Thank you! I now realize this IS the infamous NOA2! My spirits are so boosted. And yes, it seems to be trucking along, though a few seem to have received this notice today, as if there was a clearing of approved I129Fs...

Nonetheless, I feel like someone just put the air back in my deflated balloon! I can't WAIT to tell my love! This is indeed encouraging. I hope the NVC receiving and the interview date are soon to follow.

We just had a six week visit and the first days back apart are just killing us!

Thank you all for the congrats.

Now that I fully talked to her, during our 23 hour bus ride after the interview back to Tijuana, she said it was the easiest thing of her life. Really they wanted her Police Certificate (since she is Peruvian she needed one), my financials, and her medical exam.

They didn't ask her for anything else a few things like for her brother, but nothing hard or even trivial. Like who is Jorge Luis P.... T... and she said my brother. That's all he wanted to know. It was basically to just check her answer vs. what he has. The only question they asked her about me was my son's name. They did mention that she was the first foreigner (meaning non-Mexican) that he has ever seen processed there in Ciudad Juarez and he didn't understand why she was at Juarez and not Lima, but she explained she (as I am) a Mexican Perm. Resident.... yup we got Mexican Green Cards (and they are really green!) and he made a copy of it. He made some phone calls to find out if he needed anything else and approved her. She said she was in the interview less than 10 minutes.

They mostly spent the time talking about Lima because he wants to be stationed there when his turn ends in Juarez.

Yeah, she hit a small snag in the interview, but nothing to trip over. Apparently when she tried to get a tourist visa previously, she put single instead of married. She wasn't divorced at the time, but she was legally separated (in Peru you have to legally separate before a divorce)... so she figured since it would be another month or so, she put single instead of married. She explained it and proved it with the divorce docs she had and was ok.

One weird thing, the immigration agent pulled a large folder out and asked "Who is Jorge Luis P.... T...." and she said it was her brother who is a Permanent Resident living in Jacksonville with a crystal clean record. She found it surprising that they not only asked who he was, but had the whole file on him.... My fiancee is from Peru and he went to the Embassy in Lima for his stuff, not in Juarez where we went. That was a little odd to her, but obviously no problems.

I sent some letters out last week asking what the problems and plans for improvement were for VSC to a few Congressmen. I know I'm not due yet but with the difference between the two service centers growing to a gap of four months between service centers I felt it was time for some answers.

The phone numbers are useless.


Wow, think about this... We both got our NOA 1 on the same day... I got my NOA 2 yesterday and you have to wait until October... I feel for you man. That is way tough.

In all seriousness though, I was looking at similar timelines from Peru, and it seems like the Peruvian ones take a few weeks longer than the average, perhaps Peru takes longer for the background checks. It probably doesn't help that she is Peruvian living in Mexico with me.... 2 countries to check. If I don't get it by the end of the month (my timeline now says August 10th - 19th), I'll be worrying lol. She's pregnant and we are hoping to get to the USA to have our child there. Don't want him to be disqualified from being President, ya know? lol

Examples: My second time I am doing I129F
She is Peruvian but she lives in Mexico with me
We are both divorced

Do you think that could be the reason why it is not as fast as others have been?

Sorry for the late response, its been a really busy week at work.

Ok, so this is what I got to answer the questions about my divorce and the first 129f, I got it approved when I was 19, I'm now 29, so it was about 10 years ago. I have been pretty much living outside of America since I was 18 and well if you do that, obviously you meet foreign women. I've been divorced for about a year legally. I say legally because we tried to divorce 3 years ago when we broke up, but it was rejected because I tried to save money and do it myself, and messed a court document up. I was married for 8 years. it took me a little bit until I had more money to buy a lawyer and legally divorce again. I've been with my fiancee for two years now and we are looking to tie the knot.

I had thought that we only had to submit copies of the divorce decree if done within the last 6 months?

Also how long are we talking processing time, realistically? If I submit in a week

The Texas facility is for document intake only. They will cash your check, sort your documents into an official USCIS file, and forward it to the appropriate service center for adjudication. The processing time is more like six months for the petition.



The documents of hers you need to submit with the petition are her G-325A, letter of intent, a couple of passport style photos, and divorce decree. The divorce decree will need to be translated into English.



As long as she has resident status in Mexico then she should be able to interview there. Your status in Mexico isn't relevant. You can list your preference for which consulate you'd like to interview at on the I-129F. It's up to the consulate to accept it, but they usually do if the applicant has resident status in the country.



