Just a thought. I have noticed people mentioning this before, that they want the transcript from IRS not the return you sent in.

It only takes a week or less to get one after you call IRS.

In case anyone is ever in the same situation, it took exactly this long to resolve (2 1/2 months or so), which I have no complaints about. I got the corrected card today at no additional fee.

Also they changed the expiry to 10 years from when the correct card was issued.

So I'm done.

I got my 10 year greencard today - in my maiden name!! I applied in my married name and my temporary green card was in my married name, but they got it wrong on the 10 year. Has this happened to anyone else? I hope it is not going to be a hassle to have a correct one issued.

As you already know, turning in your Canadian PR card is never a good idea :)

Hi Trailmix! I can only hope you are correct regarding getting the visa soon. I did contact my congresswoman (she has an immigration specialist in her office), but the woman didn't seem to be too helpful. I am going to follow up again next week to see if I can get her to move a little faster. Anyway, I really can't wait for all of this to be over - it's all so stressful sometimes and it's driving me crazy! :wacko:

Oh...and I agree with you regarding the PR. What if something happened and they decided not to approve the visa? That's a lot of risk they're asking someone to take, for no guarantees in return.

Yeah - we had enough cash in the bank PLUS I ended up getting a co-sponsor, anyway. In the end, the finances weren't a problem at all.

Either way, I guess there's nothing we can do but wait. They received our stuff on March 19th as well, but we've heard nothing.

Well, I can see your frustration. Based on everything you have sent you should be approved.
The only thing I can think of is your income. 80% of my assets which total to quite a bit are in liquid cash,
not in real estate and they will want to see that you have enough income of your own in the US to support your
husband once he lands in the US. If you think you have that all squared away the only other thing I can think of
is to turn in your PR card. I found a form on line at the Canadian immigration website that you can fill in to forfeit your card. I did not have to do this, but I also didn't disclose permanent residency.

When did your package arrive in Montreal? As I said my interview was March 17th and I sent in my additional documentation
March 19th. That might be why I got the quick turn around. But really it feels totally unfair that you did NOT receive
Domicile. How did he even know that you came back and forth to Canada which such ties to the US?
(we also learned the hard way that I should have sent my husband to the interview alone!)
We actually own a home here in Canada so really your case should be approved. Very, very bizarre.
I actually feel guilty that we got approved.
I don't know if some people just fall through the cracks or have bad luck!

Lenie, I don't know that much about your case but you would have to have employment in the US
unless you had substantial finances. Are you back in the US? Living and working?

I am back in the U.S. going to school, but not working. We do have ample finances and own two houses in the U.S., so me not working shouldn't be an issue in our case. For domicile, we sent my mortgage statement(for the house I own alone), utility bills, credit card statements/bank statements showing activity in the U.S., my driver's license, insurance, voter registration, proof of school enrollment, and a few other things.

In my case, I never really moved to Canada full-time, never had a driver's license there, never owned a house there, or anything like that and I never gave up my ties to the U.S. at any point in time. The CO didn't like that I was spending half my time in Canada (and had a PR card) so I could see my husband even though I had only been doing that for a year. Anyway, this whole process is so depressing and it seems like everyone, even those who submitted stuff a couple weeks after us, is getting approved. It almost makes me want to abandon the whole thing and move somewhere else in the world as I am starting to dislike my own country and the ridiculous bureaucracy!

I will write more later but just to let anyone who would find the information useful we
received my husbands US Visa today after being turned down at our interview in Montreal on March 17th
due to reasons of domicile. (I have been living in Canada with him for the last 18 months). I immediately
came back to our home in Ontario and sent in several documents to prove that I had reestablished domicile in the US.
It has been almost 4 weeks to the day that those documents would have been received by Montreal and we got the Visa
packet in the mail today.

If anyone is interested I can publish a list of exactly what documents I sent in to reestablish domicile.

It is a shame they don't tell you exactly what item you sent in that lead to this approval...but I am SO relieved!

:dance: Definitely did a happy dance and even cried at the post office.

PS I even had a lawyer who failed to advise me properly about the issue of Domicile. What a hard lesson.


Conrats, Sunny! Did you use a congressman or senator to help you? It's been 5 weeks for us and nothing!

What does the statement above mean "For the two of you that would be 3 times 125%..." In the I-864p it states a household of 2 needs $18, 212 which is 125% above the poverty guideline. Why is it that the above statement mentioned 3 times that? My husband who is the immigrant will be continuing at his current Canadian employment and working remotely once we move, we want to make sure his salary still qualifies us for the necessary AOS.


That part is if you use assets, rather than income, to satisfy the I-864. So you would need the $18K times three in that case.

Yes, Montreal is a stickler for domicile and they are especially harsh on Americans who have permanent residence in Canada. I had my Canadian PR for a year, and told them that I had tried living there for my husband's job (which is important to him), but wanted to move back near my family. He said he believed that I wanted to move back to the U.S., but still refused to issue the visa to my husband.

I have always maintained that no one would go through the difficulties of applying for U.S. immigration if they had no intention of living there. I mean, who would put themselves through the torture? Though we were denied in November, we have just submitted proof of domicile (I moved back in January). Much like others, I wish I knew the things I do now about the domicile issue. I would have moved back sooner and let my husband go to the interview by himself.

That seems strange to me, too, if that's what they're basing it on. My husband is in a high demand job category that is in short supply (he used to be H1-B at one point). The U.S. desperately needs people in his field and we were denied on domicile.

