. On the DOS website is this:

 

"An immigrant visa is usually valid for up to six months from the date of issuance unless your medical examination validity expires sooner, which may make your visa valid for less than six months. You must arrive and apply for admission in the United States before the visa Expiration Date."

You have the facts.   Both your references are basically saying the same thing.  One spells it out regarding the medical, the other uses the word maximum... which means it can be no more than, but could be less.

 

Reality is the visa validity day is printed on the visa itself.   So you only need to look at it to know.

1. I just moved back to the US and been working since March. I used to live in Manila and was earning in Philippine Peso. For 2013 I did not meet income requirements. With my job now, I make above the income required. Will this be an issue? They do not allow co-sponsors in the Philippines.

 

2. Do I put a 0.00 for deposit on savings bank, personal property, stocks and bonds... or do I put N/A? I believe I don't have to provide savings bank info if I meet the income requirements right?

 

3. For #8 on the Affidavit of Support, Do I put my fiance's name and her daughter? Or does this mean if I have other dependents? 

 

4. Do you have a sample of the second Letter of Intent to Marry letter? The first one was addressed to USCIS... how about the second letter? 

 

The embassy in Manila wants to see your tax return and a W-2, not having those makes things difficult, in you case I would for sure get a letter from your employer stating your gross yearly income, that you are a full time employee and such, plus include pay stubs.  I would also suggest you write a letter explaining that you had been living in the Philippines before which is why the tax return issues for 2013.

 

As for co-sponsors, the embassy is 50/50 on accepting them; they will only consider a co-sponsor that is immediate family, so it won't hurt to include a co-sponsor.  (there is info in my link from others that have been approved with a co-sponsor)

 

You can leave the info on savings, personal property, stock and bonds blank if you have no assets to list (most times the embassy will not even consider assets)

 

USEM has not been asking for a or taking Letters of Intent to Marry for years now, but if you want to include one (just in case) simply copy the one you used for USCIS, don't need an address on it.

My K-1 petition was approved and should be on it's way to the National Visa Center.  I have been a temporary employee for two years and haven't been able to find permanent employment.  Last year I made well over what is required for a fiance' visa and this year I will as well.  I'm just wondering how critical this is?  

 

Has anyone on here had their visa rejected due to temporary employment?

 

USEM uses your gross income on your tax return (they require your most recent tax return and  W-2), they don't know temporary from permanent.  If you income meets the poverty guidelines for the I-864P you have no issues.

For USEM in Manila - NO!   Bank statements are not required nor asked for by the embassy.  USEM only requires your most recent tax return and W-2 (or tax transcript).

 

If you gross income meets the poverty guidelines of the I-864P then you are fine.

Some said, I should use the A4 size (8.27 inches x 11.69 inches)

Hello so I received the NOA2 in the mail today.

 

So far my fiance' has the copy of the i129f packet. I just need to make her copies of the RFE I had to send in and the paperwork in the response.

 

I also have the fiance letter of continued support.

 

For the I134 and other paperworks I have my LES's since December. I have my 2012 and 2013 W2's. I have my 2012 and 2013 1040s. I have annual statements of TSP (retirement) for 2012 and 2013 and for the first quarter of this year 2014. I have a proof of service letter. I will be getting a letter with my employer soon.

 

So my main question is since I am the Military and I do make the 100% cutoff. Do I need to provide Bank officer statement of opening the account, past 12 month deposits and current balance?

 

If not, then should I answer the part on question number 7 on the i134 where it ask my deposit in my savings bank account? I do not want to get RFE if I write something in that blank but do not provide the bank letter. (I do make over 100%)


Also I will already add that I will be making a copy of the NOA2 also and she will provide the information since the petition was filed about our ongoing relationship.


 

It depends on the embassy, what embassy are you processing through?

 

The I-134 is a generic form, the requirements and instructions stated on it do not necessarily relate to what the embassy requires.

 

For Manila... NO you do not need bank statements or any asset information, USEM requires your most recent tax return and W-2.

