No, he has to wait for another year.
The requirement of naturalization is that he is married to and living with the same USC in the US as a LPR for the last three years.
He can apply 90 days before he meets the requirement.

Do you still keep the receipt of the dog you two bought together? It can be an evidence as well.
It's kinda hard to collect evidence of "marriage in good faith" when you don't share finance and the marriage is over in half a year or so.
If the cause of divorce is infidelity or something that sort of your husband, you can provide the evidence of the cause for the condition lifting.

Redglasses: My husband and I have already been married for four years now. For the requirement, do you mean 3 years of marriage? or 3 years living together after entering the US?

The three year requirement I meant is being a LPR and married to the same UCS for three years.
I am also married to my husband for two years already, but cannot file for naturalization until 2012 because I have been a LPR only two months.

We filed I-865 about 60 days after my husband (sponsor) moved to a new place. We wrote the actual day he moved in and had no problem.
