IR-1 / CR-1 Spouse Visa Process & ProceduresNVC HELP
I'll go give it another read.

So I think I understand the difference between the 2. The lawyer is submitting everything. Maybe a better question is can both the lawyer and myself opt in or do you know if it's one or the other ?

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC HELP
Saylin,

You rock !

Similar question to what I asked on your May NVC thread yesterday.

This is all so nicely laid out on VJ that I feel like I only complicated things by getting an immigration lawyer. So, he's doing electronic processing for us. We're all ready to fly through NVC just waiting for case number and to pay the fees.

My fear was that if I called and opted in for email that I would somehow undo what he's set up for electronic processing. So, I still need to give NVC my emails, he does the DS260 via electronic processing and all the other stuff by electronic processing.

Basically all the emails do is notify me when stuff is happening so I can keep on top of him ?

IR-1 / CR-1 Spouse Visa Process & ProceduresHow long is the wait for CR1/IR1 Iterviews in Montreal

Hi, just to put in my two cents of experience. My wife's case was approved on April 2nd, 2007 at NVC and I spoke w/an agent there earlier this week. He explained they were trying to get us an appointment this month, but nothing was available yet. So we're hoping that this gets taken care of by July at the latest. Sorry for those who got approved in May, and good luck...seems like a ####### shoot to me.

Hi,
we are May 08, still no word... so that means I will have no interview in August since you did not get one by now... pls let us know when you get one... would help brunches...

I know exactly how you feel. The same thing happened to me. When they send you a checklist of all the docs it usually is because they have not inputted your docs into thier system yet. They then input the docs and if they actually find something missing they will send another checklist for that one. In my case it was proof of legal residence in Canada so i sent it in as soon as i found out they needed it and they just received it today, 2 weeks later so if you can, send the copy of they DS-2019 as soon as possible because this will hasten your process. Good luck.

Thanks!

I just sat down at my computer to go ahead and send in the DS-2019. Well I'm actually going to send the two packages all over again. I hope I don't get any RFE's after this!

So I called this morning like I said I would and of course no answers can be given to me. Just "I'm not sure, send it all again" WHAT? They have no sign of it in the system!!!! How do you lose an email? I think it's ridiculous. I mean It's not a crazy hassle since it's electronic and I can just resend the files, but I can only imagine how it feels for the people who have to mail these things in and this happens...how annoying!

I do have to provide a copy of my DS-2019 from my J1 visa I had a few years ago, so I guess either way I would have got an RFE, but come on state it for the right things. They basically are asking me for both packages as if they didn't receive it.

:ranting:

I opened up my email a few minutes ago to have two RFE emails asking for everything we already sent in!!!!! I'm so confused right now and don't understand how these things could be missing. My files were in PDF format and I double checked over and over. The only thing I can see on the RFE checklist as valid is a statement about me no longer having a J-1 visa other then that they are basically asking me to send in all supporting documents I sent in. Grrrrr not a way to start this hump day. I'm extremely annoyed and will be calling for some answers as soon as they open.

Oh my, I have not been on the forum in ages! I've been soooo busy, and pretty upset at some circumstances that held me back a whole month to get my AOS/IV package sent it. So finally today all of that was completed. *sigh of relief*

I'm so out of the loop, and definitely can't read all that I've missed. I hope to just catch up along the way.

I hope everyone is doing well!!

Hubby and I are going over the AOS and we are actually confused.

He is sponsoring me and not our son, as our son will get his U.S citizenship from a consular report of birth abroad, being that his father is a U.S citizen.

For the household size, does he add our son as a dependent? I know in the instructions it states:

"21d - Enter the number of unmarried children you have who are under age 21, even if you do not have legal custody of these children. You may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax returns."

He does not claim our son on his tax return as my son does not have his SSN yet, but he still is financially responsible for him

I think that he should count our son as a dependent, but I just want to make sure.

Any help with this question is appreciated.

Hi guys

So for the AOS we should have an employment letter plus your tax info for the recent year, and then 2 more years if we want? Or is it just the employment letter or the tax stuff..does it have to be both?

AOS fee and IV fee are different.
AOS - $88; IV Bill - $404
IV bill will be generated after they accept 3032 (COA)
IV bill is for sending DS 230 forms and packet.

Ok thanks. Was confused when I pressed pay that it showed me $88, but it's just because it's not generated yet.

Question:

What is the difference between the AOS fee and the IV Application Processing fee? They are both $88??