 

I would suggest reading the embassy instructions letter for the country you are processing through as it will list what the embassy requires for "Evidence of Support"

my fiance has called the 1800 hotline for USCIS 3 times this month once every week to ask where would she file my form and each time she called she got 3 different answers from each phone call. at 1st they told her she had to file it in Oakland, CA, the 2nd time they said SF, CA and the 3rd time they told her Phoenix, AZ. She even asked why it keeps changing and the lady told her that that's the information that she's pulling up. So right now she's confused on where to file it. Please help.....Thanks in advance.

Being you are talking fiancee it is the I-129F form that you use.

 

The address for filing the I-129F is on the website itself, as stated in the I-129F instructions sheet.  There are only two choices for address, which one depends on how you send in your petition.

Hello everyone,

 

My name is Ruben and my journey started on February 14th, when I sent the I-129F. It only took about a week for me to receive the first NOA in the mail; this made my fiancee and I very excited because the ball was finally rolling. After receiving the first NOA, we were looking at about 5 months for processing, which was great because she needed to stay and help her parents rebuild the family business, which was affected by the Typhoon in Tacloban; however, the second NOA arrived about three weeks after the first one. In normal circumstances, this would've been great but we were really counting on the extra time.

 

I read in different forums that we could ask for an extension but I did not know the proper way to do it. I contacted my local immigration office but they did not give me a real answer. Instead, they suggested that my fiancee could visit the embassy in manila and ask for the extension. I tried to save her a trip by calling the embassy in Manila and after explaining our situation, they said that I did not need an extension and that my NOA2 would automatically revalidate when it expires and my fiancee could schedule her interview appointment past the due date, which Is July 20th, as long as the two of us are still free to marry. This may sound like great news but I still have my doubts and I worry that the information they gave me may have not been accurate. Has any of you ever asked for an extension and if so, how did you go about it? Were there forms to fill out or any special procedure needed to be followed? Any assistance will be truly appreciated. Thanks!

 

Relax, the embassy will automatically extend your petition for up to a year.  I suggest that once the MNL # is received you at least create your account, then get you other stuff done before moving forward from there.

I am filing for my fiancee from the Philippines, she has been married and we have a cenomar that her marriage has been annulled.   On line 9 of Part 2 it only has Marital Status with one of four boxes to check Married, Widowed, Single , or Divorced. Since her marriage has been annulled would Single be the appropriate box to chck?

Yes check single.  You will need a couple of her annulment documents for USCIS.

New to this site, it's very helpful!

My Fiance and I have a bit of a situation. She is a citizen of the Philippines but she works in Taiwan. We are trying to fill out the 129f and 325a forms. Here's our problem...

 

Her current address is her Taiwan, work address. But, she will be resigning from work in October to go back to her home in the Philippines. We are not sure what address to use in the forms. We want to send the 129f packet as soon as possible.

 

If we use her Taiwan address on all the forms as her current address is that going to cause a problem when she no longer resides there in October? Is it going to cause a problem in general because she's not residing in the Philippines at the moment?

 

Any insight would be greatly appreciated.

Use the Philippines address on the I-129F for your fiancee unless you want NVC to send the petition file to Taiwan.  Only list the Taiwan address on the G-325A where you list employment, history of residences

 

You fiancee will be needing a police certificate from Taiwan, if possible she should acquire that before leaving

When I completed the form I-129 I wrote the incorrect sir name for my fiance's daughter.   I assumed her last name was the same as my fiance's but she took her fathers sir name.  We got it correct on the DS160.  Is this a big deal?

 

Not a real big issue, When the CO asks at the interview be prepared to explain the :oops: , he can correct things in the computer.

Only the Letter of Intent, G-325A and 2X2 passport photos are needed from you (beneficiary) to file the I-129F, UNLESS you were married before and got an annulment then a copy of that document is required also.

 

The NSO birth certificate, CENOMAR and NBI are not needed until the process at the embassy.

How is this possible? Approval notice was dated June 20. The approval notice indicates approved and case forward to the consulate. The RFE is dated June 24. I've not been able to find anyone who has had this happen to them. Usually the RFE comes before approval right? How can I be approved and then be unapproved? I'm not denied but an RFE obviously means I won't be approved (or shall I say re approved? ) without sending in what they want .

Secondly, the RFE wants more proof we met in the last 2 years. Well, I had already sent flight and hotel receipts, and 5 photos of us together (different outfits indicating different days). I'm not sure what else to send other than more photos and a copy of my passport entry and exit stamps. It's just weird, doesn't flight and hotel receipts and photos prove beyond a shadow of a doubt that we met?

 

Send copies of all that a second time is my thinking.

Yes I am, I know of three case just recently where NVC sent the case file to the embassy that serves the address for the beneficiary listed on page 2  even though they listed a different country on page 5.

I have a question regarding the locAtion of interview. My fiancé is a citizen of Australia and the United Kingdom. But he lives in New Zealand and is not a citizen. On the I-129f I put the closest location for embassy as auckland, New Zealand. I was talking to someone and they said they would think he would need to go to Australia or the UK for his interview... Does anyone know? He are just over 5 months from our noa1, so I am just preparing and second guessing everything now bc this whole time I thought he would just do the interview and medical in NZ. Thanks!

 

NVC will look at the address listed for the beneficiary on page 2 when they forward the case file to the embassy, so make sure you use an address where you want the interview to take place.   NVC does not bother looking at the information on page 5, just the same you should list the embassy you want to use.

The extreme hardship waiver is very hard to get, the advice you have been given is true: you need to meet in person first before you can file.

In your case, you yourself are physically able to travel. Uscis doesnt care about your lack of money or who will watch the kids, etc. The most recent case I saw where the hardship waiver was granted, the US petitioner was medically unable to travel. Your case does not demonstrate extreme hardship.

Anyways, can your fiance come there to visit you? You have to meet in person, and it does not matter where. You can meet in his country, the US, or any other country.

About your assets, usually its up to the embassy if they will accept it or not. The general rule is you need 3 times the difference you are short of the poverty line. If you can use assets, then you can use the value of your second and third car but not the first, you can also use the net value of your home.

Rule for USEM is 5 TIMES the assets, but sadly USEM does not give assets much consideration - I know of some who were required to get a co-sponsor even though the USC had large assets.

I want to get my fiancee over to the US. I have been dating him online for 9 months. I was married but separated when we decided to go from friendship to dating. I fell in love when we were still just friends, before we even started dating. Anyways, My husband got very sick and I cared for him until he passed away in March, 2014. I have a part time job and 2 children and attend college. We have not met in person because my children cannot travel out of the US due to custody agreements and also because they have mental/emotional issues they are receiving treatment weekly for. Also, I do not meet the 100% or the 125% poverty line. I do however have 3 vehicles, own a home, and have 25k in the bank (which I will be using to pay for the visa process and plane ticket if approved!). My fiancee has work experience as a carpenter and an IT degree so work should be easy for him to find once he is legally able to seek employment. Another snag I am worried about is, in my past, an ex boyfriend had abused his child while I was living with him therefore I was brought to court with him in his case which his children and mine were found to be dependent and neglect. There were no sentences and only had to work with social services which ended as soon as I was able to move out of his home with my children. Then last year, my teenage son was unruly and ended up having social services involved which was taken to court. It was not a case of actual dependent/neglect involving child abuse or neglect, it was for the reason of :The child has run away, from home or is beyond the control of the parent or guardian. The outcome was working with social services and getting my son help. The case was dropped after a complete turn around for my son after treatment. I want my fiancee to be with me and my children very badly but am unsure if I would be able to qualify to petition and sponsor him for the K-1 visa. Any advice and feedback is greatly appreciated.

 

You need to meet in person, you don't have "cause" not to.  You do not meet the income requirements, and the embassy doesn't look too closely at assets, they want to see the required income.

 

Advice:  IF you have someone who would be a (qualified) co-sponsor then -   Get someone to care for your children, fly to the Phils, get MARRIED and apply for the IR/CR-1 spousal visa, the embassy has to accept a co-sponsor with this visa.

The common sense aspect is to make sure to bring everything on the list. Unfortunately, while you watch the group sitting in what you call the paranoid corner, they will be looking back at your group sitting in the 'shoulda, coulda, woulda' wish I had a tissue corner. 

