Thx for the info. It's really interesting. As for " if your are going for a CR-1 / IR-1 visa" I guess it is the same for family-based preferences (F1, F2A, etc). It seems like at the NVC stage all the cases are processed in a similar manner (correct me if I am wrong on that).

I also heard that some consulates have quotas for different categories but quite often interviews are are scheduled on a first-come-first-served basis (I read it in a press release from last year's information session for the media)

Thanks for the advice...I think I will also snail-mail it to them...they are dragging their feet with generating DS 3032 for me even though my PD is current already in July (I am in family-based F1)...I was hoping that I can send it to them now so that it would be in the system around the beginning of July.

Take some vacations instead of waiting...it took 14 days for them to process my email with DS 3032...that was the beginning of July, so unless a miracle happened and they are lighter on workload, kick back and try not to think about it.

The good thing is that after they accept it, you will get IV bill usually within 24hrs, and if you pay immediately online then 1.5 day later your DS230 cover sheet should be ready for printing...and DS230 on its way to NVC

Just a small correction...I assumed they want a DS2019...as the NVC operator was not sure what that is they need...gotta wait for the RFE!

In the meanwhile...does anyone know what needs to be sent to them concerning proving that you are not subject to 212(e) 2 year residency? And does it have to original (if it is ds 2019) or can it be a copy?

Obviously, NVC requests DS-2019 from everyone who ever stayed in the US on J1 visa...an RFE is on its way to me....I was just wondering, if they require us to send them the original or a copy of it...anyone has any idea?

I was wondering if you have any idea how long it takes for NVC to process a RFE once they receive the requested docs.

My case would've been completed this week but NVC requested a copy of ds2019 a document that they do not even list as something that is supposed to be a part of DS230 packet. mad.gif Since I am not a mind reader there was no way I could've avoided this RFE...any ideas on how much longer it might take in a situation like this?

My RFE was just delivered to NVC today...let's see how long it takes them to take a look at it...

In case you receive a false RFE for Ds-230 which happens sometimes, you will have a bar-coded coversheet ready in case there is any RFEs in the future...this way you don't have to wait for NVC to send you one or make one yourself...so a useless RFE turned out to be of some use eventually smile.gif

IR/CR cases can be re-assigned to a different post for processing. MTL has specific requirements, take a look (it is from SUPPLEMENT TO INSTRUCTIONS FOR IMMIGRANT VISA APPLICANTS packet 3 I guess):

Note on jurisdiction. Immigrant visa processing at the United States Consulate General in Montreal is limited to:
• Canadian citizens and landed immigrants.
• Non-Canadians who reside temporarily in Canada and have the permission of the Canadian government to remain in Canada at least six months (for example, those on a study permit).
• Persons now residing in the United States whose most recent foreign residence was in Canada. “Most recent foreign residence” means that you were a student, temporary worker, or landed immigrant in Canada for at least six months prior to moving to the United States.
Please note that this list does not include refugee claimants, unless and until they have subsequently been granted refugee status in Canada.

Contact NVC and they can request a different consulate for processing if you send them your request together with a copy of your visa/work permit. You can do it via email and attach a scanned copy.

For all those that consider whether to email or snail mail their DS3032, I have some NVC processing timelines...I guess just to verify what has already been discussed. It takes NVC no less than 8-9 days just to open an email sent to NVCinquiry so that's about the time you will have to wait for your DS3032 to show up in the system. The times when it was quicker to email the form are over!

Once you are accepted at a university you can apply for F1...but since it is a non-immigrant visa you will have to prove that you do not have immigrant intent...which is kinda impossible once you have IR-1 pending...so in this case you would have to convince the CO that you will not violate conditions of F1 visa, etc. But if you start with IR-1 now you will have it by the beginning of the new academic year in 2010 I guess...

Lgg, it was about DS2019...a thing that is not even listed in the packet of forms they require, so there was no way I could've avoided that...applies only to people that had J1 visa before. Now I am really, really frustrated with NVC...my checklist response to their RFE was delivered at NVC's premises last Monday so over a week ago (I know I had a tracking number) and it is not even in their system yet as 'received.' Seems like for over a week now they have not even opened the envelope to scan the barcode! mad.gif

Does anyone have any idea how long I should wait before sending them an extra copy in case they lost it? AOS docs and DS230 packet is usually opened and scaned into the system within 2-4 days...is that possible that RFE go some other way?

As I told you before, I am not sure that they even read emails we send there...and even if you don't even have a name of the person who answered your email to hold them accountable for this information...apart from the fact that "it should not" basically means "I am not sure,"...so no guarantees there.

Usually when someone is admitted as a visitor they cannot study full time. That is why there are specific visa categories for students and exchange visitors (F and J categories). Check this out:

I remembered reading somewhere (like a press release from a visit journalists paid to NVC) that each consulate has quotas for specific categories of visa interviews (CR/IR; Family-based: F1, F2A, F3, etc.; K) and on top of that they might be scheduling them not olny according to when the case was completed but also the priority date.

Permanent residents of Canada can be interviewed in the consulate in Montreal, so he can have his interview without leaving the country. Just make sure to attach a copy of his permanent residency card with DS230 package when you are sending your paperwork to NVC. I am not sure if I-130 require a copy as well...

If you (the beneficiary) had a divorce before, you should send it in.
Otherwise, your spouse's divorce papers is not needed for the DS230.
DS230 package is an assessment of the beneficiary's eligibility.
You need to bring it to the embassy though.

I am the USC in my case and even though both my husband and I have been divorced, we only sent in the original certified divorce decree (and a copy) for his divorce to the NVC. The NVC is looking only for the beneficiary information, so you don't need to turn in anything relating to the USC. Good luck!

Just for the sake of time, I would probably just go to Montreal to get it over with, but that's a decision you have to make. Maybe prices will come down, or maybe he can go alone? Since he's already living in the U.S., I'm sure they would understand why you weren't there, especially if the cost were too high. Good luck!

Hello, I was speaking with a couple of lawyers when I was told that once the intended immigrant has overstayed in the US and tries to re-enter but is denied, they MUST file a 601 waiver once the petition has reached the Embassy.

Basically, I had overstayed due to our son being born in the US and medical reasons. I came back to Canada and when I wanted to see my husband again, they denied me entry. THey did not stamp my passport but they took my fingerprints. Anyway, in a nutshell, they assumed my intent was to stay. I just want to know if anyone else who has overstayed had to file a 601 waiver form???
