If she really came here on a tourist VISA with intention to marry, that would be immigration fraud and she probably knows that. It's likely a scam to get the money for the land.

He should go there for a visit, then do a K-1 or K-3, or nothing (probably the best choice in this case).

First off, if you want to actually talk to someone at the CSC, the way to do it is to call the main 800 number, and then follow the prompts as if you had received an RFE and don't understand what additional information they are requesting. BUT BEWARE! And read this post first:

After you read this post, FYI, I just got an approval email last nite saying my case was approved on the 27th, and like someone else here did, I'll probably get a second NOA2!

Go figure...

Bottom line, as far as I can tell, it doesn't matter who you talk to, you probably will not get correct information, but there may be a chance you'll get someone who will do something that in some way effects the processing of your case - hehe. I think all my calling actually caused the second NOA2 approval :P It could also lead to a further delay, who knows with all this!

Some people have gotten RFE's for birth certificates, I sent a copy of mine AND my fiance's with my I-129F, but then I got an RFE for credit card statements and bank statements showing that I made purcheses / cash withdrawals in Thailand on my visits.

There are two schools of thought on this:

1. Send only what they ask for
2. Bury them with everything you can get

I got an RFE so I go with #2 :P

Everything I read, except for the paranoid warnings of some people on VJ, is that a non-binding religious ceremony is permitted, quite normal and acceptable. I even wrote a letter to both USCIS and to the Embassy and received a reply, (from the Embassy in Thailand), that it was fine to do this. I even posted here our PRE-wedding photos here on this site. I figure on the off chance that we get an idiot at the POE he can talk to his supervsor. I think all the worry is overblown. I'm doing it, and I'm not hiding it.

This is just my opinion, for what it's worth.

PS I got an RFE for proof that I had made purchases / bank withdrawls in Thailand, and one of the items I sent back was the receipt for our wedding photos and explained that it was customary to have these made in advance of a wedding in Thailand as we planned to have a non-binding religious ceremony there. Next thing I got was my NOA2.

I would like to add that there are many of us that read the forums and try to give advise when we know it. It is very disappointing to see people snaping at other people or shall I say share their sarcastic remarks because someone asks a question that may not be meaningful to them.. We all started in the beginning and most of us had no idea where to start. Please be patient and if you know more than the next person, share it with us, dont snap. If you feel the question is stupid, then dont respond. Some of us do like to help others.


I think most of the sarcasm is light harted and meant more for comic relief than as an insult, at least that's the way I look at it. (I've taken my share of 'guff' here for sure, lol).

A good argument (debate) now and then also adds to the value of this forum.

When completing your I-129F there are two theories, #1 that is if send too much and you'll get an RFE because it will raise more questions or delay your case, and #2 bury them with evidence so you won't get any RFE's. I filed my I-129F based on rule #1 and got an RFE for bank and credit card statements showing purchases and cash withdrawals I made while i was visiting my fiance in Bangkok, so now I subscribe to #2. One fellow here sent in so much evidence with his I-129F it took a shipping BOX to hold it all, and got one of the fastest approvals I've ever seen. CSC got his BOX after me, and sent his approval BEFORE I got my RFE.

This is not that confusing to me at all, I'd mark it 'single' and attach a continuation page explaining that your previous marriage was annulled and a copy of the annullment. Then you've got all your bases covered. When they do the background check, and if you filed tax returns, things like that with a former spouse, they may come back with an RFE for an explanation. Better to tell then upfront IMHO and save yourself a possible delay.

I have returned! I couldn't bear watching everyone file while I was still waiting..for those of you who remember, didn't have any pictures of honey and I together..decided to wait until his next visit to take some(he arrives in 10 days!) I have, or have ordered the following:
-Marriage certificate(to prove legality of name change)
-Divorce decree
-All forms required(not going to bother listing them)
-ticket stubs from air travel
-(will have) photos together
-passport copied(as opposed to BC)
-letters of intent(to be done upon his arrival)
-passport style photos(also to be done upon his arrival)

I've got it all I assume?


Alot of people have gotten RFE's for their fiance's birth certificate, I got an RFE for bank and credit card statement showing purchases / cash withdrawals during the visit to prove I was there.

I'd send a letter post marked close to the date of his interview, explaing how much you'd like to be there but that you are trying to save money for the wedding and trip to the US etc and confirm your intent to marry within 90 days of him entering the US.

I'd have him take a TON of emails and printed pages of chat logs (try to just print pages that dont have too much personal information of course). Recipts for phone cards purchased, post marked envelopes of snail mail, receipts for gifts purchased... anthing you can think of or lay your hands on that shows the continuing relationship.

Maybe a screen shot of the two of you chatting on webcam.

I sumitted mine, clipped to the front of the rest of my documents. Didn't have any problems. Your idea of gluing them to a page is probably better and more convenient for the processors. - oops! - better not glue them because you are supposed to write the dates and places and names on the back.

So they are available to me and anyone else who takes the trouble to find them---it's that way for most of the packets for most of the posts---at least when I was going through all this, I didn't wait for any mailed packets. And I was one of those who got a provisional file open too, so I know what you mean about getting the step up.
I just don't think it is appropriate for everyone.


Hehe, in my case, noone had posted such a set recently, so it was not available for me to download. I suspect what I posted will be outdated soon too.

