Well, suppose you fiancee is loaded, and brings money, or has a skill and gets a job...? It's just not so black and white to all cases. true there exceptions I agree if you apply at 100% level, you better be prepared to present and defend your plan at interview... but maybe you do not want to unload your bank account to the USC until you arrive in the USA. There are many different situations. Why do they offer the I-134, as opposed to going straight to I-864? Good question, I have read some embassies are using the I-864.

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.




Yup that is what the embassies do, they use the same guideline as for the I-864, makes sense considering that within a few months you will have to meet those requirements anyway.

At K-1 visa I-134 you need 100%, at Adjustment of status I-864 you need 125%. (though people here recommend the 125% at i-134 as a buffer - not as a buffer, embassy uses 125%.). Or get co-sponsor who makes this, ie, single person would need to cover family of 3 or married parents would need cover themselves + any more dependents + you two. In addition to income, they also consider other things such as assets or education... but you would have to make your case.

Well you can't use a one way ticket without buying another ticket leaving the Phils again to somewhere (or you have a visa to stay in the Phils), the airlines will not let you board.

 

Pushing things a little once you have your MNL # you can be done with the interview and have the visa in about 6 weeks, its the waiting for the visa to be delivered after approval that is the unknown.  Two months would be the more relaxed and less stressful bet.

I am concerned I might get an RFE from my I-129F petition for 2 reasons:

 

1. My fiance's passport photos that I submitted are 1.5" by 1.75" not the full 2"x2" size

 

2. She signed and dated all 4 G-325A Bio forms in the small spaces directly above the large box where the words: "Signature of Applicant" and "Date" are printed

 

Has anyone gotten an RFE for these reasons?

 

If it is likely I will get one should I resubmit new photos and forms?

 

I received notice of "Initial Review" so I wonder what they check during that review.  Would they check signatures and photos and issue an RFE then or is that something they check later which may cause an RFE months from now?

 

 

It will be in "initial review" for months, you will not know for many months if you will get an RFE for those issues.  If it worries you then have your fiancée sign another G-325A and get a 2X2 photo (she will be needing 4 for the visa process anyway) then send them to you that way you will have them IF....

Hi Guys,

 

I got I-134 completed filled up form from my fiance.

 

I have a doubt in my mind, because most supporting documents attached is only photocopy.

 

    ex.: His property, he sent me photocopy of tax payment, he wrote statement where the property located is and signature on it. - I don't know if it is ok.-, I assume he will sent me Certificate of ownership even not original but photocopy with NOTARIZED by lawyer, please I need your opinion about this because I don't want to waste money to travel Manila, pay visa pay or etc., yes they can required me to submit original of these but of course it matters a lot.

 

          - Photocopy of his payroll checks with signature on it per page without certification.

 

          

The only original I got is Letter from the bank confirming he got savings account.

 

I will wait your opinion concerning this matter and then tomorrow I will make a call to NVC.

Photo copies are what the embassy requests, so copies are fine. The instructions for the I-134C state copies also.  If the embassy wants an original of anything they will state so in the Instructions Letter.

 

Hello Everyone , I am the Fiance of " meandterry ".  To answer her question ......I sent to her Photocopies of Form 1040 for the following Tax Years ....2012.....2011...2010....2009....2008.....2007 and 2003 no0pb.gif. I also sent her a Tax Transcript from the IRS for Tax Year 2011 and the letter that came with that and this is the Original . So ...in my opinion ..... the Original Letter and Tax Trancript for Tax Year 2011 along with my Photocopy of form 1040 Tax Year 2011 should prove something . Thanks ....Terry

 

The embassy ONLY requests your most recent tax return (2012 in this case), they don't care about "old" tax returns.  Read the instructions letter from the embassy. 

 

If you income meets or exceeds the 125% requirement listed on the I-864P then you are good to go and have no need to list additional assets.

One question I see is age.  One must be legally able to marry at the time of filing the petition.  This may become state specific as each state has its own age restrictions for marriage without parental consent.  Then I believe even for signing documents one must be 18 years of age for them to be legal.

