I had been operating on the assumption that the visa application fee was $240 for my financee and her child. Now I look on the usatraveldocs.com website and it says "Visa applicants, including children, are required to pay a non-refundable, non-transferable visa application fee". Does this mean that my fiancee will need to pay $480 at the embassy? While it is not unexpected I am rather surprised that this detail hasn't been discussed any of the discussions I've seen so far. Thanks!

 

 

Two people, two visas... two fees, states so on all the official websites and in the instructions letter.

I'm glad that you are rooting for my team, I hope too, butt, LOL, I guess it is water under the bridge now for my previous forms.  The two last name thing is crazy, and is taking me a while to get use to.  Is like going south, where she lives, is colder...

From what I have been reading on the embassy reviews, it comes down to the luck of the draw, of who the interviewer is.  If she gets the right one, maybe they won't make an issue. I guess I have one more thing to worry about, as if this isn't stressful enough already...

 

Going south is colder... :lol:   Holds true here in AZ also, but it has to do with elevation; Tucson is at a higher elevation than Phoenix, Sierra Vista and Tombstone are at a higher elevation ... sooooo cooler. 

 

I always root for the home team!   Reading about approvals is all the best !

1st...I would take a butt kicking, a slap or anything just to get her up here, or see her. 

 

Here is the reasoning I used: Here in the USA when a woman marries, they sometimes use their maiden name for the middle name.  It was my understanding that her middle name could be her mother's parents name, to be similar to here in USA. Does that make sense?

 

I let her look at the completed I-129F, and also let the approving service center of Vermont look at it, and the BOTH said was ok. 

 

So what you are saying is that you think it will be denied?

 

With birth certificate, passports, photo ID's etc., you would think there would be no question who she actually is? I want to do the forms correctly, but if they deny over such nonsense, that is ridiculous.

What I am saying is I hope the embassy does not have issue with it... never know.  Correct spelling of a name is not nonsense.  

 

I agree with passports, photo IDs, etc there is no doubt who she is, but does the name on the passport, photo ID, etc match the name on the petition?

 

I am just saying.... and hope it does not become an issue at the embassy.

Our I-129 petition has already been approved.  I filled the papers out, and put part of her "family" name in for her "middle" name.   Now she tells me that she only has a first name, and two parts of her family name.  Names are different there in Brazil! smile.png   What should I tell her to put now, for the middle name, the same as I did on her I-129, or leave it blank?   Does it really matter??   Thanks

 

1st ... tell her to kick your butt!   Not sure why you put part of her family name in the middle name space... had a DUH moment?

 

The name should be as listed on her passport.  Not sure what the embassy will do with that petition once they receive it.  Your fiancée for sure should use her ACTUAL name as listed on her passport for all documents... then hope the screwed up I-129F doesn't come back to bite you in the butt.

So my fiancee picked up her visa the other day and is preparing to fly tomorrow. She just noticed there is a mistake on her visa where her date of birth month is wrong. Instead of Oct they have Aug. The day and year are correct, everything else is correct. Will this be a problem?

Hi, 

my fiance in the States is unable to use internet for the next 2,3 weeks, so it's on me to find out what to prepare for his petition. I've been looking up everything on the USCIS homepage, but still it's pretty confusing comparing those informations with the informations I found on a Do-it-yourself-K1-Visa-Package.

I just wanna know what are the exact first steps to get the forms, any letters or documents together and prepared so I can send that list to my fiance and he can fill out everything and let him send it to the local office in Atlanta.

Question 12 asks if the beneficiary is currently in the U.S. and to complete the information about I-94 or I-95.  She's coming to visit me in 3 days (YAY!) and we're going to fill out this paperwork together.  She'll obviously be in the states during the time this is filled out.  I would put visitor as what she arrived as, but I don't know what the I-94 numbers and such are.  Has anyone ever filled out their I-129F together and handled this question? 

 

For many that travel to the USA they are given an I-94 to complete on the airplane before arrival, this is then stamped and dated at POE, being your fiancee is coming from Canada customs doesn't bother with that.  I guess she could ask at entry if she could complete one, or simply add an addendum stating the facts about traveling from Canada... etc.

On the DS 230 Part I Form, under the section for Spouse details, do you leave this section blank if you are submitting for a K-1 fiancee visa (since you are not married), or are you required to complete this section as if you are already the spouse?

