So I say fill out all four with your new information and include a supplement explaining the situation.

Last time we had been touched before I received the email of approval was on July 6, 2006. I had checked several times a day since the 6th, including the day of the approval which I received on the 25 (approval on the 24th).

I will tell you what I have heard, my ex-girlfriend shared her experience with me about a trip to Rocky point, Mexico (about 4 hour drive and the closest beach to Tucson!).

When returning they only asked if everyone is a USC, at the time she was not but was here legally (not VWP), the driver, her then boyfriend said "yes" and off they went. I do not remember how they handled our return.

Nogales is different and I do not know of any experience with this POE! This WILL most likely change in Jan 2008 when a Passport WILL be required to return to the US.

Is there anyone with a july NOA1 Date who has been touched or received RFE? I am just wondering because there has been many with June NOA1 dates who have received RFE's and a couple of approvals. I know there has been many May NOA1 dates with approvals. I am just trying to fill my time asking questions since my NOA1 Date is in July. Please March people do not reply , I know many of you are in "Back Log Zone"



Are they sending RFEs to the people who SHOULD be using the new form?

Hi guys,

My lawyer accidently sent our I129F to Chicago (should sent to VSC though), which then issued us a receipt number that begins with MSC. Is this all right? I heard that MSC means Missouri Service Center, which no longer exists. What's this mess all about? I'm so confused:(



MSC does still exist...sort of.

I believe it is now called the NVC (National Visa Center). The place where all I-129Fs go after approval but before they go on to the consulate.

I'm pretty sure I sent copies of EVERYTHING (with a note on my coversheet that originals could be provided IF NEEDED).

How am I certain?

My copies intended for USCIS were blown out of my hands on that windy day, so I swapped the copy of the payment with the ACTUAL payment from 1 of the other 2 copies I had made. I also had to move the passport style photographs.

The originals were stored safely in a folder after I had copied them.

Of course Olga has the originals now for her interview.

This includes I-129F and both sets of G325A, UNLESS this has changed since April.

Did your fiance' get her Visa?
The K-1 will be good for 90 days as a work permit, although when she enters the US she will need to get a work authorization stamp in her passport.
The catch is most border stations do not do that, I have only heard of JFK granting a work permit stamp.
She will have to go to a INS office locally if she does not get the stamp from the POE.
My husband entered into the US at night at a small border crossing, they did not know how to process
his K-1 and had to call a higher up to get authorization. Therefore he never did a work permit stamp.
He decided not to work since entering into US and is now a house husband.
He had to reapply with our AOS and pay another $200 to get another work permit when his K-1 ran out. We haven't heard anything as of yet.

Is your question about you the US resident entering into Mexico. The US resident is free to visit the non-resident fiance' without any delay or problems. A passport should be fine, are you flying?
You will also show proof you are returning to the US.
I went to Canada several times while we were processing our K-1 application with no problems at all.
The bank statements, payroll stubs sound fine too.
I also included noterized copies signed by the bank, as well as letters from my employers showing proof of employment.

I didn't see your signature time line, but I checked your time line out and it looks like you were touched pretty quickly. The K-1 is a long stressful process. You can see what I went through with Anton, but it is for the best as he's here now and it took less than a year for the whole process. It's hard to be apart and guess what once your fiance' is approved she will be with you and won't be allowed to leave...

My husband was interviewed in Vancouver, he is also from Calgary.
See my time line.
We applied in November of 04 and he had his interview in July of 05.
It depends on how fast you can get the information needed and returned to them on the speed of your interview.
They usually give 90 days between packages...

We applied in October 04 of course they sent it back the first time since the fee's had increased after we picked up the paper work, resubmitted in November and we didn't hear anything until the end of Jan 05 and then it was "bad news", the waiting is the hardest part..... You will hear something cause it will either be a notice that they they recieved the paper work at least and then a few more months until you are approved.

Only the non-US resident will need to take the medical exam. Basically a chest Xray for TB, immunization updates if any, and HIV test are what is included in the medical exam.

I think this is our most common worry. Not hearing anything the k-1 is a long process, and it is nerve wracking.
Patience, and Endurance is a must!!!!!
I don't know what to suggest but when I was going through all this I just tried to keep busy and hope for the best although most of the time I was trying to keep from cracking up.

Yes, the church wedding is fun and exciting.... but get married ASAP even if it's at the Justice of the Peace.
You can be legally married in the eyes of the State and US Government and then later get married in front of all the world in Church. I don't know if the Catholic Church would frown on that , but I would just do it...

We had a small civil service in November and then had our own wedding in Feb. that I wrote and created, since we wanted to do something a little bigger than just the JP...

I went to my bank and asked for my full account history, when I opened the account and how much was an average kept in the account... I also had them sign and document that it was a real bank statement.
I also got all the tax forms noterized as they were a true copy of what I had filed with the government as well as the Affidavit of Support. The more you show that you are not trying to fraud the government and you are sincere in your support of your finace' the better.

Let's see if I can remember all the details , we did get a notification that our application reached NVC, then on to Vancouver. Anton recieved the next bunch of paper work to gather, medical, police certificates, my tax statements ect. There is a 90 day limit to gather all the information after you are approved before submitting it all to the consulate in order to get your interview.
The faster you get it done the faster you get your interview....

