hi guys i received this email today, I've been waiting for NOA2 for 11 months now...(what are they asking for? example please ) is this normal.???? i'm just glad they are working on my case again coz  I didn't here from them almost 11 months.

You won't know what USCIS is asking for UNTIL you get the letter, you have 60 days to respond to the RFE if memory serves.  Being you will only be gone a week you should be fine.

Hi everyone! I got my k-1 visa today and was suprise about the annotation : Med Class: B1 and also suprise that my visa issuance is dated Sept 23, 2014 and expiration date is November 26, 2014.  I understand that for K-1 visa you're given 6 months validity. Please help me. How come I only got 60 days for my K-1 visa? I am just confused? 

 

Key wording with the visa validity is = UP TO 6 months.

 

You complete the TB process?  That would explain the limited validity.

 

Do be confused.  Be packing!   Be flying!  Be gone!!

 

 

This has no affect on the 90 days to get married AFTER you clear POE in the USA

That is a great idea. I am a type of person that will like to get everything together, then submit it all. I feel you can not have to much information to submit but you can have not enough.

 

Now I have another question, how you think the letter should be formatted? Because the issues I been having since this deployment, it appears that I am the first soldier that has ever had these issues. My remarks to the command here, "Wow I am the first soldier that has ever had these issues in the past 239 years, LOL" I do know its that the military as a whole, it just we have allot of new soldiers and commanders that never came across these type of issues. I guess i am teaching them and giving them a run for their money.

 

What I will like to do is type something up and present it to my commander. She is really nice person about 28 years of age and most of all she does listen to her soldiers. What I like to do is, get all the information together and hope they will just put the information on a letter lead and they will sign it. I believe when submitting item or problems. I think you should submit the solution. People here call me a Maverick, LOL.

I know there are many that have done expedites in the military, and you for sure have good cause for an expedite, I would suggest contacting the JAG office at your base they should be able to whip a letter up easily for your commander to sign.

I did speak with USCIS and they stated I can write a letter explaining all of this, but i was looking for a proper format of the letter. USCIS Military stated to supply proof, as news articles and some other proof.

Hi Everyone,

 

I would like to know if there is someone from here who applied for K1 visa who are less than 2 years in a long distance relationship but already has been meeting up with their fiancee several occasions in person.

 

My fiancee and I meet online and we've been talking everyday though chat, skype and phone. Stayed with him in US for a month and travels within US together. Meet the family and everything went well. After that one month of vacation with him, we also meet weekly as I am working in a cruiseship and my ship is always in the US port near to his house. He proposes when I was with him in US. We've been researching about K1 but most of the sites says, meeting personally within two years prior to the applicaiton. Has anyone applied K1 with less than a year in a relationship? The rest of the requirements we are qualified and has evidence.

 

Hope anyone can give us an idea or share their personal experience or at least give us an advise.

Requirement is not having known each other two years, requirement is having met in person within the past two years.   You can file the petition two days after meeting each other. ;)

My fiance came here in the Philippines last June, and we signed our documents like G-325A and Intent to Marry Letter on the 3rd week of June and added other documents dated 1st week of July.

But he will send the Petition on the 1st week of August. ( the gap is like 6 weeks)

So just ask if the time gap between signing the documents and the time it will send is okay...

hope you can help me with this.. I will have my interview this week and jist realize today that my passport is less than 6months from the expiration date. it will expire on jan 07 2015.. I thought I'm still within the 6months coz I counted from aug-jan without considering the exact day just "month"... this being said, if I renew my passport tomorrow I won't still be able to get the new passport after 10-15days of expedited passport... do u think this will put me to 221g or cause me any problem at the embassy?

That will be an issue as you are required to have 6 months minimum validity remaining on the passport, I would say there is a very good chance of getting a 221g for a new passport... at the minimum.

 

b. PASSPORT. You must have a passport valid for at least six (6) months.

Depends on the state, look up requirements for your state.  Many states are fine with just your passport and BC and do not require an SSN.  And no one will want your CENOMAR.

So im in a bit of predicament, my partner and I have won a prize which is a huge deal. All expenses paid wedding, flights, etc to the USA. It will be a televised event for a marriage equality event and will include celebs such as the real housewives, Kardansians, etc. Only issue is that I need to be in the USA in 2 weeks. That is not enough time for me to sort out my life here in Aus and I will need to come back home for 3 weeks after the wedding to finish packing and sort out life. Is there anyway I can make this happen?

 

Best you can do is file AOS as soon as you are married, many times USCIS gets the AP (Advance Parole) card out in about 2 months.  There is no "magic or tricks" that an attorney can pull out of a hat.

That instructions page means nothing in regards to what the embassy requires.   The embassy instructions letter is what you need to follow with that form, which clearly state - most recent tax return and W-2.

