That was my first thought, is the OP sure the RFE was for the beneficiary?

That's exactly what I tought too Bill, I would go ahead and try that too  I don't think it would hurt

Yamila, there's a scanned copy of an RFE here in VJ, I'm sure you'll find it with a quick search

Good to hear from you. I realize we' didn't start this race together, but maybe we can still dash to the finish line together, (of this leg any way). My prayers are with you.

Another option I just thought of, perhaps others could comment, would be to just get a copy of the IMBRA supplement for pre-IMBRA applications and send it in with RFE marked on the outside of the envelope, and include a cover letter stating that you never received the original RFE in over three months.

I don't know if this would work, but I'd sure try it and in the mean time, contact your congressman.

Maybe someone here has a copy of the blank IMBRA rfe they could send you, or know where you could find it online.

This may be a silly question, but did you verify they have the correct address? I think the email you received regarding the RFE states that you can request them to send another after 30 days, and for you it's been nearly 60 days if I understand your post. I'd be on the phone to my congressmans office.

K-1 Fiance(e) Visa Process & ProceduresI feel over whelmed and worried...

Bill,

-- snip for brevity--
I hope this doesn't come off as a Rant, I am just trying to explain a little...

Not at all, and my intent was not to offend. I, and others, have gotten flamed in the past for posting 'unsolicited advice', (not from any original posters), as some members have, or have had, a habbit if trying to tell others what they should be or should not be posting or respoding to on this forum. Thus the disclaimer :)

Best Wishes,

Bill

Since you included alot of personal info, I am going to comment on the personal side of things and say "don't rush into a marriage situation just so that you can continue to be together". The time apart may well do you both good, especially at your ages.

If you are both really in love, and the timing just isn't right for a marriage, why not just wait? There is an old saying that 'absence makes the heart grow fonder' - I don't necessarily agree with that, becuase absence can also help determine if ones heart is true, IMHO.

I've made misakes. I scewed up part of my life, and so when I see posts like this I'm going to comment whether it is 'solicited' or not. I'd hate to see anyone else make the same mistakes I've made.

I'd still like to see an RFE column on that list if you ever get around to it. Thanks for picking up the torch!

Maybe Gary would be willing to foward to you the html code he was using. I know a bit about programming, just not HTML. It seems to me, there would be a way to link directly to the VJ site so that those timlines would be auto-updating.

K-1 Fiance(e) Visa Process & ProceduresWTF? Wakass RFE finally arrives
I've noticed alot of people lately getting RFE's actually requesting items that should have been sent in to begin with. I never heard of a birth certificate being 'optional' - where did you get the idea it was optional?

At any rate, again, sending too much information seems to be alot better than sending to little. You should send back everything they ask for, and more! "Bury them" as Tom recetly said.

I wish I had known to do this in advance, as I fear I'm going to be in the non-IMBRA RFE club too soon.

K-1 Fiance(e) Visa Process & ProceduresShould I go for K1 or visitors Visa? Tips?
Most of these questions could better be answered in the regional forum, but since you asked here, I'd suggest you not attempt to obtain a fiance visa unless you are truly intent on getting married. Attemting to obtain a finace visa just so that she can visit and see if she likes it here, would probably be considered to be immigration fraud, and in fact, USCIS may even monitor this website...

I'd try for the tourist visa in your case, and wait to see how the relationship developes and make sure you both really want to marry before applying for a fiance visa.

It would make it alot easier for me to speculate if you were to complte your profile, (so I could see where your beneficiary was from and what office you are working through), and helpful if you were to complete your timeline. :)

Also I look forward for some help from them in passing the consulate interview, but I'm sure there is a thread somewhere for that too.

There is, in the Russia regional section of the forums!

I (rather Olga) found the questions listed in this thread helpful. Of course, it may not be needed or there may be questions asked not listed there but certainly a great place to start!

K-1 Fiance(e) Visa Process & ProceduresIntent to marry...
We have been making plans since filing. During my trip to meet Olga in person we priced wedding dresses (even bought one for 7240 Rubles)! Olga kept the reciept though as she needed it to receive the dress after it was ready which was after I left Russia.

In the suppliment about the meeting I mentioned that we purchased a dress and that Olga has the reciept and could/would produce it if needed. (I expect she will take it to the interview!)

7240 rubles at the time = ~$280USD

Furthermore that was a very akward day as I waited in the "waiting room" as many mothers and daughters came in and shopped...a couple came in but quickly left... I was the ONLY man in this building except for the 2 seconds the couple walked in and out!

Ah that's VSC's secret only process a few then ship the rest off to CSC!

no wonder CSC is so far behind handling TSC and NSC workload now also...why could VSC not handle NSC and CSC do TSC?!

K-1 Fiance(e) Visa Process & ProceduresCan this cause problems?

No one will ask that. People respect military people so much here in the US, no one would dare even think that. Military always get their way. As long as he wants you here, thats all that matters.

