K-1 Fiance(e) Visa Process & ProceduresDoes the K-1 have to be used on the next entry to the USA?

The K1 visa has a time limit for you to enter and marry. So it may be 2-4 month they give you to enter the U.S. to marry. Its is only a 1 entry visa so you cant come then leave you have to wait until you get AP and that can take up to 90 days to get.

Hii again,

 

A few questions about the medical. On the pricing medical examination sheet it states the exam is 235 pounds, are there any other fees (excluding vaccinations?) My fiance saw something on the pricing information that says "Non Immigrant visa, 280 pounds." Does he have to pay that as well? The website says that he needs to bring an appointment letter from the US embassy to the medical but you can't make an appt for the interview until you've had the medical? Do they mean the approved petition letter?

I am am trying to filled out the DS230 form so i can send it to the embassy to schedule my interview. I already look at the sample example here visajourney and that's basically for single women/people. How should a divorced woman answer questions #9 and #37.

Including my present marriage,i have been married____times.  1 time the previous marriage
 

# 37. Other Names Used or Aliases (If married woman, give maiden name)  Maiden name and the previous married name

If they took his passport that's a good sign. We had to return info too the embassy on 10/22. Just yesterday 10/31 they touch the case. They have my husband passport and say he was approve but we are still in administrative processing. Since your case went from AP to Ready maybe they getting ready to issue it to you. IJS

I know this is a long drive but can you go to Kingston @ St. Andrew Hospital call them to see if they have anything available. Then you can pickup your packet the day before your interview and just stay over somewhere in Kingston the day before. Just a suggestion. You can always go to the interview without the medical but you will get a 221g to bring it back in and then that will put a little delay on your visa issuance.

It varies that's only if you don't go into administrative processing. But once it is issued it takes a few days. Approve and Issued is two different thing so that you know. Once approve you may have to wait before you get the visa. Then once issued that's when you get the visa.

After marriage to a US citizen, I received a conditional Green Card in 2005.

The conditions were removed in 2008 and I received the 10-year Green Card.

After that we got divorced.

I understand now I have to be a Permanent Resident for 5 years before I can apply for citizenship. Is this 5 years from getting the 10-year Green Card or 5 years from getting the conditional Green Card?

The "Residence Since" date on my Permanent Resident card is the same date I got my conditional Green Card (2005).


I could be wrong but I think its 5 years after LPR. The first 2 years where conditonal resident. Then you became a permanent thats when you start to count for the 5 years of lawful permanent resident (LPR). So this would be 5 years later from 2008.

You might have a problem. If you are divorce now that is not going to apply to anymore. You must remain married to your USC spouse in order to get the citizenship after 3 years. If you are divorce I think you going to have a problem.

With Richard's Oath ceremony looming (we hope) I checked the Passport site and it appeared that first time Passport applicants they must be applied for in person. Did I read that correctly. Not that it's big deal but with a trip on the horizon I don't want to make a mistake and delay the processing. Also it says there is fee for Express mail (which I would like to use.) If anyone has used this I was wondering if they issed a seperate check or added that amount in to the fee.

If you fail again you have to reapply and pay again ?

It depends on why you did not pass. If you fail the English language or the Government History examination the first time you will be rescheduled for an interview at least 90 days later and given the opportunity to do it again. If you fail it again that time, your application will be denied. You would then have to re-file and pay the fee again if you wish to apply.

Try again and pay again. There is no limit to how many times you can take the test. Good luck!

When Can I Apply for U.S. Citizenship?

If you are a U.S. permanent or conditional resident -- that is, someone with a green card -- the basic rule is that you cannot apply for U.S. citizenship (or apply to naturalize) until you have lived in the United States as a lawful permanent resident for at least five years. That means exactly five years, to the day. For example, if you were approved for permanent residence on April 17, 2008, you would be eligible for citizenship on April 17, 2013. Check your so-called green card (permanent resident card) for the exact date on which you became a permanent resident.

If you start out as a conditional rather than a permanent resident (most likely because you got your residence either through recent marriage to a U.S. citizen or through an investor visa), your two years as a conditional resident count as permanent residence, on one condition: You must successfully become a permanent resident at the end of the two years.

Any one of several exceptions may, however, reduce the amount of time you must wait.

 

Exception to Five-Year Rule for People Married to a U.S. Citizen

You need to wait a mere three years to apply for U.S. citizenship if, during that time, you have been a permanent (or conditional) resident married to, as well as living with, a U.S. citizen. (See the Immigration and Nationality Act at I.N.A. Section 319(a) or 8 U.S.C. section 1430(a).) You will need to provide proof that you qualify along with your application.

This exception applies even if you did not get your green card through this marriage. So, for example, you could have gotten a green card through your employer, then married a U.S. citizen soon after, and you still need wait only three years from the date of your marriage to apply for citizenship.

You will, however, need to stay married to your U.S. citizen spouse all the way through to your citizenship interview. The exception won't work if you separate or divorce legally prior to your interview, or even if you choose to stop living with your spouse. Unfortunately, you will also lose the exception if your spouse dies before your naturalization interview.
