I want to sleep, but i keep hoping somehow a mistake was made, and my file is there with them. Seems things are slowing down a bit....

I feel almost ungrateful.. :unsure: ..just yesterday I would have almost died to just see a touch on my case, now I'm more like ok now that you guys have touched my file can you let me know what the heck is going on?!?!!

We haven't sent out one email to anyone. I think I'll just wait it out. I keep reminding myself that we just hit the 6 month mark (still a dreadful wait). If by the end of the month I see nothing, then I'll get hubby to send out some emails. I also hope they are prioritizing by filing date, it would only be fair.

I hope that everyone who has gotten a Feb 18thin deadline gets their approvals by then! I agree that they must be confident in this deadline to be sending it out in writing. They must be under serious pressure in that office. I just can't wait to see approval comments spread across this thread! Then we can all join the NVC gang and have some new complaints! lol. well hopefully not too many.

Can you guys imagine the day we receive our interview dates???

I totally agree.

I'm also pissed off that the system was placed in a compromising situation that would cause it be "broken". This is costing us money and our precious time away from loved ones. Something with that move to TSC went terribly wrong. I hope they work out the kinks so that something like this wont happen again or at least to this degree. No one just be waiting 8 months for a petition approval, especially with another period of waiting in the NVC process ahead. *sigh*

I'm very happy that someone responded with some honesty though. We all needed and have wanted to hear something like this.

Well, my persistence paid off, I just got an email from the Director of the Texas Service Center, this is a reply to one that I sent to her 20 minutes before getting this reply.

Mr. Grant,

Thank you for your email. I had received one over the weekend from you and your case was approved this morning. You should be able to see it on the case status online tomorrow or Wednesday. I would have to agree with you that the process was temporarily broken, but we have taken steps to correct this and we will have all cases processed within the next weeks. Hopefully your future experiences with USCIS and with TSC will be more positive. My apologies for your wait, and I hope that your son recovers soon and fully.

Congratulations!! God is listening and answering prayers at the right time. The right time isn't what we always want or think it should be but there is a greater plan we don't see (at least this is my belief system, sometimes I contradict it, but in the end I believe in some of these cliches "everything happens for a reason".

This has given some of us in this thread some hope. I truly pray we all hear good things in this week, or the next, especially for you 8 and 7 "monthers". I only turned 6 months recently, I can't imagine seeing March come with no approval, but I'm sure a lot of you weren't expecting to see February either.

Hi, you should have received doc checklist requesting IAP-66 (or new version DS2019). This is what NVC sends in such situations:

It appears that you have been in the United States as an Exchange Visitor. As
you know, certain participants in Exchange Visitor Programs are ineligible to
receive an immigrant visa until they have resided for two years in their country of
nationality (or country of last residence) following the completion of their stay in
the U.S. An annotation regarding the applicability of the two-year foreign
residence requirement to your case should appear in the lower-left hand corner
of your Exchange Visitor Certificate of Eligibility (Form IAP-66). Please submit a
copy of the form to this office.

If you no longer possess the IAP-66, please
submit a statement containing the following information: 1) The name of the
organization sponsoring your Exchange Visitor Program, its address and the
number of the Program. 2) The date on which you obtained your Exchange
Visitor visa, or date you acquired such status after admission to the U.S. and the
date of termination of your Exchange Visitor status. 3) The country of which you
were a national and resident or, if not a national, a lawful permanent resident, at
the time you obtained your Exchange Visitor status in the U.S. 4) Your
occupation and the field of specialization in which you pursued your studies
during your Exchange Visitor Program. 5) Whether your participation in the
Program was financed in whole or in part by a U.S. Government agency, the
government of your country of nationality/last residence, or a travel grant, if any.
6) Whether you are a physician who participated in an Exchange Visitor Program
to receive a graduate medical education or training. No further action may be
taken on your immigrant visa application until you provide this office with a copy
of your Form IAP-66 or a statement containing the above information.

So if you no longer have IAP-66 follow their instructions. Hope this helps. Good luck!

In case you're wondering what they're doing right now, NVC is probably preparing to send you the AOS bill and DS-3032 by paper through snail mail. Since this is all done manually, it takes a while for them to get to it. So naturally going electronic would be a wise decision.

I just posted pretty much the same question today. I called the NVC and they said I am fine with the most recent year and do not need to include the income number on the second and third line if I'm not submitting those returns. However, I am still going to send the employment letter and pay stubs to support.

Today at 6:40AM I received and email stating that all documents required for the case have been received and that I will be contacted for an interview. The email was ambiguous so I checked the sign in just to be sure and sure enough "SIGN IN FAILED"!!! good.gif kicking.gif

Another leg on the journey done! Couldn't have gotten this far without my friends here on VJ!

Are there any tips that my wife and I should be aware of for this part of the process while we wait for an interview?

Yup, I'm with christeen on this one. Also, with the IR-1 you are eligible to work immediately upon entry and don't have to worry about EAD.

My wife and I faced a very similar situation where a lawyer advised us to follow the same procedure you described and even recommended steps to "make it look good" like purchasing a round trip ticket even though I wouldn't be returning to Canada. My wife and I, after reading a lot of the guides here on VJ, thought that this was too risky and decided not to pursue. Needless to say, we did not speak with that lawyer ever again.

In the end, we decided on the CR-1 route since we too were unsure about the length of time without me working. This way I am immediately able to seek employment upon entry. Also, as I understand it, the CR-1 costs less in comparison to the K-1 as well.

I won't sugar coat it though. The time apart has been difficult and increasingly so as we wait for our interview date in Montreal. But I was able to visit her twice so as other posts have mentioned that it's not impossible.

You should receive your visa within the week. Some have had luck requesting a "next-day" pick-up in Montreal but it's not the norm. I interviewed on a Tuesday and had my visa by that Friday. (I was in Ontario.) Once you have your visa you have 6 months to apply for entry to the US. Once you enter the US and your visa is activated your passport will be stamped and that will serve as a temporary greencard allowing you to travel until your receive the actual card (I received mine a month after POE).