Much like others who were denied, I have moved back to the U.S. I started taking classes a week and a half ago to show that I am physically present in the states. I figure that by the end of Februrary, we will send in proof of domicile and hope that it is enough to prove I am living here. Being separated is a bummer, but it will all work out in the end.


I'm not trying to be smart here, but how do you know it has to do with the economy? Did they tell you that?

Hi Mike,

Considering the fact that you have the U.S. address, filed with that address AND have a U.S. job, I don't think you'll have much of a problem. Many of the denials have been with couples where both of them live in Canada and want to move over to the states. Even in those cases, usually it is approved if someone has a job offer (plus other evidence) or a job in the states because it shows intent to live there. At the interview, I would suggest that you don't ever say that you "live" in Canada at all (which you probably wouldn't, anyway), but rather that you just visit your wife there. With all the evidence you have, I can't imagine you would be denied.

So the big things here that I feel myself, that it's not an issue is that fact that I'm a USC, working for a US company and that I'm only in CA on a "visitor record." Even if I wasn't working, the fact that I'm here in a visitor record only should make the difference in my opinion.

There is the fact though, that the visitor record has been granted in this past summer and our case was complete last week and realistically, her interview won't be till May or June-ish...that I've had this record for over 6 months, almost a year...

My wife and I want to move into a house in the states once her visa is approved but I'm not going to start seriously talking with real estate agents until probably April-ish... and I'm not going to move out and secure a mortgage on a house when I'm paying rent in Canada with my wife here...But now thinking about it, a mortgage on a house could be another piece of evidence. But after all this has been said, I'd think all I'd "need" to being as domicile proof is job letter. But again, I gave them voting record, and I have alllll that other stuff with my US address on it. But I'm going to bring copies of EVERYTHING even still.

So again, does anyone think this is a problem? Thanks.

CanadaMTL interview scheduling

 

Traditionally MTL gives the NVC dates for the month at the beginning of the month.  It takes about 2 weeks for NVC to fill those dates for the next month at most.

 

Worst case is normally 2 months from case complete date.  If you end in the middle of the month you normally wait 2-3 weeks to get the interview.  

 

Example:

 

I had case complete April 15th, Interview date notified on May 1, interview June 3rd.   

 

Now when Montreal releases those dates to the NVC is dynamic, so it can change.  Traditionally it was the 1st week, but I've seen it take until the 2nd and 3rd week.  I'm guessing because of summer vacations and end of fiscal year issues but my guess is as good as yours on that. wink.png   

 

Seems like lots of folks are getting interview dates now, but I haven't seen anything from Canada yet.   

Fingers crossed for all of us Canadian's crossing over soon.  :)

Could be 1-2 weeks still.  Traditionally they happen first week of Oct, but in July I don't think anyone on the forum received a date and had to wait until Aug for a Sept date. 

 

Really?  I didn't think there were actually time periods that they send out interview dates.  I assumed it was more of a "when requested by the NVC" kinda thing.  Are they normally 5-6 weeks from the time you get the date?

Any recommendations for reasonable hotels in the area, close to the embassy and also things to do?

I have been reading the same thing about only requiring certain vaccines. This is directly from the US Immigration doctors website.

27-49 YEARS

Tdap (Adacel or Boosterix) - ensure you get Tdap not just Td

MMR Measles, Mumps, Rubella. ("MR" and "MM" are not enough). You need MMR

Varicella - If you had "Chicken Pox" disease, no vaccine is needed

Influenza (only required during October - February, annually)

Hep B may only be required up to 18 years old.

 I had my appt. on a Tuesday and did not receive my rpt till the following Friday 11 days later....it would have been ready on the 10th day for pick up.


Is that for Zaltsman or the one on St Clair?

I heard he was a good doctor, but the only issue is he takes the 7 days to process your medical results.   The one on St Clair is only 3 days.  I guess if you need an expedited medical, you do what you gotta do.

I've crossed over for 2-3 months to be with my wife and daughter.  It's a B-2 Visa, so legally we can do 6 months.   The only thing the IO did was put a solid "return by" date in my passport.   

 

As long as you don't have intentions of living in the US prior to being issued your visa/green card, there's really no reason why they wont let you go...unless of course there are other red flags.

Hey Guys,

I have my interview for the IR-1 Visa coming up in about a week and I wanted to know what the consulate will expect me to provide to prove the petitioners financial status?  I have the documents I submitted with the AOS while my file was at the NVC, but do they want this, or do they want an updated list of assets, income, debts, etc????   I had our accounts info printed the last time, and that seemed to be fine.  

 

Also, what will they ask for to prove my marriage?  We've been married for 5 years with child.  Should I bring photos, joint mail, etc...  Any help would be great.

So, I am trying to reschedule my daughters interview so that my wife can attend with her. I logged into the site yesterday and it said next available date was in 39 days. Reasonable, but too early for my wife to attend. This morning when we checked, it was now 105 days. That's not going to work either.

My question is.....how does this work? Was it 39 days yesterday due to a cancellation? Why the huge difference in available dates? We called them as well, and they just recite what's on the website at 105 days.

Any help would be great. We are trying to get mid-late December.

Mine was shipped and I received it next day in Alberta.  I flew home after the interview. 



I hope mine is even close to as efficient. My status changed to "issued" the same day as my interview and then adjusted to show that it's in the final process (meaning being shipped) one day after. Other then that, no waybill and no further actions.