I am older than my husband by 9 years . We haven't had our AOS interview yet, but what is age....
Evidence of Relationship will look for Passport stamps and more official government things than phone calls ect...
I had gotten RFE'd for Evidence of Relationship because I had only included phone bills and nothing officially government...

Once we submitted passport evidence we were over the hurdle...

I haven't heard about the co-sponsor not being able to help out, but the sponsorship level is 125% above the poverty level, so for a family of 2 you and your fiance'.. it will be about $16,030 .

You are required to be a sponsor for three years and sign an affidavit of support stating that your fiance' will not accept government help and you will be responsible for this person while they are in the US...

Just write it all in or like the last reply get a blank paper. I have 4 jobs and submitted all of them to provide evidence of support and I didn't have any trouble. I got four employee letters as well and submitted them. They just want to see that you work to make the min. requirement, they don't care how many jobs you have to get there....

Congratulations on Recieving your Visa....
When you arrive in the US get married as soon as possible.... don't forget to get your certified copy of the marriage licscene... get the paperwork prior to your getting married, start filling it out and send it in.... I can't tell you how long it's going to take, but be prepared to keep yourself busy once you arrive in the US because we were married in November, applied for AOS and EAD in Feb. and we are still waiting for EAD, I would think now that we are married the US would want some more tax money from my husband.....

Hi, Once your K-1 process is recieved by USCIS your fiance' will not be allowed to use the Visa Waiver process. I suggest to wait until after he visits at Christmas before sending in your paperwork so he can get in with his Visa Waiver... I know from experience as my husband was barred from the US for 6 months after returning to Canada on his Visa Waiver after we had submitted the paperwork last year in 2005.
Not a fun experience......
He had documentation and everything of residency in Canada at the time, although he was not entering via the airlines, but I would hate to see your fiance' spend tons of money in airline tickets and get turned away.
In any case you will be allowed to leave the US to visist him anytime.....
Remember these rules are not set in stone so what happened to us may not happen to you, because it depends alot on the POE officers.

Adding my experience to the mix of answers ..... when you go in for the interview at least with us they just wanted the legal documents such as affidavit of support, police certificate, ect... I don't think they even cared if he had reciepts for rings and such although as every answer goes it depends on the agents at the window.
We planned two wedding dates and they both fell through because of delays.
When he came into the US we went to the JP first and then later planned the big wedding.

I really cannot comment on the mail order bride thing, I'm neither for or against it, but it is good that the US government will be providing some protection for the one that is entering into a contract with the US citizen.

I am so sorry this happened to you, I am feeling way blue myself today after a crappy interview yesterday.
My husband , then fiance in Jan 05 was denied entry into the US from Alberta. They also said, he did not have enough proof to show he was going back to Canada as he is a self-employeed business owner as well as he was visiting too much. He didn't get banned, but they told him if he tried to cross elsewhere or even within a few months of the denial he would be arrested and then banned from the US. So he stayed home, he tried to get a B Visitor's Visa at the embassy in Calgary but was denied as well. We did get his K-1 last July so him abiding by the laws did help I guess, or is it all a scare tactic?
This is the crappy thing that yesterday in the interview the INS lady was trying to manipulate him into making a mistake with his dates of crossings to try to get him to look as if he had crossed illegally once or overstayed his I-95's. She had all the dates of his crossings in his AOS file ,except the one that was hand written by a POE officer in his passport when he had tried to cross in 05. She kept grilling him on the dates to the point he got frustrated and started messing up the dates. I had to defend him and tell her he gets frustrated with remembering dates ,when she commented he was awfully nervous.
I wish you good luck with your K-1.

I thought Canadian citizens could spend up to 6 months in the US without any hassle visiting. Were both of you trying to cross the border when this happend or him alone? What POE? Were you on an airlines or driving?
My husband who is an Austrian Citzen with Landed immigrant status in Canada used to come across to the US from Alberta all the time before we started the K-1 process.
In fact I crossed the border with him in 2004. No problems, then we applied for the K-1. He made it across into the US before the paper work was recieved and spent 3 months with me.
As an Austrian Citizen with landed immigrant status he was only allowed to spend 3 months at a time with a Visa Waiver.
He had to return to Canada in Jan 05, and intended to come back again for his next three months when he was denied entry into the US.
The POE officer had the same reason lack of ties with Canada, so he was not allowed back into the US until he recieved his K-1 last July.
We had our interview for AOS in May. The INS officer who interviewed us was very interested in his denial.
Since she had no records of it, but it was recorded in his passport.
In your situation, I don't think I would write extra letters showing your mistake, if he wasn't fingerprinted, and he stays in Canada until he gets his K-1 everything will be okay.
The POE officer should have filled out a report and everything gets put into the computer. It will show up somewhere, but wait till your interview to explain the reason for his denial.
My opinion anyway...

We sent our applications certified mail, with signature required and confirmation returned. Don't do anything else, it will save you peace of mind to get that green card back saying that the service center actually received your paperwork.
