Kimbear I think I know what it is!

Some people dont apply for EAD with the I-485... sometimes people apply for the I-485 then apply for EAD after. If you are applying for EAD after your the GC, then you have to show that you applied for a GC because you just cannot be granted an EAD without any legitimate reason (ie. need to be a lawful PR, or from work, or from K1/K3, etc.).

Since youre applying at the same time, it shouldnt be a problem :)

Thank you guys!!!! I am really happy :)

Kimbear -- Im trying to figure out where that paragraph is from your post -- cant find it...? Is it in the actual I-485 or the instructions guide? I wonder if thats for people who have filed for an I-485 and are reapplying again?

Should I assume that, if my case hasn't been transferred prior to my bio appointment, it likely won't be?

Nope, mine was transferred after my EAD was approved.

And I agree with you Sapphire -- they say it takes 6 months or so, so I guess if it hasnt been a year, it shouldnt be a problem...

I am getting a little apprehensive... no news yet on my I-485 application. Got the case transferred early February, and most of the Canadian VJ'ers who reported their case status indicated that their cases got resolved within a month.

I hope nothing's wrong with my application... :(

Anyone have any suggestions where I can get passport photos?
We were going to get them done at Costco, but we couldn't before my husband's mom left, she's the one with the membership...

Walmart, Target, CVS, the post office...

Google passport pics near your area.

Goodluck!

Well, Chicago has our package... *anxiously awaiting*

I wish I could actually accomplish things around here without my NOAs... but here's hoping they come quick!

The application will be processed really fast -- even with an RFE! I got an RFE for the medical and managed to get it in before the biometrics and my stuff came in just in time. In the meantime, I did a lot of house renovation and painting and watched a lot of reruns ;)

Still waiting on our marriage certificates. I have all the paperwork done except some photocopying and the sponsor and co sponsor form.
I just hope the person we're asking for a co-sponsor kept his tax returns on hand... I dont want to have to wait for copies.

Definitely bring your marriage license -- my driver's license and NOA were in different names (maiden and married), so they had issues with it.

My appointment was for 10 am and I came at 9:55, waited for maybe 10 minutes and then was called for the fingerprinting. Its really, really fast!

Rhiann -- thats crazy!

Anyway my GC has been officially transferred to CSC! Woohoo!

And my new employment has accepted my EAD, so I am now officially making some much-needed $$$!

I think they are stricter with the I-693. I think you still have to get a CS transcribe your vaccination, and then send that with your application. I got an RFE for the medical even though I sent the I-693. I still dont know why but I think its cause they missed it in the package.

I got my AP yesterday! No message alert or change of message status on my USCIS file, but its here! Its just a piece of paper with a big picture of my face (horrible pic too!) and I got two of them...

And my EAD has been sent! Yay!

Question: Is this like K1 where they would put your receipt number on the back of a cashed check before you receive your NOA? Or is there another way of finding out? Thanks!

If they cashed your check, its a sign that theyve received and are beginning your petition. You should receive your NOA1 in a few days.

Update!

So I received a hard copy of my RFE last Thurs and it was about the medical. I called USCIS and a customer rep said I shouldnt have received one. Anyway I managed to get a hold of a local CS who transcribed my vaccines the next day, Friday, and sent my RFE response via USPS Priority mail that afternoon.

Just to note, the CS said that I could have asked ANY doctor in the country, whether I appear in front of them or not, to transcribe my vaccines. Its legal. Furthermore, she didnt even look to see my ID or whatsoever... so I dont see the big deal about the Dr. Arnold thing. I think its likely they missed my medical info in my cover letter. And I think I must have posted this already, so sorry for the repetition!

Anyway the application reached Lees Summit on Monday (Jan 11) and I received an electronic alert that it was touched yesterday. So now the waiting begins!

Today I had my biometrics appointment. Since I live in south Baltimore, I elected to walk to the ACS located downtown. It is cold :P When I got there, they asked for my ID and letter. Unfortunately, my ID is still in my maiden name because the wonderful people in the MVA refused to change it to my married name until I get my EAD card  The receptionist person asked me for my marriage license, which of course I did not bring. Anyhow, as I was gearing up to fight her for my appointment, she spoke with a supervisor who said that my appointment is still good, in spite of not having my married name in any government issued ID.

The finger printing process was really fast, and they gave me the appointment letter back with a stamp detailing when I should re-appear for another biometrics (in 2011), which I presume will happen if I dont get my GC within the year, and have to renew the EAD.

What I found really weird about the process though was that they had no security in the building. They said dont bring cellphones to the appointment, but lots of people had one :P

So for those who received an RFE... do they let you know of any "decision" about the RFE... or does it just automatically continue your application process and the next alert you get is if they approve your EAD and AP or transfer your application, etc?
darkchilde794FemaleCanada2010-01-13 11:12:00
CanadaAOS'rs...
You prolly have to wait if you marry as soon as you POE. The K1 file goes to the visa center (wherever it is) from your POE point -- and it might take as much as a week to happen. But if youre marrying two weeks or a month or 90 days after you POE, you can do AOS as soon as possible! :)
darkchilde794FemaleCanada2010-01-11 08:09:00
CanadaAOS'rs...
Thanks TimandJoyce. Congrats on getting your EAD and AP AAAAND having your case transferred! Just think, you are getting your GC in a few months!

Border: Im not sure if thats the whole reason for it... it could be that Dr. Arnold was also retiring the time I got her to do my medical, so maybe she didnt keep up with her CS status. Anyway goodluck to you. If you do get an RFE, there is a thread in the AOS forum about doctors who dont rip you off for vaccine transcription. Thats how I found the one in Bethesda.
darkchilde794FemaleCanada2010-01-09 08:11:00
CanadaAOS'rs...
I finally received the silly hardcopy of the RFE yesterday, which asked me to complete a medical. Found a doctor who was willing to transcribe my vaccines and made an appointment for today. I also finally got in touch with a USCIS customer service agent who told me that I should NOT have received any RFE because what I did (submitted a I-693 signed by Dr. Le Arnold) was perfectly legal. Anyway he told me I can fight it, but why bother right?

So I drove all the way to Bethesda to the office of a local (if you can call her that -- her office was really far) USCIS CS, who transcribed my vaccine history for 30 USD. I mentioned that I called several other doctors and they required a medical, and she replied that was wrong, because CS are given specific instructions not to pursue a medical if the applicant has already completed one. I also told her that I received an RFE, which may be because I used an out-of-state CS. She said that the I-693 should have been accepted because I can choose to send my vaccines transcribed in any state in the US, as long as it is completed by a CS.

Anyway, I think I finally figured out why I got the stupid RFE. As I prepared my looong cover letter rebuttal to the RFE, I went back to my I-485 cover letter and realized that I did not bold-face the word I-693 in the letter. I had listed everything in the package and bold faced I-485, the EAD and AP, but not the I-693 which I added as part of the I-485 package. Maybe Im just delusional in thinking this, but Im almost certain that whoever opened my package, went through my cover letter really quickly and just read whatever was bold-faced. This is the rational explanation to why I received the RFE requesting a medical.

SIGH. Anyway mailed the new I-693, the copy of my old I-693 and the instruction page for the I-693 where I highlit the K1 section. Crossing my fingers and toes (and my husband's) that the application get touched next week so I can get my EAD soon.

Ok friends, got my RFE letter today and I got RFE'd for the I-693. SIGH.

Says: submit a completed and signed Form I-693, Report of Medical Examination and Vaccination Records blahblahblah. The medical examination mus be conducted by a civil surgeon who has been designated by USCIS.

Do you guys know where in the USCIS website I can find where it states I dont need a full medical exam because Ive already had one in August 2009? And that my medical is good for a year? Because the retarded idiotic people Ive talked to all say I need a full medical. Like they would know.

GAH, waiting for the RFE letter sucks. I just cant help but get panic attacks every so often about what it could possibly mean and if it means I have to leave the country, and when can I work blahblahblahblahblah.

USCIS says they mailed my RFE on Dec 31, but no mail yet :( Would anyone have an idea how long it takes?

Also, is there a customer service line I can call? I tried to call the 1-800-375-5283 number, but it wont let me get to a customer service rep.

UGH this is even worse than waiting for the K1 interview :P

I received an electronic case update that we have received an RFE crying.gif I have a feeling that it is because of the medical. Am gonna go hunt for a doctor who wont overcharge me for vaccine transcription and if anyone knows one in the Maryland area, please let me know.

So since Ive been given an RFE (and likely will get the physical paper tomorrow or Monday) for the I-485 application, does that mean they also hold my EAD and AP application too? I am hoping to work in the spring sad.gif

Oh such sad news for the New Year :/

Well girls and boys, my NAO's for the I-485, I-765 and I-131 all came in the mail last Friday! On the letter, USCIS stated that they received the documents on Dec 09 and sent the the NAO's on Dec 14... which is bizzare to why the letters did not arrive until the 18th.

Inky: Thanks girl -- I hope I dont get any RFEs from Dr. Arnold too. I just cant bear paying a CS approximately 200 for signature... its just unethical tongue.gif I have thought about what you said regarding getting the flu shot as well... I dont remember it being part of the immunization requirements -- and while I know its recommended for everyone during flu season, I hope they dont send me an RFE stating I needed to get the flu shot or the H1N1 for that matter...

Dr Arnold is retired so dont bother considering that. As well people get RFEd for sending ones from Dr Arnold. You will have to find a CS in your area to do it.

Basically if you are missing any shots or your shots arent up to date they usually RFE for the CS completed vaccination sheet. They will also ask for it if they have lost your sheet or your entire medical. The 693 is required if you do not have a complete vaccination history.

That's the thing...I'm not missing any shots and everything is up to date. I suppose that they could have lost the original medical report, but the form I sent in is supposed to meet their minimum requirements.

Oh well...

I dont think you got an RFE bec you need to do another medical -- I think its cause whether youve done a complete medical or not, you still need to get a CS to go through your vaccination record and make sure all your vaccines are up to date, and that CS has to sign the paperwork, etc.

I have read that some embassies do not require applicants to complete their vaccination requirements. But they are required for AOS. So even if your wife has been given all the shots, they wont look at the medical as they prolly believe its the CS's job (he/she looks at it and signs to say that you have all your shots complete etc.)

I was one of the last applicants that had Dr. Arnold so I will see if I get an RFE because of that. I think Ill be fine and Ill let you guys know.

On that note, some K1s who applied for AOS within weeks of getting in the US did not submit any of the medical forms (I693) and got approved!

CanadaMoving furniture and car across the border??
Since there is so much knowledgeable people on here with so much experience in various cases in regards to immigrating, I thought I would place my question here.

When I move from Canada to the U.S, I plan on driving a Uhaul truck with furniture and towing my vehicle behind. Does anyone know how this works? Is there paperwork that I would have to fill out ahead of time? I know that I would have to change my Canadian car tags eventually, but will they even allow me to cross with it being towed?

Thanks in advance.
