Thank you for your response. i think what I'm apprehensive about is that if and when the application gets approved sometime in december or january, i will most likely to start a new job around february 2015. if the embassy phase will be sometime first or second quarter next year, that will just give me about 1-4 months in my new job. though i have been working in my old job for 12 years and will be able to provide IRS transcripts for income tax return. i hope the embassy will not base my ability to support the fact that i just started a new job.

 

The embassy asks for your most recent tax return and W-2 as evidence of support.  If you have a new employer at the time of the interview include a letter from your new employer.   

 

Seriously it won't be an issue, there are many before you that have been in your exact situation.

i have a question and i'm not sure if this topic already has a thread or not, i apologize if there's already one. i'm a USC with a pending K1 petition submitted last july 2014. i'm still waiting. i will be moving to seattle, wa this december so i will start a new job when i get to seattle. my question is.... will that have an effect when i submit the i-134 for my fiancee when it's time for the interview? coz i've read that when you submit the I-134, you have to include pay stub. please help.

 

No, But for sure keep USCIS updated of your address if you have not received your NOA2 (approval) before then.  

 

Then at the embassy phase make sure your new address is used on all the forms.

Yes he can fly back to the Phils before the NOA2 is approved.  Only issue there is if he is sent an RFE he will need to have access to that letter from USCIS along with the needed documents to respond.   It's tough waiting, I know, but if an RFE shows up it would be easier to address from the USA.

My fiancée gets on a plane in Cebu Phillipines.......flies to Japan......flies to USA......where will they open that yellow envelope????     Thanks....

 

Your fiancee needs to keep the DO NOT OPEN yellow envelope in her carry-on bag.  Immigrant at POE will take that envelope.  Keep it safe and protect it so it doesn't tear.  If it has a small tear don't worry (too small to access or remove documents), if it has a big tear your fiancee needs to contact the embassy and get it replaced.

Your DO-DOING out of order.   For the I-129F petition you need evidence of having met in person within the past two years.  For the actual visa application at the embassy is where evidence of an ongoing relationship is required.

I have a girlfriend and she currently lives in the Philippines.

 

She currently has a multi-entry tourist Visa which she have been using to visit me twice now.

 

I plan to visit her on December for Christmas. During which I plan to propose.

 

We've already made plans to go back together to the US to celebrate New Year together but she's not aware of my proposal on Christmas just yet. She plans to stay here in the US for 3 months which she can use because of her tourist visa.

 

By December, she's most likely going to resign from her work as well because we've been discussing about filing a K1 Visa already.

 

I believe during the 3 months that she'll be here, that's the time that we will file for a K1 Visa. But of course, she still needs to go back home because we don't want to break the tourist visa limitation.

 

A couple things that worries me.

 

- Is our plan going to make our K1 visa filing harder? 

- her main reason for going here is to be with me with the time provided by the tourist visa - but of course being that we're together as we go back, we might be questioned on our motives

- she'll also be resigning on her job during this time which doesn't really help (she's resigning because we've planned that I'll be supporting her during this time)

- we intend to answer the immigration officer honestly of our plans, but it sounds like our reasons might not sound convincing

 

She has no idea you are proposing yet you have talked about a K-1 Fiancee visa..... sorry mate cats our of the bag ... :lol:

 

-No her visiting you is NOT going to make filing the K-1 harder, actually it is very helpful.

 

-She has possessed the tourist visa for years now it appears, no issue with you two traveling together.

 

-Absolutely no issue with her resigning her job, USCIS will not care for the I-129F petition process, and USEM will not care during the visa application.

 

-Answer the immigration officer of your plans?  You mean the question - Purpose of visit?   Answer it the same as she always has.  What you have planned beyond that has nothing to do with "purpose of visit".   Never DO-DO when DO will DO.   File your K-1 enjoy your time together, then when she flies back to the Phils it will be a very short wait before she will be returning using the K-1 visa :thumbs:

Hello, My fiance's (now wife) son is to following later from Manila.  He has to be here no later than 12/09/14.  I can no longer see his case number on CEAC case status check link and haven't been able to for months now.  He had his interview 9/05/14.  Does anyone know know another way to track the progress of his case and his passport, whether or not it is in AP/ ready/  or even if shipped?

