It's the Scarborough Commissionaires' office I'm going to be using, so that's nice to hear. I'm not sure what the difference between a fast one and the 5 month one is, though. I guess I'll find out tomorrow. I'm hoping that the four / five month wait is for when you just send it off to the RCMP yourself. (omg so hoping)

Um, what's an LFBC? Birth certificate thingie? I have my birth certificate all snugly nestled in my Envelope o' Stuff already, so that's all fine. Assuming that's what LFBC is. :unsure:

As far as having it all ready by interview time goes, I was under the impression that you don't even get an interview date until they receive the checklist completed and signed?

I've only lived in Toronto and Ottawa, so it's all Ontario anyway... but Metro Toronto Police don't do fingerprinting for civil matters like visas. They have it all outsourced. And since I actually do have a conviction, I can't just get a clearance certificate -- apparently I have to get an RCMP-approved fingerprinting agency like the Commissionaires to provide me with a copy of my complete criminal record (according to the Metro Police site)

At this rate I'm going to have to get my passport renewed as well... Montreal requires a passport that's still valid for at least a year at the time of interview, and mine expires in May 2007.

Well, luckily the nearest Commissionaires' office is open until 1 pm on Saturdays, so that's where I'll be going tomorrow morning. The best I can do is to do what I can as fast as I can, and just hope that there's an Express Lane for government requests or something.

Received Packet 3 from Montreal this week (yay me), so we're one step closer...

Of course, being the stressy little monkey that I am, I've decided to fixate on the 150 day turn-around estimate given on the RCMP's and Commissionaires' sites regarding the fingerprint / Canada-wide record check.

Thing is that I do have a conviction from 1992 or 1993 or sometime like that for DUI, but absolutely nothing since... Trouble with that is that I require court documents which 1) will take about two weeks to get because stuff that old is archived and 2) requires the exact date of the court appearance (contrary to what two people at the court told me when I dragged myself all the way across Toronto in a horrific ice storm to fill out the form)

Anyway.

I'm wondering if anyone's got any info about how long it realistically takes for the Commissionaires to do the check in Toronto. 150 days seems very long, but if that's what it takes then that's what it'll take. I just really don't like the idea of having to wait that long and then being told "four weeks" by Montreal and having it end up being November by the time I can go. That'd be really pushing my frustration envelope. :(

I know I'm not what you'd call a Heavy Participant here, but that's really because I find the answer to pretty much every question I have just by searching. This board is an incredible resource and (more importantly) a wonderful support group for all of us undergoing the immensely stressful visa process.

Anyway.

It's been about six weeks since I got my interview appointment letter. Go me!

I spent the summer in California, ten weeks with my fiancee, and other than having to fill out one of those "You give it back when you leave" things, it was all lovely. To be honest, I was a little concerned that I was pushing my luck... Showing up at the airport with a return ticket ten weeks in the future while you've got a pending K-1 and the next thing on the journey is the interview? I wouldn't have been in the least surprised if they'd laughed at me and told me to go home.

But they didn't, and we had a great summer, and when I got back there was still no interview letter waiting for me. So I phoned and Montreal said "Everything's cool, probably be a couple more weeks until you get the letter"... So I waited almost a couple more weeks before phoning again (because I'm impatient like that, you see) and they said "Looks like you're scheduled to come in on October 18th" and I said CAN YOU SAY THAT AGAIN PLEASE :dance:

So that was a good day. And the next day the letter was in the place where that guy with the bag of letters puts them. And so that was a good day too.

So yeah, here I be. 90% finished, but no less stress. Which is the way it is, I suppose.

Two and a half weeks from now I'll be sitting on the other side of a table from a guy who is saying "Okay, that's great. You're approved. Come back tomorrow and show them this and..." but I won't hear him because I'll be too busy saying NO LISTEN I'M NOT DONE TELLING YOU HOW GREAT THIS IS SERIOUSLY MAN and making hooting noises as I grin big enough to split my face in half.

All told I guess it will have taken 13 months or so, but that's with an RFE at the start and the Long Way of doing the police check. Roughest year of my life, and not likely to unroughen for a couple weeks more, but holy cow nearly done.

I don't think there's any hard and fast rule about it. I visited my fiancée twice during the K-1 process -- once I went through easy as you please and once I had to get a B-2 visitor visa. Mind you, that time I was going for ten weeks, so I can't really fault them for wanting to make sure I left again.

My fiance and I have begun the road to getting married. From what I've read, it's hard and time consuming but worth it in the end for obvious reasons.

We sent in the I-129F form probably just over a week ago. He hasn't received receipt of it yet, but we're waiting the 30 days they claimed to send the receipt out.

As for gathering evidence and what not, besides pictures of us together and emails, and other minor sources in our life (ie. playing mmo video games together and phone conversations), what else can be used?

If someone can point me to something I've missed on these forums, I would be incredibly grateful.

I tried to look for this info. but I can't seem to find an answer for my question so, that why I need you guys to help me. My fiance came here with K1 visa and we decided not to get marry at this time. He will be leaving next week because his visa will be expiring. So, here is my question, when can he come back to United States again? Can he come back right away or there are waiting period? He is from Sweden so he doesnt need to apply for tourist visa or anything like that.

Just came across your post and thought that I should comment. I am currently going through a second submission of a K-1 visa with the same person. Be patient :)

My fiance and I were in a similar situation. We were approved for a K-1 in 2007 and within the 90 day period we decided not to get married, things were just really stressful at the time. I returned back home in Sept 07 within 90 days unmarried. We loved each other very much but because of family reasons and the timing of everything we decided it was best not to go forward at the time. I went back for a visit in Dec 07 to spend more time with my fiance. My plan originally was to stay a month but ended up staying for 6 months. Im from Canada so I didnt need to apply for a visitor visa. At the time when I returned to Canada I did not have a job and had been staying with family so I didnt have a mortgage on rent in my name. Crossing the boarder was painless, although I admit that I was very nervous.

Since then I have made numerous trips to the US with no problem, we reapplied for the K-1 visa and have an interview next week. All in all I can look back as well and say a lot of money was spent and time has lapsed but its definitely worth it. My fiance and I joke all the time and say , who would but themselves through this tedious process twice. :) Although our journey is not over I think sometimes its easy to forget how challenging being away from home is sometimes. So I can definitely relate to your fiance.

We have been in the process for a year and there is still no light at the end of the tunnel as it seems our approved petition has been sent to AP HELL. After which there is still a 4-7 month process to wait for an interview in Montreal.
All of this with seriously ill infant that I must take care of on my own.

It hard to watch tv footage of illegals parading in the streets burning American flags while those of us that are obeying the law are at the mercy of an understaffed and slow moving system.

Q15 threw me a bit as well - all the other questions in the right-hand column ask specifically about 'your relative' (i.e. the beneficiary), whereas Q15 just asks for 'your present employer'.
If I am the beneficiary, and am receiving EI benefits, should I write 'None', and the date I started claiming EI?

The other lady who is in your situation is tauruslady. She had an interview for January but had to cancel it, has been waiting since then for a reschedule.

As you have discovered, there is vitually no way to contact anyone at the consulate directly, and the only way to receive an immigrant visa appointment is to wait for them to schedule you one. :unsure:

As pointed out in previous posts, there are numerous Canadian filers in this same situation (although waiting for first interview date, not a reschedule), you can read more at the IR1/CR1 Interview thread and the DCF thread. Very long and frustrating waits all around. :(

I'm new to all the immigration process myself plan on filing for the CR-1 this month, but it's to my understanding, that you as the US citizen and biological father of the child makes your child a US citizen as well. In my case my husband (the USC) is only petitioning for me and as for our son we are filing for a "Consular Report of Birth Abroad" This recognizes your child as a US citizen through relation to you.

If she changes her passport before the interview, then her visa will be issued in her married name. Then her US identification will also be in her married name

Sorry that I couldn't help you out more about the CR-1 process, as I have no clue about that....Nevertheless, I hope you do find the answers that you do need here on vj from others who have gone through the same process too.

That's odd that in your other post, the guy's wife's married name was changed back to the maiden name.
I think it also make sense, as the name on the CR-1 visa (which is a page in your passport) has to match the name in the passport, in order to be used for travel/immigration processes.
So if I were you, this is what I would do: Update your Canadian passport with your married name, asap!
It's better to spend $100 CDN on a new married name passport now,
than to have to spend another $300+ for a replacement green card later with your maiden name to your married name,
as whatever they put on the appplication form is what is going to be on your green card right away for a very long time (unless you pay and wait for the replacement or wait until US Citizenship).....

By the way, Canadian passports only take about a week when applying within Canada. Just go to your local passport office, apply in-person, submit the forms and fees and photos and get the guarrantors and references, and you're good to go. Do this first, then you have new identification and proof of your new married name. You can then use your married name to travel and other purposes later on, which makes things a lot easier too.
So when you get this CR-1 process all done, you will have your Canadian passport and green card in your married names..and you can change/update your other identification accordingly.

Lol..I think you might be right about the name change thing for me, as I was already here in the USA anyways, so they didn't have to bother with a visa for me, and hence I could wait later to do the name changes later on (though it some cases it was harder to get it changed later). Lol...Oh well...

P.S. You have your SSN card and number for the rest of your life, regardless of how you got it in the first place. So all you have to do is just update the SSA about your new immigration status and your new married name and you're good to go there. Lol..It sure beats applying for a new SSN in the first place! At least you have an SSN already, which will certainly make your transition into the USA a lot easier too, as you can start using that right away!

Just had my interview a couple days ago and as far as the name thing goes... I put Down her now married name when i first filed the forms.. At the interview they changed it back to her original name because it had to reflect whatever was on Her passport and they made her "alias or other names used" the married name... So whatever the name is used on your passport, use that... and under "aliases" use the married name.. Either way using the married name didn't change or affect my processing times. And they corrected it in the end:)


So all her US identification will be in her maiden name? Like her Green Card and SSN?

