Hi everyone!

 

I know this is a long process for all of us and wish you all luck in your journeys.  I received an RFE earlier this week for more information regarding my last personal meeting with my fiancee, who currently lives in Italy. 

 

 

We submitted the I-129F petition in November 2012.  I went to Italy to see Oscar in March 2012 (when he proposed) and again in December 2012 for New Year's. ( I have a trip planned for May 2013). With the initial application I sent in my receipts from my trip in March 2012, notarized letters from my soon to be sister and brother in law stating I was in Milan and stayed with them as well as pictures from the trip.  I realize now I should have sent in a copy of my passport but did not at the time. 

 

So this is my current dilemma:

 

I don't have my boarding passes from my trip to Italy last March or over New Years 2013.  I do have copies of the receipt and proof that Delta gave me frequent flyer miles for the trip.  I also have my passport stamps but the stamps are from Amsterdam and Paris not Italy.  Because Italy is part of the EU, I didn't have to have my passport re stamped when I arrived there.  

Basically these things are considered primary evidence.  Film-dated pictures don't count as primary evidence.  Although I submitted pictures and statements from Oscar's sister and brother in law that stated I was in Italy, apparently these don't count as evidence of meeting in person. 

 

I have until July 12, 2013 to respond but obviously want to respond sooner rather than later.  

 

Do you think that this is sufficient "primary evidence" or should I wait until after I go see Oscar in May 2013 and make sure I hold on to my boarding passes  from this trip before I send in the documents or if my passport stamps, delta receipt and Delta frequent flyer miles from the December 2012/January 2013 trip will be sufficient?

Hello to all Vjers! I know it's early to ask this question because I just recieved my NOA1 few days ago. But, im trying to gather the required documents as early as possible. My question is regarding affidavit of support, I know I needed a co- sponsor because my fiancee make less than the required income for house hold of 4 (Me, her and her 2 kids). Her mum is ready to be a co-sponsor, she made enough money and doesnt have any household or dependant. My question is,

1. Does her income has to cover her, and my pentitioner (her daughter) and her kids (her grand child) or just only me ?

Income has to cover EVERYONE that is a dependent + you and your fiance(e). Review the form I-134 you will see you need to list everyone. With the co-sponsor 4 now becomes 5.

At the I-129F petition stage of this journey, what is needed is proof of having met within the past two years. Evidence of an ongoing relationship is for the embassy phase of the process.

Embassy? I have never heard that they they "rip" things up and throw them away at the embassy interview. From what I understand, they will ask you for specific things. If it is organized nicely so that YOU can easily pull them out when requested, that would be a good idea. In other words, a disorganized mess probably won't win you any points.

For our interview, I also got a folder with sub-folders and dividers plus a little zipper pocket to contain pens, chewing gum, chapstick, a couple of tissues, and I packed a couple of printed puzzles and trivia about his new home to read to make the waiting time less stressful. For the interviewer, you are just one in a long line of the daily work load. For you, it is a crossroads in your life that you hope can be passed with no bumps (or forks!)in that road. Make it easy on yourself in whatever way you can.

If you are asking about your application or possible RFE, clipping multiple-like-items together is a nice idea so that the person who compiles your folder has an easier time. It certainly is a polite thing to do that a good citizen and moral person would probably never question. If there aren't many items, then it probably isn't an issue.


Check the timeline of the OP... they haven't even filed their I-129F yet.

For the section "Residing At" do I use my residential address even though I do not receive mail there? Will USCIS mail me anything, and if so can I use a P.O. Box in this section?

yes residential address, it even clarifies by stating "street number and name". Yes you need separate documents for the K-2.

Conflicting answers, to make it simple, better safe than sorry. Think how much it is going to take from you if you fill it out and it is not required versus what will happen if they ask for it and you don't have it. This immigration process is long and tedious, to get through it, we want to be very careful in everything we do. I am sure spending a few minutes filling out a form is not worth getting your visa delayed or getting blue slip , that could have you wait an extra month or so.

Well in your packet they do make it specific to male. In the embassy info we got the ds-157 is simply listed as one more form to complete.

I think that this DOS link is where folks are getting the "male only" information. Is that still accurate?