Yes you must send an original, signed I-134C along with (copies) supporting documentation.  If your income meets or exceeds the requirement you do not need to include other assets.

Hey everyone i am a newbie and do not know what are the requirements for I134 during my fiancee's interview in Manila Embassy?

 

Ok so here is my situation, I am retired I have 2 kids(20 and 25) they live with me  they go to school and the school is paying them because they are using my VA card.

 

I do not know what proof i should send to my fiancee. Is there a required income for those who are retired?

The embassy in Manila only wants your most recent tax return.  Now being you are retired its possible your income is not taxable in which case you will need proof of your income, such as bank statements showing monthly deposits, letter from VA/SSA stating your monthly payment.

Your two kids living with you means little if they are not dependents; i.e. you claim them on your tax return.  IF your kids are dependents (which I doubt) you would have to include them along with yourself and your fiancee for meeting the 125% I-864P requirements

Hello;

 

          As we were waiting for information to be sent from the Manila embassy, as instructed,  we realized that this was probably not the step to do. We've had our case no. sense 5-2-13. I would like to have my finance get her medical exam first. I think this can be the longest thing to wait on if there is a problem, & that would allow us to keep working, while I finish preparing & sending the things that I'll be sending her in the mail. This would be like additional forms we fill out, the complete entry that I sent to get our petition approved, & evidence of support, etc. etc.

         My question is can we get our medical started & done, if we have the case no., & then set the interview up after she receives all the information from me. I know ideally they might like the interview date set up and all, but I'm thinking this really isn't a necessity. I'd like to just focus first on getting past the medical & have that done. Meanwhile I'll finish & send the booklet on my part to her. Then she can set up & do the interview.

        Also; my finance says she needs to call the embassy to set up an appointment. From what I've read, I'm thinking if we have the Case no., we can move forward online and set up the medical exam, which I understand is a first come first serve basis.

Now that you have the MNL #, you schedule the interview (after paying the fee at BPI) then you do the medical. 

 

If you sit and wait for the embassy to mail the instructions letter it could be a very long wait... as many never get it.

Welcome to the forum. As long as Merton manang MNL p pwd manang mgbayad sa BPI for fiancée visa Fee, dalhin mo Lang yong letter mo na may MNL. Sis, don't forget the receipt kasi isa yan sa tilting an during interview sa USEM. Ok, now after you get paid for that fee. Pwd manang tumawag for scheduling. Tandaan sis, dapat may allocation ka one week prior to your interview sa USEM. Dapat Yang 1 week na Pagitan nakapasa medical exam kana St Luke's. 2-3 days Lang naman ang medical exam.

Give them 7 - 10 days after you receive the NOA2 before calling.  Call after 4:45 PM eastern time for shorter wait times K1's are not tracked through the AVR, ever. They are processed like an immigrant visa, but they are NOT immigrant visas, so they fall into a completely different class of their own. Therefore you need an operator. To get there:

Can somebody help us regarding the D160 form?according to the us embassy website if you are applying for K1 visa you are excluded with the D160 form and prepare D156 & 157 instead. If K1 visa is excluded how can i make an interview appointment? I have the Manila case number,and visa fee was paid already. I was trying to make an appointment but the system was obliging me to fill up the D160. Thank you.

I'm having trouble editing any new downloads. On some forms it wont let me save anything, I have to print it out or lose all my info. Anyone else having this problem?

 

Try a different web browser; Firefox or Chrome.  IE seems to cause issues at times.

 

Oh and one more thing before trying other browsers, uninstall Adobe, restart your computer then install the newest version of Adobe and give it another try.  The windoze update may have changed a few things

2. Send all originals of the documentary proof that you submitted for the I-129F to your fiancé for their interview at the embassy.

 

What exactly do they want? I guess all I can send is original boarding passes and hotel receipts? I already sent them the original photos? I can send them my passport, so...any help as to what they are going to look or ask for?

