I cannot even figure out what it is you are waiting for. I dont see a timeline, but 224 days is too long to wait for anything. I wonder of your petition has expired or something... It sounds to me like your fiance is not doing what he should be...

Does anyone have the number and/or e-mail address that you used when contacting NVC?

K-1 Fiance(e) Visa Process & ProceduresThe 'system errors' at CSC are delaying som NOA2's

I am curious as to what number you are calling to get this information as everytime I call the USCIS phone number all I get are reps who read me word for word what my case status message says (which I already know) and they won't give me anything further than that. Am I asking the wrong questions? I too have been "touched" a couple of times with no updates - last time being 10/19, but I have not received anything in the mail. Is there a direct number to the CSC? Your help would be greatly appreciated as the last rep I spoke to caused me to break down in tears. Thank you.

I call the main number for USCIS, but follow the prompts you are led to as if you dont know how to respond to your RFE, or what documents the RFE is requesting, this will get you to a live person at the CSC. The problem is, it seems you cannot believe anything they tell you!!! hehe! I called back a final time to tell them I received my NOA2, and as I was trying to explain about my previous calls, she told me 'why are you calling back AGAIN, we already told you your case is has NOT BEEN APPROVED YET! lol - then I told her I had my NOA2 in my hands, so she says 'Well why didn't you tell us that when you called earlier!" and I told her - "I just this moment got it, in todays mail!" - She says, "Oh! Well then! Go by that, because we have a glitch in our systems here"

hehe - i already got all my congrats on my NOA2 - I guess what this shows is that you cannot trust anything they tell you at the CSC... its crazy... I still want to let them know that I do have my NOA2 (I-797).

K-1 Fiance(e) Visa Process & ProceduresThe 'system errors' at CSC are delaying som NOA2's

Should I tell them that I have my NOA2 already? Or should I call and simply ask for the status of my petition and then if an approval doesn't show up, should I go ahead and tell them I did receive it. What's the number for the CSC, anyone have it? Or is it the number for the USCIS? I'm not sure since I've never had to call them up.

The number is (800) 375 – 5283 - there is a prompt to follow if you have a question about something you received in the mail from them, following that string of promts should get you to the CSC.

Bill

UPDATE!!!

I JUST GOT MY NOA2 IN THE MAIL!!!! "This petition has been approved blah blah blah... Valid from 10-19-2006 to 2-18-2007" - and the misinformation line told me JUST TODAY - that my application is still pending approval, and that is why my case has not been forwarded to the NVC -

I'm gona call the NVC now and see if they have my file yet - SHEESH!!!

Sirlancelot: Yes I was kind of losing it before I got my NOA2, lol, you remember :D Yeah I guess I should start to worry if a month passes and I don't hear anything from NVC.

I'm just curious, if you call them, if they tell you you are not approved yet - As I understand the misinformation I received ( ), they won't aknowledge you've been approved, or forward your package to NVC until the email goes out.

If I were you, I'd just call to see what status thier system is showing, and inform them, if necessary, that you have your NOA2. They should also be able to tell you if your file has been fowrarded to the NVC yet.

K-1 Fiance(e) Visa Process & ProceduresThe 'system errors' at CSC are delaying som NOA2's
What I failed to mention, and I should have been more clear about, is the fact that the lady I spoke to today, Thusday, initially told me my application was still pending and had not been approved yet. Then when I told her about the other lady who confirmed that my petition had been approved, she said well, that was no the 'Final Approval' and that some other supervisor still had to give the 'Final Approval'. I stood my ground and told her that was not what I had been told, that the delay in me getting my email notification was a system glitch and that I had been assured that my petition had gotten final approval - thats when I got put on hold for 10 minutes.

My point is, that there appear to be some serious 'system problems' and not just with notifications as I previously thought.

My second point is that it appears the people who answer the phone are told not to tell anyone about the system errors, rather, tell them thier applications have not been approved yet, tell them to wait...

K-1 Fiance(e) Visa Process & ProceduresThe 'system errors' at CSC are delaying som NOA2's
As previously reported, I called the CSC after several touches to see if my petition had been approved, on Monday I was told it had been approved and should be receiving my notice shortly. The same thing happened regarding my RFE. A week after returning it, I called because I had not gotten any confirmation and discovered it had been received, and then two days later finally got the email.

So, Wednesday, still no email on my NOA2 so I called again and just happened to get the same lady, she says 'hey, i remember you!' - let me check that for you again... I was put on hold and when she came back she said that the adjudicator had approved my case but that due to a 'system error' my NOA2 did not actually print out, and would have to be re-approved. She got it re-approved during the same call and said I should have my NOA2 within two weeks.

Today, Thursday, I wanted to be sure this 'system glitch' had been corrected do I called again, and got a new lady, and she told me my NOA2 had not been approved yet! I explained the context of my last 2 calls and was put on hold for about 10 minutes and when she finally came back she acknowledged that my case had in fact, been approved and re-approved, but that I was NOT supposed to actually be TOLD that until the NOA2 actually printed out and was mailed - (thats when the email's go out, from the section that actually prints and mails the NOA2's). She said that, (hopefully), it printed out this time and I should get my NOA2 soon, but not to call back for at least 2 weeks, and if I had not gotten it by then, they would do one 'manually' for me.

This may explain why someone else got 2 NOA2's - hehe! She said the possibility also exists that my NOA2 was mailed, but just not entered into the computer system for the email.

They don't ship your packet to the NVC until it shows on the computer system that your NOA2 has been mailed, this may also be the reason why some other people were approved but the NVC never got your file!