Hello everyone, I am new to this whole process and I have looked around the site at some of the other forum threads but they really do not answer my question.  When I look on the USCIS website they state that it will take about 5 months to process my K1 visa app. My question is this, the time frame stated of 5 months, is that for the service center and the time it will take them to approve and send to the embassy for the interview and final approval, or is this statement for the entire process, meaning 5 months and she will then have her visa in hand?  Sorry if this has been asked before but I could not find this anywhere in the forums.  Thank you for your help.

That is for the petition process at USCIS only.  After that there is the wait for your MNL # from NVC and then FINALLY the process in Manila which normally takes 6-8 weeks but as of late is taking longer because of a shortage of appointment openings at the embassy.

The PETITIONER must have income to at least meet the poverty guidelines of the I-864P, for two people that is $19,662 (gross income).  Beneficiary's income does not count.

 

As for assets, some embassies do not accept assets to make up a shortage.

I need to try and understand all the different dates with the I-129/ K-1 visa:

Lets see if I get these dates right:

  • I-129F is good for 4 months once approved and can be extended by the embassy (up to a year)
  • K-1 visa is good 6 months from the medical exam, plus you pass the interview (no extensions)
  • Once you step foot in the US you have 90 days to get married (no extensions)

I keep see this:"It is important to file for the AOS before the K1 expire date, otherwise you will be out-of-status". So may questions is, what is the expire date?

 

If you wait 5 months and 20 days to set foot in the US you have 10 days before the K-1 expire date and you are out of status?

 

File AOS before the I-94 expires or your are out of status.  I-94 is good for 90 days.  The K-1 visa expired the second you cleared POE, from that moment on the I-94 is your legal document for being in the USA

Being they are dealing with the embassy in Manila what someone can do in Canada is of little importance.

 

The Department of State website is very clear that the police certificate can only be obtained in person, and the U.S. Embassy Manila is very clear they waiver the police certificate in that situation.

So I got a letter saying our application was forwarded to the embassy in manila and it asked that my fiance go online and fill out the form DS-160. The form asks about vaccinations. Does she need to have vaccinations already or can she get these at her medical exam in manila? What all does she need to do before her interview in Manila? Your fiancee will get her vaccinations at St. Luke's, so answer YES to the vaccination question as they will give her a DS-3025 upon completion.

Just ask what is CSC? I read here that other petitioners send their petition to CSC because there is less backlog compared to Texas Service Center.

When we checked to where to send our petition on uscis site only post the TSC address. Is there a choice where you can send it?

My Fiancee sent me his I-134, W2 etc. that i need for my interview in US embassy here in the Pihilippines, but now he got his new job. My question is, do we need to sent papers from his new job and not from his previous one? We are worried to because maybe it will be questionable in consulate since he is new from his work and he don't have a lot of information that he can give. 

 

For the interview the embassy wants an original I-134 and copies of his most recent tax return and W-2 according to the embassy instructions letter.   Employment letters are optional, but in your case being he has changed employers I would suggest you have a letter from his new employer, that way if the CO asks where your fiance works and you answer with his new employer you can also present the employment letter.  If the CO doesn't ask then you don't need to answer ;)

Embassy instructions letter states copies of most recent tax return and W-2.  Only in the I-134 needs to be original   Read the instructions letter, follow it.  print a copy out and use it for your checklist.  ;)

I seem to remember something about needing to submit 2 sets of the I-134 and supporting documents, but for the life of me I do not seem to be able to find where I believe I saw this information.  Would some one confirm this, or am I not remembering correctly?

Only 1 original I-134 and 1 copy of the most recent tax return and W-2 are required.  

 

You may need a copy of your tax return for CFO (be sure to black out any vital info if needed at CFO)

As for having your Fiancee's birth certificate for filing the petition... NO it is not needed, only the USC need to provide proof ... such as his birth certificate.   If she has ever been married you will need a copy of her completed annulment.

Hi, my fiancé and I filed for the k1 visa about 5 1/2 month ago. We are now waiting for our RFE, cause we forgot to sent a couple of things.
I'm also slowly preparing everything I will need for my interview, and I read that I will need a copy of the I-129F.
The problem is, my fiancé didn't make a copy of it, will that be a big issue?

He couldn't find his passport (had fallen down the back of his dresser) and we didn't have any problems.

There's plenty of USCs without passports, so they can't insist on it.