If your case is a straightforward you will find all of the information you need here and should have no problems filing on your own. You will find many examples of couples that have spent money on lawyers only to realize later they could have managed just as well on their own. This process is expensive enough as it is! Not changing your name definitely won't hurt you if you have a bonafide marriage.

But since you haven't changed your name as you said, I don't understand the difference between your maiden name and your married name. You said you haven't changed it so it should be identical. You would need to clarify that for me.

As for the SSN, I would suggest you simply write an email to the Social Security Administration and find out if your SSN is still valid or not.

Changing your name does not affect the petition in anyway. Make the decision to change your name not based on immigration but based on what is important to you. This is the 21st century, many women dont' change their names and USCIS doesn't care. On the forms, put what your name is, if you changed it then put your new married name.

Yes, if you have an SSN then put it down. When processing the forms they'll know you were in the US on a J-1 and will expect you to have an SSN, if you dont' list it, it looks suspicous.

Your SSN is yours for life. WHen you move to the US on your new visa, make sure you go and update your status with the SSN office

PS you don't need a lawyer, you have found VJ so save yourself thousands of dollars and post your questions here. If you have a complicated case then by all means hire a lawyer, but if yours is simple, then VJ is for you!

The rate I'm going maybe I do need to get in contact with another lawyer, it's so weird how it looks so easy from the outside but once you start to read and fill out forms, the confusion and headache set in.

So I have not changed my name since becoming married last year, now does this affect me in anyway? Does it affect the "bonafide" relationship that we must prove? Also, does my husband use my maiden name on the forms or my married name?

Also (bare with me) 2 years ago I was in the US on a J-1 Visa. I received a SSN with this. On the forms where it asks for my SSN do I put it down? I'm assuming that I will keep this same SSN unless it was just a temporary one?

We did submit three affidavits in addition to the required marriage license. Whether or not they were necessary who knows. We did not send any other evidence (photos, emails etc.); those were saved for the interview.

Thanks everyone. I am referring to the evidence of a bonafide marriage. I was going off of the I-130 checklist on the site. According to the list it says need:

1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financialresources; or
4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
6. Any other relevant documentation to establish that thereis an ongoing marital union.


So is it not necessary to send this off in the first package? Do i save these things for the interview only? Now I'm confused.

Just wondering if anyone has or knows where I can find an example of an affidavit for me to use towards proving my marriage as bonafide? (Filing for CR-1)

also do these affidavits have to be notarized? or just signed by the person? Also should they be typed or handwritten?

I'm trying to get this first package off to start this process, we are taking longer than necessary! I want to start my own timeline too :(

Yup, Montreal is the only consulate that does spousal visas

Montreal consulate will only accept police certificates less than a year old. SO you may have to get a new one for good measure. I had one in June and I interviewed the following May and required a new police cert.

No. He just sent it as priority mail and foolish him sent the receipt of the money order sent. I'm sure he can still trace it if he goes to the location he got it from, by using his name and what not. I should tell him to go ahead and do that.

My husband sent off our I-130 Package July 17th, 2010. There is still no NOA1 received. I'm judging based off of the average timeline and it seems we are way behind. I'm worried. Do we wait longer before trying to contact anyone? We looked up the package's location via USPS and it says it made it to Chicago on July 21st. I wonder what the hold up could be.

So,

My husband sent off the I-130 petition a few weeks ago and I had left him specific instructions on the order the package was to be in and what to make copies of. Well, he put them in order alright....including every copy as well as our son's original birth certificate (60 dollar fee for the document and its expedition) as well as the whole money order, he didn't even rip off the receipt part. I was furious to say the least when I realized this, which was not until a few weeks later. I thought that my instructions were thorough enough, but obviously that wasn't so. He also "assumed" as he said that they needed the copies.

From now on I will let him read over things with me, or make sure that i'm there to send off the package with him. He leaves it up to me more, as I like to control things like this, but he should be familiar with the whole process as well.

Anyways, we received NAO1 in the mail this past Monday (August 9), but what I wanted to know is if not having the copies of all the forms filled out will be a problem in the near future? Also, is there a way that I can get back my son's birth certificate from them, or am I better off requesting another one? I know I will need it again during this process, and I also need it for his application for his certificate of birth abroad.

This is a GOOD woman. She obviously cares and has taken complete control. What she is doing is totally against normal protocol I am sure.

She is turning into a total saviour. I can only imagine her workload right now.

I have a BIG admiration for this woman.

I agree that this is probably totally against protocol. I admire her as well. She realizes the mistakes that were made and that is why she is getting on a more personal level with us in responding to emails and trying to reassure people.

This was all we wanted all along, just someone to tell us what is going on instead of leaving us in the big black hole. I'm not out the clear yet, but I feel way more at ease right now.

I will take this "soon" and shutup. I need to just have patience. They screwed up big time, but they are obviously making extreme efforts to get us along!
