If I don't adjust status, other than not being able to work (ie. not being able to apply for an EAD or SSN), which, for us, won't pose a problem, are there any other restrictions? Is this the only reason people Adjust Status after they enter the US on a K-3 - so they can work?

It seems to me that if I don't have to work, to avoid more paperwork (and expense), I can just wait for the IR-1 interview back in Canada...

If anyone can shed some light on this, I would certainly appreciate it.

I'm curious to learn your logic for giving different explanations for why the G-325As are being submitted when both G-325As are going with the same petition.

Answering for simple_male here `cause I think I see his logic -- Since two G-325A Biographic Info forms are being submitted (one for the petitioner and one for the beneficiary), it would sort of make sense that each are being submitted for different things (albeit, they are also submitted in connenction with the same petition form). In other words, the petitioner is submitting theirs in connnection with an I-130 petition for their Alien Relative, and the beneificiary is submitting theirs (ultimately), in regards to their status as a permananet resident.

But, since the petitioner is the one submitting both theirs and the beneficiaries forms, I see it the other way, too, meaning both forms are being submitted in connection with an I-130 Petition for an Alien Relative, so perhaps, to avoid confusion, that is what both G-325As should say...

Man - they don't make this easy, do they. They leave it open to way too many interpretations.

Do I check "Other" and specify: "I-130 Petition for Alien Relative"

Or do I just check "Status as Permanent Resident", since, that is, in fact, the ultimate goal...

I checked the example forms, but there isn't a G-325-A example given for what you send in with the I-130.

Hi Everyone,

I haven't been around for a while, but I thought I'd post here to let you know that today, I received an e-mail confirmation of approval the (new) I-129F form (I guess that's considered an NOA2).

From the day they received it to the day they say it was approved (see my timeline below), it was a total of 6 weeks + 1 day.

My fingers are crossed for those who are still waiting.

so I have to put NO since im a K-1 ? And I thought they meant that my fiance filed the I-129f on my behalf...oh well..IM gonna redo it for the 3rd time. I thought it was "NO" for people applying for themwelves for visitors visa and things like that and "YES" to petitions like K-1, K-3, because it involves someone else filling a petition for you.

Mephys -- Have a look at Post #12 in this topic.

K-1 filers answer "NO" to question #36 because no one has filed an I-130 on the petitioners behalf. It is "YES" for K-3 filers because in order to be eligible for a K-3, the USC must have filed an I-130 on their behalf.

Finally, a definitive answer to Question #36 on the DS-156 for K-3 applicants interviewing in Montreal!

I asked the kind woman at window #9 at the consulate, and she told me the answer is "YES" (since, your spouse did indeed file an I-130 for you). Yes, it's redundant (since s/he would've had to file an I-130 for you to even be eligible for a K-3), but we are to answer "YES" nonetheless.

Yes, excellent point. This makes sense for K-3 applicants. I will answer "yes" as well, since, yes, an I-130 has been filed on my behalf. Although, one would have to have been filed in order to even be eligible for a K-3 -- so not only is that question unclear, but it is also redundant. :P

Thanks, misa! I put my husband's name instead of just "husband" (I tried to put both "husband" and his name but it wouldn't fit.) Jeez Louise, I just hate it when the wording of (important!) questions is left to an individual's interpretation.

What I might do is bring two DS-156s with me; one where I've answered "no" to question #36 and one where I've answered "yes". Then I can just ask someone at the consulate to clarify the meaning of that question and give s/he the correct form depending on the answer. Since the question is unclear, I'm sure they get both responses (so I'm sure both are acceptable), but it wouldn't hurt to bring both versions, I guess.

Me.. again! (Ugh, sorry. I searched and searched and I found different answers.)

So I went through the DS-156 I filled out back in November and I found a speeeling misstake so I thought I'd better fill it out again. Then something struck me.

Question #36 asks: "Has Anyone Ever Filed an immigrant Visa Petition on Your Behalf?" I originally answered "no" because the word "ever" suggested to me that they were asking if someone had filed on my behalf before this current petition. But, after a search, I found that people have suggested otherwise (the ever-knowledgable Yodrak disagrees with a "no" answer here), even thought the sample on this site says to answer "no" to this question.

So, I guess I'm asking other K-3ers; What did you do?

Also, I noticed that there is a space for my photo to be affixed to this form (and since I need 2 copies, I'm assuming I'll need 2 pictures). Do *I* go ahead and glue the pictures to the form or is that something "they" take care of? (Common sense suggests that I refrain from gluing anything to the form, then, if I find I *do* need to attach pictures I can always just do it.)

Sorry for starting all the new topics lately; I really am using the search function but I'm just not finding the (definitive) answers I need.

This was also my (basic) understanding. If I were to give birth in the US, the baby would be an automatic citizen (due to the 14th Amendment). But, because I am a Canadian citizen, we could apply for CDN citizenship for the baby as well. i.e. The baby will be a dual citizen and carry two passports. Does that sound right?...

Hello VJ-ers!

I've been trying to find a definitive answer on this but I'm getting different info from different directions, so I thought I'd ask the fine VJ community.

If all goes well :: fingers crossed :: I (a Canadian citizen) will be a Permanent Resident of US sometime in the last half of 2007. If my husband (a US citizen) and I were to have a baby in the US, what would his/her citizenship be?

If we were to come back here (to Canada) to have the baby -- assuming this is an option -- what would his/her citizenship be then?

Has anyone experienced this themselves or can anyone offer any links to credible info?

I'm just getting so worried about our I-130 limbo (7 months with no touches/news) that I think I may just have to Adjust Status once I'm in the US (I would hate for the K-3 to expire before the I-130 is approved -- 2 years seemed like more than enough time when I began this process; now, not so much). It's super disappointing since I am more than willing to go back to MTL for the CR-1 interview. Ugh! :wacko:

Yikes, this is the first I've heard of this. What is this new policy and what is an I-824?

Although we have not heard anything about our petition being "retained" (see my signature below), we have had NO movement on the I-130 since the NOA-1, and that was last August.

My plan, all along (to avoid AOS!) was to reside in the US on a K-3 until the I-130 was approved and then return to Montreal for a final interview (i.e. to obtain a 10-yr green card, since we have been married more than 2 years). Is this still possible?!

Emily, does your stomach churn everytime you think about the interview? Mine does and anxiety is starting to set in! I'm going to be a f***ing wreck the night before and the morning of the interview!


Heck yes! And I know it's silly. I have everything on my list and yet I'm still freaking out. I'm a logical person, and everyone says this is the easy part, but I guess I'm just afraid I'll get someone on a bad day and they'll find something trivial that I didn't do correctly (like I accidentally checked the wrong box on one of the forms). You know how it is crossing the border; one day you'll get a guy/gal itching to snap on a pair of rubber gloves, the next day they'll ask you 2 questions and tell you to have a nice day. I almost wish there wasn't a human element to this process. That if you hand in your forms to be scanned and everything's in order, you're good to go.

I don't know how I'm going to sleep the night before. At least I'm driving -- you have a flight to worry about on top of everything else!

Yes, husband is the USC. It is my understanding that he will require his passport (for identification) in order to be allowed entrance into the US consulate. (He's coming with me for moral support; I don't expect that he will be interviewed with me.)

One thing I checked when booking my hotel was a fridge, for my beer!!!! Best of luck at ur interview. Keep in mind no electronics of any kind and no big bags, and goto the back of the elevator, as it is the door that opens!!! If ur really cocky, stand facing the back of the door, while the others face the opposite direction,lol


Thanks, flames! I'm staying at the cheap apartment-style hotel across from the consulate and I think all rooms have a kitchenette so we should have a fridge for the beer! (A definite must!)

Heh, heh -- I *just* might be feeling saucy enough to face the back door in the elevator; we'll see! Here's my understanding of how it works:

- arrive at the consulate approx. 7:15am
- show my interview letter to the dude at the door
- go through the security check/metal detector; head downstairs
- sit in chairs facing the elevator; wait for guard dude to remove the ropes in front of the elevator
- as soon as we're able to load on, be the first in the elevator and head to the back (ensuring I'm the first off)
- when the rear doors open at floor #19, break left and head straight for window #14

Gosh, I feel like I'm SO prepared (thanks of course to VJ and all its participants) and yet I'm still SO nervous... I guess you can never anticipate the questions they're going to ask you, but hubby and I are legitimately married (and ridiculously in love) and I'll have everything I need with me; I just can't forsee any problems, and yet my stomach is still flipping about. Yeesh! :wacko:

It was always my intension to go back to Montreal for my IR-1 interview since it is within driving distance of where I will be in the US, but for the reasons you state above (and the fact that my effing I-130 hasn't been touched since the issuance of the NOA1 last friggin' August!) I am seriously considering (and dreading) going the AOS route.

Anyway, thanks for posting this. I hope those 'in the know' will respond.

Well girl..........bottom line is ........what you have you have right now and there's nothing more you can do. If what you offer isnt enough, then they should ...........Im pretty sure they do.........give you the chance to make it right. You wont get denied flat out. That's where your mind needs to be right now. Dont worry about that which you can do nothing to change.

One thought tho..........does he bank online? maybe u could get a few statements.

You're right, CutienPurg. I've got what I've got -- if they need something else from me it sounds like they give people the opportunity to present further evidence before denying somebody out-right.

I just can't see that anything listed on a bank statement will prove our financial case more than IRS transcripts. I re-read the I-134 directions again and for those who are self-employed, one year of transcripts/W2s are sufficient, and we're going in with 3 years of transcripts plus copies of W2s for `06. They want us to show evidence that I will not become a public charge, and that's what I've got. Hubby made the choice not to submit any redundant/additional financial information when we got the I-134 notarized and the IRS transcripts last November. I was confident then that that would be sufficient, but now of course, I'm feeling the heat.

Well -- it is what it is. I hope I've got some good news to report on Monday night (we won't get until until later in the evening).