Hello, I couldn't find any forms stating about this topic. My question is during the last two years, I made less than 20k due to school, but this year, I will be making more than 20k. Should I just print off my pay stubs for the last six months to prove that I'll be making more than 20k? Will this work for the poverty guideline? or will I get a denie for my k-1 visa form? Please help. thanks

 

For two people the poverty guidelines 125% requirement is $19,662.  USEM wants your most recent tax return (2013 currently) and a W-2.  If you make $20k last year you are fine.  You can include copies of the current pay stubs that you have, no harm in that for sure.  Being you just started a new job an employment letter would be good also.

I'm in the process of learning about k1 visa and I'm getting stress and hopeless about it. I'm below the 125% poverty line for us two, me and my fiance and then I just learned that US Embassy in the Philippines rarely accepts co-sponsors. I'm still living with my parents there will be 5 of us plus my fiance, if we were going to accumulate my parents annual salary and mine too it will be ok but I always do my tax return they never had me as dependent. Do you guys think that i can still apply for K1 visa? or any advices if i can do something about it? thanks to everyone..  :crying:  :crying:  :cry:

 

Yes getting a co-sponsor accepted at USEM is difficult at best with the K-1 visa.  Not impossible but don't know that I would rely on a co-sponsor considering the odds.  It would be better to get a part time job to raise your income.  If the embassy will consider a co-sponsor having an immediate relative helps.

 

Another option being you have not started the visa process is the CR-1 spousal visa, the embassy has to accept a co-sponsor with that visa.

YES!   Embassy required your most recent tax return and W-2  (2013 currently)   Also because of your new employment include the letter from the employer and copies of pay stubs.   If you new employment has the necessary income to meet the requirements it would be good if your gross yearly income was listed in the letter.

Ok we have a strange situation which we need help on.

 

Details:

 

Beneficiary is Filipino  

Previously married

Divorce was final 05March, 2014 (yes it is possible, will not go into here)

We have Court stamped Divorce Order, Certificate of Finality and the original NSO Annotated Marriage Certificate (the final NSO document is the original marriage certificate annotated on the side stating the date, judge, court circuit of the divorce final pronouncement of divorce - this is on the NSO special paper, NSO stamp and signed and attested by NSO Chief Document Manager - copies of all of this were submitted with the I-129F petition)

 

Her cousin was approved for a k-1 today and spoke with someone whose "case was the same" (that's all the info I have) and that person stated that she was originally denied because she didn't have a CENOMAR.  Reading on the NSO website is looks like a CENOMAR is only for those who have never been married.  We can apply for a CENOMAR, no problem, but what would it say.

 

If anyone here has any experience like this we would really appreciate any help and advice you can provide.  Thanks.

 

 

 

Being everything has been recorded at NSO the CENOMAR (CEMAR) will be annotated to show the divorce.  At NSO you always request a CENOMAR, if married (or previously married) NSO will issue a CEMAR with the annotation showing the annulment, or as in your case the divorce.

Hi, everyone

I have been browsing this site for the past months as my fiancé and I were preparing our K1 application. I learned that a great basis for approval is to show stable income. All has been well and we were planning to file this month until we got into this situation.

My fiancé just got a job offer for a job he really wants and loves to do except that it will cause a major pay cut for him. He just started working when he got back in the US January this year as he has been studying overseas the past two years (that's when we met). He is doing well with his current job and makes well above the 125% minimum poverty requirement. We were thinking that by the time we get the NOA2 approval and my interview date hopefully early next year, he will already have a tax return for this year that can be submitted together with the I-134 and recent pay stubs to show he is finacially capable of supporting me.