We want to finally put the I 129 F in by October or November ,hoping we'll have the K1 by next year May then. But my Sweeties company is most likeley going down to Iraq (no Military ,contractor) by June or July of next year.So that would mean that he'd most likely be gone by July,so pretty much right after we got married.......Is that gonna cause problems with the INS?
Thanks for helpful advice
Nat

K-1 Fiance(e) Visa Process & ProceduresCan this cause problems?
I am going to assume that he is the NON-USC.

IF so then yes it could cause problems as the K-1 is a SINGLE entry, non-immigrant visa so until AP(travel authorization) is approved the should he leave the US for any reason he would not be able to reenter on the same visa. Thus you would have to apply for the K-3 for him to return and wait again!

I am not a lawyer but this is my understanding of it, you may wish to contact a lawyer. It MAY be better to get the documentation in now and hope the AP is approved by then...though even that is not a "sure thing".

As I said I am assuming he is the NON-USC, if he is the USC then there should not be much of a problem other then letting, except he would have to be present for the AOS interview...

Again I am not a lawyer and am only sharing my knowledge as I understand it from reading these forums.

K-1 Fiance(e) Visa Process & ProceduresHey Gang--Is this my NOA1 ?? Surely not?

I am part of the 'New Wave' group that were waiting for the new I-129F forms to come out before filing.
I sent my package in on June 20. Got my return receipt back on June 29----and now today got this I-797C form.
At first all I saw was "Notice type: receipt notice. Amount rec'd $170"--and thot "ho-hum, that's nice, a receipt for my money"---didn't ever remember anyone else saying they'd received such a thing before tho and then saw the NOA thing at the top-----is this ineed my NOA1?
I don't see a 'case number' on it anywhere----
there is a 'receipt number'---is that it? Is that what I can use to log in an check "progress"?

I live in SC and so my stuff goes thru Texas and then on to CSC as I understand it? Is this fast? I wasn't looking for anything for a long while.

JB

That is NOA-1

the receipt number is the number you enter to check the status.

As for the transfering, there is speculation that it will in the short term slow things down but in the long term it will make for an overall faster process, though I doubt it will be as fast as VSC :( :ranting:

K-1 Fiance(e) Visa Process & Proceduresafter the IMBRA RFE

Actually, preliminary processing for cases that arrived at CSC/NSC/TSC in March certainly should mean that adjudication was FINISHED before they sent the RFE - since it took them months to actually develop that ridiculous form with no checkboxes to indicate NO as an answer!!!

I'm glad I am not the only one that thought that IMBRA REF was a freakin' joke. I circled all the checkboxes with one circle and wrote N/A next to it. Can't believe no one thought, "What do people mark if they aren't a 'bad' person?" Wonder how many will not write in anything and send it back...

Regarding this IMBRA RFE -- Is it like a form and what do they ask? I am assuming that you filled it out and send it back to them. Why can that "form" be part of the initial package that you sent to the CSC?

It is part of the new I-129F, released in June, iirc. (about 4 months late!)

I have read that the K-3 can be a MINIMUM of 8 months!

k-1 is fastest and if it isn't approved in 5 months, why would something that takes longer be completed in the same timeframe?

I would tend to agree, get married and go the K-3 route instead of wasting time on the k-1, even then June might be a bit optomistic.

I think there may be something to the complainers and constant callers at the bottom of the pile, I've been sitting waiting patiently thinking it'd be Sept or more likely October before I heard anything!

Are you serious?
I dont think CSC reads VJ...and not everyone who has been waiting 4 or more months has been emailing, calling, or otherwise personally contacting the service center, senators, or USCIS. Congrats on your early approval, but please dont bum out those who are getting f***ed.

Well not really SERIOUS but I cannot explain how I jumped so far ahead of the line.

I think there may be something to the complainers and constant callers at the bottom of the pile, I've been sitting waiting patiently thinking it'd be Sept or more likely October before I heard anything! Stressing over did I submit enough, too much or just right! Not phoning anyone and trying not to complain about the slowness of CSC...though I have complained a little about the fastness of VSC! :protest:

Also I think they had to take a few weeks to train the people that were handling the other documents (ones they are now transferring to NSC and TSC) to handle their new task, I-129Fs! Now these new guys are all trained and ready to crank them out!

And doing a fine job of it! ;)

In all fairness, I was stunned when I received the email yesterday...thank goodness I am semi-prepared! Though my plans to visit Olga next year are now cancelled since she will HOPEFULLY be here by then!

Well, I just sent copies of the phone cards I used, when I was using them, I never found a good quality phone card though so I stopped using them.

I figured if they want to know where the cards were used to call, USCIS could call the customer service number! I did note on each card the date and whom I called using the card. I used some to call Olga AND the hotel I stayed during my visit AND the consulate office in Vladivostok...most were just Olga though :luv:
