I don't think you would need a cover letter since you are filing the petition in person.
We didn't need one for Tokyo at least, but I am not sure how things are in India.

You should check with the US embassy in New Delhi whether you are eligible for DCF or not with the type of Indian visa you have.
In general, you are not considered to be a resident of a certain country just having a tourist visa.
Also, check the US embassy New Delhi website.

The father must have been physically present in the U.S. for 5 years prior to the child’s birth, two of which were after age 14.


riz is right. Looks the OP is the biological mother (USC) of her son. He should be able to get the US citizenship by filing the consular report of birth at a local US consulate.

This seems to happen a lot for Japanese filers.
I assume her GC was processed based on her visa (CR1)

Anyways, you can file I-90 for replacement of GC.

You can still get tax benefits by filing married jointly even his income is Italy based.
There is a form called "Foreign Earned Income Exclusion (Form 2555)."
By fling 1040 (jointly) and 2555 (for him) together, you can waive his income from US taxes but still can claim standard or itemized deduction for 2.