Our concern now is if he will accept this job offer, he will not be able to make the 125% minimum requirement. But he is thinking that since he has worked 8 months already this year even with the pay cut for the rest of the year (4 months) he can still show by the end of the year that he made more than enough.

I'm thinking otherwise. Annual income will be based on his current earnings, right? I know copies of his current paystubs will be required during the interview and these will reflect his new job's salary. Can anybody enlighten us on this please? Can we still pass the income requirements?

I have read from another website that since the income requirement will be needed by the end of this process, he still has time to supplement his income until my interview so we can make the income requirement. He is thinking of getting a part time job to get additional income. Can he do this too?

I would greatly appreciate everyone's input and advice on our predicament.

The embassy looks really hard at the most recent tax return & W-2, which for your case will be 2013.  That is all that is required with the I-134 in the embassy instructions letter.  To take the worry out of being close, does your fiancé have a family member that would be a co-sponsor?   

 

Rule # 1 is never lie.  Is the job change moving to another company?

Hi ..my Fiance has her interview on Oct 20th...We are confused...we have seen in many places that DS 160 took the place of other forms (DS 156, DS157, etc), but also seen that it didn't for K1 visas...which is true....we want to be sure...she already di the DS 160 and has paid and scheduled medical and interview..just want to be sure if she needs the other forms also and if she mails them or brings them...one other question..sorry...is October 6th official holiday and if so is St Lukes closed...she has Medical that day planned out???

 

DS-160 is the only form that needs to completed by the applicant now.   DS-160 is an online form, have to bring the confirmation page to the interview .

 

Embassy instructions letter lists everything that is required by the embassy.

Embassy wants the most recent tax return, 2013 (having previous years returns normally does not help but in your case it may be good).  Being you income was down dramatic last year your 2013 tax return probably sucks, are you on track for making (or exceeding) the 125% poverty guidelines for this year?  You may want to explain why your income dropped so dramatic for 2013, job change, health, whatever, maybe write a letter.  Then in this case it may be a good idea to go online to the worksnumber site and print out the employment info, plus for sure include copies of pay stubs (a fair number is my suggestion) to show your income is on track.  You have to over-come the low income tax return for 2013 issue, the embassy is not shy about denying if they see the potential for becoming a "public charge".

 

Tax transcripts are acceptable.

Hello so i got a letter from the NVC saying that they received the approved i129f and are going to forward it to the Embassy on manila.

 

so im doing the DS-160 fro my fiance online and already registered her on the medical center where she hast to take the exams.

 

 

my question is im getting the documents ready to send them to her, but I work for UPS and they wont give me a letter of employment, instead they gave me a paper where it says i have to go to thwworknumber.com and register there and then give my information to the people requesting the proof of employment so they can go to the websit and order it them self. 

 

can i just send like 5 pay stubs to my fiance or how can i do? because i dont think the embassy will go to a weird website to request information about my employer.

OK, you can complete the DS-160 for your fiancee, but she must submit the form electronically (it's the law), then she needs to print out the confirmation page for the interview.

 

 Embassy requires the most recent tax return and W-2.  Employment letter is optional, not required.  You are correct the embassy will not go to any website.  I know of others that have went to that "worknumber" website and printed something out and brought it to the interview.

You must complete the visa process within a year.  The initial petition validity is 4 months, the embassy will automatically extend that validity up to a year as long as you are actively pursuing the visa.  If you want to wait a few months, at least get the profile setup :

OK.  Priority date is the RECEIVED date on the NOA1... BUT... priority date isn't used with the K-1 visa so you could use any date ;)

Hey guys, 

 

So I have a question again. My fiance just told me that he has a criminal record- assault and battery on a police officer back in 2002. He didn't go to prison but got 18month probation and paid fines. We file our K1 petition in July  and I know that he didn't include this info on the forms we filled out. Would that be one the reasons for us to not get approved or a reason why its taking alot of time of the USCIS to review our petition?  Need your thoughts on this guys I tried to research about this but I am not getting enough info.

That is not a listed crime on the I-129F, thus understandable your fiance didn't list it.  It is good that he disclosed this to you just the same as it is possible for USCIS and/or the embassy to have this information and may ask you about it.

Would do no good to send your birth certificate, for the USC that is used to prove you were born in the USA.  Being you are a naturalized citizen you need to seen copy of that documentation or a copy of ALL pages of your passport.

Hello everyone.its been a while since i started using this VJ. I stop reading some information because me and my boyfriend talk about to moved the filing of fiance visa maybe next year. Well anyway here are some of my question that i hope somebody will help me before he file K1.

1. Does my boyfriend required to have a house by his own?like he just stayed to his mom's house for the main time.
2. He still paying his debt. Which is the reason we talked that to move the filing by next year because of his debt, so does debt affect filling K1? (He has 2 job and earn $3600 a month)
3. Do we have to wait after he paid all his debt before filing K1?

1)  NO.  There is no issue where someone lives, as long as they reside in the USA.

 

2)   NO.   Income requirement is based on GROSS income, neither USCIS or USEM look at a person's debt.  But I do understand him want to paying off his debt.

 

3)  NO.  That is a decision between the two of you.

The initial question was regarding not having a copy of the packet for the interview, your first reply stated - it is best to have a copy of the I-129F packet at the interview because in your case in HONG KONG  (not MANILA) the CO asked for something you had put in the I-129F package.

 

So there are three things that drew my attention; 1) you stated the CO can ask for "anything", that is not true, the requirements are cleared listed in the instructions letter.  2) you didn't process in Manila - every embassy is different.  3) What you stated the CO asked for from the I-129F package was not a required document for the I-129F it is just something you added extra when you filed.  What the CO asked for was relationship evidence and would be part of the visa application process.

 

One other thought -  If your fiancee hadn't mentioned it the CO wouldn't have asked for it.  

 

Not trying to pick on you, just want the OP to not stress and to know that a copy of the I-129F packet is not needed for the interview .. irregardless of what you stated.

 

 

- and good suggestion for the interview with the CO is "never DO-DO when DO will DO", meaning answer the questioned asked don't become "chatty Kathy" . ;)

As you already know, the CO can ask [for] anything...  My gal did the K1 in HK where she was an OFW.  The process there was much easier and simpler than the Phil, no CFO, the medical was much easier, might have cost less (I don't remember), and there were a few other things that were easier and less fees.  Also, no long lines at the US embassy for visa applicants.  A chinese woman interviewed my gal first and I am sure it must have been a novelty item for her to interview a filipina in HK for a US fiance' visa.  During the conversation my gal must have mentioned that we first met and emailed each other back in Dec. 2005.  The chinese woman asked to see the first email we exchanged in my gals packet.  The chinese woman had the packet that I submitted for the K1 but either was too lazy or just wanted to see if my gal had it with her.  VJ does encourage that the petitioner make 3 (complete) copies of each petition..., and that is what I did.

I will add my gal had much less home sickness being an OFW for many years.
 

 

What happens in HK stays in HK ;)  

 

An email between you two has no bearing on the I-129F petition process for showing evidence of having met in person within the past two year, but it would fall into the category of ongoing relationship evidence, and that is asked for the instructions letter, at least for Manila,    I have no idea with HK as each embassy is different.

Yes, you are correct.  During my gal's K1 interview the CO did ask to see documents in her packet, even though the CO had our original packet in front of her.  There should always be 3 copies made:  one submitted, the petitioner keeps a copy and the beneficiary keeps a copy.

My question is what do I do If I lost the Original K1 Fiance Visa packet. It was at my work and the cleaning crew must have thrown it away. We are currently waiting for our NVC #  and I know where close to the end and now Im freaking out. Do we need the original? Or will NVC send the packet to Manila?

 

 

 

Are you talking your copy of the I-129F petition?  Not needed.   

 

USCIS sends the approved petition to NVC, NVC assigned the MNL # then forwards the case file to Manila.

 

Once you have your MNL # it is ROCK n ROLL time!!
