Having your cheque cashed really just means....they got your cheque smile.gif

Now they will start processing your file, this can take several months. Once USCIS approves your application, you will receive confirmation of this in the form of a piece of paper called an NOA2 (notice of action).


After that, your file will be sent to the National Visa Center, once all of that paperwork is done and approved your file will be sent to Montreal, after NVC schedules an interview for you.

You will probably want to read the guides (just click on the guides tab at the top of the page here)

Question for you, you mention you sent the application from Canada - do you both live in Canada? If so you could probably have done direct consular filing.



Sorry..seemed to have gotten a little too excited. Actually we've gone through the guides already and have a very clear idea of what we're doing and what to expect. We've just been ancy worrying that USPS might have lost the package and to hear the cheque is cashed is a relief smile.gif.

We cannot actually use DCF as he's here on an expired temporary work visa. We met when he was brought up from Chicago to work for the same company that I do in Toronto. His visa expired later and he could not get it renewed due to the economy thus didn't have a legal reason to really be here since his visa had expired.

I received I-797C NOA letter from the USCIS today, I am assuming it is the NOA-1 that everyone mentions, am I correct?

In this letter there is a paragraph that states"If this case is an I-130 petition"...and metions that this is only the first step and that you have to wait for a visa number and sometimes it could take years. Is this just a standard paragraph on all the NOA-1 letters or is there something wrong here?

Hi Guys this is Mike from Toronto and first of all............CONGRATULATIONS to you both on passing your interview!!!!! FABULOUS!!!!!! Mine is on the 30th of June(GOD, that's next Monday for heavens sake.......LOL) so doing flip-flops emotionally at 3 in the morning......lol.

Sorry I don't have a profile up yet as I just discovered this amazing site last week but I couldn't help notice your advice on having a denial on your record. Last April, based on my frequency and duration of visits to see Debra was asked to "Withdraw my Application for Admission" at Pearson Airport because at the moment I didn't have documents(utility bills, proof of employment, etc) to prove my intent to return but came back a week later and was given a 6 month B2 Visitors Visa. Then just on May 13th past I was refused a TN work Visa(before I received my interview letter) based on the fact that my 1977 Guelph University degree said "Bachelor of Science" as oppposed to "Bachelor of Computer Science"......lol, can you believe that???

So sorry to be so long winded about asking if you think that these 2 denials spaced more than a year apart will adversely affect my interview. All other extensive documentation as been given to me by my Lawyer and it seems like almost a slam dunk........lol, but just wanted perhaps a more educated opinion about things!!!!

And once again............all the BEST!!!!!!

We have the same withdrawal of application of admission from Toronto Pearson. I asked a CBP officer the last time I was thru and he said it shouldn't affect anything; that the K visa would basically wipe out the Denial.

Ok,

How are you supposed to MAIL your forms from Packet 3 in? Because Montreal consulate for USA is a PO Box....no one will mail it, not Fed-ex, not Purolator, and not Xpress-Post. What's up with that. I actually already Faxed it in 3 weeks ago, but figured they might need the originals as I still have yet to get a Packet 4, why the delay?

IMHO, I would think proof that you ARE working together doing intense counseling would prove that you have a viable commitment to the relationship.

Splitting up or giving up on the problems would lead them to question your relationship.

You may want to get an affidavit from your counselor to add to the proof of your ongoing relationship.

I just went to my bank yesterday to get my cheque. I was told they don't do certified cheques any more, but I got a bank cheque instead. So the funds were pulled from my account right away. The bank also guaranteed that I could go back to them and find out when the cheque was cashed.

In mid March I drove to Ontario Canada and then back to the US through the Queenston/Lewiston crossing. Both the Canadian and US agents commented on the expiration of my Green Card on 03/30/08.

On the way to Canada I was told that I need a stamp in my passport when the card expires. I told her that I have a letter already that allows me to travel, she said that was okay.

When I came back, the US agent told me that I cannot travel with an expired card! I was anxious to get my Timbits home so I didn't bother correcting him.

However, it is clear that US officials don't know the rules! Be careful!

If you can, take the NOA with you; hopefully you'll get it in time, just for insurance.

I like the idea of getting the stamp from the embassy, but you'll have to prove you sent off the petition. Would you be able to get the stamp here before you go?

I travelled to Canada in mid-March 08 with my card expiring 3/30/08, and the immigration official told me not to travel with an expired card! Obviously they cannot be expected to know all the rules!

You asked that I post this in the thread so here it is. ANy help is appreciated. I've seen your posts and you seem to be the resident expert here on US/Canadian taxes. I'm wondering if you may be able to help me with a couple of questions about an RRSP sale (while living is US). My wife and I have been living in the US for about 2 years now and in 2008 we sold our last RRSP in Canada. We paid the 25% non resident tax to the Candian gov't.

So to do our US tax return we've been getting mixed information about the amount we record on the US return. Some people say you only have to record the gains on the RRSP between the day you left Canada and the day you sold them, and other people say you have to list the entire amount of the sale (in US dollars) on your US return as income on the 1040 - so a $10 000 sale = $10 000 of extra income which really affects our return.

I'm hoping its just the gains, as this would make more sense considering we've already paid the 25% non-resident tax to Canada and (from what I've read about the 2008 tax treaty) the US treats it at that point like an IRA - so when you cash it out you just pay the capital gains. We went to two accountants and they both did it opposite - one just the gains, the other the full amount. The difference in our return is amlost $2000 so we want to make sure we're doing it the right way. Any information you could pass along would be really helpful and greatly appreciated!

1. Yes, you must report the sale of the RRSP's as a pension distribution on a 1040. You take the 25% non-resident tax as a foreign tax credit. You also must file the form to report the RRSP amount that I mentioned earlier in this thread (the number escapes me right now)

2. You have no obligation to file any return with Canada as they took out the non-resident tax.



Thanks for your help on this Zyggy! I have a couple more questions - you mention that I have to report the sale on a 1040 - do I have to report the full amount withdrawn or just the gains (total amount when we left Canada - value when cashed out)? It seems like if we put the entire sale amount in TurboTax it calculates our refund as if it's taxing that whole amount as additional income and says we have to pay like 25%-30% of the total amount - which I don't see as being possible considering we already paid the 25% non-resident tax.

I hope this isn't getting too detailed but would it be possible to provide some details on how to record all of this in TurboTax (or can it be done in TurboTax)? As for the form you mentioned - were you talking about the 1116 or 8555? Can this be done in TurboTax as well?

Removing Conditions on Residency General DiscussionI-751 June 2011 Filers
Today I went in for an infopass appointment to verify that my online change of address was successful. Turns out the online form worked exactly as expected and that they had my new address on file.

I also had the bonus news that as of yesterday (2/28), my case was actually being reviewed by someone and that I should expect the decision in the mail within 30 days. The gentlemen behind the counter also informed me that moving during the lifting conditions process often results in a slight delay in processing. He didn't suggest a service request or anything like that, but simply to wait for the decision or make another infopass appointment if I didn't get anything in the mail next month.

The moral of the story is -- making an infopass appointment is painless and very much worthwhile if you can go. You don't have to stay on the line on hold to talk to someone and all you have to do is show up at the appointed time. I definitely felt that it gave me peace of mind to talk to someone in person.
