  • Affidavit from witnesses to the relationship/marriage (parents, siblings, other relatives, close friends)
  • Wedding announcements, invitations
  • Church certificate

They mean the copy you get from the court itself just like an original. Well you need to get the divorce paper stamp by the court in Brazil

your mother-in-law can be the co-sponsor she has to say she retired and provide her taxes and a bank statement and do a I-864 affidavit of support and your husband do a affadavit of support I-864 also. He dont have to show bank account if he is not using assets he would only need to show his last 3 years of income tax 2010-2011-2012 tax transcript. If he dont have a job he can write a letter to explain the situation.

Hello!

 

Here is our story :

 

I am French and my wife is American.

Met online in 2005 and got married in France in May 2010, we live in France since then and we decided to move to the US in about 2 years from now. After reading on the forum, I see that we need the IR1/CR1 visa, (IR1 I think because we are married since more than 2 years, right?)

We have few questions :

- During the visa procedure, do we have to be apart from each other ? Or can we do this from France and both move to the US when I receive the visa ? (I see that we can send the first form I130 to the Chicago Lockbox, is that the right way for those who want to stay overseas until the visa gets accepted?)

- About the financial support, my wife will not be able to sponsor me since she won't have an income in the US when we move.(SHE STILL HAVE TO DO A I-864 REGARDLESS IF SHE HAVE INCOME OR NOT) But can her mother, or someone else (friend or other family relative), sponsor me ? (YES THEY CAN THEY WILL BE THE CO-SPONSOR) If so, what do we need for proof and which form do the sponsor has to fill ? (SAME I-864 AFFIDAVIT OF SUPPORT) COPY OF THEIR INCOME COPY OF THEIR PASSPORT BIO PAGE INCOME TAX FORM THEY NEED TO MAKE 125% OF POVERTY GUIDELINE THE FORMS YOU NEED IS HERE CLICK ON THE LINK BELOW. Hello, I'm my husband and I currently live in the UK, I am the petitioner and he is the beneficiary. Our family friend is our joint sponsor since I have been living in the UK for the past 2 years.

 

Our sponsor is married and they have no children so his household size should be 3, correct?YES On Part 6. Sponsor's Income and Employment he has listed his individual, annual income as $50,000 which meets the poverty guideline requirements for a 3 person house hold size.

 

This means there is no need to list his wife's income, correct?

But they may ask for the wife to do I-864a if they filed taxes together. Get the wife to do one just in case they ask for it and that want delay the decision. He may need to send his W2's and tax transcrpts if you are using his income alone because he needs to show what he makes.

 

 

Also, on Part 6, 13.a-13.c where he needs to list his total income, it should just be what HE earned in those years and not he and his wife together? They need total income before deduction do not look at AGI adjusted gross income.

Remember the wife is on the taxes so she will need to do I-864a sorry if you dont have that they may delay your approval until you get it. You probably dont need it but have it just in case and to be safe.

I know that they don't look at AGI they look at total income 3 years of tax transcript would do it from IRS. GOV. 1099 should be apart of your taxes so I am confused about what you mean. So you was self employed or a independent contractor you would have to show all your schedules and so forth. I was a independent contractor I didn't send my 1099 or w2's but I had them when my hubby went to his interview just in case. Send your tax transcript it is less paper that you have to send.

No you can't use that. They need to see pay stubs, a job letter, your w2's your income taxes. So like the post before you need a co-sponsor. You got that money from the goverment and it must be paid back its not income that was earned on your part. So get yourself a co-sponsor

Hellow everyone Good day, we are CR -1 and currently we approve the petition last Dec 6,2013 and currently waiting the Mcn number from Nvc , my Question is When filing out a i864 /i864A for petitioner / co sponsor to determine the right poverty guidelines bracket , I live with my Parents and has 2 kids that I live here also at same address will this mean that I am in a household of 5 or in a household of 3 considering that it's only me and the 2 kids on my tax return Papers ??? if you are filing for your spouse then it would be 4. You + 2kids+spouse= 4. You dont claim your parents and you are the principal sponsor your parents would need to do either I-864/I-864a as a co-sponsor. If father is co-sponsor the mom would need to do I-864a if they claim taxes together their is a lot of embassy that ask for the wife of the co-sponsor to do a I-864a because of them filing taxes together. I am sure someone will either agree with me or disagree but from my experience and what i had to do we had to get a I-864a.  Safe rather than sorry and not to hold up your case at the NVC stage or Embassy stage..

We have just sent off our I-129F to the Dallas Lockbox via U.S.P.S. and sent it using their Certified Mail service (Certified Mail, Return Receipt). Through tracking it via the U.S.P.S. site, it states that "Notice Left (No Authorized Recipient Available)". I'm just a little worried that it's been sent to a near-by Post Office as it couldn't be signed for. Is this the service that the majority of you wonderfully, informative people use or have we made a mistake by sending Certified Mail to a P.O. Box? I notice that on the guide, it advises to send that way so I guess it's worked for others, right?

Whether you need to file an I-864 Affidavit of Support or an I-134 Affidavit of Support will depend on the type of family green card application you are filing. You will generally need an I-864 Affidavit of Support if you are filing a visa application for a spouse and you will need an I-134 Affidavit of Support if you are filing for a fiancé(e) (k1 or K3 visa applicant). You will need an I-864 for most visa applications for immediate relatives and also for some employment-based immigration applications. The two types of Affidavit of Support differ in other ways as well. For example, the I-864 Affidavit of Support is legally binding. If you and your spouse are separated, you will still be financially responsible for your spouse, to ensure that they do not become a burden on the state. As well, you can co-sign on an I-134 Affidavit of Support if you need some additional income or assets declared on the petition to be accepted. In addition, Form I-134 is much simpler and smaller. The two-page application asks for some basic financial information while the I-864 Affidavit of Support is more involved and requires much more detailed information. As a result, the processing times for the I-864 Affidavit of Support can be longer.

Despite the differences, the I-864 Affidavit of Support and the I-134 Affidavit of Support are similar in many ways. Both are necessary for some green card sponsorship applications and both forms will ask you to make statements about your financial resources, including income and assets. Both the I-864 Affidavit of Support and the I-134 Affidavit of Support require that you show that you are sufficiently above federal poverty guidelines to support your family member in the US.