First let me tell you a quick story about my fiancee and I. We met through Facebook 2 years ago but we never really talked. She thought I was just another Filipino-American playboy (faaaar from the truth) and I am very shy person. Yes, even saying hi via FB messages was hard for me. Even before we talked I already knew she was the one for me. So about 5 months ago, December to be exact, Glomie and I started dating. We've been talking on Skype and FB message ever since. Literally, everyday and night we've been talking. On May 7th 2014 my plane landed in Mactan-Cebu International Airport and that's when I finally got to see the woman of my dreams. I spent two weeks there in the Philippines. 1 week in Batuan, Bohol where her and her family are and the next week she came with me to Maasin City, Southern Leyte, my mothers side of the family. Those had to be the best two weeks of my life, because I got to spend every moment, of every hour, of every second with the love of my life. I know it sounds cheesy but I love this woman, shes my Queen. My flight was scheduled to leave on May 18th 2014 and before she saw us off I proposed to her. Right there in the airport. She said yes and I've never felt so happy in my entire life.

 

Now this is my first time doing anything of this calibur and I just want to know if I'm doing it right. I've gone through and read the guides found in this website here. Below is a list of things that I have, in order. Please let me know if I am missing anything. The items are as follows:

 

  • I-129F Cover Letter
  • G-1145 Form
  • I-129F Form
  • My G-325A Form. Attached is a present passport photo, Declaration of Eligibility and Intent to Marry, a copy of my birth certificate stating I was born in the USA and a copy of my passport
  • My fiancees G-325A Form. Attached it her present passport photo, Declaration of Eligibility and Intent to Marry, her birth certificate stating she was born in the Philippines and a copy of her passport, first and last page only
  • Photos showing us and my time in the Philippines. Each photo is dated and has a description of where it was taken and what is going on. A felt tip pen was used to write on the back of these
  • Tickets and boarding passes as well as luggage tags and receipts acquired while I was in the Philippines 
  • Skype logs (proof of relationship)
  • Facebook messages (proof of relationship)
  • Recent Skype logs showing proof of ongoing relationship

And that pretty much sums it up. I tried to cover all the bases but I'm sure there are more knowledgeable people here that will know more about this and the things I need. Seeing how this is my first time I'd like to ask you guys and girls for your help. If I am missing anything important, please feel free to message me or respond here. Your help is much appreciated. Apologies. What i meant was, does my fiance need to send me her original itr & w2 or she can just send me a photocopy.

 

Only copies, she can email them to you if she chooses.   Only the I-134 has to be original with original signature.

Good morning everyone, I hope all is well. I have a question about the ITR requirement for the affidavit of support. I'm a US citizen and I just sent off the petition to bring my fiancé here to live with me. My problem is that I started a new job on December 9, 2013, so my most recent ITR will be of little use to them at her interview(I think). The prior year (2012) also only has me working a short time. Is that going to be a problem? Should I just send the transcripts I have available and provide them with all of my paystubs, an employment letter, and a bank statement from an officer at my bank? If they take my hourly rate and average hours worked, I am well above the poverty guidelines. Also, my fiancé lives in the Philippines. Please provide any suggestions and thank you for reading.

Yes you provide a copy of your most recent tax return (transcript) and W-2, which would be your 2013 tax return, not 2012.  If you started a new job then for sure include the employer letter and copies of your pay stubs.

 

Your income must meet the poverty guidelines of the I-864P for the number of dependents (including you).

This is for our friend's case. He is a US Citizen who plans to go to Philippines to meet his girlfriend. They been talking online for almost 2 yrs now. He will go to Phil. this August 2014, my question is  can he file for a fiancee visa before he meets his gf?  He wanted to bring his gf here asap and he's wondering if he can file it now or not yet till he meet her in person.

I appreciate your insights about this situation. pls. share...thank you so much!

No.  Main requirement of the I-129F is having met in person within the past two years.   He can have her complete the G-325A, the Letter of Intent to marry and get 2X2 passport photos while there... that would help greatly.

I'm engaged to a pinay, and she was previously married in the Philippines, which doesn't believe in divorce (most catholic countries don't) and we've been working on getting the nullment done, no problems getting the provinces approval but have run into a snag with the NSO in Manila. They either want a hefty bribe or are just unwilling to budge on approving my future asawa's name change so we can get working on the K1 documents. I've been told that just resubmitting the birth certificate would work, but want some advice.  Would you advise doing that? or is there a better and faster way to get her to the States? Thanks for the help!

The annulment has to be finalized before you can petition for your fiancee, both of you MUST be free to marry at the time of filing the petition.  BIG requirement.   The annulment process takes time to complete.

We've got a lawyer in the Philippines and they are working the case but it just seems they are coming up with one thing or another that we haven't done, when we've gotten all the paperwork filed and in triplicate. Was wondering if there is another way to get this done and get her here.

 

Nope.  No shortcuts for the annulment process, get all the required paperwork filed, and wait.

Being your timeline is blank I have to ask - where are you in this process, just starting the I-129F petition?

 

It is fine if you complete the forms and forward them to your fiance.  But if you are just starting the I-129F petition process the evidence you need is of having met in person within the past 2 years - passport stamps, boarding passes from the airlines, pictures of the two of you together.  (not chat logs or screenshots... that is for later at the embassy)