That letter does not say MALES only. I would look at the list of required documents from your embassy and complete ANY and ALL they have listed. I for sure would not want to show up at an interview missing a required form.

IF its not required by your embassy what are you out? A few minutes used to complete the form? Spent more time discussing it here then it would take to complete it.

Hi im sending it all out tomorrow finally! I choose to send it with a money order and,
Im including my birth certificates and complete Passport copies.
Is it ok that for proof of meeting on top of the copies of my airline tickets, i put a sticky note that says, please see passport copies page 24, for travel stamps. Is it ok i did that? Or should i just include a extra copy of the page with the stamps there in case?

Also is it ok to send the packet through priority mail usps with a tracking number, to keep track of it?


all is fine, if you want to use priority mail with tracking, you do not need a sticky note (won't hurt either) or extra copies of the passport - I send just one copy of (all pages) the passport

I am betting the passports are still at the embassy. St. Luke's may or may not need to see the passports again, after all they have all that info on record already. I would make lots of copies of that letter from the embassy and bring a couple to St. Luke's when re-doing the medical. Contacting St. Lukes would be my be next on my list to verify, then off to BPI, then online to (this one may require a phone call) schedule the interview - again.

I just got off the phone with the USCIS and they told me to talk to the U.S. Department of State and I talked to a supervisor
there and he said that they shouldn't have issued the visa for that short of a period without first talking to Eve. When she went to the embassy on Tuesday, she was told that they should have warned her about the short timeframe when they gave it to her, but that didn't happen because it was delivered to her by a courier.

They are telling me I have to wait for the embassy to decide what they are going to do based on the letter she delivered to them yesterday. They also told me that I should get my U.S. Senator involved, which I already have done.

Calm really isn't in my vocabulary right now. I have $2,200 in non-refundable airline tickets. All of her stuff is packed in boxes carefully weighed so that they don't get overweight charges. She had to pay for transportation to and from the airport. She said goodbye to all of her friends. She took her daughter out of school. I had a bunch of people on this end ready to meet her at the airport. Some of her stuff was sent here via Fedex. I had appointments set up with people at the school. All of my friends had helped me get the house ready for them to come here. I sent her money for the extra luggage fees. Her brother was set to move into her place and rent his.

Can you get an idea of the picture from all that? It just isn't a calm situation......



Nope its not a "calm" type situation, but you are going to have to go there anyway, you have to be the rock.

You have to accept that all those things could be dust in the wind and be prepared to do what it takes to get things done, you have to grab that extra deep breath and be there for your Fiancee.... those little gals may appear to be tough as nails but they are also as fragile as spun glass when it comes to emotions.

All of this sucks big time! It appears the embassy is trying, just give them the 7 days as suggested.
Even if you can't be calm, fake it for your Fiancee... :thumbs:

I hope they can handle this without issue, but being CDC is involved the question of another medical exam popped into my head along with all the other issues you are struggling with right now.

I would suggest asking this question in the country specific forum as some embassies won't allow the petitioner even in the embassy.

What it says on the certificate is "It is punishable by U.S. law to copy, print, or photograph this document without lawful authority." Making a copy to provide to an agency of the US government is "lawful authority". You can make copies to submit to any US government agency.

I'm looking it over and I see it says to send the i-134 amongst other thing once the NOA2 arrives. The NOA2 is something the non citizen gets from their consulate right?

No the non-citizen doe not get the NOA2, its the 797 Notice of Action the Petitioner gets when the petition is approved.

The reason I ask was I've been checking the USCIS status site (http://www.visajourn...t/k1guide#proof) and finally got approved March 7, 2012. It says though that they "mailed me a notice that we approved this 129F PETITION FOR FIANCE(E)"; but that's not NOA2 right? Or is it?

And you have been approved!! Congrats!!!! :dance: :dance: The actual notice will arrive in the mail.

Should I wait till she gets her letter or can I send it now? Thanks all!

You should start to complete the I-134 and supporting documents so you can send them.

I am stressing out a little bit :help: as I am generally known to do anyways :yes:

I am putting together my package to send my fiance for his interview, which will be April 18th. I am trying to get this together, because his cousin is traveling back to Peru this Saturday and has offered to take this for me :dance:

Here are my questions:
1. I have my NOA2 and my Receipt Number letter from NVC, but I cant seem to find my NOA1..is this a problem? Does this HAVE to be inclded?