No you (USC) do not need your birth certificate, you can use your passport for the required proof - states so with the I-129F instructions.  All you need to do is photo copy EVERY page of your passport.

only.

 

Its required to list children on the I-129F ONLY if they will be applying for a visa also.

 

Are the children applying at a later day?  They have a year from your approval date to process the K2 visa.

Earlier today I got a packet in the mail from US Embassy Manila. In it is a letter informing that our petition is approved and I can pay the visa fee and schedule for an interview already which we already did. Another thing in there is a copy of the I-129F form which has a stamp that it was approved and I noticed there that it says that the action taken is only valid for 4 months. In our case it is 3/7/13 to 7/6/13.  I really don't know what the validity means though... I am thinking now that maybe we need to be interviewed on or before 7/6/13 but that is the problem now because our Interview date is on 7/26/13. I don't know what to do now...

 

Should I call USCIS or the US Embassy for extension of the Validity? Is there a form we need to fill out? What proper steps should we take this time...

Hope you guys could enlighten me with this and hopefully give advices and solution to our problem now...

I agree with Tahoma, contact the embassy to get the petition validity date extended.  The embassy will do this without issue for up to a year.

I really appreciate all condolences, comments, concerns & opinions in all your replies above.

It is worth mentioning that I did not evade taxes after the accident. I was self-employed without health insurance. I cashed all CD?s, all savings, all cash & many help from good old American Samaritans & charities.

The quad. ex-wife & the brain injured daughter spent 6 months in hospitals, then 3 months in rehab facilities, and then returned home. I was the sole caregiver for 6 years. After the accident, I spent 3 years in a law suit against the infamous Firestone tire which lead to an un-disclosed out-of-court settlement. The ex-wife & the daughter received multi-million dollars in settlement protected by special needs trusts to cover all their life-long needs. I received ZERO Dollars. It dawned on me that the wife would ever be too greedy & divorce me. It did happen! My lawyer told me years later that most similar cases (80-90%) end up in divorce!!!

We were separated in 2010 then divorced in January 2011. I accepted a two-year overseas teaching position (2011-2013). I can file taxes for only those 2 years but my income is exempt & I owe no taxes. I reached 66 last February & started collecting social security benefits.

I hope this removes any ambiguities, uncertainties or vagueness in my post.

I agree with you: the car & the homestead house cannot be considered assets in Florida & I will need a co-sponsor.

I am curious whether I need to explain the whole drama to get an approval for the K1 visa? Or there is an easier way to get through this phase?

It seems many on here are clueless about the FACT you do not need to file tax returns on certain income, plus are clueless that you can do the visa process and not have to provide tax returns.   I would suggest ignoring the bad advice and comments in this regard.

 

Being your ex-wife (not that she counts anyway) and daughter have "income" to provide for themselves you would need to disclose this to the embassy as your daughter is not dependent on your income.  Thus your needed income to meet requirements is actually for you, your fiancee and step-daughter.  This still is not simple.  And yes the embassy will want details and proof.

 

It appears you could have a tax return for the most recent year being you were working 2011 - 2013, but if that income is exempt... ?

 

There is not an easier way of completing the K-1 process.  My only suggestion being its very likely a co-sponsor will be needed is to get married there then file for the IR/CR-1 visa as co-sponsors are not an issue.

A  66 year-old US naturalized citizen (divorced, retired, own home with no mortgage, living on a monthly $1,000 social security & medicare) wants to petition for a K-1 Fiance visa (48 year-old lady).  I have not filed taxes since 2004 due to a fatal auto accident that resulted in the loss of 2 children, then caring for a quadriplegic ex-wife & traumatic brain injured daughter (now 17 years old).

I have an engineering professional license, doctor's degree & have taught in several universities for many years without any retirement benefits. Most likely, I will teach at local university as an adjunct professor upon their arrival. The foreign fiance & her 19 year-old step-daughter will be working in the US after adjustment of status to help with family expenses.

1. Are there a concern about the K1 visa approval?

2. Do I need a co-sponsor (my 42 year-old son from my first marriage or a brother)?

3. Did any one have similar experience? ideas? feedback? issues of concern? etc...

Not filing tax returns means nothing in this process, there are many that have income that is not taxable thus exempt from filing, what matters is proof of income, and proof of (liquid; as in can be liquid within a year) assets adequate to meet the 5 year 125% requirement as listed on the I-864P for the total number of dependents and self.

 

"...most likely I will teach upon their arrival"  = you need this income before they arrive, or you will need a co-sponsor.