 

Maybe that is an issue with the embassy in China.. don't know, don't really care.  But in regards to the OP, who is processing through the embassy in Manila .... no need for paranoia.   Bring what is listed in the embassy instructions letter is all that is needed...... no "shoulda, coulda, woulda" BS

Dude! One can get by and bring the minimum if they so wish. That being a little dab 'el do ya. Better to be prepared for all contingencies as there is no way of knowing what they will ask. So, yes, if someone has neglected to keep tax returns and W2s from previous years, they can just get by with whats they gots. Better to stuff the bag full before going to an interview, than to pack light because it's just a day trip. 

 

Dude?     Being prepared.. yes.  And being prepared means to bring what is listed in the embassy instructions letter... the rest is paranoia.

Hi Vj's. My fist question. Aside of I-134 Affidavit of Support. Should I ask my fiancé about his W-2 of 2011 to 2013 and 1040 form for embassy? And what is this ITR mean? I so confused about this. And also about Evidence of having Relationship. Emails and Pictures are they have minimum and maximum of these? Were only have few chats, but he did calling me like everyday for about 1hr. Im worry about our emails :sleepy: and we don't have much photos like you guys have. We traveled together and go many places but we missed taking pictures sometimes.

Only need the most recent tax return and W-2, follow the embassy instructions letter for all requirements. DO NOT need multiple years of tax returns or W-2.

 

As for emails, phone and chat logs, just bring a sampling of each from over the months.  With the pictures 4-6 of the two of you will be fine, if you have any with all your family include one or two of those.

Proving a bona fide relationship is very important, especially if the VO has suspicion that one or both of you is being dishonest. You should have the same photos that depict the two of you together to prove a face to face meeting. For the interview, it's important to bring more. You needn't bring a photo album, but at least six more that have the date and location of the photo written on the back. 

 

It is not necessary to include the entire content of an email, but a copy that shows the email header of your name and email address and his name and email address, date sent, subject, and so on. If you talk on the telephone or skype, get records of the time and dates of the phone calls. These should show the originating telephone number, the number called, and the duration of the call. 

 

Don't worry that you didn't take dozens of photos or talk every day. What's most important is that you are able to show an on-going relationship over time. 

 

Totally WRONG.   The embassy does NOT require three years of tax returns.

Hello so we paid for the BPI now the DS160 is getting filled and it ask for her passport information, but...

 

her new passport will not come in until the 22nd July.

So she has the new passport in 2 weeks and she still has her old passport. Is it okay if she puts information from the old passport? We really want to schedule ASAp.

 

You can create your account with the old passport number, then once you receive your new passport contact the embassy to update the information.  At interview time bring both passports.

 

As for appointments, there are very difficult to come by as of late.

Where does it say if the children of the foreign fiance(e) qualify for US citizenship, then do not list them as a child of the foreign fiance(e)? What you linked says separate petitions are not needed for the children that may require a K-2 visa to travel with the foreign fiance(e) parent.

 

ALL children of the foreign fiance(e) are asked for on the I-129F. That is what the form states. So, even if a child is not a USC and will not be applying for a K-2 to immigrate with the parent, they are still listed on the I-129F. I do not see how the fact that her child qualifies for a US passport changes the question.

 

The I-129F is a USCIS petition. It is not an application for a visa. A child listed on the I-129F petition does not mean the child will absolutely be applying for a visa. Applying for a visa is a separate process. If a child listed on the I-129F does not need a visa, then they will not apply for one when the time comes for the parent to file for the K-1 visa. The K-1 visa applicant will not fill out the required separate DS-160 for the child, if they were to apply, and they will not list the child as accompanying them or following to join on their own DS-160 because the child will not be needing a visa of their own from the Dept. of State. When their USC fiance(e) goes to their country to travel to the US with them, they are also not listed on the form as a travel companion.

 

When it asks about their children under the Family section of the form, then they can list the child and state it will be traveling with them. I am sure they will tell the CO the child is a USC with a US passport and not in need of a visa.
 