Your reading that from the GUIDES.   I think that particular info in the guides is such a misleading pile of manure.   The embassy wants NONE of that information from the I-129F, they have your complete petition file (from USCIS) sitting there in front of them.  Everything the embassy requires is listed in their INSTRUCTIONS LETTER .  

 

Read the instructions letter I provided a link to at the very least. 

 

You could attach a copy of your G-325A to an email for your fiancée so she has information about you and your family which will help for CFO.  CFO will want a copy of the bio page of your passport and other information.

I met a guy last 2010 and he filled a petition on my behalf and the USCIS approved it after 6 months. then something happened between me and my fiance..I thought he's going to cancelled the petition but he didn't..I never take my medical and interview we just let it to expired. after 1 year and a half I met a new guy and he filled a petition on my behalf (again)..and it was approved already. I am nervous if my old petition will cost a problem on my new petition. Is there anyone know what I need to do? pls. help me...

 

 

PS. I still have all the documents from my old petition.

 

I have read some on the couple with the similar issue and their currents problems - old petition still lingering.  I would suggest if at all possible contact the "EX" and ask him to cancel his old petition - being you have all the information still that will help.  I think USCIS only requires a letter.

The 125% is used for the I-864. For the I-134 it only has to be 100%. They will not combine both income but his mothers income will only have to prove that she's able to provide for you and herself. If she supports her husband then she will need to meet the income for a household of three. Double check it for your country

 

 

Do you have a link to that "fact" ?   That may be an embassy specific requirement, I know for USEM they require 125% with the I-134.

He will need to send you copies of the 1099 from SS and any other source of monthly income, along with bank statements showing the monthly deposits.  Have him download IRS publication 915, complete the worksheet then send that along with a letter explaining that his income is not taxable.

Yes at application time.   During the I-129F process your daughter is listed in section 13 of that form, that's it until approved and moved on to visa application time.

Yes once the petition is approved you will be completing applications for TWO (2) visas; the K-1  and a K-2

 

UNLESS you do not plan to have you daughter accompany you to the States, if you plan to wait you have up to one (1) year after the K-1 visa approval to get the K-2 processed.

 

USC here. I read that on that link you gave us it also says

 

"Your children may travel with (accompany) you to the United States or travel later (follow-to-join). Like you, your children must travel within the validity of their K-2 visas. Separate petitions are not required if the children accompany or follow to join you within one year from the date of issuance of your K-1 visa."

 

Are you sure that a separate K2 is required? I guess I will have to do some more reading or call the USCIS myself to be sure.

 

NO a separate petition with USCIS is not required during the I-129F stage, just list daughter on the I-129F in section 13 as I mentioned above.  During the visa application is when you do two applications.

I read here that after my K-1 fiancée petition (I-129F) is approved, I should begin gathering the information/documents that will be needed for the K-1 visa application. My question is, will the Embassy reject my fiancées K-1 visa application because the associated I-134 Affidavit of Support package (with supporting documents) was assembled BEFORE an Embassy case number is assigned? Is there such a thing as completing the Affidavit of Support package too early...especially Affidavit of Support supporting documents that my fiancée will need to prove financial support at the K-1 visa interview?

 

To be clear, I am completing the I-134 package (and supporting documents) AFTER K-1 petition approval but BEFORE NVC receipt of the approved K-1 petition. Seems this is ok from what I have read here...but I need to make sure I'm not wasting my time. I don't want to delay the K-1 visa package submission by waiting to prepare the I-134 until after the Embassy sends the visa application package. At the same time, I do not want my fiancée to be denied (or delayed) K-1 visa approval because the I-134 was completed before the Embassy formally requested this of my fiancée.

 

The US Embassy, in this case, is Manila. I would greatly appreciate a reply from anyone with deep knowledge or experience with the Manila Embassy in this regard.

No issue with your timeline for completing the I-134, USEM will have zero issue with the date, they just want the required documentation.