 

According to the I-864P that amount is $29,437, if the total of income PLUS 5 times the difference in assets does not meet that then a co-sponsor is needed. 

 

Not all embassies accept sponsors with the K-1 visa, but ALL embassies are required to accept co-sponsors with the IR/CR-1 visa.

 

There a variety of concerns with this scenario.

I know these may seem to be easy questions for someone farther down the journey than myself but here are some questions that I would like to ask.

 

  1. I visited several sights concerning this process, on VISA journey you talk about the I-129F package and payment but I am not positive about the amount of payment. I visited a sight called Travel.State.Gov that looks like a government type site, see below:

They talk about the 129f with a fee of $340 as discussed on VisaJourney but then they talk about a second step and form DS-156 that I do not see mentioned on the VisaJourney site. This nonimmigrant visa application processing fee, Form DS-156 (required for each K visa applicant) is $240, is this real or just a site trying to take my money?

  1. What do you consider the quickest and most reliable way to mail paperwork back and forth between Manila, Philippines, and the US?
  2. My fiancé has two boys aged 10 and 14, are the children required to file the K-2 VISA?s along with the K-1 VISA?s or can these wait till after so that the interview?s may be handled during their break from school?
  3. I have a VA disability pension from an injury I incurred while in the Navy. I could not see a place to add this in the I-134 Affidavit of Support. I also have a fulltime job as a teacher with a salary of approximately $50k so this may not be needed but I just wondered how to handle this.

Sorry I have asked so many questions but I am trying to make this process as painless as possible. I do not see any major hurdles but I would like to do it right the first time. Thank you?

 

Both fees are real, $340 is the petition fee (I-129F) the $240 is the visa fee that is paid later.   BTW there will be a $240 for EACH visa ++ .

 

For sending documents, DON'T use the mail, it may be reliable here but in the Phils no so.  DHL, FEDEX, UPS, LBC are options.

 

The K-2 visas can be delayed for up to a year from the approval date of the K-1 visa, if they are not processed by then ... its a do over and lots of waiting.. again.

 

List the VA disability income with your salary income on the "I derive an annual income of" ________,   then provide supporting documents.  Its that simple.   If you income is adequate for supporting all according to the I-864P 125% guidelines then you don't need to list anything else.

Visa validity date is tied to the date of the medical completion date.   The visa is never valid for 6 months from issuance date.  The actual date is stamped on the visa.

 

You can re-schedule the interview twice before having to pay a new visa fee.  Remember the petition approval is only good for 4 months, but it can be extend up to a year 4 months at a time, so if you are going to re-schedule for a much later date to contact the embassy to extend the petition approval time also.

 

No consequences if no marriage and the beneficiary returns to their home country.  It may make it difficult on the beneficiary to get another K-1 later if the petitioner does not contact USCIS to cancel things, but that is about it.

No issue, as said, remember your visa validity date is tied to the completion date of the medical.   The date will be stamped on the visa, just make sure to enter the USA before that date.

 

With time to spare right now you could get your CFO completed.

I am getting frustrated with this case. My fiance is an American who filed a k1 visa for a Cambodian way back 2009. Got approved but he had to cancel it because he, together with the USEM in Cambodia found out that the girl cheated and lied based on the DNA test of the baby she claimed to be his. The DNA was negative so he wrote the USEM Cambodia to cancel it and ban her. She had the child to another American, they found out that she is a hooker working in a pub. They replied to his request, they cancelled the petition and banned the Cambodian.

June 2011 my fiance and I met and had a relationship. I got pregnant and gave birth August 2012. Our baby is already an American citizen through CRBA and was granted with an American Passport rightaway. We filed our k1 petition April of 2013. Got the NOA1 last May 10. I am very nervous that we may be denied or delayed due to the previous case. I have heard from different filers that it may affect us same way as they got affected, delayed. Some are denied. Whatdo you think should we do about this situation? Will this previous k1 petiton affect us?

 

I don't think the previous K-1 will have an adverse affect on this K-1, they may ask you more questions and look more closely but I believe all will be fine.  IF your fiancé could attend the interview in THIS case I believe it would be a very good thing.

Big question first off:   Is this a child of a USC?  If so you only need to get the U.S. passport

Hey Everyone,

First of all, I want to thank everyone here. I posted awhile ago unsure if we should use a lawyer or do it ourselves and it was this site and all of you helpful people that made us feel more comfortable about doing it without paying the extra money for a lawyer. It's a lot less ominous now. :)

We are getting the papers ready to file for the K1 and had a couple questions.

1. On the I-129f form, it asks what US Embassy will be handling this. I'm from Oshawa, ON and assume this means I should enter Montreal Canada, correct? I've seen a couple people here in random posts I've browsed list things like Ottawa, but I think it is only Montreal and Vancouver that handle K1, so wanted to be sure.

2. Question 12 asks for info if I am currently visiting the US when this is submitted. Since I am Canadian and do not have to get any kind of visa to visit, I am not sure what to fill out in these boxes. Should we just wait until I leave before we mail it, to avoid worrying about this? (I leave at the end of the month, so it's not too far away.)

3. On form G-325A, My fiance has had more jobs and living addresses in the last 5 years than there is room for him to list. Should we list these on separate pages, one for each question, or should they be combined? Also, should this be combined with the extra info we may include for question 18 that wants the description of how we met?

4. How do we list this on the cover page?

5. For my G-325A form, I am not sure what to put for employment. I started a job during the summer, but before that was a freelance web designer for several years. The problem is, I had no registered business and only earned money in small amounts, very rarely. I was kind of self-educating while taking care of my mother. I was going to put self-employed web designer but am worried because my taxes will not show much income, if any, during those years and don't know how far they really look into things like this. Should I just list unemployed? I'd prefer at least student, but only have records of one correspondence course during that time. The rest as independent. Any advice?

6. Both of us will likely be living in different locations (possibly a different state for my fiance), and have different jobs by the time this is complete. This just requires sending them updated information, correct?

That's all I can think of for now. :) I'll be glad when this part is done and it's just waiting for the NOA2 without worry that we messed something up.

Just wanted to say that I'm seeing some great advice about meeting first. I'm currently visiting with my fiance for the 3rd time since we met online over a year ago and every visit has been different. The first one was sort of awkward in some ways, because you are first adding physical aspects to a distance relationship (even something as simple as being able to hug the other person). The second visit was exciting, but the first time we stayed together alone so there was a lot to get used to. The third, and current visit, is really quite awesome -- we've already gotten past any awkward moments, accepted each other's quirks, and it pretty much feels just like being home. Neither of us are in any way worried that it won't work when married now, but it really does take time to get there. Just like in a local relationship, getting married after a couple dates is rarely the best idea and will often lead to a bumpier road when it comes to adjusting to the fact that you are joining two completely separate, unique lives into one. Everyone has their own habits, likes, and dislikes. Marriage is about those complementing each other, or the ability to accept the parts that don't.

Even after visiting in person, there is still a vast difference when you have to go back to just text/video/phone. You think it is great now and you know the person, but there is so much you miss when you have to go back to it that it better shows what you were missing to begin with.

Good luck to you both, though. I hope it works out how you both wish. :)

I can really relate to this. The only family that I have left is my mother and she doesn't like the idea of her only daughter moving to another country, even though she does like my fiance. :( It has caused a lot of upset and stress. My mother's health is not good, too, so I think it scares her to be alone. Also, my fiance's parents both died when he was a child, so family on his side is limited. I have only met his grandmother and Skyped with his cousin and other grandfather so far.

 

We don't plan to have affidavits because of this. Just a ton of pictures, chat records, receipts, etc. He's planning to visit this summer and also for the interview, so hopefully that will help us. We've visited 3 times prior to filing the K1, too. 

 

It certainly makes the process much more difficult, doesn't it? It's hard enough being separated from your fiance(e), but having to deal with unsupportive family sucks.

We included pictures from all 3 visits along with receipts from things we did together (like receipts from the tickets for the CN Tower when he visited me in Canada, plus a photo of us in the CN Tower. One visit we went to the zoo and both purchased our own tickets with credit cards, then took a photo at the zoo entrance sign and submitted that. I sent copies of my passport stamps, boarding passes, and itineraries. His was all CC receipts because they never stamped his passport when he drove past the boarder. Also proof of relationship stuff like phone call logs and cards/envelopes sent back and forth.

 

Really hoping this will be enough. No hotel receipts and I only had one CC receipt because he never lets me pay for stuff. Lol.

It's my understanding that you don't HAVE to file AOS within a certain period.  But the (expensive) physical he will have to do for the K-1 is only valid for one year.

 

Tell your fiance to be prepared to not leave the country for AT LEAST 3 months.  Can he make someone his power of attorney in England?  It would be a pain to have to abandon this whole process because of the sale of a house. 

 

PS - pick up a time-consuming hobby .  Or all the waiting will drive you crazy!  Good luck!

I will tell my fiance he'll have to make his brother the power of atty just in case, which won't be a problem!

 

I do need to get a new hobby! I can be kinda impatient...which I know isn't going to be ideal for this process! One day at a time...wink.png

i had to wait abit after our wedding to get the funds..  it was a month after her i-94 expired

 

Holy moly, it costs $1070 to get the Green Card! I knew it was going to be an expensive, but yikes! Now it's time to start saving every penny so we can afford this. Aye yai yai, it's a good thing I love this man so much! :)

I?m beginning the k-1 paperwork, and to say I?m overwhelmed is an understatement! I?m so glad this forum is here to hopefully help me through the moments when I want to hyperventilate and pee my pants at the same time. smile.png

 

We got engaged a week ago!!!!

 

I?ve pretty much got all the paperwork finished, my fiancé and I were together last week so we were able to get all the forms completed together. He went back to England on Tuesday but now the waiting begins!

 

I just have a quick question (and I?m sure they?ll be many more throughout this journey) once my fiancé enters the country and we get married, do we have to file for an AOS pretty quickly? How long does it take to get the AOS approved? I?m just worried in case my fiancé needs to leave the US to return to England again to finish up the sale of his house, or if we want to go visit his mum in England to celebrate our marriage. How soon after we get married can he legally leave the US to visit the UK again and then come back here to the US?

Yes, I think you have enough to get approved. It proves you met which is the main proof they are seeking, well that and that you are a USC (birth certificate) , and both are free to marry and intend to marry (two letters of intent).
 

 

Thanks for all your help - I'll leave out the Mamma Mia tickets even though they have his name on them we should have taken a pic outside the marquee! Oh well...in the scheme of things, that part isn't really going to matter.

 

The visit in 2011 was June 2011 so it's almost 2 years but not quite...

 

I'll label the hotel info...the bar purchase receipt just shows the last 4 of my credit card, so I just made a copy of the card I used and blocked out the first 12 numbers...

 

I do have signed letters from both of us saying that we are free to marry and intend to marry once he enters the US with the visa so we should be ok there! 

 

I just don't believe in front loading with convos and emails when the factual proof is there...did you send any of those when you originally sent your stuff?

Here's a list of the items that I'll be sending along for the K-1 visa. I have a few copies of emails and Skype conversations but they are sporadic as my fiancé and I spend most of the time talking on the phone. Is it better to just include a few emails to prove that we've been in our relationship for so long? I'm more inclined to keep the packet short and simple because I don't want overkill with convos and emails, I feel like the proof is in the pudding. :)

Hi everyone!

 

I know this is a long process for all of us and wish you all luck in your journeys.  I received an RFE earlier this week for more information regarding my last personal meeting with my fiancee, who currently lives in Italy. 

 

 

We submitted the I-129F petition in November 2012.  I went to Italy to see Oscar in March 2012 (when he proposed) and again in December 2012 for New Year's. ( I have a trip planned for May 2013). With the initial application I sent in my receipts from my trip in March 2012, notarized letters from my soon to be sister and brother in law stating I was in Milan and stayed with them as well as pictures from the trip.  I realize now I should have sent in a copy of my passport but did not at the time. 

 

So this is my current dilemma:

 

I don't have my boarding passes from my trip to Italy last March or over New Years 2013.  I do have copies of the receipt and proof that Delta gave me frequent flyer miles for the trip.  I also have my passport stamps but the stamps are from Amsterdam and Paris not Italy.  Because Italy is part of the EU, I didn't have to have my passport re stamped when I arrived there.  

Basically these things are considered primary evidence.  Film-dated pictures don't count as primary evidence.  Although I submitted pictures and statements from Oscar's sister and brother in law that stated I was in Italy, apparently these don't count as evidence of meeting in person. 

 

I have until July 12, 2013 to respond but obviously want to respond sooner rather than later.  

 

Do you think that this is sufficient "primary evidence" or should I wait until after I go see Oscar in May 2013 and make sure I hold on to my boarding passes  from this trip before I send in the documents or if my passport stamps, delta receipt and Delta frequent flyer miles from the December 2012/January 2013 trip will be sufficient?
