K-1 Fiance(e) Visa Process & ProceduresStatus Update Times?
How often during the day are the Status Updates done for K1's on the website? What time also (and time zone)...

I am in a position where I am on a pc all day and I update the status about 100 times a day looking for a change. It only takes me a second each time I do it. I have a lot of free time at my job :) Am I wasting my time? Is there more convenient times to check?

Also up until how late PACIFIC TIME are statuses updated? I have mine at the CSC and I am in Pacific time. What do you guys think?

We aren't worried about our papers or anything but it is driving me nuts not being able to plan my life out at all.

K-1 Fiance(e) Visa Process & ProceduresDivorce Decree vs Divorce Resolution for K1
She has a Resolucion de Divorcio, which USCIS did accept as proof of divorce with the I129F application... but there also is a certificate of divorce apparently. I researched this (well she did with me) and I've found some interesting results.

In my opinion, the Resolucion de Divorcio reads exactly as a Divorce Decree, which is why I believe that USCIS accepted it. Having originally translated it from Spanish to English, it reads pretty much the same as my Divorce Decree from Las Vegas, different wording, but same meaning. A divorce decree and a divorce certificate are two different items. The Resolucion de Divorcio fulfills the requirement for the decree in my opinion as it reads pretty similar (but different format obviously) as to my Divorce Decree. The certificate of divorce is kind of like a birth certificate but for divorces. Peru does have a Divorce Certificate in addition to the Divorce Resolution.

Her DNI has been updated very recently to show her current address of living abroad so she can stop getting the fines for not voting in the Peruvian elections. We had to pay all of those before they would let her get the Police Certificate or the Divorce Certificate. So unless the officer would think that she got married to somebody else in the last 30 days while pregnant with my child and while awaiting her Fiancee Visa I think we are safe.

It's all a moot point anyways because we are getting the certificate just in case, it's like $5.00 (15 soles) and getting it mailed to us when we get the police certificate mailed to us next Monday/Tuesday since today and tomorrow are holidays in Peru and the official departments are closed. So I'll have more than enough for everything I need.

K-1 Fiance(e) Visa Process & ProceduresDivorce Decree vs Divorce Resolution for K1

If that is what is customarily issued by the court (or the authority granting the divorce) then I would think it is enough. If there is something else that is typically issued, I'd investigate that.

It's probably worth posting in the regional forum to get input from those that have gone through Lima.

Well since you so informed me about the police certificate, that won't mail out until Tuesday, so we called up and checked. They told us we could use the Resolution, but there was also a divorce certificate, so for the extra $5.00 and day it'll take us to get that, we are just going to get it ordered as well.

Thanks for your help man.

K-1 Fiance(e) Visa Process & ProceduresDivorce Decree vs Divorce Resolution for K1
Thanks for you blunt words... lol I love it. I would think we are fine since it asks for proof and not a specific document. Further proof would be her official Peruvian ID shows her as Divorced for civil status.

K-1 Fiance(e) Visa Process & ProceduresDivorce Decree vs Divorce Resolution for K1
So I can't believe we got a NOA2 without an actual divorce decree or certification, but anyways we did. We only submitted a divorce resolution. Saying that the marriage is resolved... is that what they are looking for?

It says in Packet 3: Proof of the termination of
any previous marriage must also be submitted in original (e.g. death certificate of spouse, final decrees of divorce or annulment).

So while not being a decree or being an official divorce certificate, it is a legal resolution showing the end of the marriage, will that work for the consulate interview?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresVisa petition sent back for possible revocation.

It is really a shame that Lagos get away with this. Think of the equilivant in the USA. You give/get an engagement ring-you are not married. You book a honeymoon - you are not married. You buy a dress- you are not married. You hold a rehersal - you are not married. You get the licience -you still are not married. You have a marriage and get the licience signed and filed - then you are married. Until Nigerians fight for what is correct then they will get away with sending K1 petitioners home with a wave of the hand like they love to do.

Well stated. It is soooo true what you just said. I do not know much about African and Nigerian cultures, but I do know enough that a simple payment can't just finalize a marriage and that could be seen the same as when I gave my fiancee an engagement ring.

K-1 Fiance(e) Visa Process & ProceduresCd. Juarez packet 3?
See this is what is tough for us. To plan a wedding, move from Tijuana to San Diego, her being pregnant and trying to not lose anymore work than necessary. Imagine that many go through that, but the pregnancy and also the fact that I, the American Citizen am living with her in Mexico (she's Peruvian though!), we have to move everything across the border, me mostly by myself because she can only cross once. I have sentri, but I can't move my house while using sentri. Just trying to plan this is tough. Like we gotta get the utilities shut off because they are in both of our names (water and electric) so we may be a day without water or electric before we move. It's insane, plus since school has started its been taking me 45 minutes a day in the Sentri lane at Tijuana.

We are hoping to be able to move by Nov. 1st. Who knows though. Who knows.

The letter that arrived was one dated August 30th saying that the NVC will send my papers to Juarez within the next week. It was dated the 30th, but only arrived yesterday, post marked Sept. 5th. That's why I thought it was the packet 3.

Anyways thanks for your help so far man. I appreciate it.

