When filing an application to sponsor a family member for a US green card, you will typically need to file some type of affidavit of support, generally either the I-864 Affidavit of Support or the I-134 Affidavit of Support. In a visa application, the affidavit of support plays an important role. It shows immigration officials that you are willing to support your family member once in the US, to ensure that your family does not rely on tax-funded public benefits in the US. In fact, by signing an affidavit of support, you are legally obligating yourself to take care of your family in the US while they pursue a green card.

Whether you need to file an I-864 Affidavit of Support or an I-134 Affidavit of Support will depend on the type of family green card application you are filing. You will generally need an I-864 Affidavit of Support if you are filing a visa application for a spouse and you will need an I-134 Affidavit of Support if you are filing for a fiancé(e) (k1 or K3 visa applicant). You will need an I-864 for most visa applications for immediate relatives and also for some employment-based immigration applications. The two types of Affidavit of Support differ in other ways as well. For example, the I-864 Affidavit of Support is legally binding. If you and your spouse are separated, you will still be financially responsible for your spouse, to ensure that they do not become a burden on the state. As well, you can co-sign on an I-134 Affidavit of Support if you need some additional income or assets declared on the petition to be accepted. In addition, Form I-134 is much simpler and smaller. The two-page application asks for some basic financial information while the I-864 Affidavit of Support is more involved and requires much more detailed information. As a result, the processing times for the I-864 Affidavit of Support can be longer.

Despite the differences, the I-864 Affidavit of Support and the I-134 Affidavit of Support are similar in many ways. Both are necessary for some green card sponsorship applications and both forms will ask you to make statements about your financial resources, including income and assets. Both the I-864 Affidavit of Support and the I-134 Affidavit of Support require that you show that you are sufficiently above federal poverty guidelines to support your family member in the US.

Dear All,

Were awaiting K1 Visa interview schedule.

Once its approved, were not gonna used it yet as it is part of our plans. When you get the K1 visa it will expire so you have to go and get married within that 90 day frame. (For one is, my daughter will be celebrating her 7th birthday in my home country on January first then i be going to US).

But we want to meet on September coz its been awhile we want to spend time together. Let him come visit you

Im thinking of applying a tourist visa. May i say that i want to visit my fiance and i actually have a fiance visa? then of course if they ask, ill just explain why i am not using it yet....

I want to hear from what you guys think smile.png If they already approve you for a fiancé visa why would you apply for a tourist visa they will cancel that tourist visa.

Just a few quick questions, on question 32 on the DS230 form where it says 'in what occupation do you intend to work in the United States?'. If I don't really know the answer to that question what is the best answer to write? Number 32 don't ask that question it ask you to list all employment for the last 10 years. Ok I see it now just put what he plans to do when he come to America. I don't think I put anything there.

 

And on question 33 on the same form where it asks ' list below all educational institutes attended?'. Is that just asking for college or universities? or high schools too? Number 33 ask to list the schools that you have attend since you was a child going to school

Direct Consular Filing In General Pluses Minuses

Direct Consular Filing (DCF) allows a US Consulate to process a IR-1 / CR-1 Visa (for a Non-US Citizen (spouse) married to a US Citizen) without having to wait for the USCIS in the US to process the required paperwork. Instead all paperwork is filed and processed AT THE CONSULATE. This is often a much faster way to get a IR-1 / CR-1 Visa however there is one requirement that must typically be met:

To Qualify: U.S. consulates will typically only do this for US citizens who are Legal Residents of the country (typically for at least six months) in which the US Consulate sits (overseas). You will be required to show proof. This can be any country with a US Consulate (that the US Citizen is a resident) and need not be the country in which the Non-US Citizen Spouse lives.

If the US Citizen qualifies to file using DCF, in most cases it is the quickest route to obtaining a IR-1 / CR-1 Visa. Be sure to contact your respective Consulate to determine if this option is possible. Do not assume it will be. Once the IR-1 / CR-1 Visa is approved their rights of the IR-1 / CR-1 Visa Holder are the same as if they had gone through the USCIS in the US initially. The Non-US Citizen Spouse will upon receiving their visa and entering the US immediately become a Legal Permanent Resident. Their "green card" will be mailed to them shortly after their arrival. As a Legal Permanent Resident they may work and travel to and from the US freely using their "green card" and status as a Legal Permanent Resident.

I guess you dont know this but each year the amount of money they expect you to make for the poverty guideline goes up each year. Every year they change that amount and you file I-134 now but when you do your AOS you will need the 125% for the I-864 affidavit of support.

you the petitioner always do an affidavit of support regardless of income. I think tax transcript would be the better one less paper you have to send but you can carry does others ones to interview.


 

I just got out of college and have yet to file a tax return above the poverty line so my father filled out an I-134.
  • Do I need to fill out an I-134 as well? yes
  • Do I need to provide proof tax returns? yes
    • If so, do I need a "copy of tax return," or "transcript of tax return" from the IRS, or will it be sufficient to print off my return from turbotax (or freetaxusa.com in my case)?

You the sponsor needs to file a I-134 too because you are the petitioner you are filing for your fiance. So you and co-sponsor should have done one. Until you get these documents in they will not approve his petition so get the forms filled out and send them in. I guess you can make another apointment to take them back in or send them in which ever one you choose.

The major difference between these two documents is the fact that an I-864 is filed in connection with an immigrant spouse visa application and an I-134 is filed in connection with a non-immigrant dual intent fiancee visa application (commonly referred to a K1 visa application). The legal effect of an I-864 affidavit of support is slightly different from that of an I-134 affidavit of support as the I-864 is more enforceable against the American sponsor. That being said, the I-134's usage is technically by discretion of the Consular Post and acts merely as a means of providing a streamlined way of adjudicating multiple parties abilities to support foreign fiances. In the past, it was more common to see many Consulates accepting I-134 joint-sponsorship, but this trend seems to be receding as more Consulates now ask that the US Citizen sponsor show an ability to independently support a foreign fiancee thereby precluding the use of joint sponsorship affidavits in K1 visa matters. This is a recent trend as in the past there were Posts which were allowing this practice, but there are good policy reasons why I-134 joint sponsorship affidavits are in decline.
 

 

 

Keeping in mind that I-134 affidavits are not legally binding, a US Citizen Petitioner could enlist the help of a friend or family member to act as a joint-sponsor on the I-134 affidavit of support for a foreign fiance. After arriving in the USA, the foreign fiance and the American Petitioner get married. Subsequent to the marriage, they file for the foreign spouse's adjustment of status. At the adjustment of status phase, the American Petitioner must file an I-864 affidavit of support, but the original I-134 joint sponsor decides not to act as sponsor on the I-864 affidavit. The I-134 is not enforceable against the original I-134 joint sponsor and if the American petitioner cannot show requisite assets it places the Immigration authorities in a position where they may need to find that the foreign spouse could become a "Public Charge" is allowed to remain in the USA. This scenario leaves all parties in a relatively negative position. Therefore, it is this author's opinion that I-134 joint sponsorship is being phased out in order to make certain that those sponsoring non-immigrant fiancees for a visa to the US can meet their obligations with regard to a future I-864 affidavit.

Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship. I see it now it must be valid for 5 years so this 2013-2018 that's 5 years depending when you got it. Anybody can correct me if I am wrong.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 2. Send copies of the documentary proof that you submitted with the I-129F for your fiance(e) to have on hand for their interview at the embassy. Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well). 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate: 

(A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance 
(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available) 
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern 
(D) List containing serial numbers and denominations of bonds and name of record owner(s). 

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well) 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)