Thank you for that info Bill. I would say it is definately worth while for any member to fax a 'Request for Provisional File' along with their NOA2 if it meant a chance to receive the Packet from the consulate earlier.

Well in a way yes (sorry to pick up an argument here...) but in a way no. Why give people something else to just torture themselves and the consulate staff about? By now anyone should be able to find out the contents of P3 and have them ready anyway, right?

Not saying it's not a good idea, but I wouldn't advocate everyone starting it up again. There's a reason it's mainly considered obsolete...


Well, the packet three forms posted on the US Embassy in Thailand website are not current, don't include the checklist or other information included in the actual packet 3 that gets sent out, (such as the instructions written in Thai or the most recent changes in proceedures) - and it takes time to fill out all those forms and get the all the info together. I just ignored everyone telling me not to waste my time, and it seems I did save myself a little time in doing so.

I posted a complete scan of every document we received in Packet 3 on the Thailand thread (Sawasdee2) - compare what is actually in the packet to what is posted on the website, and there's quite a difference.

I bet US Embassies STILL get alot of such requests, because so many websites out there are out-of-date and still include that in their instructions. I bet alot of attorneys who had been doing it for years, still do it too! You have to understand how breaucracies work and how 'hard' it actually is for them to change the rules - lol.

Seemed to work for me... (may not work for everyone)

I used the example that is in the 'forms' section here on Visa Journey - and I just checked, I am a LITTLE off on my dates, I faxed it on Oct 30th, I got the notice DATED Nov 7 that our case had bee forwarded to the US Embassy in Bangkok from the NVC, and the envelope from the US Embassy in Bangkok was POSTMARKED Nov 6th. So I am assuming they acted on the 'Request for Provisional File" I faxed WITH a copy of my NOA2. She then got a SECOND Packet 3 when the file arrived in Bangkok.

I'm more of a 'lurker' here and less of a poster, mostly because it's hard for me to answer other peoples questions when I am still in the midst of the process myself and dont want to leave wrong answers.

I just want to say 'THANK YOU VERY MUCH!' to gary for posting these timelines.

One thing you might to to improve the accuracy, is indicate which applicants are still 'active' on VJ vs 'inactive'. For example, if a person joined over 90 days ago, filled out a timeline and has not been active on VJ since, it would be nice to show that on your timelines.

Some of those that show waiting for a very long time have been innactive for a very long time and have never posted anything at all. It makes me wonder if they stopped the process, or just failed to keep up with thier timeline on VJ.

With this information, we could know for sure who is 'really' still waiting vs those who we really don't know the status.

Were you asking me? If so, no. There is no such thing as a request for an expedited decision after 60 days unfortunately. It's simply the point at which USCIS says it's acceptable for the petitioner to contact them. According to USCIS, expedites are only done for a very specific list of criteria, #1 apparently being military deployment. But texasseoul's letter did reference the data showing the inequity in processing times which I think made the senator's office agree that something was very wrong and pushed them to inquire.


No, I was asking the OP. I found my mistake:

... I placed a phone call to VSC. I must have the best luck in the world when calling VSC, I always get the nicest people. She said that they received my reply for more information and request 60 days to give an answer or request further information. She said that would be on September 28th. After I explained that I'm counting July 28th as 1 day and there are 31 days in July & August, that it has been 60 days. She put me on hold and returned with a fax number to request expedited service. She said that I should state in my request that it has been 60 days since the receipt of my RFE and that I am outside normal processing times.


It was not in the RFE, but a lady at the VSC he talked to that instructed him how he could request and expedited decision.

Maybe the OP could ask Andy for the fax number...

If there is 'no such thing' - maybe you should call the VSC, find out who Andy talked to, and get her squared away on how to correctly do her job :P

I can't imagine how frustrated you must feel. I have can't follow everyones posts here, but I read that the IMBRA RFE's they sent out had some sort of language that you should receive a reply within 60 days, or to call. I imagine you've called them, probably several times...

What do they tell you when you explain that you know many couples who applied months after you, and have already been approved?

I have a similar situation, my ex and I were seperated for over 8 years and our divorce was just final in March of 06. I just explained this in a letter I included with my application. If you belive this might be an issue, you should get a copy of the divorce petition translated so that USCIS can see the 'grounds'.

However, I do not believe it will be an issue. I believe all you have to do is show you are single, I don't believe it matters how long you have been single and including such information would most likely be superfluous.

I just included the information sort as a 'side note' in my letter of intent to marry, explaining that I'd been seperated and living alone, rasing my children by myself for over 8 years.

If they told you that your 6 months started in June, then I'd wait it out anyway. If you do the K3 then they will most likely have to pull the prior K1 and look at it too, so it would take longer than normal to process the K3. I couldn't imagine waiting as long as you have waited, and then starting all over.

Remember touches don't always mean anything!!! They could simply be moving your case from one pile to another.

I think after this week, the majority of July applicants will have their NOA2's, and a good percentage of August NOA2's. I'm happy for everone that gets approved.

At the same time, like most everyone else, I get frustrated when I see so many people who filed after me being approved before me, and not being able to determine the reason.

If by "RE-LAX" you mean "just be happy with the fact you may have to wait another 4 months" - fat chance!

Ya, I noticed that some people got touches and subsequently received their NOA2 in the mail, with no email confirmation. Tom did not get the email notification but it did show a change in status on the USCIS website, someone else got the letter with no status change showing on the website - so go figure :clock:
