Just an update, the immigration of officer my husbands been dealing with - in additional to the hotline have told my husband our I-130 has been shipped back to the NVC on Friday. There is no explanation as to why it was requested back in the first place but I imagine it was an obvious error and part of the K-3 problem.

What upsets me more is that it can take another 30-60 days to REACH the NVC, so that will be a totoal of 4 months wasted because of THEIR mistake.
Hopefully, they will take this into consideration when we request a medical expiate because pf the situation with our daughter given the fact that had this not happened, I would be getting ready for my interview right now.

You will get an A# from your I-129F application approval. Look at the approval notice, it is on it.

A friend of the family works in the US consulate in Toronto and he made some inquiries but could not come up with anything as- his boss also spoke to my husband and said he was completely baffled as to why the USCIS would request it back in the first place. My husband had a job for the DND so he already had special security clearance. They also has my police certificate showing I have never been arrested so I really doubt there was any sort of hit on our names. Not to mention that we just had a baby together and there there isn't high instances of immigraton fraud with the US and Canada.

Our lawyer advised us to cancel our still outstanding I-129 petition thinking that may be the cause, ironically enough her letter to them requesting it be canceled crossed with out letter of approval). So again, it couldn't be a false hit, as they wouldn't have approved it if they felt they approved the I-130 in error

Nor have we received a letter stating that we are in any sort of administrative review.

A few weeks later, there was a "Touch" on the USCIS website in regards to the I-130.

Today, my husband met with an immigration officer who said that the she has no record of the USCIS ever requesting it back- nor does she have a record of receiving it from the NVC.
She seemed to think it went to a storage facility they keep applications in for people that are currently in the US on other visas while they await the process. #######?


So after a third info pass appointment - my husband was finally able to convince and officer to contact the NVC to find out who requested the case and why. Hopefully, they will find something out.

My husband also said that the officer told him that I have an Alien number assigned to me...does this make any sense because from what I have read that happens when you apply for your Green Card or when you do you AOS. Which we have not done since I am still in Canada waiting for my visa. Does this make sense?

I'd like to add that I am NOT in the US, I am in Canada with our daughter. Our frustration is compounded by the fact that our infant ( who is a USC through her father) has a serious neurological disorder and we are trying to get her into the US asap so she can receive early intervention therapy that is offered by the state.

Just wanted to know if we allowed to use a PO BOX or do we need a physical address to report to USCIS??? I am not sure how safe the area is but , understandably so, he does not want anyone going through our information/letters.

He said that it will have a physical address but it is still a PO BOX, isn't it!!!???? That is why I am hesitating but we spoke to a USCIS op and she said the PO BOX is okay, but i would far more trust a VJer ANY DAY

LING LING, in December it will be TWO years- so that is exactly what I should get- but who the heck knows- anything can change. I dont think that I can give up but sometimes being far apart, as we all know, creates tension but we have to overcome this obstacle. For us and our son too!

Well, since they transferred the file in August, they said we would have to wait 60 days before we can make an inquiry. I am the CC and my husband is the USC- so we decided to involve the congressman in our area. No, there are no RFE's or anything of that sort. I am at my wits end and not sure where to go from here but to congress and hopefully that works for us!
I really feel most horribly for my husband who does not get the time with our son that I do!

I can not believe that it has been ONE F#@%in year and absolutely nothing--more than the record being transferred from one service center to another-- has been done!! I am totally annoyed that we have to put our life on hold for I dont know what.

I wish that they could tell us one way or another whether we are approved, that way we can move on- I am sure we all feel that way but to be in limbo for one year or longer, this is completely bananas!

Anyway, I thought that I should let that out!!
I dont feel any better but I said what I said.

Well I told my husband that we should call the congressman in Atlanta but he did not listen to me and had made an inquiry to USCIS- I thought, like others, we would not hear anything, but they replied in roughly one week after the inquiry. If it wasn't because of the call, I would like to think it was because it was over a year old- but there are still a few more of us out there!!!!!!!!

This may not help, but I was travelling from the US back to Canada with an expired passport and since I am a CDN citizen, I was able to enter back into the country. I would suggest you be there a few hours before.

Well my confusion is that when you check "head of household" that means that you are the one earning the income for the household!!! So that does not exclude that you are married, does it?????

As a Canadian, that is not an option! My taxes do state that we are married and I had to show the amount he made.

So I have an interview third week of May and wanted to ask what are we supposed to do if our joint sponsor, because he has a med-sized business and a wedding the same month (pretty hectic to say the least), has filed an extension. My husband has requested his 2008 transcripts so we should be good there but we need the joint sponsors tax return right???

So does that screw us up in the interview? Should we reschedule???

THis has been going on for soooo long, I am so tired of this- I am sure you all understand!!!!!!!

Quick question, you are aware of the affidavit of support form? Because your wife will not be working you will need a joint sponsor or else enough assets that are easily liquidated to cover 3x the 125% poverty guideline for a family of 3. I'm not sure because the child is being petitioned as well if it is 5x or still 3x.

Because you wife has proof of school etc, you might get an expedite due to extreme financial hardship? I'm not sure on that though.

Unless you have a legitimate medical/financial reason that you need to be with your spouse and LOTS of evidence to back up that claim, an expedite won't be granted. Even if it were, you'd still have to wait in Canada, and request separate expedites for both NVC and interview scheduling. Even then you'd be cutting it close to an attempt to be there by July.



What about the fact that my 2 year old daughter needs to accompany my US Citizen wife to the US in July. My daughter is also in the I-130 approval process. Plus, my wife will not be working and I am the sole income earner while she's in school (income from Canada, not US). Should that be enough to expedite?

Wondering if someone can help with this issue...

Wife petitioned me for PR and we filed the I-130 in March, still pending approval. My issue is that she is starting school in the US in Aug and I need to be down there with her in July to help take care of my daughter. I don't have to work in the US as I run a company in Canada, but does anyone know how I can potentially live in the US during the process instead of waiting abroad and abandoning my wife and daughter for many months?

Any advice is appreciated.

Thank you...yes, I've read up on this, about domicile. My wife is already registered for school and she has all of the docs for this. Her mom will also be writing a letter confirming that we will be sharing a home with her and we'll be paying x amount of dollars. I love this site...I wouldn't have known to do any of that, if not for VJ!



I am in a similar situation where my US Citizen wife will be attending school in the US and I am still awaiting my i-130 approval for myself and my daughter. I am the only income earner and have substantial assets to help support her. Does anyone know if this can help expedite the Visa Process for my daughter (2 years old) and I?