Was that your only other I-129F? How long ago was the petition approved? If you've had an I-129F approved within the past two years, or if you've ever submitted two or more I-129F's, then you need to request a waiver of the multiple filing limits with your petition. This is explained in the I-129F instructions. Other than that, you can expect the subject of your first wife to come up at your fiancee's interview. They tend to be skeptical with multiple petitions filed from the same petitioner. They don't like US citizens acting as personal immigration portals. As long as your relationship evidence is solid then it shouldn't result in a denial.

You both have to submit copies of all divorce decrees with the petition.

Hello!

I have a couple I129F questions.

1. The processing times in Texas, how long do they typically take? Do I have to file in Texas? Why not California or Vermont? I check the USCIS Processing times website and the I129F hasn't been updated since 2010. Are they really taking almost 2 years there?
2. My fiancee's documents are in Spanish. Do I need them translated or can I send them in Spanish?
3. My fiancee is from Peru, I'm a California resident. We both live in Tijuana, Mexico together and we both have Mexican Residency. She has been a Mexican Resident since 2010. Does this mean that they will let us go to Cuidad Juarez instead of Lima, Peru since we are legal residents of Mexico.

We are both divorced, my first wife was from an i129F also. Does this matter?

I also noticed that for her address on the i129f I put down BC where it says STATE, COUNTRY. I probably should've put BC, MEXICO. But where it asks her address in the foreign country, I put down Mexico for the country, so it should be all right, wouldn't you think?

How does this work? Also, what if we move? Mexico doesn't really have mail forwarding.... Wow, this creates a lot of problems for us now possibly.

When I did my first i129f about 10 years ago, they mailed everything to me in the United States. I'm praying that happens again.

Do you have a lease with both your names on it? Do you have the boarding passes for the planes you took to go along with the passport stamps and photos? Any sort of receipts that have both your names on it placing you in the same place at the same time within the last 2 years? Is there a way to get the records of your entries and exits using your SENTRI card? All of these things could help prove the fact you have been together in the last 2 years.


No the lease was only done in her name. Our first place was in both our names, but the new lease on the new house is just her name coz its a simple rental agreement but some of the ultilities are in my name (cable, internet, phone) and some in hers (electric). We don't have the boarding passes, i'm not a hoarder. we have the passport stamps. i doubt I can get my records for sentri....

aren't the pictures good enough? with family members, a picture of us being baptized together, not good enough?

We live together. We have lived together for nearly 2 years. I live in Tijuana, Mexico with her. I maintian my California residency because I work in San Diego, I cross every single day and I have an address there also. On the appliication I disclosed both addresses.

I told them that we live together. I gave as proof a copy of my passport showeing my arrival stamp to Peru. I showed my departure stamp from Peru, my arrival to Ecuador, my depature from Ecuador, and my arrival in Tijuana, Mexico. I also showed the same stamps for her starting with leaving Peru and entering Ecuador. This happened because we took a plane from Quito to Tijuana because it was cheaper than Lima to Tijuana even with the trip to Quito. We have resided in Mexico since under Residency Visas.

I also included like 7 pictures. One of her and me in front of the Presidential Palace in Peru, one of her family and me saying goodbye in Peru, one of her mom and me at the border in Mexico, one of her mom, my son, her, and me for christmas (also one for new years), one of my father when he visited with her, my son, and him, one of her and me being baptized together in Mexico, and lastly one of her, me, and my son at church in Mexico....

Is that sufficient evidence? Its a little strange I think than whats normal for them, but I told them, hey we live together, like what more proof do you want?

Do you think we will be alright? I am mailing it tomorrow.

USCIS/CBP also has all of my information because I have a SENTRI card... not to mention this would be my 2nd i129f, the first one was about 10 years ago.

LASTLY.... Lol, I said multiple questions...

For proof of meeting because we met in Peru, left Peru together, entered Ecuador, left Ecuador together, and entered Mexico together where we currently live together... I sent in a copy of our passport stamps... however I didn't copy all the pages, only the relevant pages. As proof of having of met though, I did also send in a copy of our renters lease that has both our signatures. So considering they have one complete piece of evidence, with the passport stamps, will we be alright? what do you think?

Update your timeline with "California Service Center" and you will have an estimate of when to expect your NOA2. Be aware that this estimate will change over the months, but it usually takes 4-6 months. Good luck, and keep you inform of the next steps! :-)


I actually did that before I post this lol... It says Sept 3rd to 19th.