 

No it is not an application for a visa, it is a petition seeking authorization to apply for a visa - that is what the I-129F is.

 

So with your reasoning a person (beneficiary) being petitioned who has adult, married children needs to list those children on the I-129F?  I don't think so.  The wording that I underlined does not infer that all children must be listed on the I-129F no matter what, it says IF they want to be eligible to apply for a visa they must be listed.... not listed - not eligible.

 

"No. Your eligible children may apply for K-2 visas based on the approval of Form I-129F, Petition for Alien Fiancé(e), that your U.S. citizen fiancé(e) filed on your behalf, but your U.S. citizen fiancé(e) must list the children on the petition. "

 

There is no harm in listing them, but that is not what is actually be asked.

Thank you Hank for your reply. So just to confirm we don't need to include our child's name on the I-129 form? Isn't it VISA fraud if we don't include the name of our child on the form? Or since we are not going to apply for a visa for her there's no need to include it? I really really need your help on this. I called US embassy here in Manila and they informed that I need to include the name of our child on the form because I need to disclose that information but when I called them again just to double check the second person told me that they don't have an idea about visas. I really really need your help on this. Thank you so much in advance. 

 

No it is not visa fraud to not list USC children on the I-129F (after all they are not elgible for a visa ;) ), in fact not listing foreign children on the I-129F only means they will NOT be eligible to apply for a visa once the petition is approved.  

 

The I-129F is a PETITION by the peitioner (USC) for the foreign beneficiary/beneficiaries to be allowed to apply for a visa.

Actually, Hank_ stating not to list the child is incorrect. You do need to list the child on the I-129F. It is your child and you are to list all of the foreign fiance(e)'s children, USC or not, on the I-129F. It does not matter that they will not need a visa. You will simply not apply for a visa for them later when you apply for your K-1.

 

As it says on the form > "Complete the following for all children of your alien fiancé(e)"
 

 

No I am not wrong, if the children are USC they do not need to be listed on the I-129F, only foreign children of the beneficiary need be listed, as this is a petition for a visa and USC are not eligible for a visa to the USA.

Hello all, I really need your thoughts on this. My fiance is about to file a K1 petition, I would like to ask if we need to include our 4 month old kid to the I-129 form to be processed for the K2 visa, tho I read online as well that we can also just request for a special passport for her since her dad is a US citizen and he acknowledged our kid on her birth certificate. I really really need your help. we're about to file the petition this week. 

 

Being your fiance, USC, is the father you will not include the child on the I-129F as he is already a USC, you need to complete CRBA and get him a U.S. passport.   Do delay with this as it can take a few months to get this done.

Do I put the Texas address I mail it to?  Or since I live in California do I put the CSC's address?  If the CSC address, what is it?

Embassy in Manila does not accept assets to meet the income requirements for the I-864P.  They want to see income.  They will either ask for a co-sponsor (unlikely with the K-1 visa) or deny.

Hi folks

 

I had posted some questions a few weeks back regarding my fiance and her 2 year old daughter in the Philippines, who had contracted meningitis and had become critically ill. I had asked about the possibility of getting them here to the US for proper treatment. Soon after my post the baby's condition worsened, she lapsed into a deep coma, and sadly 2 weeks ago she passed away. Now my question is do I have a case to expedite my K1 to get my fiance here?attachicon.gif20140304_173019.jpg She is distraught and depressed over the loss of her child, she's extremely poor, and has virtually no family to speak of to help her. I try to help her financially as much as i can (she didn't even have money for her burial service and the hospital would not release the death certificate because of the bills for treatment), but i would rather use my resources to apply and fly her here ASAP.  We have all the hospital records, death certificate, letters from staff, etc. and can prove severe financial and emotional hardship. My package is all set to send. My main question is should i send everything now, including the  I-134 and all the paperwork usually required for the Manila embassy? I believe we have a strong case. This has been a rough time for us both, We need to be together. Any suggestions or tips at all on what I should do next would be greatly appreciated. Thank you

There is no reason or value in sending the I-134 or anything required at the embassy stage of this process to USCIS.
