Hi everyone,
I am being a pain but I'm freaking because I am visiting family and I'm not close to my residence and that is where the actual copy of my marriage certificate is. I have a scanned copy of the certified copy...is that going to be ok to send with my DS230 or do I have to order another one?
ps...I'm Canadian going through Montreal.

Hey All...
I have been using USPS Priority Mail service since the beginning of this process and this is the first time I have run into an issue. Here it is...
I sent my Checklist back to NVC via Priority Mail (with tracking confirmation but no signature) and they attempted to deliver on Saturday but it could not be delivered so they left a notice. I spoke to someone at USPS today and she said that they would hold it at the post office for 15 days until someone comes to pick it up!!!!
My Question....

Does anyone know if NVC will have someone go and pick up the mail? Should I be freaking out right now that my package with my new ORIGINAL police report is stuck at a post office in New Hampshire and NVC will not recieve it?

PLEASE HELP!!!!!

A couple of things I wanted to add to what has already been said:

I believe you need to enter your Maiden name in on that second line - even though you didn't change your name. Our DS-230 is for my Husband - so non-issue. I mean they could just be skim reading and not have noticed, so what can you do, other than fill it in even though it seems redundant. I would put my maiden name and then (did not change my name when I got married).

As for the police certificate, who did you get your first one from? Whether it is RCMP or Local Police, as long as it is a Canada wide search it doesn't matter - so I too find this confusing. I am assuming you have no criminal charges on your record (therefore you didn't require a fingerprint check) - they should accept either.

That said, you are doing the right thing by getting another one - it would take you longer to argue with them than to get a new one!

Thanks for the advice...I think I will put NONE and then attached a letter explaining everything that they asked me to change. As for my police report...I ordered mine from Winnipeg because I was in Florida at the time and you can send in your documents and they will mail it to you. (I do not have any criminal record so it was fine). It is a Canada Wide SEarch and honestly I think it's a mistake that they are asking me for another one...it's because i had a gap in my "places of residence"...it was a stupid error on my part...I started my list from when I was 18 instead of 16...totally my fault. Anyway, even though I think it is fine...I will wait to recieve the other police report from Toronto before I send it in.
It's just another snag in the process...such a drag...my husband and I didnt have any of this drama when he came to Canada!!!! Go figure!!!

Hello all..
I have been RFE's for my DS230 and I recieved the letter today and I have a couple of questions and I hoping you all can help me so that I dont mess it up this time!!!

So the first red circle is around PART 1 Question #2 Other Names Used or Aliases (if married woman give maiden name).

My Answer was N/A because I did not change my name when I got married and I do not use any other names.

So how to I answer the question now?? Any advice??

The next red circle was around my present address and I think it is because I left the Office Phone number BLANk...however, I did change my Canadian address since this whole process started and I have the email which the NVC sent us saying they recieved my change of address. I guess I will include this email just to be safe.

Also they are saying that maybe my police report was not good even though it was Canada Wide Search....I ordered another one anyway from the Toronto Police Department and I should have it in a couple of days.

NEXT, #20...I think it is because I had my residence start at 1993 at which point I was 18 and not 16...that was my mistake. BUT just to be clear...you don't need to put specific address....they only was CITY, PROVINCE, COUNTY, DATES right? not street address and all that stuff.....please help here as well.

I got my IIV number from the NVC Operator ....We have not received the I864 yet, so will be directly downloading it from the website and sending it off ..as as suggested by Nita and Loto.......

Now my next question is :

As my spouse visa processing will be from the Montreal Consulate , Will they be sending me the DS-230 OR will it be NVC? When does NVC hand over the case to the foreign consulate? I have given myself as the agent of choice in the DS3032 Form earlier...

Also any idea what they will need me to submit along with DS230...I checked Loto's Guide smile.gif , I was wondering whether this checklist changes from consulate to consulate ....
I am also checking the Canada forum for some input on the same issue

Tried to call NVC today to get my IIV to pay my IV bill online , no success, will try again today at night as suggested in several other posts..The bill was generated on July 1st

So I guess from the time they say "Case Complete' to the final interview it is about 2+ months in general

For my case, We sent in the first fee bill and choice of agent ....

When I called the automated service they say" Immigration Fee Bill has been generated on July 1st and will be sent soon" ..

I guess after that we still have to fill I-864( Affidavit of support) and then they will send us the third packet ( for police clearence, medical etc)

I was wondering after the final package ( with medical and police clearence) is sent to NVC , how long it will take for me to get the interview date..

Also , how do I look at the Canada Forum?

Although I can only answer your question based on the K1 visas being processed at MTL, I can say that six weeks would be a dream. There are plenty of K1 people who returned their packet 3 in March and STILL have not even heard a peep from Montreal for their interview date. Montreal is slower than many 3rd world countries' consulates and have a projected 4-6 months wait time (according to them), although it's closer to 2-3 based on VJ user's timelines. At this point, with all the people waiting in this Montreal thread http://www.visajourn...h...083&st=1230, it appear closer to 3 months now.

So, theoretically, once I receive a case number from the NVC, then can I print out the packet 3 and do the medicals and police report instead of waiting for it in the mail? Is here a way to find out the case number from NVC before they mail me the papers? ( I knew this would get confusing)

Hi everyone! Newbie here *blush* hehe :-)

Quick question...

My fiance and I are filing for the K-1 and the first package requires that you show proof that you have met in the past two years (which we have because we've officially known each other for 6 years).

The thing is that the we only have evidence (e-tickets) dating as far back as 1 year and 5 months ago.

Is this going to be a problem?

Will it be enough evidence?


***A bit of additional background info:
-years ago I always drove down with friends on my birth certificate and license (so, no past evidence - August 07 was my first time ever flying to the US)
-my fiance lost his passport years ago (so, no past evidence of entering Canada, nor does he have any old flight tickets from 2002 - 2006 *frown*)

Also...

We don't have a ring because we both want to get tattoo rings when we're married.

Will this have a negative effect on our application?

Hi everyone!!!

I was arrested almost 7 years ago due to a domestic disturbance call placed by the neighbours (very loud and long argument - good ol' sibling rivalry). My sibling and I were never charged and we were released unconditionally with no convictions (this will be my explanation on the DS-230, DS-156 and the online DS-160 forms).

We were never finger printed or had our pictures taken, nor did we fill out a police report - but I called the station and the officer I spoke with advised me that although I technically was not arrested (he stated the full procedure of an arrest was not carried out and technically we were just cuffed and detained) to state that I was because they still have the incident in their system - he said, "You definitely don't wanna play around with immigration!"

So to avoid any problems I will be selecting the "yes" box *sighs* sad.gif

I am aware that I require the police clearance certificate (which states that my record is clean), however if there is anyone, who has had a similar situation, who can tell me if I need anything else (other papers/documentation) or if this will cause any delays/problems along the way and/or at the interview, please, please do let me know.

If you can relate I ask you, ever so kindly, to help calm my nerves and ease my mind please, lol.

As for your other points, my husband does have an Ontario health card but it's expired as his status has been revoked due to a negative LMO. He is here unlawfully so a DCF is out of the question. I figured we would have to file at Vermont but I've been hearing that the processing times are extremely long and I really can't stand to be away from him for close to a year.

Do you think it would be best for him to file with his Chicago address at the Chicago lockbox? Could that possibly be quicker? I know that processing times vary but I'm hoping maybe someone might have some answers I haven't quite come across yet. I think I'll take the visting route when it comes to travelling to the states and just bring proof of ties to Canada (ie. job letter when I'm returning to work etc.) so I can at least visit him before I move there.

Anyone out there with more advice would be greatly appreciated.

Hello,

I just have a few brief questions about the I-130 process.

I am a Canadian citizen (Toronto) who got married to a US citizen in March 2009. He was in Canada on a work permit that has since expired and could not be renewed due to his LMO (Labour Market Opinion) being denied.

Our plan is for me to follow him to the US (Chicago) to live permanently. We are taking the CR-1 visa route and we're about to file the I-130 but are hearing conflicting information. Since we're both residing in Canada at the moment we wanted to send the I-130 off as soon as possible so I can follow him to the states sooner. He'll be leaving for the US himself within the next month and was hoping to have me follow him a month after that.

How do we file the I-130 from Canada? (He is not a "lawful resident")

Should we file it from the US?

If we do file it from Canada can I not enter the US until the CR-1 visa process is done? or just the I-130 process? (we spoke briefly to a US immigration lawyer and he told us that I can enter the US before we even file, that intent to immigrate usually isn't an issue..I'm not sure how right he is about that. He also told me I can enter the US after filing from here but again I'm hearing conflicting information)

At one point do you think I'd be allowed to enter the US after the I-130 is filed? (How many months?)

What is the processing times for I-130 and what office do we send it to in the States if he's in Canada only for a month?

What are the processing times for each step of the CR-1 visa?

I know a lot of this information is available on-line, but as I've said I'm finding conflicting information.

Having your cheque cashed really just means....they got your cheque smile.gif

Now they will start processing your file, this can take several months. Once USCIS approves your application, you will receive confirmation of this in the form of a piece of paper called an NOA2 (notice of action).


After that, your file will be sent to the National Visa Center, once all of that paperwork is done and approved your file will be sent to Montreal, after NVC schedules an interview for you.

Question for you, you mention you sent the application from Canada - do you both live in Canada? If so you could probably have done direct consular filing.



Sorry..seemed to have gotten a little too excited. Actually we've gone through the guides already and have a very clear idea of what we're doing and what to expect. We've just been ancy worrying that USPS might have lost the package and to hear the cheque is cashed is a relief smile.gif.

We cannot actually use DCF as he's here on an expired temporary work visa. We met when he was brought up from Chicago to work for the same company that I do in Toronto. His visa expired later and he could not get it renewed due to the economy thus didn't have a legal reason to really be here since his visa had expired.