Yesterday when I paid my AOS fee I saw the IV application processing fee underneath and I couldn't select it, but this morning when I logged in it says Not Paid and gives the option to pay?

I'm just confused.

Hmmm...seems I will no longer click on links here from VJ as they aren't always up to date, I must of been going to an old CEAC site because now it's working through the link I pressed on the NVC site.

I spoke with an operator and she said they are the same form but to go ahead and fill out the DS-261 just in case.

Poor me guys. I'm so anxious to get things done. I'm gonna have to stop and wait until my son goes to sleep because I can't concentrate on both things at once.

A ha. I went to the site through a link here on VJ ...Electronic Processing. ...and I was following that, it may be old instructions.

I will call the operator and see what they say. UGH! I should always check with the Sensei before making any moves!! I know better next time. :bonk: :bonk:

Definitely use IE. Safari and Chrome always give problMy linkems with the payment portal site.

Well, the online forms are REQUIRED for Canada now. I believe you were supposed to fill out the DS-261. Where on NVC's site did you see to attach the DS-3032 with the optin email? That's only for those doing EP, but not eligible for online forms. I just sent my optin email by itself and filled out the DS-261 once it was available online. But since these forms are the same thing, I'm not sure if it will make a difference. I'd call an operator up and ask about it.

Mrs. PFemaleCanada2011-03-09 19:43:00

It's the online version of the Choice of Agent form that can be found on the payment portal site with the DS-260.

Yeah, it's supposed to. Are you using Internet Explorer? The payment portal is designed for IE and might not work in other browsers.

No, I'm using Safari. Ok onto the old laptop I go. Ummm...so was I not supposed to send in the DS-3032 form? Are these forms the same thing? I'm so confused. I sent it in with my OPT IN email as it says to do on the NVC site.

I know that by having a lawyer, there is no DS-3032 because the lawyer is automatically designated as the agent and because of that both bills are generated at the same time. The only thing I don't know is if you could pay them. I thought your lawyer has to because he's the agent. I'd call up an operator asap and ask about this.

Saylin, I'm looking at your NVC timeline. What is this DS-261?

Received an email from NVC - contains the attached pdf file with 5 pages. In short - it has AOS and IV instruction to make payment. Now also able to login to the NVC site to make payment. Can I select both AOS and IV and make both of these payments at the same time? Using a lawyer for processing the I-130, so nothing mentioned about the Choice of Agent. Email addressed to a lawyer, but copied both to petitioner and beneficiary. I agreed with the lawyer, that I will make payments myself. Any suggestions before doing so?

Lucas we seem to be on par with everything. I just got the email too.

Haha, sorry for leaving you in Canada :P I'm doing good! It's nice to finally be back in the USA! Got my green card last week, just waiting on my SSN now which I had to apply for in person on Friday.

And the email you got means CC! Most people get the SIF first. Are you checking on the right site? https://ceac.state.g...ice/signon.aspx If you don't get SIF, it's not a big deal. The CC email is what counts ;) Plus, the AVR should update to reflect a CC as well.

Either in a few days or a few weeks, you'll find out your interview date. Good luck!

Super Saylin to the rescue!! Of course I was looking at the wrong site. :bonk: Poor me. I clicked on the link you posted and sure enough "Sign in Failed"! That makes me feel a little giddy!

I got 2 RFEs within the past few months. I finally got this email a little while ago..

All documentation necessary to complete the National Visa Center's processing of your case has been received. As soon as an interview date has been scheduled, the applicant, petitioner and attorney (if applicable) will be notified.

The applicant should NOT make any travel arrangements, sell property, or give up employment until the US Embassy or Consulate General has issued a visa.

The US Embassy or Consulate General may require additional documentation at the time of the interview

Thank God no more RFEs, I would of just had a breakdown. Does this email mean an SIF will follow soon?

I just want this to be over with. October (the month I plan to move) is so far away, yet I know it will come fast with all the things I have to do take care of before leaving, including our son's American Consular Report of Birth Abroad papers, that we still have yet to do (long story as to why it hasn't been done yet).

I wish everyone the best, it has definitely been a journey!

I just sent a text to the reporter that interviewed me to find out what happened to the article.........................I want the story out there so people really can learn what happens, or should happen when dealing with USCIS.

And as thrilled as your wife sounds, I can "hear" the excitement in your posts as well. No better feeling than knowing you will all be together very soon!