It makes me wonder to about those of you who got your NOA2's but never got any email confirming it! You cases could still be waiting in the mail room because they don't realize you have your NOA2!!

WHAT A MESS!

Bill

K-1 Fiance(e) Visa Process & Proceduresi feel very devastated!!!

Be glad they're touching your case! I haven't been touched since the 21st and only 3 times in all of Oct. and USCIS has had my petition for almost 8 months! March 8

No additional RFE's nothing? not in security checks. I guess it just makes a nice paperweight?

Imagine how you'd feel in 3 months if you were still waiting?

I bet you get your NOA2 within a week or so. they're working on your case at least. Be happy for that.

I'd be checking my mail very closely (both of you), I sure hope you get your NOA2's!! I can't imagine how upset I'd be if I were hornet!

I, and others have gotten our NOA2's with no emails about the same time you two were last touched. They've got some major 'system glitches' (at CSC at least!). The people there don't even seem to know what's going on or who's been approved and who has not.

Hornet, you might even want to check with the NVC, explain to them that some people have also had their cases sent to the NVC who never even received an NOA2!!

Can you imagine what the backlog would be like if they had to chage the status to 'expedited' on every case they made a mistake on?

(seriously, at this point, they have been moving so quick once they receive the RFE's you might actually delay your case by trying to get it expedited)

Dear Bill,

hehe! I am surprised it took ya so long to get your RFE, but I'm sure you'll be approved soon also, (that is, if you have not been approved already as the notification system at CSC is running way behind. K-1 Fiance(e) Visa Process & ProceduresGoing back to Thailand to see my fiance
I will be going back to Thailand to see my fiance again on November 15-24. :D

Something bothered me about my last trip, and I am not sure this is the BEST place to post it, so I am going now to post in in the 'off topic' forum. It's about a guy I had to sit next to on my last trip to from LAX to my connection in Taipei, who was going from there to Vietnam, to see his 'fiance' - and I suspect fruad, I'll post the whole story there. I'm just wondering if I should report the incident, or 'butt out' ... and I'm having a hard time deciding but if I am going to do anything, I should do it now, as his petition is probably at about the same point mine is, or so I figure...

Yes, praying is always good. Aside from that, you can twiddle your thumbs, whistle, twirl your hair aournd your finger, check your status on the USCIS website 5 times a day, gripe about how slow the process is... Oh, and don't forget to visit VJ every day and read all the posts here, (misery loves company :P).

K-1 Fiance(e) Visa Process & ProceduresCancel K1 VISA

Is it possible to cancel my application for a K1?

Reasonable question - not covered in the guides and chances are darn good that someone here can help

why do you want to cancel it?

Totally unreasonable question - why oh why must people do this? I seriously doubt it's because you think the reason for canceling actually impacts the answer.

Maybe I'm losing my patience for VJ or maybe I just really need that extra hour of sleep, but I more than a little irritated by people who probe into a poster's reasons for posting a question such as this one simply for their own enjoyment.

I seem to remember reading somewhere that the IMBRA rules dont apply if you are re-apply later for the same person which would perhaps get him different answers if that were the case. If he was going to get married overseas and apply for a spouse visa instead the poster might get more / different answers also.

I've also read some horror stories about some of these 'marriage brokers' that basically run 'meat markets', and I suppose its possible that the poster would get entierely different answers if the reason was 'finding a better peice of meat'... (I've never seen anyone admit to that here, but then I don't read all the posts, and I'm sure that such posters would be reluctant to post thier reasons under such circumstances) - but under such circumstances the aswers would be quite different - no doubt - hehe.

K-1 Fiance(e) Visa Process & Procedureswhat to do????need help

m_hafiz,
Extensions to K-1 are not allowed. If you get married, even outside of the 90 days, you can still adjust status.

I am like Yodrak, I wonder how many days have actually passed since entering the USA. I don't know about staying beyond the 90 days, getting married, and then adjusting status... I have never heard of that before, and would like to hear Yodraks view on that.

I would think that even if you could get AOS if you were married after the 90 day period, it would seem very risky to me. What if you overstay and then don't get married? How would a prior overstay effect a future visa application?

I'd be very careful. If you did not get married within the 90 days as you had agreed to do, I'd seriously consider leaving before the 90 days is up.

Your congressman needs to be made aware that you are far beyond the normal processing times for your petition, and also needs to quit accepting the canned replies of the USCIS 800 number. I'd take a trip down to your congressmans office personally and explain that SOMETHING IS WRONG! I'd demand that they do more for you. Perhaps somone else can offer a suggestion as to what more they can do, but I'd think it might involve faxing a letter and requestint a written response from the service center.

K-1 Fiance(e) Visa Process & ProceduresHow risky???
I've read only about people from Canada trying to visit thier fiances here in the US while the fiance visa petition was still being processed. The advice was to have plenty of 'proof' that you had reasons to return to your home counry with you at the POE. Flying in from Germany would seem to be alot riskier than trying to drive across the Candain border. It would sure be a 'bummber' to be turned around and have to fly back out.

From what I've read, I would not risk it while the petition is pending.

My advice on this matter is just based on what I've read here in these forums. Your question falls well outside any of my own personal knowledge on the matter, so wait for a better reply.

I just posted this to help keep your question at the top of the forum - hehe.

K-1 Fiance(e) Visa Process & ProceduresMy fiancee says she needs to own Land before moving here

If she really came here on a tourist VISA with intention to marry, that would be immigration fraud and she probably knows that. It's likely a scam to get the money for the land.

He should go there for a visit, then do a K-1 or K-3, or nothing (probably the best choice in this case).

Ditto I say! Has he actually met this lady?