Also, how long out are the appointments usually in Juarez? Like are we talking a week or two, a few weeks? A few months? I got no idea what to expect with that.

K-1 Fiance(e) Visa Process & ProceduresCd. Juarez packet 3?
I changed it, even though she'll probably get mad since she is Peruvian... lol

Anyways, yeah this is probably the confirmation letter from NVC but strange they would send it to me now considering it left NVC on the 27/28th of August and my stuff arrived on the 30/31 of August. Seemed more fitting to be the Packet 3 letter.

We are waiting for the letter as we are trying to do the ASC appt in Tijuana. We want to make sure we have that letter first ;) Unless it is possible to schedule ASC/Interview in case the letter didn't arrive first.

Thanks.

K-1 Fiance(e) Visa Process & ProceduresCd. Juarez packet 3?
So I live in Mexico, work in San Diego and I have a private mail place for my mail. I just called to see if anything came today and they said a letter has arrived from the Department of State. I assume that would be Packet 3 right? They also said it was a regular sized envelope, is that the size that the Consulate uses to mail out packet 3? The NVC doesn't sent you any type of confirmation that it was sent to the consulate, right?

Can I make my appt now? Or am I better off to wait to pick it up and see? Lol I'm too anxious! I want this over with now!!! lol

And we all ready did the DS-260 that Juarez requires.

Scratch that, we are using Peru. When she leaves Mexico, she'll be giving up her Residency in Mexico. So it will just be better to use the Peruvian, because she won't ever lose that.

Why do you say DNI Celeste?

Ok, with that then, I have completed it. I put yes and marked my name.

Also, we decided to go with the Mexican CURP number, seeing that that's what we feel they would be interested in since she is currently living in Mexico and going to see the American Consulate General in Mexico. It made more sense.

Thank you all :)

On #36, it says has anybody ever filled an immigration visa petition on your behalf. The example say no.

Wouldn't I put yes because I filled one out on her behalf, that's why she is going to the interview.

K-1 Fiance(e) Visa Process & ProceduresDS-156 Form
Hello! On the DS-156 it asks for the National Identification Number (Question 14). We live in Mexico, she has a FM3, which has a CURP on it... but she is Peruvian.

Which National ID # are they looking for. Mexican, where is a resident and currently resides? Or Peru, where she is a citizen?

K-1 Fiance(e) Visa Process & Proceduresciudad juarez interview. police records

Police certificates are required for every visa applicant regardless of the country you are from. You must submit police certificates from each country you have lived in for 6 months or more from the day you turned 16 years of age. Do you honestly think the US doesn't want to know if people they grant visas to whether or not they have a criminal background? Give them what they ask for

Police Certificates are not required in Mexico. Only if you have a criminal record. We needed police certificate because she is Peruvian and living in Mexico. We are currently in Juarez.... appointment is tomorrow morning.

K-1 Fiance(e) Visa Process & ProceduresNeed Help! K-1, Mumbai - ASAP Please!!!
If you live in a bigger city, it's not enough. But when you live in the country, in the middle of no-where, it is enough. His mortgage payment is like $400 a month. The cost of life in rural America (at least most places) is quite cheap and people that have only been in metropolitan areas don't fully understand that.

I owned a home that was a 5 bedroom, 2 story house with a garage and a small (very small) yard. It cost me $29,000.

Yes, $25,000 in rural PA is enough to support a family of 3 - 4 pretty decently.

Also the I-864P says the minimum needed is only $18,912 @ 125% for 2 people. He clears that benchmark easily with property owned, income, and funds in bank account. He clears it with income alone.

Not trying to argue or anything, but has anybody ever heard of something like this at the mumbai consulate? Could the lady working just be mistaken? This wasn't the immigration official that did this, this was the lady working the counter reviewing her documentation, so it could be a mistake? Thanks!

K-1 Fiance(e) Visa Process & ProceduresNeed Help! K-1, Mumbai - ASAP Please!!!
Ok, this isn't for me but a good friend. His fiancee just went to the Mumbai embassy and they told her they were going to reschedule her appointment until tomorrow because she didn't have the proper documentation.

They are trying to say my friend didn't earn enough money because he was born blind and gets partial disability. I say partial because he works as well (about $12k income about $12k disability). All together his income is about $25,000 in rural Pennsylvania where that is good money to live off of. He also owns (mortgage) his own house that is worth $58k. He submitted the last appraisal and listed it on the I-864 (they wanted the I-864 not the I-134).

He is well over income wise. He submitted paystubs from both work and his disability statement, bank statements, and the home details. Why are they still saying he needs a co-sponser? That doesn't make sense. It is only for 2 people.

Any advice? They only have 24 hours to provide more financial proof.

Thanks.

David

Considering that the current guidelines say 2012, it would be pretty safe to consider that they'll be updated with the current information since we are in 2013.

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List
Ok, Pennsylvania only has 1 form of a birth certificate, so that is what I sent. That's good I assume?

Also, for evidence:

1. A Rental Agreement we are both listed on and signed (translated into English)
2. Passport stamps showing we were together leaving Peru, going to Ecuador, and entering Mexico... although I didn't include the whole passport. Just the stamps.
3. Photos, me with her family, her with my family... my son with her... and us getting baptized...

Is this sufficient evidence?