Ya know though, with this being my 2nd i129F and also having Sentri and being ex-military.... there is not really anything more the Government could want from me that they all ready don't have... so I am hoping, praying, and begging for a quick approval with no hiccups. I believe I have all my i's dotted and my t's crossed.

2. About how long after you file would you receive a RFE if they were going to ask for a RFE? Roughly speaking obviously.

1. That is fine, assuming your job will continue when you move back to the USA- it is current and sustained income that counts. Just bring some paystubs to prove your new income.

2. I am a little unclear what you mean here, but the K1 fiance visa process takes 6-8 months, you cannot just walk into the embassy and get a visa. First you, the USC petitioner, sends off paperwork and a few months down the line, the beneficiary will be called for an interview. 3. There will be certain vaccinations she cannot do; she can have those when she Adjusts Status in the USA after marriage.

4. YOu can cross at any official border crossing.



To clarify #2 for you: I am talking about after you get approved and do the paperwork. This is just the appointment part that I am talking about. I remember when we did this like 10 years ago we had to call a 900# in Mexico which was for the Embassy to verify that the paperwork was there. From there we pretty much packed up and left to Juarez. We still had to do the i-129f and all that other paperwork, so I am assuming they now give you an actual appointment date? Also where can I find out more information about the medical & the consulate for Juarez? Thank you!!!!

Ok, so I have some questions about the K1 process. Thank you all!

1. Income Requirements. I live in Mexico and hold Mexican Permanent Residency although I work in the United States. My income needed is a lot different in Mexico than it was in the United States. Due to the economy I had a crappier job. My income was $22,821. Although towards the end of the year I got a better job in my field finally and am starting to make decent money. So far this year I have $25,000 made. I need $23,862 by the poverty guidelines by 3 people. Even though I haven't made that last year, I have more than that all ready made in the first 7 months of this year (by the time I go to the appointment probably in Sept/Oct it will be closer to $33,000 earned this year). So considering I was living in Mexico and can prove the residency and the poverty level being different there AND the fact that she is pregnant with my child, will this be an issue? I really don't think it will be but seek further opinion.

2. So how does this work in Juarez? Will they give you an appointment now? I was there once before about 10 years ago, but they didn't give appointments back then. I just showed up a day before, did the medical, and went the next day to the appointment. Is it still the same way? Is there a place on the site I can get more information, tips, etc. for Ciudad Juarez?

3. How will the medical go with her being pregnant?

4. Do we have to cross at Ciudad Juarez? Can we cross at Tijuana into San Diego? Can we cross in a car since she is Pregnant and the long lines at Tijuana would hurt her? Or do we have to cross on foot walking?

5. Anything else you'd like to share with me?

If she is a resident of Mexico, and you used your Mexican address on the forms for her, then she should be able to interview in Juarez.

You do not get a visa the same day. It will go through DHL. It typically seems to be about a 2-5 day wait.

I have heard of a few instances where the USC was also at the interview, but for most and in general, the USC is not allowed to enter.


Yes, we BOTH are residents of Mexico. If my packet I included an extra section that requested that we have our interview in Mexico due to her being a resident of Mexico and us residing here. I included a copy of her Mexican Residency Card.

Also, its sent DHL? Like to the DHL office? Because they'll never find my house, hell I've never even seen them here lol

First, sorry for starting a second thread, but being as totally different topics, I wanted to make sure somebody answered this directly.

We requested Ciudad Juarez because we are living in Mexico. She is from Peru. What is the chances that Ciudad Juarez will listen to her case? How do I find out which embassy/consulate it was sent to? Like I said, I requested Mexico and put that down as our current address.

Also, does Juarez give the visa same day anymore? Or do they mail you the visa?

Lucky indeed. This is my second i129F. My first wife was Mexican and we married, but it was soon after Sept. 11th and the DHS was just starting and changing from INS to BCIS to USCIS and so on.... It took us 10 months with a RFE. This time, it only took us 116 days.

Now that this part is out of the way, we have more control and can start planning our life since we have to move across the border into the USA.

Yeah its pretty much the only system I have to use to "relieve my bordem" but I just wanted to know if there is a more strategic timing that I can set up to "refresh" around.

My job is a job that takes a year or two until I have enough clients to be busy all the time. Unfortunately because of our product, there is a limited client list and territories and blah blah blah... so bottom line is for the next 9 months, I only have about 3 - 4 hours of work to do during my 9 hour work day. I have lots of free time and Twitter & FB are getting boring... lol