I sent copies of the NOA2 and the NVC letter to my fiancee. (not the NOA1)

2. My certificate of Dissolution of Marriage that I sent in my original I-129F petition is dated as issued on May 2, 2011 (not my divorce date btw, this is just when i requested a copy, I have been divorced for 7 or 8 years) BUT since sending it out, I must have requested another copy, because the original one I have here is dated as issued on July 25, 2011..do you think this will be a problem??

Date of your divorce decree is not a big deal, as long as it is complete and a certified copy. The one I sent was 14 years old.

3. Do I need to send him more passport pics? I have one, that I was going to include anyway, just not sure if I need to send more.

4. Does my I-134, Affidavit of Support, need to be notarized ?

5. Interview is April 18th...my new Letter of Intent is dated March 15th, is this too soon? Should I date it closer to the date of interview?

I would not worry about the date of the LOI just so long as it an original signed.

6. I am including a letter from my employer, tax returns from 2012 and 2011, last 3 pay check stubs...is this enough?

I am sure you mean 2010 and 2011 tax returns ;-), as long as you have what is listed on the instructions for the I-134 you will be fine, and it appears you do.

7. I dont really have "official" paycheck stubs, because I get direct deposit, my company is based out of the UK, so my stubs are emailed to me...not very "official" i guess...do you think this might be a problem??

They are what they are, if you feel it might be an issue, attach a letter explaining.

Ok well, 7 is a lucky number so I will leave it at that, lol...Sorry so many questions, but I looked for these things online, and still not totally sure about these...imput will be greatly appreciated !! Thanks ahead of time !!!

hello. We plan to file the petition this month. I have a problem with our proof of relationship. We only have like 7 pictures together, we met only once twice (2008 and 2011). We dont have postcards or hard copy mails. We only chat and talk through phone.. But i have western union papers from december 2007 until now.. i have papers every month. Do you think we need more proofs?


I only sent 4 pictures, pictures are secondary evidence. Chat and phone logs are not needed for the I-129F. The I-129F requires proof of having MET within the past two years, proof of ongoing relationship is for the interview phase at the embassy. Proof of meeting in person within the past two years can be passport stamps, receipts, airline tickets and such.

quite a few have had issues with printing the 156, I believe after completing the form the website has to generate a scan code and that is where the hang-up occurs then it won't print.

hi everyone! I have a question my interview date will be on April 22, 2012 in Abu Dhabi, but we received the I-797 Notice of action from the USCIS, giving my case an approval notice from DEc 21/2011 to April 20, 2012.My question is can the interview date be before the approval notice expires? or can the embassy extend the approval notice that USCIS have given us? Should I call the embassy and inform them or just leave it for its ok. thanks in advance


The 797 is a petition requesting for approval to apply for a visa, once you start your visa application you have fulfilled the petition and timelines are now from the embassy. Don't worry about it.

In my G-325A Form, i answered NONE in other names used. however when i read the US Embassy (Philippines) website, it says the NBI clearance should be in the applicants birth certificate name and any aliases or NICKNAMES used.. also, in form DS156 item 9 asks for other first and middle names used. my birth certificate name is evangeline doe. my first name in all my records is evangeline. i have never used jane in any document, but my nickname, the name friends and family call me is jane and my email address is janedoe@xxx.com. should i add jane to my first names used in form DS156 then secure an NBI clearance with the name janedoe as my alias? if i do this, is there any negative effect in adding a first name in DS156 that i did not add in Form G325A? good day, everyone!


On the G-325A my Fiancee listed her nickname and identified it as such. later when completing the DS-156 she did not list her nickname, nor did she do an NBI with her nickname. The nickname is only used by yourself and friends not on any official documents. Names for the NBI need only be any "official" names you have used; i.e. married then annulled so two names, or you used a name to sign documents other than your birth name. So don't worry about NOT doing an NBI or listing your nickname on the 156, leave those spaces blank when completing the DS-156 the form does not accept N/A, but the CO at the embassy will ask your to put N/A in there later, at least our CO did.
